Natural FinishSurface is only lightly sanded

leaving some occasional minor pitting and air bubbles.

Smooth FinishAir bubbles are patched and blended to produce a smooth surface.

PricingAll pricing is quoted in U.S. Dollars, all products are FOB Dallas, TX. Prices include packing supplies and standard crating. Specialized crating, especially for custom items, may incur an additional charge. Please take care to select the proper finish (natural or smooth) and color (grey or one of our many integral colors) and select sealer options to ensure that you understand pricing. Please note that all former part numbers and finishes have changed as of June 1, 2019. Prices are subject to change without notice. Online pricing, catalog or supplement prices, shipping rates, and special promotions are subject to change without notice. Jackson Pottery reserves the right to void and/or alter orders and prices in response to circumstances beyond our control. Jackson Pottery reserves the right to append fuel surcharges in response to extraordinary fuel price increases. Jackson Pottery will not be held liable for any customer loss of sales due to changes in our prices, or due to circumstances unforeseen or beyond our control. Jackson Pottery sold by 3rd party customers (stocking dealers, distributors, websites, or trade professionals) may have different pricing.

DepositsA minimum deposit of 25% (Wholesale Trade) is required to initiate the production of an order. Any direct to retail order requires a 100% prepayment before order will be produced. DEPOSITS AND PREPAYS ARE NONREFUNDABLE. Payment indicates acceptance of the Jackson Pottery, Inc. Business Terms and Conditions. Any remaining balance, including freight and handling, is due prior to shipment of product.

Payment Forms We accept ACH, cashier’s checks, all major credit cards, and company checks (subject to a 12 day wait period for all new customers).

Cost QuotesQuotations will be honored only when quoted by Jackson Pottery, in writing. No agent or representative is authorized to change prices, terms or conditions of sale without the consent of Jackson Pottery. Quotations are for a period not to exceed 30 days unless otherwise noted on the quote itself, or extended in writing.

TaxesSeller’s prices do not include sales, use, and excise or similar taxes. Accordingly, Buyer shall in addition to prices specified by Seller, pay any sales, use, excise or similar tax attributable to the sale of goods covered hereby, or, in lieu thereof, provide Seller with tax exemption certificates acceptable to the taxing authorities.

Order Acceptance Buyer’s acceptance is sealed upon deposit against quotation or order. Both standard and custom orders are subject to acceptance by Jackson Pottery, Inc. under the Terms and Conditions herein, in addition to the published price list and acknowledgments. These terms and conditions will prevail when in conflict with the terms and conditions of the Buyer’s purchase order contract.

Changes Buyer may request additions or modifications to either their standard or custom order. Jackson Pottery shall have the absolute right to accept changes, revise the prices, dates of delivery, and to add charges for work and materials rendered necessary by such additions or modifications. We do not allow changes on finished goods.

Cancellation Orders accepted by Jackson Pottery, Inc. for Jackson Cast Stone products may be canceled by the Buyer only upon written consent of Jackson Pottery, Inc. If such written approval is given, Jackson Pottery, Inc. shall retain Buyer’s deposit and Buyer shall, if such cancellation is made within 2 weeks of the scheduled shipment date, make payment to Jackson Pottery, Inc. for the balance due for products ordered.

ReturnsNo returns will be accepted without the written authorization by Jackson Pottery, Inc. We make your items to order, so no unauthorized returns will be accepted. Buyer is responsible for return freight in the rare case that a return is authorized. All goods to be received in original condition by Jackson Pottery, Inc.

Dealer NetworkJackson Pottery, Inc. sells our Jackson Cast Stone and other products through a variety of sales channels including but not limited to this catalog, our website, our dealer and distributor networks, landscape architects, and those in the design or commercial building profession. Jackson Pottery Inc. is not engaged in the price monitoring of these customers and does not seek to compete with them by matching another wholesale customer price. Whenever possible, we prefer that the end user (the retail customer) purchase through one of our

B2B partners. We do not allow retail/end users to pick up from our location and encourage them to contact a dealer in their area.

Production Lead TimeEach cast stone item is produced to order. Due to the high demand of our items, we are seldom creating excess stock items. As each order is produced, production time fluctuates with order volume. Generally, orders are shipped within 6-8 weeks of the order date (deposit receipt), with shipping time accounted for within the coastal US. Products to be exported outside of the US are subject to longer shipping times.

Storage of Delayed Shipments (Intentional or Unforeseen)Jackson Cast Stone products are made to order and our space is limited. We understand that sometimes projects get behind and, unlike our competitors, we offer a 30 day grace period on storage of finished goods. A storage fee will be charged for completed orders when the shipment is delayed at the Buyer’s request more than 30 days after the original indicated ship date. This may include purposeful delay of final payment by Buyer to delay shipment of product that they are not prepared to accept. If the Buyer cannot accept delivery when product is ready for shipment, Jackson Pottery, Inc. will bill Buyer $10.00 per unit stored per day, based on 7-days per week. Should shipment be delayed in excess of 90 days beyond original estimated ship date (or finished goods date), Jackson Pottery, Inc. reserves the right to cancel items without refunding Buyer’s deposit or payment.

FreightJackson Pottery, Inc. will make every effort to accommodate requested shipping and delivery dates, but we are unable to control exact delivery windows/days, as we ship our orders 3rd Party Freight. Orders are subject to delay of delivery due to strikes or other labor difficulties, failure or delay of source of supply, transportation difficulties, riot, fire, accident, and compliance with government regulations, acts of God, or other causes beyond our control.

Cast stone items ship separately from all pottery items and are subject to its own program, terms, and conditions.

When a physical delivery address is given to Jackson Pottery, Inc., by the Buyer or a Representative of the Buyer (including on-site Contractors), it is the Buyer’s responsibility to disclose any provisions or limitations for delivering to that site. These include, but are not limited to seasonal closures, serpentine or narrow roads, hard to reach locations, road closures, or height limitations for large vehicles. All freight deliveries are scheduled through 3rd party Freight Carriers and delivered via 18-wheeler tractor trailer trucks. If Buyer is requiring Lift Gate Service, they must let us know IN ADVANCE of freight estimate. Additional charges will apply.

If a “residential” or “limited access” delivery is needed, via smaller box truck, Buyer is responsible for disclosing that request at the time the physical address is given for delivery. Furthermore, any costs incurred from having to re-route the delivery truck, will be billed directly back to the Buyer.

TERMS & CONDITIONS

Jackson Pottery to Arrange Freight Once final payment has been received, a Jackson Pottery, Inc. representative will contact Buyer to confirm shipping, shipment date, and coordinate shipping unless Buyer uses a preferred Freight Forwarder and account. Jackson Pottery, Inc. provides this coordination as an accommodation only to the Buyer. All freight is shipped via 3rd Party Freight Carrier. Buyer is responsible for providing all shipping related details at time of order. Once the product has been shipped, the customer will be responsible for, and incur any charges related to changes in shipping destination or otherwise. If shipping details change after the time of shipment, buyer must immediately notify Jackson Pottery, Inc. Choice of carrier, shipping method, and route, shall be selected by Jackson Pottery, who will provide tracking information when available.

Buyer to Arrange FreightIf the Buyer specifically designates the shipping company, the Buyer shall make arrangements for pickup, shall be responsible for all fees to the carrier, and shall make any and all freight claims directly with the carrier that the Buyer has selected. If the Buyer specifically designates a carrier and organizes the shipping, the title to the product is passed to the Buyer and Jackson Pottery’s responsibility terminates. Jackson Pottery, Inc. will not accept any claims for freight, warehousing or installation damage, including any incidental or consequential damages.

International ShippingJackson Pottery, Inc. does not export our products directly outside the United States. Jackson Pottery can be shipped to a domestic freight forwarder of the Buyer’s choosing.

Freight Claims In most cases, Jackson Pottery will be selecting the appropriate carrier for the goods and coordinating the freight to its final location. Jackson Pottery carefully inspects items prior to secure packing. Buyer must notify Jackson Pottery, Inc. (if Jackson Pottery arranged the freight) or 3rd Party freight carrier (if Buyer arranged freight) immediately if damages occur.

It is the Buyer’s responsibility to review all units shipped at time of delivery and in the presence of

the delivery driver before or during off-loading. Photos of damaged items must be taken while the object is still attached to the pallet in order to be considered as valid evidence of mishandling by the carrier or as a consequence of inadequate packing by Jackson Pottery. Failure to make such claims shall constitute acceptance of the merchandise and waiver any defects, errors or shortages.

Transportation and InstallationDue to size and weight of planters, great care should be taken in moving, transporting, and installation. Planters should be kept in an upright position and are best transported using wood pallets with pallet jacks, a forklift, or other commercial equipment. Extreme care should be taken to protect planter bases, edges and rims from chipping with use of protective cushioning or moving blankets. Buyer shall be solely responsible for the installation and operation of the goods covered hereby, including with limitation the obtaining of all permits, licenses, or certificates required for the installation of such goods.

WarrantiesJackson Pottery, Inc. offers a 2-year limited warranty on our Jackson Cast Stone products defined as concrete planter, concrete benches, and accompanying concrete items, to be free from defects in workmanship and materials under normal use from the date of delivery to your project. It is the Project Designer and/or Project Owner’s responsibility for proper placement of concrete products within the built environment, which includes responsibility for understanding the nature of the product material purchased. Jackson Pottery, Inc. is not responsible for any consequential damages incurred from the Buyer’s and/or Project Owner’s lack of product understanding and/or responsibility for installation. Replacement or credit (with evidence of field destroy) at the discretion of Jackson Pottery are the sole remedies of this warranty. In the case that a product is to be replaced due to Manufacturer defect or failure, Jackson Pottery, Inc. will replace product according to terms of Warranty specified herein, and is not responsible for any consequential damages incurred by replacement of product, beyond warrantied product itself.

This Warranty Does Not Cover The Following1. Surface abrasions caused by failure to remove

packing cardboard, shipping straps, and/or protective plastic wrapping, or other packing material in a timely manner. (If packing material is not immediately removed, but is left on for extended period, exposure to climatic heat, rain, salt etc., will adversely affect the surface finish of concrete planter.)

2. Damage incurred from dropping or rough handling of merchandise during installation, causing chipping and/or fracturing. (All damages must be noted while items are attached to the pallet at time of delivery.

3. Damage that occurs as the result of product alteration, impact, misuse, neglect, accident, act of vandalism, acts of God, or natural disaster.

4. Improper maintenance to item. (If you have questions on maintenance or cleaning your product, please refer to the user guide or contact us).

5. Cracking and fracturing caused by an improper foundation, soil or other foundation settlement, or relocation of item.

6. Cracking and fracturing caused by use of expansive soil or other additives in or around the planters. Quality, lightweight planter soil should be used to avoid a negative affect incurred as soils retain moisture and experience freeze/thaw cycles.

7. Damage incurred from drilling/boring into concrete product wall and/or base.

8. Surface damage from use of chemicals, harsh brushes, and/or power washers.

9. Damage caused by obstruction of the planter drainage hole. (Improperly drained planters prior to freeze/thaw cycles can lead to fracturing of planter pot. Adding irrigation lines up through the drain holes may constrict the ability of the planter to drain and the obstruction is likely to cause damage due to aforementioned freezing and thawing.)

10. Naturally occurring changes in the concrete surface, including efflorescence or patina development from environment exposure; naturally aging the exterior of the concrete product. Any observation of significant cracking that alters the structural integrity of a Jackson Pottery product should be reported to the company immediately.

11. Appearance of non-structural hairline cracks.

12. Planters used as fire pits/features or water fountains/features.

13. Interior planters with irrigation/drainage systems installed, other than manual watering.

14. Modification of the finish or to the existing surface.

15. Damage incurred to edges of concrete products from contractor installation, including use of forklifts, pallet jacks, liftgates, carts, cranes, cutting tools, pry bars, hand tools, and other unprotected equipment that directly interacts and/or impacts concrete surfaces and edges.

16. Damage incurred to edges of concrete planters from skateboard impact and/or similar activities.

17. Concrete planters and accessories are not designed to take impact to edges from recreational equipment such as skateboards or rollerblades. Jackson Pottery, Inc. does not warranty our products against such types of impact nor the application of protective edge guards which can also fracture product edges. In no event shall Seller be liable for indirect, special, or consequential damages of any nature, including, but not limited to, personal injury or property damage. Buyer’s recovery from Seller for any claim shall not exceed the purchase price paid by the Buyer for the goods, irrespective of the nature of the claim, whether in warranty, contract, or otherwise.

• Unwrap and unpack all items in the presence of the freight carrier.

• Report all freight claims immediately at the time of unloading.

• Do not leave packing material in contact with product after delivery, even if product is not to be immediately installed to avoid unwanted discoloration, marring, and/or surface damage to units.

• Handle items with care. Use of machinery such as forklifts and pallet jacks to transport materials on a pallet is recommended.

ColorsWe proudly offer 10 everyday colors: Grey, Cocoa, Graphite, Limestone, Conifer Green, Desert Rose, Sandstone, Terracotta, Aqua Green, and Blue Mist. While our best selling, standard base color is grey, all other colors are integral colors and are available at varying upcharge levels. Based on the standard Grey price, Cocoa, Graphite, and Limestone are + 15%. Conifer Green and Desert Rose are + 20%. Sandstone and Terracotta are + 30%. Aqua Green and Blue Mist are + 40%. With integrally colored concrete, the entire batch of concrete is colored all the way through, similar to adding food coloring to cake icing. We use powdered form integral color that is derived from natural iron-oxide pigments. The palette for integral pigments consists primarily of soft earth tones that integrate well with most landscapes and architectural elements. Unlike topical stains, the chief advantage of integral pigments is that the color extends throughout the entire planter, so even if surface abrasion occurs, the color will not wear away.

Efflorescence is the white substance that may build up on the surfaces of unsealed concrete. It is caused by migrating moisture that brings soluble salts to the surface. Efflorescence is very normal, but is noticed more on darker colors like Graphite and Cocoa. To best minimize the chance of efflorescence, we recommend adding either of our penetrating, breathable sealers. Efflorescence is not a manufacturer’s defect and as such, is not covered under Jackson Cast Stone’s product warranty.

While we do our best to accurately represent the product color and texture, image variations do occur. Colors and textures may appear differently based on screen and monitor settings, varying lighting sources, environmental factors, and photographic enhancement. Sealers will enhance and also darken the color. Please keep in mind that all pictures are for illustration purposes and the actual product may slightly vary from the photos. Requesting color samples is recommended.

FinishesWe offer 2 finish types, natural and smooth. The natural finish is just that, a lightly sanded surface with some occasional minor pitting and air bubbles. Intended to celebrate the natural raw look of stone, natural is our preferred finish. Minor pitting from air pockets is a normal part of cast stone manufacturing. We take the utmost care in our casting process to minimize surface pitting. Natural finish surfaces can range from piece to piece. For those wanting a more refined look, the smooth finish is offered at a 25% upcharge. We patch any air bubbles and blend the surface area to produce a smooth surface finish. Especially in darker colors, occasional color differences may occur to patched areas. Sealers may enhance these differences. Please contact us for more information on finish differences.

Within these catalog pages, almost all product images are shown in the smooth finish with no sealer. It is important that the purchaser or client understands what to expect from each finish.

SealersFor a minimal 7% upcharge, you can protect and enhance the planter surface by choosing to add sealer. Depending on location and environmental factors, you can expect typical buildup of dirt and dust over time. Sealers will both help to minimize cleaning efforts and can protect the surface from stains and abrasions. Sealers will also help minimize the chance of efflorescence in darker colors. We offer both matte and glossy sealers. Please note, the addition of sealers will change the overall product look and color. Matte sealer will slightly darken the product, while the glossy sealer will drastically enhance and darken the product. Beyond the practical reasons, adding sealer is a matter of aesthetics and personal preference. If you prefer the natural “raw” look of cast stone, we recommend not adding sealer.
