Call to Order The meeting was called to order by Commissioner Peters at 10:04 AM.

Pledge of Allegiance and Moment of Silence

1.a Approval of minutes of November 22, 2019.

Richard E Beck made a motion to Approve minutes from the November 22, 2019 meeting. F. Nelson Peters seconded the motion. Motion Passed: 2 - 0

1.b Independent contractor agreement with Katheryn Valentic for mental health assessments on behalf of Community CorrectionsAttorney Spencer Feichner explained that Katheryn Valentic has served as an independent contractor doing mental health assessments for Allen County Community Corrections for several years. However, she is expected to sever that relationship and Community Corrections is also looking for another vendor to perform the service. Therefore, the language of the agreement has been adjusted to reflect no term length and a brief 15-day termination for either party.

1.c Warranty Deed for Notestine Rd Bridge # 13 over Gorell Ditch, Project # 0100116 a. Parcel 1 - GraberHighway Director Bill Hartman explained that this was the final parcel of four to be obtained and he anticipates a spring bid letting for the Gorell Ditch project.Richard E Beck made a motion to Approve . F. Nelson Peters seconded the motion. Motion Passed: 2 - 0

1.d Right of Way Grant for Copper Mine PassageHighway Director Bill Hartman noted that the Copper Mine Passage had been completed satisfactorily and he endorsed the project.Richard E Beck made a motion to Approve . F. Nelson Peters seconded the motion. Motion Passed: 2 - 0

1.e Agreement with Neil Wiffill for plaster and paint restoration and Scagliola repair at the CourthouseChief of Staff Chris Cloud explained that this project, recommended by the Courthouse Preservation Trust, would restore the paint and plaster, and also restore the Scagliola, which is the faux marble effect in the courthouse.

1.f Sanitary Sewer Shared Tap Agreement between the Board of Commissioners and Hall Drive-Ins, IncChris Cloud, Chief of Staff, noted that when Hall Drive-Ins, Inc. moved a restaurant building onto a lot partially owned by the Allen County Commissioners, they were required to utilize a sanitary tap line which is also used by the county. Because of this shared use, a standard shared sanitary tap agreement is necessary, and was presented for the commissioners' review.

1.g Settlement agreement and release of all claims in the case of Richard Cole v. David Gladieux County attorney Spencer Feichner explained that due to the expense of taking depositions from medical personnel, researching medical records and other considerations of the plaintiff's situation, it was decided to offer a settlement in the case of Richard Cole V. David Gladieux in the amount of $2,500. Commissioner Peters inquired if there had ever been a "break-even amount" study done between paying out a negligence or nuisance claim and fighting it in court. Feichner responded that he didn't think so but there were many considerations in each case.
