EXAMINATION NEWS EXAMINATION RESTRUCTURE UPDATE On January 1, 2016, the Board of Behavioral Sciences (Board) began the implementation of the examination restructure. These first few months of the examination restructure were not without its challenges, impacting both Board staff and examination candidates. On May 5, 2016, the modifications to the BreEZe data system were implemented. These modifications automate many of the steps that Board staff was completing manually and will allow candidates to move through the process more efficiently. Examination candidates who still experience difficulty in scheduling an examination should contact the Board’s Examination Unit for assistance. MESSAGE FROM THE BOARD CHAIR

May denotes the end of spring, and summer is around the corner. It is an exciting month for the graduating students who will receive their diplomas and accomplish a milestone in their education. I offer my most heartfelt congratulations to the graduates for their accomplishments. Welcome to this challenging, yet rewarding, mental health field!

For those who are about to start the application to receive the initial intern registration number, please visit our Board of Behavioral Sciences (BBS) website (www.bbs.ca.gov) where the application forms, supervision resources, and tutorials are posted. You will find valuable information to guide you through the examination process and the pathway to licensure.

The long-expected Examination Restructure became effective as of January 1, 2016. Many thanks to the BBS staff for their long hours and diligent efforts behind the scenes attributed to a relatively smooth transition to the new examination process.

The BBS Sunset Hearing was held on March 14, 2016, before the Senate Business, Professions, and Economic Development Committee and the Assembly Committee on Business and Professions. The purpose of the hearing is to review the Board’s function, programs, and performance. We are pleased to announce that the Committees are proposing that BBS receive the maximum of four years until the next Sunset Review.

I would like to introduce Mr. Max Disposti, the newest BBS Board member. Mr. Disposti is a public member and was appointed by former Assembly Speaker Toni Atkins. He is from San Diego and possesses a wealth of knowledge serving LGBTQ populations in a nonprofit setting. Please join me in welcoming Mr. Disposti to the BBS.

On a personal note, my two terms as the BBS Board Chair will end on May 31, 2016. It has been an honor and privilege to serve you. I am humbled for the many opportunities to learn and to lead. I am grateful for the outstanding quality of service the Board provides to make the mission of consumer protection possible. My best wishes to the next elected leaders. LICENSING NEWS CONGRATULATIONS! YOU’VE PASSED THE CLINICAL EXAMINATION. This is the phrase all candidates for licensure look forward to seeing. If you are the recipient of this wonderful news, celebrate your achievement but remember to apply for your initial licensure. The initial licensure form is available on the Board of Behavioral Sciences (Board’s) website at www.bbs.ca.gov/forms.shtml.

Select the initial licensure form applicable to your license type. Submit the completed form and appropriate fee to the Board. Your initial license will be processed within 30 days. Remember, the law allows all successful candidates one year from the date of their last examination to apply for their initial licensure. So don’t wait—apply for the license you have worked so hard to achieve.

CONTINUING EDUCATION AUDITS On January 1, 2016, the Board resumed continuing education audits. The purpose of the audit is to verify compliance with the continuing education requirements. Each month the Board will randomly select 1 percent of each license type for an audit. The selected licensee will be asked to provide documentation to demonstrate he or she has completed the required number of continuing education hours and coursework. Licensees determined to be out of compliance will be referred to the Board’s Enforcement Unit for the issuance of a citation and fine.

Thus far, the Board has completed three audit periods. Unfortunately, the audit failure rate is nearly 30 percent. At least half of the licensees audited neglected to take a six-hour Law and Ethics course, a requirement for each renewal period.

In 2015 the Board developed the Continuing Education Information brochure to assist licensees with the continuing education process. The brochure contains information regarding the required coursework, record retention of your continuing education certificates, and where you may obtain your continuing education. The brochure is included in this newsletter and is also available on the Board’s website, www.bbs.ca.gov. Please take some time to review the continuing education requirements for your license type. Understanding these requirements will help you avoid a failed continuing education audit.

BBS SUNSET REVIEW Each year, the Assembly Business and Professions Committee and the Senate Business, Professions and Economic Development Committee jointly hold Sunset Review Oversight Hearings to review the boards and bureaus under the Department of Consumer Affairs (DCA). DCA boards and bureaus are responsible for protecting consumers and the public and regulating the professionals they license. The Sunset Review process provides an opportunity for DCA, the Legislature, the boards, and interested parties and stakeholders to discuss the performance of the boards and make recommendations for improvements.

This year, the Board of Behavioral Sciences (BBS) was one of 10 boards and bureaus scheduled for Sunset Review. In preparation for its Sunset Review hearing, BBS developed a comprehensive report detailing its work since the last Sunset Review in 2012. The BBS Sunset Review Report is available on the BBS website at www.bbs.ca.gov/pdf/publications/bbs_2015_sunset_report.pdf. This 529-page report provides detailed information regarding BBS’ history, legislation, and regulation activity; licensing, examination, and enforcement programs; fiscal information for the past four years; and responses to the issues raised in the previous Sunset Review.

BBS Chairperson Christina Wong, Vice Chair Deborah Brown, Executive Officer Kim Madsen, and Assistant Executive Officer Steve Sodergren attended the March 14, 2016, hearing. During the hearing Ms. Wong and Ms. Madsen responded to questions from the Committee regarding the Board’s performance.

BBS is pleased to share that Assembly Bill 2191 (Salas) proposes a four-year extension (January 1, 2021) for the BBS until its next Sunset Review.

BOARD MEMBER NEWSOn March 8, 2016, Max Disposti was sworn in to become the newest public member of the Board of Behavioral Sciences (Board/BBS).Maxwasappointedby former Assembly Speaker Toni Atkins and brings years of experience advocating for mental health services and education to the Board. Max was born in Italy in 1968 and lived in Rome for 30 years. After college, he pursued his volunteer aspirations by working

with different human rights nonprofit organizations. Upon arriving in the United States in 1998 and after moving to Southern California in 2001, he soon began volunteering his time with local agencies, where he noticed the need for a stronger North San Diego County LGBTQ community. In January 2008, he founded the North County LGBT Coalition, a nonprofit organization that almost immediately increased LGBT visibility in the North San Diego community. After four years of hard work, an outpouring of community support, and with the help of a dedicated board of directors, the North County LGBTQ Resource Center was opened in 2011, where Max operates now as Executive Director. He is seasoned nonprofit executive in organizational oversight, marketing/communications,development/fundraising,eventplanning, outreach, membership building, and campaigns. Max provides ongoing coaching, Board governance, training on LGBTQ competency, and support for others on the team through the continued sharing of his knowledge and experience. Welcome to BBS, Max!

Continuing Education Hours Required for Renewal

Thirty-six hours of continuing education (CE) are required during each two-year license renewal period. Newly licensed individuals must complete only 18 hours of CE prior to their first renewal. Courses may be credited to only one renewal period and cannot be counted twice. You must have your CE completed BEFORE submitting your renewal. Exceptions

You are NOT required to complete CE for license renewal if:

• Yourlicensestatusis“inactive”or“retired”OR

• YouweregrantedanexceptionbytheBoardofBehavioral Sciences (Board). The Board may grant an exception if, during the previous renewal period:

- You resided in another country for at least one year OR

- You were absent from California due to military service for at least one year OR

- For at least one year during your previous renewal period, you or an immediate family member, for whom you are the primary caregiver, had a physical or mental disability or medical condition.

For more information on obtaining an exception, see the Request for Continuing Education Exception form (www.bbs.ca.gov/pdf/forms/ce_exemption.pdf) on the Board website. Mandatory Courses

1. Law and Ethics: ALL licensees are required to complete at least six hours of CE in Law and Ethics as a condition of each and every renewal. These hours count toward the total 36 (or 18) hour requirement.

2. One-time mandatory course(s): Each license type has additional one-time mandatory course(s) that must be completed: Licensed Professional Clinical Counselors (LPCCs): HIV/AIDS (seven hours) Licensed Clinical Social Workers (LCSWs) and Licensed Marriage and Family Therapists (LMFTs):

• HIV/AIDS(sevenhours)

• Spousal/PartnerAbuse*(sevenhours)

• Aging/Long-TermCare*(threehours)

*Requirementwaivedifyoucompletedthiscourseinyour degree program.

Licensed Educational Psychologists (LEPs):

The Board does not approve specific CE courses and has no information about individual courses offered by providers.

Providers are required to ensure that the content of a course is relevant to the practice of marriage and family therapy, clinical counseling, clinical social work, or educational psychology. Self-improvement courses and courses designed for nonpractitioners are not acceptable.

To ensure that a course will count toward your CE requirements, you must ensure the provider is acceptable and maintain records of course completion.

Licensees may obtain all of their CE hours through interactive, electronic means. This includes online, teleconferencing, and video. Acceptable Providers

CE must be taken from an acceptable provider, otherwise the course will not count toward your renewal requirements. The law that defines the types of acceptable CE providers changed on July 1, 2015, as detailed below:

Provider Complaints

You should first contact the provider of the course to resolve your concerns. If you are not satisfied with the outcome, contact the provider’s approval agency or send your complaint in writing to the Board. Include the course name, date, location, the names of the instructor and provider, and specifics about your complaint. Alternative Ways to Earn CE

Teaching

You may claim CE credit for teaching a course if the course meets all other CE requirements. You can claim the same amount of hours as an attendee. You may claim credit for teaching a course once during a single renewal period.

Board Enforcement Case Review

Effective July 1, 2015, if you serve as an expert consultant for the Board’s Expert Witness Program, you may be awarded up to six hours of Law and Ethics CE course credit. See the Board’s website, www.bbs.ca.gov, to apply.

Serve as a Board Subject Matter Expert

Effective July 1, 2015, if you serve as a subject matter expert for exam development, you may be awarded up to six hours of Law and Ethics CE course credit. See the Board’s website, www.bbs.ca.gov, to apply.

Participate in a Professional Law and Ethics Review Committee

Effective July 1, 2015, if you participate in a professional organization’s law and ethics review committee, you may be awarded up to six hours of Law & Ethics CE course credit. Miscellaneous Information

Course Hours

1 hour of instruction = 1 CE hour

1 semester unit = 15 CE hours

1 quarter unit = 10 CE hours Double Counting Hours

If you have more than one license with the Board, you may apply CE hours to both IF the subject matter relates to both scopes of practice. CE earned for other licenses may be applied to your Board-issued license if the provider is acceptable and the subject matter relates to your license’s scope of practice. Recordkeeping

You must maintain documentation of completed CE courses (certificates, transcripts, etc.) for at least two years after the license renewal period during which you took the courses. DO NOT submit your course certificates with your renewal. The Board will not retain them.

The Board does not manage or track CE courses for licensees. Providers do not submit certificates to the Board. If a certificate has been misplaced, you must contact the CE provider for a replacement. CE Audits

The Board may audit your records to verify completion of CE. If you are selected for audit, you will be notified in writing and required to submit documentation of courses (or alternative CE methods) completed. If audited, a prompt response is important. Failure to comply may result in disciplinary action against your license. Laws Referenced

ENFORCEMENT NEWSTHE COMPLAINT PROCESS AND YOU

As you sit down to sort through your mail, you notice a letter from the Board of Behavioral Sciences (Board). You open the letter and you take a breath as you read the following sentence:

The Board of Behavioral Sciences is in receipt of a complaint from Jane Doe alleging …

The letter requests your understanding of the event or events and specific documentation, and specifies a due date for your response. You are filled with anxiety. Your mind races with questions about the allegation, the Board, and the entire complaint process. You are uncertain about your next steps. Do you need a lawyer? Will the Board revoke my license? The allegations are not true—why is the Board investigating me? What will I do if my license is revoked? All of these emotions and reactions are typical for anyone who is the subject of a Board complaint.

Understandably, the fear of losing your license and livelihood will create a stressful time for any licensee or registrant. Yet, not every licensee or registrant who is the subject of a complaint has their license revoked, is placed on probation, or is issued a citation and fine. In the past five years, on average, the Board received 1,966 consumer complaints and subsequent arrest notifications annually. During this same time period, the Board referred an average of 125 cases (6 percent) to the Attorney General’s Office for formal discipline. Additionally, in the past five years, the Board issued an average of 36 citation and fines per year—just 2 percent of the total consumer complaints and subsequent arrest notifications received annually. While these figures may ease your mind a bit, you still are anxious about the complaint process itself.

First, it is important to understand the Board’s role in the investigation process. As a regulatory agency, the Board is mandated to protect the consumer. However, the role

of the Board in all investigations is to be an impartial fact finder. This role simply means the Board is gathering all documentation, statements, and information (referred to as evidence)relevanttothecomplaint/allegationtodetermineif a violation of law occurred or did not occur. The evidence must support any decision made by the Board.

As the subject of a complaint, you are a vital part of this process. Your role is to respond to the Board’s request for information regarding the allegation. You may respond independently or you may seek legal representation to assist you with your response. The decision to use legal representation is up to you and has no bearing on the outcome of the complaint. However, it is important for you to participate in the process. The Board cannot make an informed decision without your information.

After you submit the requested information to the Board, it is reviewed and analyzed by the enforcement analyst and/orasubjectmatterexpert(alicenseeoftheBoard)todetermine if the evidence supports that a violation of the law did or did not occur. If the evidence does not support a violation of the law, then the case is closed, the licensee is notified of the outcome, and no further action is taken. A case that warrants the issuance of a citation and fine or referral to the Attorney General’s Office for formal discipline must have clear and convincing evidence that a violation of the law occurred. This is a high evidence standard and is necessary if the Board is to discipline any licensee or registrant.

As the enforcement data above demonstrates, most of the Board cases are closed without any action taken against the licensee or registrant. If you are a subject of a complaint, take a moment to remember that an impartial process exists and that the Board must have clear and convincing evidence that confirms a violation of the law occurred in order to initiate the formal discipline process. Finally, remember you are part of the fact-finding process. This affords you the opportunity to respond to the Board’s request for information. How you respond—independently or with the assistance of legal counsel—is up to you.
