Q. It is recommended that the following resolution regarding the 2019-2020 school year calendar be approved:

WHEREAS, COVID-19 has resulted in State and County governments declaring a state of emergency; and

WHEREAS, on March 16, 2020, the New York State Governor ordered, pursuant to Executive Order No. 202.4, the closure of schools for students statewide for a period of two weeks ending April 1, 2020; and

WHEREAS, the New York State Governor issued additional executive orders resulting in the closure of schools for students through the end of the 2019-2020 school year; and

WHEREAS, the New York State Education Department requires a minimum of 180-instructional days during the course of the school year (“instructional quota”); and

WHEREAS, in accordance with the Executive Order No. 202.4 and its subsequent executive orders, school districts were required to provide continuous instruction, including instruction during times designated on the 2019-2020 calendar previously approved by the Board of Education as vacation periods (April 6-10, and May 22, 2020) and utilize available snow days; and

WHEREAS, the West Genesee Central School District has collective bargaining agreements with many of its employees that dictate the length of the work year, and for ten-month employees, the length of the work year is connected to the delivery of a number of instructional and professional development days (the “academic work year”); and

WHEREAS, in accordance with the executive orders, instructional staff delivered instruction during the scheduled vacation periods (April 6-10, and May 22, 2020) and the District has utilized its available snow days, and, thus, will have delivered the instructional quota prior to the currently scheduled last day of the 2019-2020 academic work year; and

WHEREAS, in order to prevent the District’s ten-month employees from working beyond their contractual work-year days, it is necessary to adjust the school calendar by bringing the 2019-2020 academic work year to an earlier close (i.e., on a date after the instructional quota is achieved and prior to the contractual work year days being exceeded).

NOW, THEREFORE, BE IT RESOLVED that the 2019-2020 school district calendar is modified to reflect:

1. April 6-10, 2020 and May 22, 2020, days originally planned to be no school for students, were days when school was in session as part of the Governor’s continuity of instruction plan.

2. As a result of the additional continuity of instruction student days, the last day for student instruction during the 2019-2020 school year shall be June 15, 2020.

3. As a result of the additional continuity of instruction student days, the last day for the 2019-2020 academic work year for ten-month employees shall be June 18, 2020.

4. Sections 2 and 3 above are subject to any prospective requirements or mandates from the State that may necessitate their modification.

5. The Superintendent shall provide notice to the staff, parents, students, and community of the adjusted school calendar.

6. This resolution shall take effect immediately.

SUPERINTENDENT’S REPORT

Superintendent, David Bills, opened his remarks by requesting an update from Mr. Pelton on the status of the 2020-21 Budget Vote and the logistics of how it will work. Mr. Bills then spoke on the topic of health during the COVID-19 pandemic, and the governor’s extension of the executive order which keeps school buildings closed for the remainder of the academic year. He spoke of how remote learning has affected our students and staff, notably, the senior class and traditional events for them as they prepare for the end of their high school career, asserting that their legacy will not be defined by this period of time. Mr. Bills went on to speak of eventual re-entry, and pointed out that New York State has a reopening advisory board that will be working with the governor. He added that he had assembled a taskforce of about 25 people that met a few times before we were separated from the buildings, and in the next week or the week after, they will begin to plan for that eventual re-entry. Mr. Bills, with Mr. Kesel, then went on to review the results of the recent survey that was sent to families and teachers.

OPEN FORUM

The Board of Education and the West Genesee Central School District look forward to the opportunity to honor the retirees in-person at a future date.

Amanda Simmons shared a few words regarding Susan Taylor, noting that her retirement will leave the Stonehedge faculty and staff heartbroken. Susa is wonderful to work with, she consistently displays an exemplary understanding of Early Literacy practices and helps to support students in the reading process. She is sensitive to the academic and emotional needs of our children. She is always a positive influence in our classrooms and school community. Sue looks forward to spending more time as a grandma, and we send her off with best wishes.

Mary Bily tells of Linda Bianchi, whose retirement from the Food Service department at Split Rock Elementary School. Linda came to the Camillus area from Camden in 2014 and began working with the District as a sub, until she found her niche at Split Rock and became permanent in 2015. Linda loves working at Split Rock, and especially loves the children. Mary describes Linda as sweet, and soft-spoken, a gem. Linda will be missed by the Split Rock Staff as well as the children. Linda hopes to be enjoying time by traveling being with her family soon.

It is recommended that the resolution regarding an Energy Performance Contracting Agreement between West Genesee School District and King + King Architects, 358 West Jefferson Street, Syracuse, NY 13202, be approved:

WHEREAS, the Board of Education has determined that it is in the best interest of the District to retain an Architect/Engineer to provide Architectural, Engineering, project management, and related professional services in connection with its 2019-2020 Energy Performance Project in conjunction with an Energy Performance Agreement with Siemens Industry, Inc. (the “Project”); and

WHEREAS, the Board of Education has determined that it is in the best interest of the District to continue its professional relationship with King + King Architects, LLP (“King + King”) for the purposes of providing Architectural, Engineering, project management, and related professional services for the Project; and

WHEREAS, the District’s legal counsel, Ferrara Fiorenza PC and King + King have jointly prepared a contract for Architectural, Engineering, project management, and related professional services relative to the Project (a copy of which has been shared with the Board);

NOW, THEREFORE, be it resolved as follows:

1. The Board of Education approves the retention of King + King to provide Architectural, Engineering, project management, and related professional services and proceed with the Project in accordance with the terms and conditions of the contract approved by legal counsel and previously shared with the Board of Education.

2. The Board of Education hereby authorizes the President of the Board or the Superintendent of Schools to enter into the approved contract with King + King on behalf of the Board of Education and take all steps necessary or convenient to proceed under the contract in connection with the Project.

3. This resolution shall take effect immediately.

Shall the West Genesee Central School District levy and collect a tax, pursuant to Section 259 of the Education Law of the State of New York, in the sum of $352,777 (which is an increase of $6,917 from the Maxwell Memorial Library Tax Levy in effect from 2019-2020 in the sum of $345,860) for the continuing support and maintenance of the free library services offered to district residents by the Maxwell Memorial Library historically supported by the residents of the West Genesee Central School District?

3. Shall the West Genesee Central School District levy and collect a tax, pursuant to Section 259 of the Education Law of the State of New York, in the sum of $354,776 (which is an increase of $6,956 from the Fairmount Community Library Tax Levy in effect from 2019-2020 in the sum of $347,820) for the continuing support and maintenance of the free library services offered to district residents by the Fairmount Community Library historically supported by the residents of the West Genesee Central School District?

ONONDAGA-CORTLAND-MADISON BOCES Adult and Continuing Education Resolution

RESOLVED that the Board of Education of the

Central School District authorizes the Onondaga-Cortland-Madison Board of Cooperative

Education Services to operate Cooperative Adult and Continuing Education programs at no

charge to the district; without affecting their right to operate district programs.

WHEREAS school districts are authorized to provide Adult and Continuing Education

programs in a consortium administered by their BOCES, and

WHEREAS the number of enrollees in certain programs in a single school district does

not warrant the operation of those programs, and

WHEREAS there is ample evidence that there is a sufficient demand among adults in the

supervisory district to support self-sustaining instructional programs,

THEREFORE let it be resolved that the Central

School District authorizes the Onondaga-Cortland-Madison BOCES to operate a self-sustaining

Adult and Continuing Education Comprehensive Program, during the 2020-2021 school year at

The Onondaga-Cortland-Madison Board of Cooperative Educational Services agrees to provide the Equivalent of Attendance Program for residents of the district who are:

(a) 18-20 years old and attend instruction at sites throughout the counties; and

(b) attend the program as approved by the district’s E.O.A. designated

contact person.

The training is in the High School Equivalency Program, Basic Education Instruction, English as a Second Language. This agreement will be null and void if the Onondaga-Cortland-Madison BOCES fails to have the program approved by the New York State

Education Department. The billing for this program will be once a year. The amount of billing shall be equal to the district’s E.O.A. contact hours at $6.00 per hour.

The BOCES shall assume responsibility for the attendance of the students and any

inaccuracies or penalties a District may suffer shall be paid by the Onondaga-Cortland-Madison Board of Cooperative Educational Services.

Affiliation Agreement Between West Genesee Central School District and

State University of New York Upstate Medical University

This Agreement is made by and between West Genesee Central School District, located at 300 Sanderson Drive, Camillus, New York 13031 (hereinafter referred to as "Host") and the State University of New York, an educational corporation organized and existing under the laws of the State of New York, with its principal place of business located at State University Plaza, Albany, New York 12246, through and on behalf of The State University of New York Upstate Medical University (also known as SUNY Health Science Center at Syracuse), a component of which is College of Health Professions, located at 750 East Adams Street, Syracuse, New York 13210. (hereinafter referred to as "University").

WHEREAS, University has undertaken an educational program(s) in the discipline(s) of Physical Therapy and

WHEREAS, University and Host desire to have an association for the purpose of carrying out said educational program(s).

NOW, THEREFORE, it is agreed that:

1. The University shall assume full responsibility for planning and executing its educational program in the discipline of Physical Therapy including programming, administration, curriculum content, faculty appointments, faculty administration and the requirements for matriculation, promotion and graduation, and shall bear all costs and expenses in connection therewith. The University furthers agrees to coordinate the program with Host’s designee. Attached as Exhibit A is a copy of the curriculum for each covered discipline.

2. The University shall be responsible for assigning students to the Host for practical experience. University shall notify the Host one (1) month in advance of the planned schedule of student assignments to practical duties including the dates, number of students, disciplines, and instructors. The schedule shall be subject to written approval by the Host.

3. The University, at its sole cost and expense, shall provide faculty as may be required for the teaching and supervision of students assigned to the Host for practical experience.

4. The Host shall appoint qualified personnel to act as Clinical Instructors/Preceptors in the clinical education of the students. Attached as Exhibit B is a copy of the Teacher-Learner expectations.

5. The Host shall make appropriate field work experiences available to the students enabling the students to meet the objectives of the educational program for their discipline. This shall be at all times subject to patients’ rights and the training and abilities of the students.

6. The University agrees that at all times students and faculty members are subject to the

supervision of the Host and are considered part of the Host’s workforce only for purposes of access to and disclosure of protected health information (“PHI”) as defined by 45 CFR 164.501. University shall inform students and faculty that they must comply with all rules applicable to both students and faculty while at the Host’s facility, and that failure to comply shall constitute a cause for terminating such student’s assignment to or such faculty member’s relationship with the Host. The Host will provide copies of all policies and procedures to the students and faculty members. The University and Host agree to cooperate with one another’s operational, regulatory, licensure and accreditation requirements including but not limited to related surveys, audits, and other reviews.

7. Students and faculty members shall respect the confidential nature of all information that they have access to in accordance with the policies and procedures of the University and the Host. Host acknowledges that the University is a public entity and that Host’s proprietary information may be subject to disclosure pursuant to New York State Public Officers Law or other applicable law. The University is an agency of the State of New York, and as such, any and all agreements to which the University is a party are considered public record and subject to disclosure under the New York State Freedom of Information Law (“FOIL”).

8. The Host may terminate any student’s or faculty member’s assignment from the Host when a student or faculty member is unacceptable to the Host for reasons of health, performance, or for other reasons which, in the Host’s reasonable judgment and to the extent allowed by law, cause the continued presence of such student or faculty member at the Host not to be in the best interest of the Host. Any such action will be reported by the Host to the University orally and in writing.

9. The Host, as it deems necessary and proper, shall make available for student experience classrooms and other facilities, including equipment and supplies, libraries, and cafeteria facilities, consistent with its current policies in regard to availability. The Host shall also provide orientation for the University faculty and students.

10. In the event of an emergency during the clinical field work experience, the Host shall provide faculty and students with emergency medical care. The cost of this care shall be billed to such faculty member or student.

11. Except as set forth in Paragraph 6 of this Agreement, students and faculty members shall not be deemed to be employees, servants or agents of the Host, but shall be considered invitees. Neither party shall pay the other any compensation or benefits pursuant to this Agreement. The parties acknowledge that the Host is not providing any insurance, professional or otherwise, covering any students or faculty members.

12. The University agrees that it shall secure Workers’ Compensation Insurance for the benefit of all faculty and other University employees required to be insured by Workers’ Compensation Law, and shall maintain such coverage throughout the duration of this Agreement. The laws of the state where the Host is located shall dictate whether a student is covered by Workers’ Compensation Law.

13. Subject to the availability of lawful appropriations and consistent with the New York State

Court of Claims Act, University shall hold the Host harmless from and indemnify it for any final judgment of a court of competent jurisdiction for the University’s failure to perform its obligations hereunder or to the extent attributable to the negligence of the University or of its officers or employees when acting within the course and scope of this Agreement.

14. University shall maintain during the term of this Agreement liability insurance, in amounts not less than $3,000,000 for bodily injury and property damage combined single limit; and the Host is to be additionally named insured under such liability policy or policies. The persons insured under such policy or policies shall be the students of the State University of New York with respect to liability arising out of their participation in the programs carried out under this Agreement. The University’s faculty members are covered by the defense and indemnification provisions of section 17 of the Public Officers Law with respect to liability arising out of their participation in the clinical programs carried out under this Agreement. The University agrees to notify the Host in writing no less than ten (10) days written notice prior to the cancellation, modification or non-renewal of any insurance coverage. Notwithstanding the foregoing, the Host shall remain liable for direct damages resulting from its negligence.

15. It is mutually agreed that neither party shall discriminate on the basis of race, color, national origin, religion, creed, age, disability, sex, gender identity, gender expression, sexual orientation, familial status, pregnancy, predisposing genetic characteristics, military status, domestic violence victim status, or criminal conviction.

16. In accordance with the provisions of the Family Educational Rights and Privacy Act (“FERPA”), in order for the University to share information about the student from the student’s educational records, the Host must agree not to disclose the information to a third party without the student’s consent, and to use the information only for the purposes for which it was disclosed.

17. This agreement shall be governed by the laws of the State of New York without regard to conflict of law provisions. Any dispute arising under this Agreement shall be resolved in a court of competent jurisdiction in the State of New York. This Agreement contains the entire understanding of the parties with respect to the matters contained herein.

18. This Agreement or any of its provisions shall not be assigned, delegated, transferred, conveyed, sublet, or otherwise disposed of without the prior written consents of the University, the New York State Attorney General and the New York State Office of the State Comptroller, and any attempts to assign, delegate, transfer, convey, sublet, or otherwise dispose of this Agreement without said written consents shall be null and void.

19. The effective date of this Agreement shall be January 3, 2021 and shall continue in full force and effect for five (5) years or until terminated as set forth in this paragraph. This Agreement may be terminated by either party upon ninety (90) days written notice to the other. Notwithstanding anything in this paragraph including the expiration of the term of this Agreement, this Agreement shall remain in effect for any student who began their clinical rotation at the Host prior to the termination of this Agreement to permit such student to complete their rotation.

20. All notices required by this Agreement must be in writing, signed by the party giving it and

23. This Agreement may not be amended or changed in any of its provision except by a subsequent written agreement signed by the duly authorized representatives of the parties.

After several discussions that have included directors, the secondary administrators, and the high school department chair people, we would like to share with you the parameters for determining MP4 Pass or Fail, course credit, and Final Averages.

Let’s determine MP4 Pass or Fail.

“Complete.”

Next, let’s discuss Course Credit.

Final examinations are officially canceled.

When we close MP4, you will give the student a “Pass” for MP4 if 50% or more of the MP4 assignments are

If a student’s average for Marking Periods 1-3 for full-year courses (or the MP3 average for a semester course) is 65 or greater, s/he will receive course credit.

If a student’s average for Marking Periods 1-3 for a full-year course (or the MP3 average for a semester course) is between 58 and 64, the Executive Principal will review the student’s marking period averages AND performance in MP4 and make a decision about awarding course credit. If, after review of the MPs, the Executive Principal determines that a student will be denied course credit, recovery may occur through Principal’s Interaction Time or completion of work based on essential Standards for which a student has not attained. (Right now, we do not know the status or style of Summer School.)

And, let’s discuss Final Averages as they relate to GPAs.

For full year courses, the average of MP 1-3 will determine the Final Average for the course. For semester courses, MP 3 will be used as the Final Average.

However, if the Executive Principal awards Course Credit after reviewing the student’s overall performance including MP4, then the Final Average cannot be lower than a 65. In this case, a written record of the change of grade will be completed and authorized by the Executive Principal.
