    1 Endorsement 1 - Permanent Partial Disablement

    Compensation under Section B benefit 1 Permanent Total Disablementas shown in the Schedule is extended to include the

    following benefit - subject to a maximum total of 100% in the aggregate.

    1. Total loss of use of:

    a. back or spine (excluding cervical) without cord involvement 40%

    b. neck or cervical spine without cord involvement 30%c. shoulder, elbow or wrist 25%

    Insurance Agreement

    The Insured and ACE Europe Life Limited and ACE European

    Group Limited (ACE) agree that:

    The Insured will pay the Premium.

    ACE will subject to the terms, conditions and exclusions of thisPolicy, provide the Insurance in the manner and to the extentset out in this Policy. The Insured acknowledges that ACE hasoffered this Policy and calculated the premium using theinformation which the Insured has provided, and that anychange to the responses provided by the Insured may result ina change in the terms and conditions of the Policy and/or achange in the premium.

    This Policy, the Policy Schedule(s) and endorsements, if any,

    shall be read together as one contract and any word orexpression to which specific meaning has been attached shallunless the context otherwise requires bear such meaningwherever it may appear.

    Law Applicable to Contract

    This Policy shall be governed by and construed in accordancewith the Law of England and Wales and the English Courtsalone shall have jurisdiction in any dispute. The language ofthis Policy and all communications relating to it shall be in theEnglish language.

    Policy Definitions

    Whenever the following words or phrases appear they willhave the meanings as described below

    means United Kingdom pounds sterling.

    ACEmeans ACE Europe Life Limited with regard to Section Abenefit 1, and ACE European Group Limited with regard toSection A benefit 2 and all benefits covered under SectionB.

    Accident & AccidentalMeans a single, sudden, unusual, and unexpected event,which occurs at an identifiable time and place during thePeriod of Insurance and which causes Bodily Injury

    Accidental Deathmeans death caused by Bodily Injury and excludes Deathcaused by any other cause.

    Air SportsMeans any aerial pursuits or sports including but not limitedto the following:

    GlidingHang-glidingMicro-lightingParachutingBallooningBungee-jumpingParaglidingParascending

    Aggregate Limitmeans the maximum amount that ACE will pay per Event in

    total under this and any other policies issued by ACE to theInsured.

    Annual Salarymeans the gross salary or wages payable per annum(excluding bonus payments or overtime) to the InsuredPerson as remuneration for services provided immediatelypreceding the date of occurrence of the Accident giving riseto Bodily Injury.

    Benefit Periodmeans the maximum (but not necessarily consecutive)period for which benefits are payable in respect of anyInsured Person for any one Accident. The Benefit Period

    commences at the end of the Deferment Period, if any.

    Benefit AmountThe maximum amount ACE can pay based on the level ofcover the Insured Person has at the time of the Accident orat the time of death if the death was not due to Bodily Injurycaused by an Accident as shown in the Policy Schedule.

    Bodily Injurymeans injury which is caused solely by Accidental meansand which independently of Illness or any other cause,occurs within 12 months from the date of the Accident.

    Death from Natural Causes

    means the death of the Insured Person arising directly as aresult of natural causes, the symptoms of which firstmanifests themselves during the Effective Time and fromwhich death occurs within 30 days of such symptomsmanifesting themselves.

    Deferment Periodmeans a period at the beginning of a period of TemporaryTotal Disablement during which benefits are not payable.

    Effective Timemeans the time, during a Period of Insurance, when anInsured Person is coveredas detailed in the Schedule.

    Eventmeans each and every individual loss or series of lossesarising out of one event or one catastrophic Accident duringany one period of 72 hours which results in Bodily Injury,dismemberment, disability or death of Insured Persons

    Hazardous ActivitiesMeans the following activities:

    Air Sports or Winter SportsSub aqua diving more than 20mClimbing or mountaineering where the use of ropes or

    guideswould be reasonably expectedPotholingProfessional sports; orRacing, unless this is on foot

    Hospitalmeans any establishment which is registered or licensed asa medical or surgical hospital in the country in which it islocated and where the Insured Person is under the constantsupervision of a Qualified Medical Practitioner.

    Hospital Confinementmeans any continuous period of 24 hours or more duringwhich time the Insured Person has been confined toHospital.

    Illnessmeans any illness, disease, malady, medical complaint,

    congenital defect or medical condition

    Insuredmeans the Insured named and shown in the Schedule.

    Insured Personmeans any person or category of persons described underthis heading in the Schedule.

    Loss of HearingMeans to be deemed to have occurred:a) in both ears means total and irrecoverable deafness inboth ears confirmed by audiometer and sound thresholdtestsb) in one ear means total and irrecoverable deafness in oneear confirmed by audiometer and sound threshold tests

    Loss of Internal Organmeans total and permanent:a) loss by removal: orb) effective loss of use ofone lung or one kidney, the spleen or the liver.

    Loss of Limbmeans in respect of:a) an armamputation or complete and permanent loss ofuse - at or above the wrist;b) a legamputation or complete and permanent loss ofuse - at or above the ankle (talo-tibial joint).

    Loss of Sightmeans to be deemed to have occurred:a) in both eyes when the Insured Persons name has been

    added to the register of Blind Persons maintained by thegovernment on the authority of a qualified ophthalmicspecialist; or

    b) in one eye when the degree of sight remaining aftercorrection is 3/60 or less on the Snellen Scale (whichmeans the Insured Person is only able to see at 3 feet thatwhich they should normally be able to see at 60 feet) andACE is satisfied that the condition is permanent andwithout expectation of recovery.

    Loss of Speechmeans total and permanent loss of speech.

    Maximum Limitmeans the maximum amount shown in the Schedule payablefor any Insured Person for all Bodily Injury arising from anyone Accident.

    Nuclear, Chemical or Biological Weapons or Agentsmeans the use of any nuclear weapon or device or theemission, discharge, dispersal, release or escape of any

    solid, liquid or gaseous Chemical Agent and/or BiologicalAgent.

    Paraplegiashall mean complete paralysis of the lower half of the bodyincluding both legs which results in Permanent TotalDisablement.

    Period of Insurancemeans the period between and inclusive of the dates shownfrom: and to: in the Policy Schedule commencing at 00.00hours on the earliest date shown and expiring at midnight onthe latest date shown. Both dates refer to local standard timeat the address of the Insured as shown in the Policy

    Schedule.

    Permanent Disabling Injurymeans Loss of Sight, Loss of Hearing, Loss of Speech, Lossof Internal Organ or Loss of Limb.

    Permanent Total Disablementmeans disablement other than any Permanent DisablingInjury which has lasted for at least 12 months from the date ofthe Bodily Injury and which in ACEs opinion is beyond hopeof recovery and will in all probability continue for theremainder of the Insured Persons life and will prevent theInsured Person from engaging in or giving attention to:a) their Usual Occupation if in gainful employment;b) business profession or occupation of any and every kind if

    the Insured Person:i) is not in gainful employmentii) is employed solely as a footballeriii) has football as their main employment;

    c) business schooling profession or occupation of any andevery kind if the Insured Person is under 16 years of age orunder 18 years of age and in full time education for the

    Premiummeans the amount specified or referred to in the PolicySchedule in respect of the specified Period of Insurancewhich is payable by the Insured to ACE.

    Primary Dislocation

    shall mean the first time an Insured Person has suffered adislocation of specified joints

    Quadriplegiashall mean complete paralysis of all four limbs. which resultsin Permanent Total Disablement.

    Qualified Medical Practitionermeans a doctor or specialist who is registered or licensed topractise medicine under the laws of the country in which theypractise other than:a. an Insured Personb. a relative or partner of an Insured Person

    Studentmeans an Insured Person who is in full time education andenrolled or attends classes at a school, college, or university.

    Temporary Total Disablementmeans temporary disablement which entirely prevents theInsured Person from engaging in their Usual Occupation.

    Terrorismmeans an act, including but not limited to the use of force orviolence and/or the threat thereof, of any person or group(s)of persons, whether acting alone or on behalf of or inconnection with any organisation(s) or government(s),

    committed for political, religious, ideological or ethnicpurposes or reasons including the intention to influence anygovernment and/or to put the public, or any section of thepublic, in fear.

    United Kingdommeans England, Scotland, Wales and Northern Ireland(excluding the Isle of Man and the Channel Islands).

    Usual OccupationThe tasks, duties and other functions, which the InsuredPerson normally performs in connection with their occupationfor which they are engaged in 16 hours or more per week.

    Warmeans armed conflict between nations, invasion, act offoreign enemy, hostilities (whether war declared or not), civilwar, rebellion, revolution, insurrection or military or usurpedpower.

    Weekly Wagemeans the average of the gross weekly amount (or in thecase of salaried employees 1/52nd of the Annual Salary)payable to the Insured Person as a wage or salary forservices provided as set out in the Insured Persons contractof employment, (excluding bonus and overtime payments) inthe thirteen weeks immediately preceding the date ofcommencement of the period of Temporary TotalDisablement.

    Working Daymeans each complete day of Temporary Total Disablementduring which, had it not been for the disablement, the InsuredPerson would normally have been working or engaging fullyin their Usual Occupation.

    Winter SportsMeans any winter pursuits or sports including, but not l imitedto, the following:

    skiing outside the area of the normal compacted snow skislope i.e. off-piste;tobogganingsnow boarding

    ice skatingSki or ski bob racingMono skiingSki jumpingski boardingIce hockey; orthe use of bobsleighs or skeletons

    What this Policy covers

    SECTION A - Life & Accidental Death

    1. LifeIf during the Effective Time an Insured Person suffers Deathfrom Natural Causes ACE will pay the amount shown in theSchedule.

    2. Accidental DeathIf during the Effective Time, an Insured Person has an Accidentand suffers Bodily Injury which results in death, ACE will paythe amount shown in the Schedule.

    If an Insured Person disappears and, after a suitable period oftime, it is reasonable for the Police or registration authorities tobelieve that they have died, ACE will pay the amount shown inthe schedule.

    But before ACE do this, the Personal Representativeresponsible for their estate must sign an agreement to refund

    the Benefit Amount if the Insured Person is found to be alive.

    Specific exclusions that apply to SECTION A ofthe policy

    ACE will not pay any claim arising out of, contributed to by, orconsequent upon;1. any Illness, injury or medical condition which the Insured

    Person knew about at the commencement of the Period ofInsurance

    2. the Insured Person Participating in or training forHazardous Activities

    3. Not following the advice of a Qualified Medical Practitioner

    SECTION B - Injury

    If an Accident occurs during the Period of Insurance andEffective Time that causes Bodily Injury to an Insured Personwhich results in:

    Permanent Total Disablement

    Permanent Disabling Injury

    Temporary Total Disablement

    ACE will pay the Insured Person the amounts shown in theSchedule if shown as insured

    Extensions of Cover (SECTION B)Applicable toboth Adult and Youth Teams

    This describes a number of additional benefits which areprovided as an extension of cover for Insured Persons whenshown as insured in the Schedule.

    Emergency Medical ExpensesIf an Accident occurs during the Period of Insurance andEffective Time and causes Bodily Injury to an Insured Personand directly as a result of, the Insured Person incurs anyadditional reasonable emergency medical expenses forimmediate and urgent treatment including the cost ofradiography after referral from a Qualified Medical Practitioner;ACE will reimburse the Insured Person up to the amount shownin the policy schedule.

    Rehabilitation and Retraining ExpensesWhere Bodily Injury results in the Permanent Total Disablementbenefit becoming payable for an Insured Person, ACE willindemnify the Insured Person up to 2,500 for reasonable costsincurred to rehabilitate and/or retrain the Insured Person for analternative occupation, subject to ACEs prior written approvalbeing obtained.

    Home/Car Modification benefitWhere Bodily Injury results in Quadriplegia or Paraplegia, andthe benefit for Permanent Total Disablement becomes payable,ACE will also indemnify the Insured Person for expensesincurred, up to the amount shown in the policy schedule, foradapting the Insured Persons home or Car and/or forrelocating the Insured Person to another home to cater for thepractical changes involved in living with the disablement.

    Legal Advice and CounsellingDuring the Period of Insurance the Insured Person may callACE Assistance on 0207 1737 807 quoting, 72718, to obtainpersonal legal advice or access Counselling over thetelephone.

    The legal advice may include but is not limited to:a) Advice where injury has been caused by the negligence of a

    third party.b) Advice on employment issues including redundancy,

    bullying, harassment, unfair discrimination and retirement.

    The Counselling advice may include but is not limited to:a) Identifying and managing stress and stressful situations.b) Crisis counselling.c) Debt counselling.d) Addiction counselling.e) Advice on the practical and emotional aspects of living with a

    long-term injury or disablement.f) Following death, support and help for the bereaved family

    and colleagues to cope with the trauma of their loss.g) Support in dealing with the psychological impact of not being

    able to continue in employment due to injury and adviceabout finding more suitable employment.

    h) Providing information and details of organisations whichprovide face-to-face counselling.

    Broken Bones BenefitIf an Accident occurs during the Period of Insurance andEffective Time that causes Bodily Injury to an Insured Personand directly as a result, the Insured Person fractures one ormore of the bones listed below:i) Leg (Femur, Tibia, Fibula), Ankle (Tarsals) or Kneecap(Patella)ii) Arm (Humerus, Radius, Ulna) or Wrist (Carpals)iii) Cheek Bone (Maxilla)iv) Collar Bone

    v) Finger or Toe

    ACE will pay the Insured Person up to the amount shown in thepolicy schedule

    Coma BenefitWhere Bodily Injury results in Coma, Insurers will pay theInsured Person the amount shown in the schedule for each daythe Insured Person remains in a Coma up to 365 days.

    Emergency Dental Pain Relief ExpensesACE will pay up to 100, if during the Period of Insurance andEffective Time, external oral impact results in damage to the

    Insured Persons teeth which necessitates immediateemergency pain relief. This extension does not cover any otherprocedure other than the relief of pain.

    Hospitalisation BenefitIf during the Period of Insurance, an Accident occurs during theEffective Time shown in the Schedule and the Insured Personsustains Bodily Injury which, independently of Illness or any othercause, results in their Hospital Confinement, within twelve calendarmonths from the date of the Accident, ACE will pay the InsuredPerson the amount shown on the policy schedule for each completetwenty-four hour period of such Hospital Confinement up to amaximum of 30 days.

    Dental InjuryIf an Accident occurs during the Period of Insurance and EffectiveTime and causes Bodily Injury to an Insured Person and directlyresults in the loss of permanent natural teeth, ACE will pay up to250 in total for all teeth lost or partially lost. Claims for partial loss oftooth or teeth shall be calculated by assessing the percentage oftooth lost in relation to the maximum benefit payable. This coverdoes not apply to deciduous (milk) teeth, dental implants, crowns,veneers, dentures, bridges or intra orally wear and tear of teeth.

    Physiotherapy CoverIf an Accident occurs during the Period of Insurance and EffectiveTime and causes Bodily Injury to an Insured Person that directlyresults in a valid:1. Temporary Total Disablement claimor2. Broken Bones claimunder this Policy, ACE will pay the Insured Person 50% of the costsfor each session of necessary physiotherapy incurred within 12months of Bodily Injury, up to a maximum of 25 per visit, for total of6 sessions provided that he Insured Person has a written referralfrom their General Practitioner for physiotherapy arising from suchBodily Injury.

    This cover does not apply if treatment has been received by the NHSor claimed for under a current private medical insurance or any otherinsurance policy.

    Examination Re-sit benefit:If during a Period of Insurance an Accident occurs during theEffective Time and causes Bodily Injury to an Insured Person whichresults in the Insured Person being unable to attend their academicexaminations ACE will reimburse the Insured Person theirrecoverable examination resit fees in respect of all reasonable costsnecessarily incurred in re-sitting the examinations in accordance withthe following scale:

    a. Following Bodily Injury evidenced by a certificate from aQualified Medical Practitioner - up to a maximum of 50.

    b. Following Bodily Injury which results in the payment ofTemporary Total Disablement or Student Tutorial benefitfor aperiod of up to 12 consecutive weeks or less

    c. Following Bodily Injury which results in the payment ofTemporary Total Disablement or Student Tutorial benefit for aperiod of 12 consecutive weeks or more or in the payment of a

    Permanent Disabling Injuries Benefit - up to a maximum of2,500.

    Facial & Bodily Scarring:Where Bodily Injury results in:

    1. permanent disfigurement or

    2. permanent scarring

    of the Face or Body of at least the minimum Benefit Amount specifiedin the Schedule of Benefits below will be payable. Disfigurement orscarring covering an area of the Face and Body greater than theminimum will be assessed in relation to:

    1. the specified minimum Benefit Amount; and

    2. the maximum Benefit Amount as specified in the Schedule ofBenefits for disfigurement or scarring covering the whole area ofthe Face.

    The Benefit Amount payable will not take into account anypsychological effects.

    Extensions of Cover (SECTION B)Applicable toAdult Teams only

    This describes a number of additional benefits which are provided asan extension of cover for Insured Persons insured under the AdultTeam cover when shown as insured in the Schedule.

    Home HelpTemporary Total Disablement cover includes Insured Persons whoseoccupations are as full time house wives or house husbands. In theevent of such a claim, ACE will indemnify the Insured Person up tothe benefit stated in the Schedule for additional costs incurred(excluding costs charged by member of the Insured Person's family)in respect of household duties that the Insured Person is unable toperform due to Temporary Total Disablement.

    To validate such a claim the Insured Person must provide invoices orreceipts as evidence of costs incurred for services that the InsuredPerson was unable to undertake. Medical certificates will also berequired to confirm that the Insured Person is unable to carry out100% of their usual duties. This benefit will not be payable to anyInsured Person who receives any form of income or benefit, includingstate benefits.

    Primary Dislocation BenefitIf an Accident occurs during the Period of Insurance and EffectiveTime that causes Bodily Injury to an Insured Personand directly as aresult, the Insured Person suffers a Primary Dislocation which needsto be reduced by a Qualified Medical Practitioner of the followingjoints;i) Kneecapii) Elbowiii) Hipiv) Shoulder

    ACE will pay the Insured Person up to the amount shown in theschedule

    Extra Travel ExpensesIf an Accident occurs during the Period of Insurance and EffectiveTime and causes Bodily Injury to an Insured Person and directly as aresult of, the Insured Person incurs any additional reasonable travelexpenses, ACE will pay the Insured Person for any additionalreasonable travel expenses incurred up to an amount of 25 perweek for a maximum period of 4 weeks in addition to any otherbenefit payable to the Insured Person.

    Extensions of Cover (SECTION B)Applicable to YouthTeams only

    This describes a number of additional benefits which are provided as anextension of cover for Insured Persons insured under the Youth Teamcover when shown as insured in the Schedule.

    Parent/Legal Guardian Inconvenience Expenses benefit

    If an Accident occurs during the Period of Insurance and Effective Timethat causes Bodily Injury to an Insured Person and directly as a result,the Insured Persons parent or legal guardian incurs unforeseenadditional reasonable travel expenses, ACE will pay the Insured Personfor any additional reasonable travel expenses up to an amount of 100.

    Student Tutorial BenefitWhere Bodily Injury results in Temporary Total Disablement, ACE willpay up to the amount shown in the Schedule for expenses which relateto providing a home tutor or necessary additional expenses required toattend school where the Insured Person is a Student.

    To validate such a claim the Insured Person must provide invoices orreceipts as evidence of costs incurred for addition expenses that the

    Insured Person has incurred as a result of the Bodily Injury. Medicalcertificates will also be required to confirm that the Insured Person isunable to undertake their usual duties as a Student.

    Temporary Total Disablement Benefit (applicable for 16-18 yearolds in paid Employment only)If an Accident occurs during the Period of Insurance and Effective Timethat causes Bodily Injury to an Insured Person which results inTemporary Total Disablement, ACE will pay the Insured Person theamount shown in the schedule provided that the amount paid does notexceed 100% of the Insured Persons Weekly Wage.

    Specific exclusions that apply to SECTION B of the policy

    ACE will not pay any claim arising out of, contributed to by, orconsequent upon:1. Temporary Total Disablement if the Insured Person has no UsualOccupation or if the Insured Persons Usual

    Occupation is a professional footballer;

    2. post traumatic stress disorder or related syndromes

    4. Permanent Total Disablement, Permanent Disabling Injuryor Temporary Total Disablement attributable to arthritic orother degenerative conditions in the joints, bones, muscles,

    tendons or ligaments;

    5. repetitive stress (strain) injury or syndrome or any othercondition or injury which develops over a period of time;

    General Exclusions

    This Part of the policy provides Exclusions thatrelate to both Sections A and B of the policy

    ACE will not pay any claim arising out of, contributedto by, or consequent upon;

    1. War or any act of War;

    2. suicide, attempted suicide or deliberate self-inflicted injury bythe Insured Person regardless of the state of their mentalhealth;

    3. the Insured Person engaging in any form of air travel, unlesstravelling as a fare-paying passenger in an aircraft which isprovided and operated by an airline or air charter companywhich must be licensed for this;

    4. alcoholism or solvent abuse, or drugs ingested except fordrugs which are properly prescribed and not taken for thetreatment of drug addiction;

    5. the Insured Person driving with an alcohol level in the bloodwhich exceeds the legal limit of the country in which theInsured Person is driving;

    6. Human Immunodeficiency Virus (HIV) or other forms of thevirus, Acquired Immune Deficiency Syndrome (AIDS) and

    AIDS Related Complex (ARC) other than if contracted as aresult of a blood transfusion given by a Qualified MedicalPractitioner;

    7. ionising radiations or contamination by radioactivity from anynuclear fuel or from any nuclear waste from the combustionof nuclear fuel including the radioactive, toxic, explosive orother hazardous properties of any explosive nuclearassembly or nuclear component thereof;

    8. Being a professional footballer;

    9. the Insured Person committing a criminal act or taking partor whilst engaged in a civil commotions or riots of any kind;

    10. travel to Afghanistan, Iraq, Ivory Coast, Somalia, Nigeria,Pakistan, Venezuela, Columbia, Mexico, Yemen, Cuba or

    Chechnya;

    11. motor cycling other than in respect of mopeds or scooters upto 50cc;

    12. club social events that include fireworks, bonfires, drivingevents, bouncy castles, water sports or any activity above 3metres off the ground;

    13. the Insured Person being a full time member of the armedforces of any nation or international authority or a member ofany reserve forces called out for permanent service;

    14. any claim in excess of:i) the Aggregate Limits;ii) the Maximum Limit per Insured Person;as shown in the Schedule.

    Policy Conditions

    Benefit Limits

    1. ACE will not pay more than the Maximum Limit for benefits 1and 2 under section A of the policy and benefits 1 to 7 underSection B of the policy or any other sum insured as shown inthe Schedule for any Insured Person.

    2. ACE will not pay more than one of Benefit 1 and 2 underSection A of the policy shown in the Schedule in respect ofany one Insured Person for death however so arising.

    3. ACE will not pay more than one of Benefit 2, section A andBenefits 1 to 6 under section B of the policy shown in theSchedule in respect of any one Insured Person for BodilyInjury arising from the same loss.

    4. The Maximum Limit payable in respect of Accidental Deathof an Insured Person under 16 years of age or under 18 yearsof age and in full time education shall not exceed 10,000 orany other sum insured as shown in the Schedule whichever isthe lower.

    5. The Maximum Limit for a weekly benefit payable forTemporary Total Disablement will not exceed 100% of theInsured Persons normal Weekly Wage.

    It is the duty of the Insured or Insured Person to inform ACEif any claim payment does exceed these limits. Payment willbe proportionately reduced until these limits are notexceeded.

    6. Payment by ACE to the Insured Person of any weekly benefitdoes not prejudice the Insureds or Insured Personsentitlement to any other benefit but payment of weeklybenefits will cease if ACE pays any of benefits 1 or 2 underSection A or benefits 1 to 6 under Section B as shown in theSchedule and ACE will not be liable to pay any further benefitsin respect of the same Insured Person for the same loss.

    7. Where a period of Temporary Total Disablement, or partthereof, is less than a complete week the amount payable foreach Working Day shall be pro rata of the Insured PersonsWeekly Wage.

    8. ACE will not pay more than one of benefit 7 as shown in theSchedule in respect of any one Insured Person for the sameloss.

    9. ACE will not pay more than one of benefit 7 as shown in theSchedule for an Accident arising from separate originatinglosses concurrently.

    10. Any contributory degenerative condition or disablement (asdetermined by a Qualified Medical Practitioner) known bythe Insured Person to be in existence at the time ofsustaining Bodily Injury will be taken into account by ACE inassessing the level of benefit payable.

    11. If the aggregate amount of all benefits payable under thisSection exceeds the applicable Aggregate Limit the BenefitAmount payable for each Insured Person shall be

    proportionately reduced until the total of all benefits does notexceed such Aggregate Limit. Where one or more Policieshas been issued by ACE in the name of the Insured, only thegreatest Aggregate Limit shall apply over all.

    12. ACE will not pay more than 25 per week to an InsuredPerson if they are a Student under Benefit 7 for Adult Teams.

    13. If the Insured Person is a Student, the maximum BenefitPeriod under Benefit 7 is 6 weeks for Adult Teams.

    Reasonable PrecautionsThe Insured and Insured Person shall take all reasonable steps toavoid or minimise any loss or damage.

    Adjustable PremiumsIf it has been agreed that any part of the Premium, being based onestimated numbers, is adjustable then the Insured shall within 30days of the end of the Period of Insurance provide the actualnumbers to ACE and the Premium will be adjusted accordingly.

    ArbitrationIf any difference arises as to the amount to be paid under thisPolicy (liability being otherwise admitted) such difference shall bereferred to an arbitrator to be appointed by the parties inaccordance with the relevant statutory provisions. Where anydifference is to be referred to arbitration in accordance with thiscondition, the making of an award shall be a condition precedentto any right of action against ACE.

    AssignmentSubject to the General Condition headed Payment of Benefits,the benefits under this Policy may not be assigned by the InsuredPerson. ACE shall not be bound to accept or be affected by anynotice or any trust, charge, lien, purported assignment or otherdealing with or relating to this Policy.

    Payment of BenefitsNotwithstanding the General Condition headed Assignment,where in relation to any Claim the Insured, at its discretion, directsACE to do so, ACE shall pay benefits to, or indemnify, a namedInsured Person and the receipt of such Insured Person shall be asufficient discharge of ACEs liability to indemnify or pay thebenefits concerned.

    Change in Business DescriptionThe Insured shall give written notice within a reasonable time ofany alteration in the Insureds business.

    MisdescriptionIf the Insured or Insured Person makes a representation whichwas untrue or misleading and:a) they knew it was, or did not care whether or not it was, untrue

    or misleading and knew that the information was, or did notcare whether it was, relevant to ACE then ACE may havethe option to void the Policy; or

    b) they made it carelessly then ACE may be able to avoid thePolicy and return the Premium or vary the Policy includingvarying the terms and conditions or increasing the Premium

    depending upon the impact the information would have hadon ACE's decision to issue the Policy

    CancellationACE may cancel this Policy by giving thirty days written notice tothe Insured at their last known address and in such event thePremium for the period up to the date when the cancellation takeseffect shall be calculated and ACE shall promptly return anyunearned portion of the Premium paid.

    In the event of cancellation by ACE the Insured must notify allInsured Persons of such cancellation.

    The Insured Person may withdraw from the cover provided by thisPolicy at any time by giving notice to the Insured. No refund ofPremium will be payable.

    ACE reserves the right to retain the annual Premium where claimshave occurred in the Period of Insurance when cancellation takesplace.

    Compliance with Policy RequirementsWhere the Insured or the Insured Person or their personalrepresentatives do not comply with any obligation to act in acertain way specified in this Policy ACE reserves the right not topay a claim.

    Contracts (Rights of Third Parties) ActThe Contracts (Rights of Third Parties) Act 1999 or anyamendment thereto shall not apply to this Policy. Only ACE andthe Insured or Insured Person can enforce the terms of this Policy.No other party may benefit from this contract as of right. ThePolicy may be varied or cancelled without the consent of any thirdparty.

    InterestNo sum payable by ACE under this Policy shall carry interestunless payment has been unreasonably delayed by ACE followingreceipt of all the required certificates, information and evidencenecessary to support the claim.Where interest becomes payable by ACE, it will be calculated:1. from the date of final receipt of such certificates, information

    or evidence and2. at the base rate established by the Bank of England on such

    date.

    Material DisclosureThe Insured and the Insured Persons must ensure that all of theinformation, which they have provided to ACE in the ApplicationForm, by correspondence, over the telephone, on claim forms andin other documents is true, complete and accurate. Please notethat providing incomplete, false or misleading information couldaffect the validity of this Policy and may mean that all or part of aclaim may not be paid

    Policy Age LimitAge limit restrictions will apply to Insured Persons covered underthe following sections of the policy;

    SECTION A benefit 1. Life;i) no cover will apply under this section for persons until

    attainment of 6 years of age and cover will cease uponattainment of 50 years of age.

    SECTION A benefit 2. Accidental Death and SECTION B;i) cover will cease upon attainment of 55 years for persons

    covered under Category A as shown in the scheduleii) cover will cease upon attainment of 75 years for persons

    covered under Category B as shown in the schedule

    Other Taxes or CostsACE is required to notify the Insured Persons that other taxes orcosts may exist which are not imposed by ACE.

    Right to ChangeACE reserves the right to make changes, add to the Policy termsand/or to change the total amount payable for this insurance forlegal, regulatory or taxation reasons.

    General Claims Conditions

    1. In the event of the death of a Insured Person, ACE must be

    notified as soon as possible. ACE will then ask the InsuredPersons legal representatives to complete a claim form.ACE will need to be sent any medical certificates or otherdocuments which ACE ask for. ACE will not pay for these.

    2. In the event of the Death of the Insured Person, ACE will beentitled to have a post-mortem examination carried out at itsown expense. The benefit payable for Death will be paid tothe estate of such Insured Person.

    3. If any claim under this Policy shall be in any respectfraudulent or if any fraudulent means or devices shall be usedby the Insured or anyone acting on the Insured's behalf orby an Insured Person or any Insured Person's legal

    representatives to obtain benefit under this Policy ACE shallbe under no liability in respect of such claim.

    4. The Insured and/or Insured Person shall at their ownexpense furnish ACE such certificates, information andevidence as ACE may from time to time reasonably require inthe form prescribed by ACE. ACE shall be allowed at its ownexpense, upon reasonable notice to the Insured, to request amedical examination of an Insured Person as appropriate.

    5. The Insured Person shall as soon as possible after theoccurrence of any Accidental Bodily Injury:a) obtain and follow the advice of a Qualified Medical

    Practitioner;b) co-operate with and follow the advice of an independent

    rehabilitation case manager where appointed by ACEand ACE shall not be liable for any consequences of theInsured Persons failure to cooperate and obtain and followsuch advice and use such appliance or remedies as may beprescribed.

    6. If the Insured Person is aged under 18 years, ACE will paythe Parent or Legal Guardian of the Insured Person, for thebenefit of Insured Person. The Parent or Legal Guardians receipt shall be a full discharge of all liability by ACE inrespect of the Claim for such Benefit Amount.

    Data Protection

    ACE fully accepts its responsibility to protect the privacy ofcustomers and the confidentiality and security of informationentrusted to it.

    ACE is part of the ACE Group of companies. It and the groupcompanies will use information given together with other

    information for the administration of this Policy, the handling ofclaims and the provision of customer services. The informationmay also be disclosed to ACEs service providers and agentsfor these purposes. It may be disclosed to the Insureds andInsured Persons agents, where appointed. It may also be usedfor the purposes of fraud prevention including passing details toother insurers and regulatory bodies.

    Where the Insured or Insured Person has provided personaldata including sensitive personal data about another person inconnection with the purchase and performance of thisinsurance Policy, ACE will assume they have appointed theInsured or Insured Person to act for them. This information maybe transferred to any country including countries outside theEuropean Economic Area for any of these purposes and for

    systems administration.

    ACE (or reputable organisations selected by them) may monitorand/or record communication to ACE, to ensure consistentservicing levels and account operation.

    ACE will keep information about the Insured or Insured Persononly for so long as it is appropriate. The Insured or InsuredPersons each has a right to request a copy of the information(for which ACE may charge a small fee) and to correct anyinaccuracies. To make sure instructions are followed correctlyand to improve ACEs service through staff training, telephonecalls may be recorded.

    Please read this document carefully. It sets out the terms and conditions on which we agree to act for you, contains details of our responsibilitiestogether with your responsibilities both to us, to insurers and to other third party providers. Please contact us immediately if there is anything in thisdocument that you do not understand/or with which you disagree. Your receipt of this document constitutes your informed consent to its contents.In the interests of security, staff training and to generally improve our service please be aware that telephone calls may be monitored and/orrecorded.

    1. Definitions1.1. Commercial customer means a customer who is acting within their trade or profession in respect of the insurance cover requested or

    arranged.

    1.2. You or your means you (and/or your appointed agent).

    1.3. We or us or our means Bluefin Insurance Services Limited.

    2. Who regulates us?2.1. We are authorised and regulated by the Financial Conduct Authority (FCA) an independent body that regulates the UK financial services

    industry. Our details may be confirmed on the Financial Services Registerwww.fca.org.ukor by phoning the FCA on 0800 111 6768.

    3. Our service3.1. We are committed to providing you with quality products. We will provide you with information to enable you to make your decision on

    which insurance is right for you. As an intermediary and your agent we owe various duties to you and will advise you as necessary ifcircumstances occur that may create a possible conflict of interest.

    3.2. Our permitted business activities are advising, arranging (bringing about) deals, making arrangements with a view to transactions, dealingas agent, assisting in the administration and performance of a contract and agreeing to carry on a regulated activity in respect of GeneralInsurance contracts.

    3.3. Unless we have informed you to the contrary in writing we will not assess your specific insurance needs and make a personalrecommendation but will provide you with information from to enable you to make a decision on whether our products meet your needs.

    3.4. Upon receipt of your instructions we will place, amend or renew insurance cover on your behalf with insurers. We will advise you of any

    inability to place your insurance.

    3.5. You are not to rely on any insurance policy you have instructed us to place on cover until we have confirmed in writing to you that theinsurer has agreed to such insurance cover being in place. Please note that you must comply with the terms and conditions of theinsurance policy you purchase including any matters where the insurer makes cover subject to your compliance with conditions or withexpress or implied warranties. Failure to comply may entitle the insurer to cancel your insurance contract and/or risks a claim you make notbeing paid in part or in full. (Also see Clause 14. Claims).

    3.6. Please also note, unless your policy confirms otherwise, the rights under your policy may only be pursued in an English court.

    4. Our remuneration and other income4.1. We are usually remunerated by commission from your insurer(s) for our insurance broking services, or by way of a fee negotiated and

    agreed with you. If we receive both, this will be confirmed in writing to you at the t ime of incepting or renewing your insurance. In addition:

    4.1.1. We may also make individual charges up to 100 to cover the administration of your insurances e.g. arranging a new policy, mid-term adjustments, short period or mid-term cancellations, renewals, issue of replacement or duplicate documents. We may also

    make individual charges where we prepare and issue documents on behalf of insurers, these will be confirmed in writing to you atthe time of incepting or renewing your insurance where applicable.

    4.1.2. Some insurers may make additional payments to us reflecting the size and/or profitability of our account with them and/or in respectof work we undertake on their behalf. In addition we may also receive payment from other firms, such as premium financeproviders, where non-insurance products or services are supplied to you.

    4.2. Our remuneration in whatever form and in respect of any policy shall be due on the date of inception or renewal of that policy. We shall beentitled to retain all commission and/or agreed fees in respect of the full policy period including where you appoint another intermediary inour place during the currency of a policy or where a policy is cancelled after inception or renewal. (Also see Clause 13. Short period andcancelled policies).

    4.3. You are entitled, at any time, to request information regarding any commission which we may have received as a result of placing yourinsurance business.

    5. If domiciled in a country other than the UK5.1. The law or regulations in your country of domicile may take precedence over any relevant UK legislation. Therefore references in this

    document to the FCA or Financial Ombudsman Service or Financial Services Compensation Scheme and any rights or benefits thereundermay not apply. If you wish to clarify your position in this respect then we will discuss this on request.

    6. Duty of disclosure6.1. It is your responsibility to provide complete and accurate information to insurers and us prior to and when you purchase an insurance

    policy, throughout the life of the policy and when you renew that policy. Failure on your part to immediately disclose information relevant toyour insurance or any inaccuracies in the information given could result in your insurance cover being invalid or not fully operative.

    6.2. All statements and material facts disclosed on proposal forms, statements of fact, claims forms and other documents should be full, trueand accurate. Material facts are those that would influence an insurer in deciding whether or not to accept a risk and the terms andconditions that would apply. Where forms are completed or partially completed on your behalf, you should check them for accuracy beforesigning. If you are in any doubt as to whether a fact is relevant, you should disclose it and then ask for guidance.

    7. Notification of changes, alterations and renewals7.1. Amendments to policies may be arranged upon receipt of full details and on return of the certificate of insurance (if applicable). Cover is

    subject to acceptance by insurers and payment of any additional premium required inclusive of Insurance Premium Tax (IPT).

    7.2. Renewals are invited on the basis that there have been no changes in the risk other than those specifically notified to us or your insurers.

    8. Insurer security8.1 We will only place cover with insurers who satisfy certain minimum criteria assessed by the rating agencies and/or our own assessment,

    or for whom you have given us specific approval to use. Whilst the information upon which we rely is obtained from sources considered tobe reliable, and we use all reasonable endeavours to review that information in order to protect your interests, predictability of solvencycannot be, and is not, guaranteed by us. The financial standing of any insurer can, of course, change after the insurance contract hadincepted. We do not guarantee the ongoing ability of any insurer to meet their contractual obligations.

    9. Quotations9.1. Quotations are valid until the date cover commences up to a maximum of 30 days, unless otherwise stated. Specimen policy wordings are

    available upon request.

    10. Documentation10.1. It is your responsibility to read all documentation upon receipt and raise any query regarding it otherwise you risk a loss you suffer not

    being paid in part or in full. Documentation including your policy and certificate, if applicable, will be issued to you upon receipt frominsurers.

    10.2. You must check all documentation issued to you to ensure the details are correct and the insurance cover provided meets yourrequirements. We will arrange insurance cover according to your instructions but only you can identify if it does not meet your intentions. Ifyou have any concerns in respect of your insurance cover or are uncertain as to the meaning of any terms and conditions or if youdiscover errors in the documentation, then you must notify us immediately.

    11. Payment of the premium11.1 We must receive your payment, unless it is made by you directly to your insurer, by cheque, credit or debit card, electronic funds transfer

    or be in receipt of a completed premium instalment application form (with deposit where requested) drawn on a bank, building society orother UK financial institution account in the policyholders name and before cover commences unless we agree otherwise. A charge mayapply to payments made by credit card and this will be confirmed to you in writing at the time of incepting or renewing your insurance. Ifwe agree to accept payment from someone other than the policyholder then this must be notified to us and agreed by us.

    11.2 We have no obligation to fund any premium, taxes or fees (if applicable) on your behalf nor do we have any responsibility for any loss youmay suffer as a result of cancellation of insurance cover or any other prejudicial steps taken as a result of late payment substantiallyattributable to you. If we decide to retain certain documents whilst awaiting payment, we shall provide details of your insurance cover andany information or documents required by law.

    11.3 We shall be entitled (but not obliged) without providing notice to you to set off any amounts due to us from you, against any amountswhich we may receive on your behalf (i.e. claims moneys, refunded premiums and other sums). Please be aware that full or partial non-payment of a premium or default on a credit agreement may result in the cancellation or lapsing of your policy.

    12. Transferred business12.1. When we are appointed to service insurance policies other than at their inception or renewal and which were originally arranged via

    another party, we shall not be liable during the current insurance period for any loss arising from any errors or omissions or gaps in yourinsurance cover or advice not supplied by us. Should you have any concerns in respect of a policy, which has been transferred to us, or ifyou require an immediate review of your insurance arrangements, you must notify us immediately. Otherwise we shall review yourinsurance arrangements and advise accordingly as each policy falls due for renewal.

    13. Short period and cancelled policies13.1. If you wish to cancel your policy then you will need to return the policy document and current certificate of insurance (if applicable) and

    confirm your cancellation instructions. Subject to the cancellation terms of your policy, a refund of premium may be available. Details ofany applicable cancellation terms and charges will be found in your policy documents. Our commission and/or fees are fully earned fromthe date insurance cover commences and may not be refundable in the event of cancellation, avoidance or early termination of a policy.

    14. Claims14.1 We will assist you with advice when you make a claim under your policy but it remains your responsibility to have read, understood or

    queried all documentation upon receipt. All incidents that could possibly give rise to a claim must be notified to us or your insurer inaccordance with the terms of your policy and a claim form completed where required. Delay on your part in notifying a claim and/orcompleting required forms may risk a loss you suffer not being paid in part or in full.

    14.2 You must not under any circumstance admit liability for a loss or agree to any course of action, other than emergency measures carriedout to minimise the loss, as you will risk your claim not being met in part or in full. All correspondence, claims, writs, summonses etc.should be forwarded immediately, unanswered, either to us or to your insurer. You are also reminded of your duty to keep all losses andcosts arising from an incident to a minimum and that failure to comply with policy terms and conditions may invalidate cover.

    14.3 We will remit claim payments received on your behalf, to you as soon as practicable after confirmation of receipt of cleared funds in ourbank account. In the event that an insurer becomes insolvent or delays making settlement, we do not accept liability for any unpaidamounts.

    14.4 Where we have a delegated authority from an insurer to settle your claim on their behalf we shall make you aware of this on notification ofthe claim and obtain your informed consent to proceed.

    14.5 We will provide a claims handling service for you as long as you remain our customer. We reserve the right to charge a fee for our claimsservices if you cease to be a client but still wish us to handle any claim, and we are prepared to do so. If you wish us to provide claimsservices on policies issued before our appointment, we also reserve the right to charge you a fee.

    15. Client and insurer money15.1. The FCA requires us to hold all client monies, including yours, in a trust account, the purpose of which is to protect you in the event of our

    financial failure since, in such circumstances; our general creditors would not be able to make claims on client money as it will not formpart of our assets.

    15.2. We hold all client monies in a Non Statutory Trust bank account in accordance with the FCA client money rules. Under these

    arrangements, we assume responsibility for such monies and are permitted to, and may:

    15.2.1. Use such monies received on behalf of one customer to pay another customers premium, before the premium is received fromthat other customer. However, we are not entitled to pay ourselves commissions before we receive the relevant premium from thecustomer;

    15.2.2. For the purpose of effecting a transaction on your behalf, pass your money to another intermediary, including those residentoutside the UK who would therefore be subject to different legal and regulatory regimes. In the event of a failure of theintermediary, this money may be treated in a different manner from that which would apply if the money were held by anintermediary in the UK. Please inform us if you do not agree to this.

    15.2.3. Retain for our own use, any interest earned on client money.

    15.3. Your money will be held either as agent of the insurer or agent of the client, depending on which insurer(s) your insurance has beenplaced with. Where money is held as agent of the insurer, this means that when we have received your cleared premium, it is deemed tohave been paid to the insurer.

    15.4. Unless we receive your written instruction to the contrary, we shall treat receipt of payment from you and of any claim payment and/or

    refund of premium which fall due to you, as being with your informed consent to the payment of those moneys into our Non Statutory Trustbank account.

    16. Our liability to you16.1. Unless we have otherwise agreed with you in writing, we shall treat your instructions to us to place or renew your insurance cover as

    acceptance of the limitation of our liability to you and to any other person with an interest in your insurance cover, as follows;

    16.2. Except in respect of any claim: - resulting from our fraudulent act; or resulting from a breach by us of the FCA's rules or Principles of Business; or in relation to any liability for death or personal injury resulting from our negligence; or in relation to any other liability which cannot lawfully be excluded or limited

    our liability to you (whether in contract, tort (including, without limitation, negligence) or otherwise) shall be limited to 10,000,000 inrespect of any and all insurance mediation activities undertaken by us on your behalf over any 12-month period.

    16.3. This Agreement contains all obligations owed by us to you. Our liability shall be strictly limited to direct liability in contract. We expresslyexclude any liability for indirect or consequential loss howsoever arising and any and all liability in tort save in relation to liability for ournegligent acts causing personal injury or death or other liability expressly reserved by statute.

    17. Ownership and control17.1. We are an independently authorised firm ultimately controlled by AXA UK Plc through our parent, Bluefin Insurance Group Limited.

    18. Confidentiality and security18.1. We will ensure that any information obtained from you is treated as private and confidential by us. These Terms of Business assume that

    any information you supply to us on behalf of a third party is done so with their permission.

    18.2. We will not take instructions on your insurance arrangements from anyone else unless we have your prior written permission. We will alsonot provide information you supply to anyone else unless we have your prior written permission to do so or are required by a regulatorybody, by law or are required to do so in the normal course of arranging your insurance or in connection with claims matters or otherservices we may provide to you.

    18.3. We may from time-to-time, provide you with marketing information on other products we supply and/or pass your contact details to othersuppliers of products or services of whom we approve. Please notify us promptly in writing if yo
