    National Police Check Requirement

    All applications for registration as a building practitioner must include a completed authorisation for a

    National Police Check as part of the Building Practitioners Board probity checking requirement.

    The National Police Checking Service Consent Form is available on the Victorian Building Authority

    (VBA) website and must be accompanied by 100 points of certified identification. Scanned or copied

    signatures will not be accepted.

    Incomplete or incorrect registration applications will not be processed and will be returned to the

    applicant by standard post.

    The National Police Check should be forwarded to the Building Practitioners Board at the same time as

    the registration application form.

  • IntroductionThe Building Act 1993 (the Act) requires people working in the registration categories covered by the Act to be registered by the Building Practitioners Board. These people are called Registered Building Practitioners (RBP).

    The RBP status is only achieved by having a good balance of relevant qualifications, industry experience and building knowledge. All applicants must be of good character and carry appropriate insurance.

    The RBP status gives consumers the highest confidence that building work will be completed to industry standards.

    Prior to completing this application, you must read the information sheet relevant to your registration category. The information sheet details the qualifications, knowledge and experience you require to successfully register as an RBP.

    The Board may require you to support your application with details of your qualifications, training, professional memberships, business operations and some samples of your work.

    Only an individual person may apply to the Board to be registered as a building practitioner. Applications by corporations or partnerships cannot be accepted.

    Registered building practitioners in other Australian states must complete a Mutual Recognition Application Form which can be downloaded from www.vba.vic.gov.au

    Application Process There are four steps in the process that must be completed:1. Read all the information included in the application package 2. Complete the application forms and gather the additional

    information required for registration 3. Lodge the application with the Building Practitioners Board. 4. Pay the fee. Once your application is received, the Board will complete thefollowing steps:1. Application is checked for completeness and further information

    may be requested 2. You will be advised if you need to attend an examination as part

    of your assessment 3. Once the examination is complete, a recommendation is made at

    a meeting for the Board 4. You will be notified promptly after a decision is made by the

    Board. The recommendation will be one of the following:

    Register the applicant Refuse to register the applicant Ask the applicant to give it any information that is

    reasonably required to determine the application.If the Board accepts the recommendation that you should beregistered, you will receive a Registered Building Practitioners certificate, a photo identification card and a new registration pack.

    Important Information It is an offence to make any false or misleading statement or provide any false or misleading information to the Board in relation to your application (Section 246 of the Building Act 1993).

    Appealing the Building Practitioners Boards decision If you are not satisfied with the Boards decision, you can apply for a review of the decision at the Victorian Civil and Administrative Tribunal (VCAT). Refer to www.vcat.vic.gov.au for more information.

    Collection of personal informationPersonal information provided by you in connection with this application is collected by the Board under Section 169 of the Building Act 1993 for the purposes of:

    Determining your eligibility for registration as a buildingpractitioner

    Notifying the public of your registration status Monitoring your continued ability to practice as a Registered

    Building Practitioner in Victoria

    As may be otherwise necessary for the Board to fulfill its dutiesand obligations under the Building Act 1993.

    If you fail to provide the personal information requested, your application may be refused.

    The Boards Privacy Policy The Board respects your privacy. Your personal information will be collected and used in accordance with the Privacy and Data Protection Act 2014 (Vic). If your application is successful, a limited amount of your personal information will be made available to the general public. This information includes your name, professional contact details and registration details, all of which can be accessed atwww.vba.vic.gov.au

  • IntroductionThe Board may, where appropriate, disclose your personal information to the Victorian Building Authority, a law enforcement agency, a court or tribunal.

    You may gain access to personal information collected from you by the Board, provided that the Board may require requests for such information to be submitted in accordance with procedures set out in, and in a form required or permitted by, the Privacy and Data Protection Act 2014 (Vic) or other relevant legislation.

    All the relevant legislation the Building Act 1993, Building Regulations 2006, Domestic Building Contracts Act 1995, Occupational Health and Safety Act 2004 and Domestic Building Contracts Regulations 2007 are available on the Victorian Legislation and at www.vba.vic.gov.au

    How do I certify a copy of a document?

    Take your original document/s, along with the photocopies to a person who is authorised to sign certified copies. See list below and opposite.

    Ask them to write the following statement on a blank area of the photocopy. I certify that this document is a true copy of the original having been sighted by me this day .../.../... Ask the authorised person to sign the copy, then legibly write or stamp his or her name, title and address.

    Note: Where a certified copy is requested do not send original documents as the original documents will not be returned.

    Persons who can witness statutory declarations

    The following people are authorised to sign and certify copies in Victoria:

    A justice of the peace or a bail justice

    A public notary

    An Australian lawyer (within the meaning of the Legal Profession Act 2004)

    The prothonotary or a deputy prothonotary of the Supreme Court, the registrar or deputy registrar of the County Court, the principal registrar of the Magistrates Court or a registrar or deputy registrar of the Magistrates Court

    A clerk to an Australian lawyer

    The registrar of probates or an assistant registrar of probates

    The associate to a judge of the Supreme Court or of the County Court

    The associate of an associate judge of the Supreme Court or of an associate judge of the County Court

    A person registered as a patent attorney under Chapter 20 of the Patents Act 1990 of the Commonwealth

    A member of the police force

    The sheriff or a deputy sheriff

    A member or former member of either House of the Parliament of Victoria

    A member or former member of either House of the Parliament of the Commonwealth

    A councillor of a municipality

    A senior officer of a Council as defined in the Local Government Act 1989

    A person registered under the Health Practitioner Regulation National Law to practise in the medical profession (other than as a student)

    A person registered under the Health Practitioner Regulation National Law (i) to practise in the dental profession as a dentist (other than as a student); and (ii) in the dentists division of that profession

    A veterinary practitioner

    A person registered under the Health Practitioner Regulation National Law to practise in the pharmacy profession (other than as a student)

    A principal in the teaching service

    The manager of an authorised deposit-taking institution

    A member of the Institute of Chartered Accountants in Australia or the Australian Society of Accountants or the Institute of Public Accountants

    The secretary of a building society

    A minister of religion authorised to celebrate marriages

    A person employed under Part 3 of the Public Administration Act 2004 with a classification that is prescribed as a classification to which this section applies or who holds office in a statutory authority with such a classification

    A fellow of the Institute of Legal Executives (Victoria).

    Insurance

    Provide proof of insurance or eligibility for insurance, as applicable. Registered Building Practitioners are required to carry the appropriate insurance for their registration category. Evidence of insurance is required by the Building Practitioners Board when registering or when renewing your registration. Insurance must be in compliance with the relevant Ministerial Order. A copy of the Ministerial Orders can be found on the Victorian Building Authority website www.vba.vic.gov.au

    The Building Practitioners Board cannot issue registration without written evidence that you have obtained the required insurance. Insurance provides consumers and other practitioners with a level of confidence. You may submit your application without the required evidence of insurance to commence an assessment, but the Building Practitioners Board will not decide your application until they have received a copy of the required insurance.

    Attach proof that you are covered by the required insurance or, in the case of applicants to be solely engaged in domestic building work, attach proof of your eligibility to be covered by the required insurance.

    Letter of Eligibility for Domestic Building Insurance (also known as Home Warranty Insurance) If applying for registration as a Domestic Builder Limited where the contract price of the domestic building work does not exceed $16,000 or limited to multi-storey residential construction, insurance is not required.

    Professional Indemnity Insurance

    Required for Engineers, Draftspersons, Building Surveyors, Building Inspectors and Quantity Surveyors.

    Public Liability Insurance Required for Demolishers, Supervisors or Erectors of Temporary Structures.
