Proceeding Under K.S.A. Chapter 26 Title to Real Estate Involved
PETITION FOR CONDEMNATION
COMES NOW the Plaintiff, Westar Energy, Inc., and for its verified Petition alleges and
states as follows:
1. The Plaintiff is a Kansas corporation, active and in good standing with the Kansas
Secretary of State, having a principal place of business at 818 S. Kansas Avenue, Topeka, Shawnee
County, Kansas.
2. The Plaintiff has determined that it is necessary and in the best interest of the public
safety, service and welfare, for Plaintiff, on its own behalf and on behalf of its successors and
assigns, to acquire easements for the construction, maintenance, improvement and operation of
high voltage electric transmission and distribution lines (and the conductors and structures, with
their appurtenances, used to carry them) upon real estate hereinafter described, pursuant to the

limitations imposed by law, regulation and professional standards.
3. The acquisition of private property by eminent domain is necessary to the lawful
public purposes of the Plaintiff and to facilitate the expansion ap.d improvement of the
transmission and distribution of electric services.
4. Pursuant to K.S.A. 17-618, K.S.A. 26-501, et seq. and the Kansas and United States
Constitutions, the Plaintiff may acquire, by exercise of the right of eminent domain, easements
upon lands, or interests or rights therein, and other property and rights necessary for the purposes
described in this Petition, for itself and its successors and assigns.
5. The Plaintiff has performed all acts necessary to exercise the power of eminent
domain pursuant to K.S.A. §§ 26-501, et seq and any other applicable provisions oflaw.
6. In order for the Plaintiff to carry out its lawful powers and duties as stated herein,
it must acquire, by exercise of the right of eminent domain under K.S.A. 17-618, K.S.A. 26-501,
et seq. and the Kansas and United States Constitutions, easements to the following described lots,
parcels or tracts of land. The owners, all lienholders of record, and any party in possession of
each lot, parcel or tract of land are described as follows:

The ''Entire Ownership Tract" upon which the Right-of-Way is located is described as:
Tract I: Lot 4, Block F, Southgate Commercial and Industrial Subdivision in the City of Topeka, Shawnee County, Kansas.
Tract IT: A part of Lot 3, Block F, Southgate Industrial Triangle Subdivision in the City of Topeka, Shawnee County, Kansas, described as follows: Beginning at the Southwest corner of said Lot 3; thence North 1 degree 32 minutes 50 seconds West, along the West line of said Lot 3, 295.81 feet to the Northeast comer of said Lot 2; thence North 88 degrees 24 minutes 10 seconds East, parallel to the South line of said Lot 3, 339.22 feet to a point on the East line of said lot 3; thence South 1 degree 24 minutes 04

seconds East, along the East line of said Lot 3 and along the East line of said Lot 3 extended, 255.83 feet to the South line of said Lot 3; thence Southwesterly, along the South line of said Lot 3 and on a curve to the left that has a radius of 80.0 feet and a chord that bears South 46 degrees 10 minutes 52 seconds West, an arc distance of 60.97 feet; thence South 88 degrees 24 minutes 10 seconds West, along the South line of said Lot 3, 294.54 feet to the point of beginning.

Purpose: Board of Commissioners consideration is requested to approve the findings of the Professional Services Selection Committee for design services for the Lake Shawnee Trail renovations and authorize Parks + Recreation to enter into contract negotiations with the selected firm for their services.
Justification: The trail at this location is challenging to maintain, particularly during inclement weather such as rain or snow. This stretch of the Lake Shawnee Trail currently requires bicyclists to adhere to signage stating they have to dismount and walk their bicycles between marked sections of the trail. Furthermore, the slope of the trail at this location limits its usability to persons with limited mobility or those that use assistive devices. This section of trail does not meet current American Association of State Highway Transportation Officials (AASHTO) standards. The newly renovated trail would be AASHTO compliant.
On April 3, 2017, the Board of Commissioners approved the department to solicit Requests for Qualifications (RFQ) for design services for the realignment and/or reconfiguration of the Lake Shawnee Trail along SE 45th street. The department received three (3) responses to RFQ #028-17. They were CPS Engineers, Landplan Engineering and Treanor Architects. The Professional Services Selection Committee unanimously selected CPS Engineers as the most qualified firm to provide design services.
At the May 8, 2017 meeting ofthe Board of County Commissioners meeting Tom Vlach, Public Works Director requested authorization to seek RFQ' s for design firms for improvements to SE 45th St between SE California and SE Croco. Commissioner Cook asked at that time if Public Works and Parks + Recreation had discussed the trail renovation project and the road improvements project. Mr. Vlach stated that he has talked with Mr. Knight and will bring Parks + Recreation in when the design of the road is being contemplated.
Mr. Knight and Mr. Vlach have since had additional communications and determined there is indeed a potential for savings in the future widening of SE 45th St with the possibility of the Lake

Shawnee Trail alleviating the need for a sidewalk along the north side of SE 45th between East Edge Road and West Edge Road. In addition the bridge over the waterway at East Edge Road could be made narrower without the need of a 10' wide walk.
Mr. Vlach and Mr. Knight agree that Parks + Recreation should be part of the design of the road south of Lake Shawnee. This would allow Public Works and Parks + Recreation to consider how linkages between the SE 45th St sidewalk and the Lake Shawnee Trail might function and to consider impacts of the East Edge Road and West Edge Road intersections in the Lake Shawnee area.
Cost for the design and subsequent improvements would come from the Lake Shawnee Trail Fund (33CPOOO). This fund was dedicated for the completion of the Lake Shawnee Trails Project.

WHEREAS, The Board of County Commissioners of the County of Shawnee, Kansas desires, pursuant to K.S.A. 19-430, to appoint Steve Bauman, an eligible Kansas appraiser with at least three (3) years of mass appraisal experience, as the Shawnee County Appraiser;
NOW, THEREFORE, The Board of County Commissioners of the County of Shawnee, Kansas, meeting in regular session on this_ day of June, 2017, does hereby resolve as follows:
1. Steve Bauman, an eligible Kansas appraiser with at least three (3) years of mass appraisal experience, is appointed as the Shawnee County Appraiser for a four (4) year term pursuant to K.S.A. 19-430, effective on July 1, 2017 and ending June 30, 2021.
