CSLB-Sponsored Bill to Show Citations on All Licenses Moves On The Assembly Business and Profession Committee yesterday unanimously approved a Contractors State License Board-sponsored bill, SB 1209 (Morrell). This measure, which is on the fast track for passage, would require that citations issued against a licensed contractor follow the contractor if he or she is issued another license. Under current law, Business and Professions Code (B&P Code) §7124.6 (e)(1) limits disclosure of a citation only to the license subject to a complaint substantiating that citation. Once that citation is disclosed, B&P Code section 7124.6 does not extend that disclosure to licenses obtained or joined by persons thereafter. Contractors trying to ‘skirt-around the law’ know that if the CSLB issues a citation, they can cancel that license and obtain or join a new license not subject to the complaint disclosure affecting the previous license. Thus, persons aware of this limitation are free to operate under a different entity clear of any disclosure action. According to the CSLB, “this eviscerates the purpose of B&P Code §7124.6 disciplinary action, which is to provide for consumer protection by reporting the activities subjecting individual contractors to discipline.” This bill, which would take effect on January 1, 2017, requires that citations be disclosed from the date of issuance and for five years after the date of compliance if no additional disciplinary actions have been filed against the licensee during the five-year period. If additional disciplinary actions were filed against the licensee during the five-year period, all disciplinary actions are required to be disclosed for as long as the most recent disciplinary action is subject to disclosure under the section. At the end of the specified time period, those citations will no longer be disclosed. (BPC Section 7124.6 (e)(1)) This measure requires that accusations that result in suspension, stayed suspension, or stayed revocation of the contractor's license be disclosed from the date the accusation is filed and for seven years after the accusation has been settled, including the terms and conditions of probation if no additional disciplinary actions have been filed against the licensee during the seven-year period. If additional disciplinary actions were filed against the licensee during the seven-year period, all disciplinary actions will be posted for as long as the most recent disciplinary action is subject to disclosure under this section. At the end of the specified time period, those accusations will no longer be disclosed. (BPC Section 7124.6 (e)(2)).

A contractor ‘stepping up to the plate’ for his first application ‘triples’ a question down the right line in seeking expert advice. Another interested in getting back to work discovers there is an extra step or two because of his ‘inactivity’.

Like a rerun of Johnny Carson’s rerun of The Tonight Show’s fortune teller act Karnak-The-Great, I ‘telecommunicate’ an answer for an electrical contractor…Q:  We currently have a “C-10” (Electrical) license.  I am aware that we can do low voltage work with our current license, however some of our customer’s request that we have a “C-7” (Low Voltage) license in order to do telecommunications work.  How difficult would it be to add that classification to our license?  Would I have to take the test?

A:  B&P Code section 7065.3 allows for Contractors to request a Waiver of the Trade Exam for some additional classifications - if the classification is closely related to your current license and is a significant portion of the work you perform.  These Waiver requests are reviewed on a case-by-case basis and is dependent on your work experience and project background, but I believe you would have a pretty good chance of being approved to Waive the exam based on your “C-10” experience.  Waiver requests need to be done in writing.

Q:  I’m scheduled to take the “B” (General Building) exam at the end of the month. (1) If I don’t pass how much does it cost to retake it?  (2) How long do I have to wait to take it again?  (3) Is there a limit to the number of

times I can take it?  

A:  If you fail the exam you are required to pay a $60 rescheduling fee.  The fee should be submitted with the application on the bottom of the notice informing you that you didn’t pass.  The CSLB will then reschedule you for the exam (usually about 3 weeks out), and you can take the exam as many times as needed within an 18-month period.  If you don’t pass within 18 months, your application ‘strikes out’ and will be void.

Q:  I have an Inactive license that I obtained years ago and I want to Reactivate it.  The Responsible Managing Employee (RME) that I used to obtain the license no longer works with me and I want to become the Responsible Managing Officer (RMO) on the license.  Can I still reactivate it?

A:  Yes, however, a reactivation application requires the signature of your Qualifier.  Therefore, I would suggest completing an Application to Replace your Qualifier in order to then add yourself as the RMO, and then request a Reactivation application. Call if you need any assistance.

Safety Tip of the WeekSUMMER - HOT WEATHER

Summer is here and we need - to think serious about working in heat and high humidity. Too much heat and humidity can make people sick and in some cases, even cause death. Everyone reacts differently to heat but we all need to know how to recognize and treat heat emergencies.

Normally the body cools itself by sweating. When the outside temperature is equal to or above the temperature of the body and the humidity is high, our sweat does not evaporate and the body can become overheated. Heat emergencies fall into three different categories:

HEAT CRAMPS cause painful spasms of the leg and stomach muscles resulting from loss of fluids and salt from sweating. Treatment is simple: massage the cramped muscles and drink fluids.

HEAT EXHAUSTION - the skin will be cold, pale and clammy from perspiration. You may feel fatigue, nausea and have a headache; you may also feel weak and faint. Treatment - move the victim to a cooler place and lay them down with their feet elevated. Have them drink small amounts of fluids at frequent intervals. Medical follow-up may be advisable.

HEAT STROKE is the most serious and potentially deadly heat emergency. here is a malfunction in the body's regulating system resulting in lack of sweating. Heat stroke is a medical emergency and requires immediate treatment by a doctor. Symptoms include mental confusion, the victim may stagger or even lapse into unconsciousness. The skin will be dry, hot and flushed. Treatment - call an ambulance or nearest medical responder immediately. Move the victim to a cooler place and lay them down with the head elevated. Sponge with cool water until help arrives.

Here are some basic things we can do to prevent heat emergencies and make it easier for our bodies to handle the heat and humidity. Get a good nights sleep, eat moderately on hot days, wear loose fitting, lightweight clothing, drink plenty of cool water, avoid intake of alcohol, drugs, etc. Even some prescription drugs may affect your tolerance to heat. Never ignore the symptoms of heat illness in yourself or a co-worker. Get help immediately!
