On July 18, 2016, Perpetuating Unique Educational Opportunities, Inc. (“PUEO”) filed

its Motion to Set Issues [Doc-99] (“Motion”). The following documents were filed in response

to the Motion:

• On July 20, 2016, the Temple of Lono filed its opposition to the Motion [Doe-

119].

• On August 1, 2016, the University of Hawai’i at Hilo (“UHH”) filed its

substantive joinder to the Motion [Doc-140j.

• On August 1, 2016, TMT International Observatory, LLC filed its substantive

joinder to the Motion [Doe-I 52].

• On August 1, 2016, Petitioners Mauna Kea Anaina Hou, Ct at. filed its position

statement to the Motion [Doc-164].

• On August 9, 2016, Harry Fergerstrom (“Mr. Fergerstrom”) tiled his opposition to

the Motion [Doc-186].

• On August 10, 2016, Mehana Kihoi filed a joinder to Mr. Fergerstrom’s

opposition to the Motion [Doe-1951.

• On August 22,2016, UFIH filed its supplemental comments on the Motion [Doe-

242].

The Motion came on for hearing before this Hearings Officer on August 29,2016. Per

the request of this Hearings Officer at the hearing, PUEO submitted its proposed minute order

granting the Motion on September 9, 2016. The parties had until September 19, 2016 to respond

to PUEO’s proposed minute order.

This Hearings Officer having considered the Motion, all other written and oral

submissions of counsel and parties related thereto, the entire record, and for good cause shown,20$9679,VI 3

IT IS HEREBY ORDERED that the Motion is GRANTED pursuant to Hawaii

Administrative Rules “HAR’ §13-1-36(a) and all other applicable rules of HAR Title 13,

Chapter 1, Rules ofPractice and Procedure. This Hearings Officer finds that the following

issues may be addressed during this contested case hearing:

consistent with the eight criteria in HAR § 13-5-30(c) and other applicable rules

This Hearings Officer finds that the following issues will not be addressed In this

contested case hearing:

1. The sovereignty of the Kingdom of Hawai’i or any other issues relating to the

purported existence of the Kingdom ofHawai’i.

2. Challenges to the legal status of the State ofHawai’i.

I Cindy Freitas, in the subject matteron the site visit to Mauna A Wakea which is

scheduled for September 26 2016.

I have deep respect for Manna A Wakea and as well for my ancestors before me for

thousands of generation. We are the living Native Hawaiian, descended of the native

inhabitants of Hawai’i.

JEi all due respect 1 cai only disclosed that what moves my na’au to inform you that

the site of the proposed area is many generational of our culture customary traditional

religious practices.

Logistics ofSite V&L The Department ofLand and Natural Resources has obtained

transportation for participants; three Aniot’s vans have been hired, one ofwhich will be

designated an emergency vehicle to drive down the mountain if needed. All approved persons

should be at the Hilo Bayfront Soccer Fields prepared to depart at 8:30 a.m. on Monday,

September26, 2016. Here is the schedule:

The Hearing Officer and her party will meet the vans and participants at the Visitor

Center or Hale Pohaku at the start of the Site Visit. Only authorized vans carrying approved

participants will be allowed on the Site Visit. There will be no unscheduled or impromptu stops

unless specifically authorized by the Hearing Officer.

Lunch will be provided for participants. However, participants are advised to brine

their own drinks: e.a. water, iuice soda.

DesignatedSites After considering the recommendations and requests in the documents

noted above and further considering that the purpose ofthe Site Visit is to see first-band the

location and observable impact of the Thirty-Meter Telescope project, the following sites will be

visited on September 26,2016:

Proposed Thirty-Meter Telescope Site

) The Sunimit Loop road near the Keck Observatory

> Possibly two or three other sites to be determined by the Hearing Officer as the

visit proceeds

Either the 110 or the UHH is requested to arrange for the illustration using a red helium

balloon attached to a rope approximately 187 feet long.

Recordation. There shall be no recordation ofthe Site Visit except for the media as

permitted under Minute Order No. 10 (Document 65), No court reporter will be present to take a

verbatim record of what is said or to produce transcripts. Notetaking by counsels and parties

using computers or electronic tablets will be allowed.

On September 19. 2016 Minute Order No. 1 8 [DOC 274] was tiled. The tiling stated

the following documents ol the Site Visit Proposal was tiled and granted [DOC 214, 215,

216. 217. 218, 219. 220. 255. and 2601 and approved the following person in the DOC

274 for site visit and a requested to arrange for the illustration using a red helium balloon

attached to a rope approximately 1 87 feet long was confirmed in DOC 274. But yet other

parties have requested toillustrate other red helium balloon in other areas of the proposed

TMT site. Neither there were no other illustrate red helium balloon that was requested by

other parties nor were there any clarification in any way or form on any minute order.

This red helium balloon would have illustrated the impact were the location of the TMT

proposed telescope would he and also the 5.000 tanks that will he stored underground as

Therefore Minute order no. 18 violates the Due Process Rights of Cindy Freitas,

‘Petitioner” and other parties that submitted their proposal to Site Visit.

Site Visit on Mauna Ken was completely inadequate. I have requested in DOC 220’

Site Visit proposal and in DOC 278 Motion to Amend DOC 274 to include request in

D()C 220. Request as followed:

The Site Visit on September 26. 2016 at 10:30 n.m. was done in a “fast track” order.

I sat in the van and cried while we pass the AHU SITE (a place of worship) and I was

told by the driver he was instructed that no one can come out of the van nor I could view

the rope that holds the helium balloon, it did not seem to be a 1 87 feet it seems to be

much shorter.

The Driver drove the van to the TMT proposed location and then to the summit loop

road near the Keck Ohsevatory and to the Batch plant’ were we could go out and use the

bathroom and back into the van and back down to Hale Pohaku. It only lasted less than 2

hours.

Petitioner could not follow my own protocol in my culture and traditional and religion

practices. Therefore the right of my culture and traditional and religion practices as a

practitioner is violated. The Scared Mountain of Mauna Kea is not to ‘fasi track it there

is proper protocols that need to be address. The Hearing Officer had the opportunity first

hand to observed in the spiritual and tradition funeticn of the important of this significant

impact of this TMT hut yet did not give the Petitioner the opportunity to see the

significant impact that will cause a substantial injustice and also the emotional and

psychological of our culture and traditional and religion practices as a Native Hawaiian,

descended of the native inhabitants of Hawai’i prior to 1778.

Therefore the right of my culture and traditional and religion practices as a practitioner is

violated, The Scared Mountain of Manna Kea is not to “fast tracks’ it there is proper

protocols that needs to he address and that the Hearing Officer had the opportunity.

My request in the DOC 220 and DOC 278 was not address therefore the contested case

hearing has violated my Due Process Right and the right of my culture and traditional

religion practices therfore this objection to the site visit on September 26, 2016 has

shown good cause to be granted.
