1. Disposal point of the treated effluent is proposed at 14.7 KM away from CETP premises into saline zone of Kundalika River, However the point certified by the NIO is not mentioned for existing CETP as well as for proposed expansion.

2. As per the RRZ Policy the RED category industries are allowed beyond 750 mtrs in MIDC area and as per the application Kundalika River (Notified River) is at a distance of about 780 mtrs, However the River Distance Certificate from the Exe. Engg. of Irrigation Department is not submitted.

- As per the minutes of 4th CC meeting held on 30/05/2014 the case was kept in abeyance for non revalidation of C to E.

- PP has submitted application for revalidation of C to E on 06/08/2014 and accordingly SRO Thane-I has submitted processed application to HQ on 27/08/2014. However area applied for revalidation of is for BUA – 35654.57 Sq. Mtrs. Out of TBUA – 57342.27 Sq. Mtrs.

- The question of revalidation of C to E for remaining area out of TBUA as mentioned in the EC obtained on 17/05/2013, was discussed personally with the representative of the PP on 23/09/2014.

- PP has submitted copy of revalidated consent granted by Board on 06/01/2014 for the TBUA – 57342.27 Sq. Mtrs. As per area prescribed in the EC granted by GOM.

- In view of above, the decision made during the CC meeting dated 30/05/2014 regarding revalidation of C to E may be reviewed and accordingly shall be cancelled.

- In view of above, it is clear that, PP has filed application for revalidation of C to E inadvertently and considering this we may grant part C to O for the area of 35654.57 Sq. Mtrs. Out of 57342.27 Sq. Mtrs.

- Further, we may consider the application made by PP for revalidation of C to E is disposed.

- Re submitted for discussing the application in forthcoming CC meeting.

Residential Project to MPC Board and Area details of the project :- Total plot area-86139.75 sq.m Total BUA as per E.C. 89851Sq.mtr.

2. The application was placed before Consent Committee meeting of Board dated: 29/04/2014, along with their reply submitted in respect of show cause notice for refusal of consent to operate vide their letter dated: 28/02/2014 and submitted as under :

They are withdrawing their application for 1st Consent to Operate for residential project was inadvertently filed by them with MPC Board, in view of the judgment dated: 23/01/2012 passed by Hon’ble High Court of Delhi ( Division Bench) in LPA no: 895 of 2010 and 37 other petitions ( copy of the judgment is enclosed)- Consent to establish /Consent to Operate is not applicable to residential complex under Air Act and Water Act.

They reserve their right to file fresh application, if required in the mater. This is without prejudice to our rights, contentions and remedies available to them under law.

3. The application was placed before Consent Committee meeting of Board

dated: 29/04/2014, along with their reply submitted in respect of show cause

notice for refusal of consent to operate vide their letter dated: 28/02/2014 and

as per decision taken in the Consent Committee meeting dated: 29/04/2014, it

was decided to keep the case in abeyance and put up in next consent

committee meeting with legal opinion.

4. Legal wing opined that, as per decision taken in the CAC meeting held on

28/04/2014, P & L division has sent letter addressed to PS Env. Dept. regarding

applicability of consent under water and Air act on 19/05/2014.

5. As per instruction of Hon’ble Member Secretary we may place the application

for discussion in the forthcoming CC meeting.

As SRO reported that industry has proposed to carry out weaving activity

in Air Condition and for this is need humidification, and for

humidification water requirement is 200 CMD and no effluent will

generate from this activity. However industry has proposed the

increase in Domestic effluent by 25 CMD and the treatment facility

provided for D.E is Spetic Tank. Board official visited the industry on

03.04.2014 and observed following;

a. Industry is opting in staggered manner as per schedule circulated by

TEPS –CETP.


b. Water consumption is within consented limits as per water bills shown.

c. Effluent discharge was in CETP drain.

d. O & M of ETP was not satisfactory, i.e effluent in aeration tank was

blackish and in septic condition.

e. Fuel pattern is as per consent.

f. During visit Wet Scrubber was not in operation.

g. H.W not sent to CHWTSDF in stipulated period and quantity is also less

against consented quantity.

h. Flow meter, pH meter is provided, however separate energy meter to

APCs is not installed.,

i. Lock & key arrangement is not provided.

1) Paint empty containers, plastic liners and hand gloves contaminated with paint residues are stored haphazardly in the premises. No isolated storage area is made for storage of hazardous waste.

1) The distance of Junad Opencast Mine from the river Wardha (Notified A-II Class) is 0.10 Kms thus not meeting the RRZ policy in respect of Wardha River (A-II Class).

2) The Board had issued closure directions to the said mine vide letter no. MPCB/ROC/Dir/172/942/2013, dated 07/05/2013 due to coal transportations issues, RSPPM results exceeding consented limits & various non compliance observed during joint visit of WCL & MPCB officials.

3) RO-Chandrapur has already submitted the proposal for initiating further stringent action, in view of violation of closure directions vide letter dated 28/04/2014.

4) During the survey of overburden of various mines, in the region, the overburden of this mine was within 45 mtrs distance from the Wardha River.

5) The mine has submitted quarterly environmental monitoring reports. The mine has also submitted analysis reports of ambient air monitoring which revels exceeding RSPPM results.

6) RO-Chandrapur has already communicated the mining authorities not to take any steps for commencement of coal production activities, unless restart order from MPCB is obtained and consent to operate is granted to the said mine.

7) SRO-Chandrapur vide dt: 26/09/2014 submitted present status report along with details of pollution control system provided.
