Method of Payment: i) cheque on day of performance upon receipt of invoice or : ii) within 28 days of receipt of invoice Notes: i)Changes to the programme are not acceptable and may nullify the contract unless for exceptional circum- stances, illness, accident and/or with agreement of both parties. ii) Travelling, accommodation and meals are at the artist’s expense and HCS will not make any payments in addition to the fee other than with prior written agreement.

CONDITIONS 1. The Artist shall provide to HCS as agreed in the Terms all publicity material and details reason-

ably required by the Promoter to compile programmes and to advertise the Performance. 2. The Artist may be required to attend not more than one rehearsal (not exceeding three hours)

on the date of the Performance to terminate at least one hour before the performance. Addi-tional rehearsals shall be by mutual agreement and shall be limited to two rehearsals of three hours in any one day prior to the date of the Performance with a break of at least one hour be-tween each rehearsal. !

3. No rehearsal shall be conducted before an audience without the Artist’s prior written consent. 4. In the event that the Fees and Expenses are not paid when due the Artist shall be entitled (but

without prejudice to any other rights and remedies) to charge interest at 2% above the base rate in force at the time of the National Westminster Bank PLC computed from the original due date until paid. !

5. If the Artist is unable to fulfil or is delayed in fulfilling the Performance owing to circumstances beyond the Artist’s reasonable control, then such non-performance or delay shall be deemed not to constitute a breach of this Agreement. The Artist may, if requested by HCS, suggest a deputy of equal standing acceptable to HCS or offer an alternative date. !

6. HCS may make and receive such charges for admission to the Performance as HCS shall in its sole discretion determine. !

7. HCS shall use its best endeavours to promote and advertise the Performance and shall consult with the Artist concerning such promotion and advertising. !

8. It is the responsibility of HCS at its own cost to: i) Pay all fees or expenses of other artists and/or persons taking part in the Perfor-

mance in addition to the Fees and the Expenses payable to the Artist; and ii) Ensure that any monies due to the Performing Right Society are paid; and iii) Ensure that the Venue for the Performance is exclusively available to the Artist

for rehearsal for a period of up to three hours on the date of the Performance; and

iv) Ensure that the Venue has adequate changing room and cloak room facilities for the Artist; and

v) Ensure that the Artist’s name is afforded due prominence on all advertising and publicity material; and

vi) Ensure the the Artist’s name or likeness shall not be used for the endorsement of any product or services without the Artist’s prior written consent. !

9. i) HCS will ensure that no part of the Artist’s performance shall be recorded, reproduced or transmitted in any manner or by any means whatsoever without the prior written consent of the Artist

ii) Any BBC broadcast (radio or television) of the Performance to be recorded shall be recorded subject to the current agreement between the BBC and the Incorporated Society of Musicians. !

10. If the Performance is cancelled by HCS, they shall immediately notify the Artist in writing of the same and shall pay the Artist a cancellation fee determined by the notice period between notifi-cation and the date of the engagement:

i) Notice of four weeks or less – 100% of the Fee plus any expenses incurred; ii) Notice of more than four weeks but not more than twelve weeks – 75% of the Fee

plus any expenses incurred; iii) Notice of more than twenty-six weeks – 25% of the Fee plus any expenses incurred; iv) The payment of the cancellation fee shall be without prejudice to any other rights

and remedies of the Artist against HCS or any third party. !11. This Agreement is made in accordance with the laws of England and Wales and the Courts of

England and Wales shall be the Court of Jurisdiction. !12. Additional conditions:
