Cal/OSHA Reminds Employers to Protect Outdoor Workers from Heat Illness Oakland—Temperatures at outdoor worksites across California are rising as the weather warms up. On Friday, Cal/OSHA will participate in a news conference and training sessions to help employers plan for and prevent heat-related illness and death from affecting outdoor workers.
Cal/OSHA’s heat illness prevention model includes annual trainings statewide in both English and Spanish. On Friday, Nisei Farmers League and nine other agricultural employers will co-sponsor training sessions in Easton in both languages. This collaborative training has been held every year since 2008 to protect outdoor workers from heat illness and to highlight the requirements of the state’s heat illness prevention standard.
Next Tuesday, April 16, Cal/OSHA will host a Heat Illness Prevention Network conference call to review best practices and allow for questions and answers.
“When it comes to preventing heat illness, employers with outdoor workers should not wait until it gets hot to review their procedures and ensure their training is effective,” said Cal/OSHA Heat and Agriculture Program Coordinator David Hornung. “Workers should know the signs and symptoms of heat illness and what to do in case someone gets sick. This helps prevent serious and fatal heat illnesses while working outdoors.”
Heat illness is a serious hazard for people who work outdoors. Cal/OSHA’s investigates heat-related incidents and complaints of hazards at outdoor worksites in industries such as agriculture, landscaping and construction. These investigations ensure compliance with the heat illness prevention standard and the injury and illness prevention standard, which require employers to take the following basic precautions:
1. Train all employees and supervisors on heat illness prevention. 2. Provide enough fresh water so that each employee can drink at least 1 quart
per hour, or four 8-ounce glasses of water per hour, and encourage them to do so.
3. Provide access to shade and encourage employees to take a cool‐down rest in the shade for at least 5 minutes. They should not wait until they feel sick to cool down. Shade structures must be in place upon request or when temperatures exceed 80 degrees Fahrenheit.

HOW MUCH DO YOU NEED?
Sorry to say, but sometimes the ‘parts’ don’t add up to the whole ‘experience’. Confused? No wonder its contractor license regulation we are talking about… Q: I would like to explain what my company does and see if you have any advice or an opinion. I own a business that contracts with vacation home owners to come in after their rentals check out to inspect the place for any damage. Usually these owners live out of town and their occupants “rent” the property for an extended period of time. We will come in clean and make any minor repairs. Some examples are repairing a hole in the wall, minor drywall and paint touch ups, we’ve done door replacements, minor plumbing (such as leaks in the sink), snow shoveling, minor tile repair, etc. A large majority of what we do does not require a Contractor’s license, or the repairs fall under the $500 rule. In the instances where we have been asked to perform work that would require a Contractor’s license, we have a circle of contractors that we refer to our clients and they work directly with them. However, as this is coming up more often, I’m thinking my company should obtain a Contractor’s license so we can take on this work ourselves. Based on what I’ve described (I’ve done all of this repair work for over 5 years), would I qualify for a Contractor’s license? A: As you may know, there are many types of licenses in CA, from General Building, to specialized classifications such as drywall. In order to qualify for any license, you must document at least four years of full-time work experience in that particular trade. Since you are doing a variety of trades depending on the specific need, you would have a hard time showing four years of full-time experience in any one trade.
Q: I’m really confused about an application we have pending with the CSLB. We are a sole member managed Limited Liability Company (LLC). Our only Member is a Corporation. The CSLB sent us a form to complete called “Designated Signatory” form. The form came with a letter stating an individual needed to sign on behalf of our Sole Member (the Corporation). Does it matter what title this person should hold? And will this individual have to do fingerprinting and the background check? A: The Designated Signatory can be any official Officer or Director of the corporation (Sole Member) that you intend on designating “signing authority” for the license. The individual you designate does not need to be fingerprinted and go through a background check. Only the individuals who are direct personnel of the applying entity (the LLC) need to be fingerprinted. While knowledge is power, knowing where to go for the answers is half the battle. Safety Tip of the WeekFLAG PERSONS
We are not talking about someone who raises the American Flag each morning or takes it down in the afternoon. In construction, a flag person is best known as the worker or workers who manage traffic flow along a highway or street when road repair is underway. There are also flag persons who are responsible for signaling crane operators, truck drivers when dumping loads, for hoisting operations, etc. These people must be knowledgeable in the use of correct hand signals.
In either case a flag person has a great deal of responsibility. For roadwork they must be easily visible to traffic and must be able to direct traffic around the work the crew is doing. When flagging traffic they should try to position themselves in such a way that there is some type of barrier between them and the traffic if at all possible. This will give them some protection should they need it. They must be sure their signals can be clearly seen by oncoming traffic. Stop and slow paddles work very well. The red or orange garment provided must be worn at all times and must be made of a reflectorized material if work continues into the evening hours.
OSHA Standard 1926.201 Signaling requires - (I) When operations are such that signs, signals, and barricades do not provide necessary protection on or adjacent to a highway or street, flag persons or other appropriate traffic controls shall be provided. (2) Signaling directions by flag person shall conform to American National Standards Institute D6.1-1971, Manual on Uniform Traffic Control Devices for Streets and Highways. (3) Hand signaling by flag persons shall be by use of red flags at least 18 inches square or sign paddles, and in periods of darkness, red lights. (4) All flag persons shall be provided with and shall wear a red or orange warning garment while flagging and at night shall be of a reflector type material
If you as a flag person have any questions about your flagging duties, check with your supervisor before beginning your shift. If you need a break, let your supervisor know so a replacement can take over your position.
