BOARD FOR BARBERS AND COSMETOLOGY DRAFT MINUTES OF MEETING The Board for Barbers and Cosmetology met on Monday, November 6, 2017, at the Offices of the Department of Professional and Occupational Regulation, 9960 Mayland Drive, 2 nd Floor, Board Room 4, Richmond, Virginia. The Board for Barbers and Cosmetology met on Monday, November 6, 2017, at the Offices of the Department of Professional and Occupational Regulation, 9960 Mayland Drive, 2nd Floor, Board Room 4, Richmond, Virginia. Call to Order

The Board took the agenda under consideration. Mr. Quesenberry asked for any amendments. Mr. Melis stated to the Board that Item 15 on the Agenda, Case 2017-02585, Chonlanut Lanla, was removed from consideration, as errors were identified in the Regulation cited in the Consent Order. Mr. Melis also reported that Case 2017-01452, Thien Pham, had been removed from consideration prior to the Board meeting, as an error had been identified in

Jones, the Board voted to adopt the amended Agenda. The members voting ‘yes’ were Mr. R. Jones, Ms. LaPierre, Mr. Minor, Mr. Quesenberry, Ms. Tsamouras, and Mr. Williams. There were no negative votes. The motion passed unanimously. The Board took the minutes of the August 21, 2017 Board Meeting and the under consideration. Mr. Quesenberry asked for any amendments. There were none. Upon a motion by Ms. LaPierre and seconded by Mr. Minor, the Board voted to approve the August 21, 2017 Board for Barbers and Cosmetology Board Meeting minutes. The members voting ‘yes’ were Mr. R. Jones, Ms. LaPierre, Mr. Minor, Mr. Quesenberry, Ms. Tsamouras, and Mr. Williams. There were no negative votes. The motion passed unanimously.

Approval of Minutes for the August 21, 2017 Board Meeting

There were no written communications to be reviewed. Communication Mr. Quesenberry asked if there was any public comment. Public Comment Ms. LaFarn Burton, of LB Beauty Academy, addressed the Board on the topic of the transfer of credits between schools as described in the Board’s Guidance Document dated May 12, 2014. Ms. Burton also addressed the Board on the language of the Laws and Regulation portion of the theory examination. The Board took Ms. Burton’s comments under consideration. Ms. Ronda Oconnell, of Great Wolf Lodge, addressed the Board on the scope of practice for estheticians and master estheticians; specifically, chemical exfoliation and peels. Ms. Oconnell was advised that the Board would be providing guidance during the New Business portion of the meeting with regard to the types of chemical exfoliators and the use of vitamin based acids by estheticians. There was no additional public comment.

Cases Ms. Tsamouras made a motion to accept the thirteen (13) Consent Order Cases after Mr. Quesenberry determined that there was no one present who wished to

Nails, and Agenda Item 16, Case 2017-02801, Thiary T. Hua, could be not be included in the block consideration, as Ms. LaPierre had been a consultant on the two cases and would need to be recused. Upon a motion by Ms. Tsamouras and seconded by Mr. Williams, the Board voted to consider and accept the recommendations for the remaining eleven (11) Consent Order cases as a block. The members voting ‘yes’ were Mr. R. Jones, Ms. LaPierre, Mr. Minor, Mr. Quesenberry, Ms. Tsamouras, and Mr. Williams. There were no negative votes. The motion passed unanimously.

REPORTS Mr. Kirschner provided a report on current pass rates for exams, noting that there was a drop in scores for applicants who were re-taking the exams.

Examinations

Mr. Kirschner reported to the Board on pending regulatory actions, including Fast-Track action to allow estheticians to teach waxing programs in wax technician schools. The 30-day comment period will begin on November 13 and will end on December 13, 2017. The regulation is projected to be effective on January 1, 2018. Other regulatory action reported by Mr. Kirschner included a Notice of Intended Regulatory Action (NOIRA) for a general review of the Tattoo and Body-Piercing Regulations. The public comment period is underway and will end on November 15, 2017. He advised the Board that a sub-committee will be created, and the proposed revisions would take approximately six months to complete. Mr. Kirschner also advised the Board of Fast-Track action to amend the Barber scope of practice and the barber curriculum in the Regulations to bring the Regulations into line with the Code of Virginia. The Fast-Track process will begin in approximately one week. He stated that letters have been mailed to all licensed barbers, barber teachers, and barber shops advising of the changes; and that letters would be mailed to all licensed barber schools in the coming week.

Mr. Melis reported to the Board regarding the Esthetics Committee’s discussion on the practice of microneedling and the need for further discussion on this topic.

Mr. Kirschner advised the Board of the Virginia Department of Education’s work on revisions to the Nail Tech Framework in its Standards of Learning for high school programs. Mr. Kirschner and Mr. Quesenberry attended on behalf of the Board at the meeting that included Department of Education representatives, teachers, and industry representatives.

Mr. Kirschner updated the Board on actions underway to update the definitions and scope of practice in the Regulations. He indicated that a Notice of Intended Regulatory Action (NOIRA) is anticipated to be filed in the coming week. The Guidance Document, regarding the Barbering Scope of Practice, and authorized by the Board at its August 21, 2017 meeting, has been published. A list of Frequently Asked Questions (FAQs) regarding the changes will be placed on the Board’s webpage. Mr. Kirschner also advised the Board that the Barber Standards of Apprenticeship will require updating to bring them into compliance with Code, and recommended that the Barbering Committee meet to review the Standards of Apprenticeship.

Barbering Definition and Scope of Practice

Mr. Melis advised the Board that the examination vendor, Professional Credential Services, Inc., will ask the NIC to remove questions from the Master Esthetician examination that are beyond Virginia’s master esthetician curriculum and scope of practice. He reported that staff is working with PCS to determine whether any candidates have failed the examination due to the material that is outside the Virginia curriculum.

Master Esthetics Examination

Board Guidance Mr. Kirschner provided a hand-out and asked for Board guidance on Esthetics Regulation 18 VAC 41-70-250.B, with regard to products used in facials that may contain natural, vitamin-based acids or enzymes. The Board discussed the definition of chemical exfoliation. Mr. Melis recommended that the Esthetics Committee meet to develop a Guidance Document on the topic. Mr. Kirschner explained a question brought to the Board regarding the nail technician scope of practice, and recommended that the Board defer discussion of Agenda item IX.B.ii, regarding manicuring and pedicuring, until a nail technician Board member has been appointed to fill the seat vacated by Ms. Norma Dorey. Mr. Kirschner provided a hand-out, and the Board was asked for its guidance on Barbers and Cosmetology Regulation 18 VAC 41-20-90 and Esthetics Regulation 18 VAC 41-70-70, regarding the eligibility of endorsement applicants to obtain temporary permits. After discussion, and upon a motion by Ms. Tsamouras, seconded by Ms. LaPierre, the Board voted to ask staff to create a Guidance Document making it explicit that endorsement candidates are not eligible for temporary permits.
