invocation. 2. The meeting host, Jake Webb with First United Bank, welcomed the group. 3. The Ambassador of the Month, Paula Salamon with Kona Ice – South Lubbock was
recognized. 4. The May Business of the month, Main Event was recognized. 5. Audit report: Greg Taylor, D. Williams and Company, presented the 2017 audit reports for the
Chamber and provided a copy of the audit for the Foundation. a. Taylor reported an unqualified opinion for both audits.

Memo for Executive Committee and Board of Directors From: Eddie McBride, President and CEO Date: June 15, 2018 Subject: Program of Work and Division Reports Business Advocacy—Vice Chairman Dave Marcinkowski Issues Management • The U.S. Department of Labor on June 13 allowed a deadline to pass without asking the
Supreme Court to hear an appeal of a March appellate court ruling that voided the Fiduciary Rule. The end of the day Wednesday marked the deadline for such a petition. The DOL’s silence effectively ends the short-lived rule and favor our role in this lawsuit.
• We are monitoring and considering official comment on two rulemakings: o The National Labor Relations Board announced a rulemaking to clarify the definition of
“Joint Employer.” In 2015, NLRB issued a decision imposing liability and requiring bargaining in ‘joint employment’ situations. Under the NLRB’s decision, joint employment can be found in situations where a business possesses only potential and indirect control over the employees in question, such as in restaurant franchise situations.
o Comment due July 3 on a Proposed Rule for food labeling requiring disclosure of bioengineered ingredients. The U.S. Chamber drafted comments, and most of the proposed rule appears reasonable and positive for ag., food industry and consumers.
o The Chamber is awaiting issuing of Final Rule for two regulations: Association Health Plans and the Persuader Rule Rescinded Rule.
Government Relations • We are awaiting confirmation of a date the first week in August for a Legislative
Appreciation Luncheon honoring Congressman Jodey Arrington. • Tom Sell of Combest, Sell & Associates, updated the Committee on the 2018 Farm Bill. The
bill failed narrowly in late May due to unrelated politics surrounding scheduling of an immigration bill vote. Sell also discussed trade issues.
Agriculture & Natural Resources • John Duff of National Sorghum Producers updated the Committee this month on the surprise
lifting of an anti-dumping investigation and 179% tariffs on sorghum launched earlier this year by China. The committee discussed the Proposed Rule for Bioengineered Food labeling.
Transportation • We submitted a letter to Secretary of Transportation Elaine Chao expressing support of anti-
trust immunity for American Airlines and Quantas Airways as they apply to form a joint venture. The letter was submitted at the request of Transportation Committee Chairwoman Kelly Campbell, LPSIA Director.
