MINUTE NO. 494 1. C02224. Western Sydney Academy of Sport The Meeting was addressed by Mrs Carolyn Brimfield, the Co-ordinator of the Western Sydney Academy of Sport. Following this, each young athlete was presented with an award certificate by the Mayor, Councillor Angel, and Councillor Kime to mark the occasion. RESOLVED UNANIMOUSLY on the MOTION of Councillors Kime and Angel that Council receives this report on the Western Sydney Academy of Sport and congratulate the young athletes of the Blue Mountains on their successful participation in the activities of the Academy.

2. C04261. International Year of the Volunteer Celebrating the “Theme Months” of: October - Emergency Services; November - Civic Participation; and December - Corporate Bodies

RESOLVED UNANIMOUSLY on the MOTION of Councillors Henson and Kozelj: 1. That the Minute by Mayor be received. 2. That Council, being increasingly aware of the invaluable assistance provided by

volunteers, acknowledge their work and the work of all volunteer groups in the Blue Mountains associated with the Themes.

3. That volunteer groups be aware they are entitled to receive a Certificate signed

by the Mayor acknowledging their work. 4. That volunteers be made aware a civic reception is planned for lunchtime on

Sunday, 25 November 2001 – at Springwood Civic Centre and Buckland Park.

OFFICERS’ REPORTS, 6/11/01

MINUTE NO. 496 3. C02454. Lawson Town Centre - RTA Proposal The Meeting was addressed by Erst Carmichael and Nance Cooper. A MOTION was made by Councillors Van der Kley and Myles: 1. That the report from the Group Manager Strategy be received. 2. That Council advise the NSW Roads and Traffic Authority (RTA) and the local

State Members that it accepts responsibility for the coordination of the redevelopment of the Lawson town centre as part of the broader RTA project to upgrade the Great Western Highway. Further that Council accepts, in principle, the funding package offered by the RTA to assist in the redevelopment of the Lawson town centre on the basis that the RTA agrees to provide additional funding to cover the cost of any major, unanticipated adjustment to underground services that is above and beyond normal expectations.

3. That Council appoint an appropriately qualified and experienced project

manager as soon as possible to coordinate the Lawson Town Centre Redevelopment Project.

4. That Council not prepare a separate Development Control Plan for the Lawson

Town Centre but rather that design and other appropriate development controls be incorporated as precinct provisions in DLEP 2000 for the Lawson core village area.

5. That the General Manager report back to the Council with a suitable proposal

for involving the public in the redevelopment of Lawson as it proceeds. Councillor Gaul moved an AMENDMENT which the Chairman ruled to be a direct negative. Councillor Gaul then moved a MOTION of DISSENT against the ruling of the Mayor that her amendment for deferral was a direct negative. The Mayor PUT to the Meeting the Chairman’s ruling be upheld.

MINUTE NO. 497 4. C03419. Katoomba Town Square - Carrington Hotel Site RESOLVED UNANIMOUSLY on the MOTION of Councillors Hamilton and Kozelj: 1. That Council approves the conclusion of a lease with Balpar Pty Ltd to lease land

in front of the Carrington Hotel for the purpose of a town square. 2. That Council enters the lease as soon as the Conservation Management Plan and

masterplan are approved by the Heritage Council and all of the remaining lease issues are resolved to the satisfaction of the General Manager.

3. That Council formally accept the additional funding for the town square under

the State Government Urban Improvement Program and that WSROC be thanked for their support and assistance in gaining the funding.

MINUTE NO. 498 5. C03283. Mapping of Native Vegetation Communities, Implementation of Findings and Ramifications for DLEP 2000 RESOLVED UNANIMOUSLY on the MOTION of Councillors Greenhill and Hamilton: 1. That the information relating to the progress and application of the native

vegetation mapping project be noted. 2. That Council endorse the application of the principles described in the

‘Recommended Approach’ under the heading ‘Section 2-Application to Draft Local Environmental Plan 2000’ of this report as the basis for incorporating the new vegetation mapping for significant vegetation communities into Draft Local Environmental Plan 2000.

MINUTE NO. 499

6. C05085. Draft Vegetation Management Order RESOLVED UNANIMOUSLY on the MOTION of Councillors Hamilton and Henson: 1. That pursuant to Section 54 of the Environmental Planning and Assessment Act,

1979 (as amended) Council prepare and publicly exhibit draft Local Environmental Plan 1991 Amendment No. 32 and draft Local Environmental Plan No. 145 to amend Local Environmental Plan 4, as detailed in Attachment 1.

2. That Council use its delegations to issue a Section 65(1) Certificate in accordance

with the Director-General’s 1997 Delegations to Council. 3. That Council publicly exhibit the draft Vegetation Management Order and its

intention to supersede the Tree Preservation Order across the City in all areas other than Megalong Valley.

4. That the Director of Urban Affairs and Planning be advised that in Council’s

opinion a Local Environmental Study is not required to be carried out in accordance with Section 57 of the Act.

MINUTE NO. 500 7. C03150. Draft LEP 2000 - Addressing Affordable Housing Issues The Meeting was addressed by Chris Baulman, Ann Gethin and Mary Calbeck-Moore. RESOLVED UNANIMOUSLY on the MOTION of Councillors Van der Kley and Henson: 1. That the report by the Group Manager Strategy be received. 2. That Council note that the achievement of outcomes for the City and the World

Heritage National Park in terms of protecting the natural environment and the character of our towns and villages will have implications for housing in the City.

3. That Council note the regulatory strategies incorporated into DLEP 2000 to

assist in addressing housing affordability. 4. That housing affordability action plans be developed in conjunction with the

community, key housing providers and Government as part of the City Strategy. 5. That Council explore funding opportunities for a demonstration affordable

housing project as part of the Area 2 Community Plan Action Plan. 6. That Council explores options for land along the Great Western Highway with

the RTA and State Government. Councillor Egan was not present in the Council Chamber when this matter was considered.

MINUTE NO. 501 8. C00618. C00036. Safety Measures on the Great Western Highway at Lawson and Bullaburra A MOTION was moved by Councillors Van der Kley and Henson: 1. That Council receives the report. 2. That on the basis of the RTA advice, Council consider waiting for the public

exhibition of the upgraded highway between Ferguson Avenue, Hazelbrook and Ridge Street, Lawson, which is expected to occur in early 2002, before deciding its further action.

Commerce, Lawson Public School P&C Association, FLAG (Friends of Lawson Action Group), Ward Councillors, RTA and Council staff, to identify where traffic lights are required in Lawson Town Centre and any required seagull intersections at the highway through Lawson and Bullaburra.

MINUTE NO. 502 9. Z00/034. Preparation of a Draft Local Environmental Plan to amend the Schedule of Environmentally Sensitive Vegetation Units in LEP 1991 RESOLVED UNANIMOUSLY on the MOTION of Councillors Greenhill and Hamilton: 1. That pursuant to Section 54 of the Environmental Planning and Assessment Act

1979, Council prepare a Draft Local Environmental Plan to amend Schedule 3 — Environmentally Sensitive Vegetation Units of Local Environmental Plan 1991 by incorporating the proposed descriptions of significant vegetation communities that: a) are proposed to be included in Draft Local Environmental Plan 2000, and b) have been identified specifically within Megalong Valley as a part of the

native vegetation mapping project for the city, to apply to all land subject to Local Environmental Plan 1991.

2. That the 31 significant vegetation communities identified in Attachment 1 be

included in the Schedule 3 as part of the Draft Local Environmental Plan for the purposes of exhibition.

informed that Council: a) does not intend to prepare a Local Environmental Study, and will instead

rely on studies undertaken in the preparation of the Draft Local Environmental Plan 2000 and the city-wide native vegetation mapping project to augment Environmental Management Plan 1; and

b) intends to exercise its delegations with respect to ss 65 (1) and 69 of the Environmental Planning and Assessment Act 1979.

4. That the Draft Local Environmental Plan be placed on public exhibition and a

report be submitted to Council for consideration after the exhibition has been completed.

MINUTE NO. 505 12. C02789. Review of Environmental Education Strategy RESOLVED UNANIMOUSLY on the MOTION of Councillors Kime and Van der Kley: 1. That the Environmental Education Strategy (2001-2004) be adopted by Council. 2. That the Annual Environmental Education Action Plan (2001-2002) be noted for

implementation by the Council during the current business planning year.

3. That the recommended consultative approach for developing the Annual Environmental Education Action Plan 2002-2003 be endorsed for implementation, which includes a Working Group comprised of internal and external representatives chaired by the Mayor.

MINUTE NO. 506 13. C02312. Memorandum of Understanding between Blue Mountains Urban Runoff Control Program and Blue Mountains Council RESOLVED UNANIMOUSLY on the MOTION of Councillors Hamilton and Van der Kley: 1. That Blue Mountains City Council endorses the proposed MOU with the Blue

Mountains Urban Runoff Control Program Task Force.

2. That Council prepares an annual maintenance plan for submission to the Task Force.

3. That the annual asset maintenance plan for the URCP be included within the

Council’s 4 Year Management Plan and Environmental Management Strategy, commencing 2002-2003.

Landscaping 8 To minimise the impacts of future development upon

adjoining allotments, screen landscaping is to be carried out to the rear of all lots to provide a buffer between the lots and within the 8m front building setback for Lots 32 and 33 prior to release of the Subdivision Certificate. Full details of the landscaping are to be included in the Construction Certificate application and shall comprise local native plants along the frontage of Lots 32 and 33 at least two metres wide and the landscaping to the rear of the Lots shall be at least two metres deep on all Lots.

Kerb and Gutter

Construction 9 To minimise impacts upon Council’s assets, rolltop

concrete kerb and gutter and shoulder seal is to be constructed for the full Heather Road frontage of the site, together with all necessary works and drainage to make the construction effective. The kerb alignment is to be approximately consistent with the existing tabledrain alignment,

Interallotment

Drainage 10 To ensure legal and practical drainage is available to

all proposed lots, an interallotment drainage easement (a minimum of 1m in width) and piped drainage system is to be installed in accordance with engineering design to service future development on the proposed lots.

Erosion & Sediment

Measures 11 To preserve the unique environment of the Blue

Mountains and to contain soil and sediment on the property, controls in accordance with Council’s Erosion & Sediment Control Policy are to be implemented prior to clearing of the site vegetation and the commencement of site works. ‘Site works’ includes any service extension works or road and drainage works outside the property boundary.

MINUTE NO. 508 (CONTD.) This is to include the installation of a sediment fence

with returned ends across the low side of the works. These shall be maintained at no less than 70% capacity at all times. All drains, gutters, roadways etc., shall be kept clean of sediment. Soil erosion fences shall remain and must be maintained until all disturbed areas are restored by turfing, paving, revegetation. All disturbed areas are to be stabilised prior to release of the Subdivision Certificate.

Traffic Management

Plan 12 A Traffic Management Plan Report prepared by a

suitably qualified person is to be submitted with the Construction Certificate application for consideration and approval of the Principal Certifier prior to commencement of works. The Management Plan is to address but not be limited to the following - loss of on-street parking during construction, safety of public, materials storage and handling deliveries and construction traffic and parking.

Safety devices such as signs, barricades, barriers,

warning lights, etc. shall be placed where works affect Council roads and shall be in accordance with Australian Standard 1742 – “Manual of Uniform Traffic Control Devices” and RTA Manual – “Traffic Control at Work Sites” 1998. Details are to be included in the Traffic Management Plan Report. The contractor shall submit to Council the names of proposed traffic controllers with a signed declaration that they are appropriately trained in the duties of traffic controllers and RTA accredited.

MINUTE NO. 508 (CONTD.) Engineering Plans 13 All engineering works required by this development

on the site and its curtilage (including sediment and erosion controls, road, access and drainage works) are to be in accordance with Council's Specification for Engineering Works for Subdivisions and Developments - Part 1 Design and Part 2 Construction. § The design and construction is to include any

additional works to make the construction effective.

§ Design plans and specifications are to be submitted with the Construction Certificate.

Performance, Damage

and Defects Bond 14 A performance, damage and defects bond to the

value $2 000 must be lodged with Council prior to the issue of the Construction Certificate. These monies are refundable on application, 6 months after the completion of all work, subject to satisfactory performance of the works.

Site Management 15 To prevent site works and associated materials and

activities causing a nuisance to the surrounding properties and the area generally, all site and construction works shall be carried out Monday to Friday 7am-6pm and on Saturdays between 8am-1pm and no work on Sunday and Public Holidays. Alteration to these hours may be possible for safety reasons but only on the written approval of Council.

Works as Executed

Plans 16 Works as executed plans of the road and drainage

works, certified by a Registered Surveyor, are to be lodged with Council prior to the issue of the Subdivision Certificate.

Subdivision Certificate 17 An application for a Subdivision Certificate is

required on completion of all conditions of Development Consent. The application is to be lodged with and approved by Council as the consent authority. The application should include the original plan of subdivision plus 5 copies. The location of all buildings and / or other permanent improvements must be shown on one copy.

Attachment 1 - Conditions of Deferred Development Consent

The Deferred Commencement Consent is subject to the applicant, within a period of two (2) years from the date of the endorsement of the Deferred Commencement Consent, satisfactorily submitting plans and/or documentation that address the following:

1. The submission to Council of a written authority to discharge water from the subject site onto Lot 2 DP 232147 signed by the owner of Lot 2 DP 232147.

2. Documentary evidence from NSW Land and Property Information of

registration of the plan of subdivision of Lot 2, DP 232147, (3 Birdwood Parade) approved under Development Application No S96/0102.

3. Documentary evidence from NSW Land and Property Information of

registration of an inter-allotment drainage easement in favour of Lot 5 Section 1 DP 660 (17 Glendarrah Street), over Lot 2 DP 232147 (or relevant lots created by the approved subdivision of this parcel) adjacent to and for the full length of the western boundary of Lot 10 in DP 9067 (22 Kingsway). The easement is to be a minimum of 1m wide.

4. The development being modified as follows:

a) The width of the verandah return to Unit 3 being reduced to a maximum width of 1800 mm.

b) Units 5 and 6 being redesigned as a more conventional two (2) storey building and the entry floor level lowered by a minimum of 0.5 metres so that the floor levels do not exceed: i) Upper ground floor (entry) level - RL 93.170; ii) Lower ground floor level - RL 90.470. Services 4. Arrangements must be made with Integral Energy,

Sydney Water and an approved telecommunications service provider for the extension of services to and within the site. Written evidence of such arrangements are to be submitted prior to the issue of the Construction Certificate. In this regard a copy of a Section 73 Certificate from the Sydney Water Corporation shall be submitted to the Principal Certifying Authority prior to issue of a Construction Certificate.

Survey plan 5. A Survey Report prepared by a registered land

surveyor is required to ensure that the proposed development is located on the correct allotment, at the approved distances from the boundary and that the approved levels are being maintained. This is to be verified by the submission of a Survey Report to the Principal Certifying Authority prior to works proceeding past lower ground floor level.

Home building

insurance 6. It is the responsibility of property owners to ensure

that Home Owners Warranty insurance has been obtained in accordance with the Home Building Act 1989. Prior to any works commencing on the site, a copy of the Home Warranty Insurance Certificate for the property is to be submitted to the Principal Certifying Authority. Information on this insurance scheme can be obtained from the Department of Fair Trading.

Excavations 7. All excavations are to be guarded and protected to

prevent them from being dangerous to the public and surrounding properties.

Building Code of

Australia 8. All building work must be carried out in accordance

with the provisions of the Building Code of Australia.

deliveries and provides information on the person responsible for the site, a sign displaying the following information is to be erected: a) The statement “Unauthorised access to the site is

not permitted”. b) The names of the builder or another person

responsible for the site along with an out of hours contact number.

c) Lot or Street number. Site management 10. To safeguard the local amenity, reduce noise nuisance

and to prevent environmental pollution during the construction period: a) Site and building works (including the delivery of

materials to and from the property) shall be carried out Monday to Friday between 7am-6pm and on Saturdays between 8am-3pm. Alteration to these hours may be possible for safety reasons but only on the approval of Council.

b) Stockpiles of topsoil, sand, aggregate, spoil or other material shall be stored clear of any drainage path or easement, natural watercourse, footpath, kerb or road surface and shall have measures in place to prevent the movement of such material off site.

c) Building operations such as brickcutting, washing tools, concreting and bricklaying shall be undertaken on the building block. The pollutants from these building operations shall be contained on site.

d) Builder’s and demolition waste must not be burnt or buried on site. All waste (excluding felled trees) must be contained and recycled or removed to an approved Waste Disposal Depot.

Recycling on site 11. Any vegetation requiring removal for the purpose of

access or dwelling construction shall be immediately mulched or chipped and stockpiled on site to be used for restoration or landscaping on the completion of the works.

plan 12. To preserve the unique environment of the Blue

Mountains a Soil and Water Management Plan in accordance with Council’s Erosion & Sediment Control Policy is to be submitted to and approved by the Principal Certifying Authority, prior to clearing of any site vegetation and the commencement of site works.

This plan is to include scaled drawings and detailed

specifications that can be readily understood and applied on site by supervisory staff. Items to be shown on the plan are to include:

a) locality; b) contours (existing and final); c) existing vegetation; d) existing site drainage; e) limit of clearing, grading and filling (location of

all earthworks including roads, areas of cut and fill and regrading);

f) locations and design criteria of erosion and sediment control structures;

g) site access; h) proposed vegetative buffer strips; i) location of critical areas (drainage lines, water

bodies etc.); j) proposed techniques for stabilisation of

disturbed ground; k) procedures for maintenance of erosion

controls; l) details for staging works; m) techniques for dust control.

Soil erosion 13. All exposed earthworks and disturbed areas shall have

suitable sediment control measures in place prior to the commencement of construction to prevent soil erosion and the transport of sediment off the site during rainfall and runoff. The sediment control measures shall be continually monitored and maintained for the duration of construction and for six months after completion. All disturbed areas shall be revegetated with native vegetation endemic to the area.

MINUTE NO. 509 (CONTD.) Workers amenities 14. Before work starts, toilet facilities must be provided

for construction personnel on the site on the basis of 1 toilet for every 20 workers. Amenities are to be installed and operated in an environmentally responsible and sanitary manner. Toilets cannot remain on site for any longer than 12 months, without the further approval of Council.

Plans on site 15. A copy of the stamped and approved plans,

Development Consent and the Construction Certificate are to be on the site at all times.

Materials & colours 16. To have regard of the amenity of the area, and

amended schedule of materials and colours shall be submitted to and approved by Council, prior to issue of a Construction Certificate: The colours shall be of dark, earthy tones, consistent with the bushland setting of the site. Any variations to the approved colour scheme shall require the approval of Council.

Construction

inspections 17. To ensure structural integrity, the maintenance of

minimum health standards, the management of the buildings surrounds and the protection of the environment, Compliance Certificates are to be issued at significant stages throughout the construction period. These stages are: a) Reinforcing steel in position and before concrete is

poured (footings, lintels, beams, columns, floors, walls and the like.

b) Floor frame, dampcourse, antcapping, and foundation walls before floor material is laid.

c) Framing when external wall and roof cladding is in place and prior to internal linings.

d) Wet area flashing prior to tiling or covering. e) Stormwater drainage between building and

discharge point (drainage pipes, soakage pits and the like) prior to covering.

f) Completion of the development and sign off to all conditions of the consent including landscaping, prior to occupation and use.

At each inspection, erosion and sediment control measures and site management are to be inspected.

MINUTE NO. 509 (CONTD.) Demolition

management 18. The work is to be executed by a competent person,

with due regard for safe working practices and in accordance with the requirements of the Workcover Authority. At all times during demolition a competent person shall directly supervise work. It is the responsibility of the person to ensure that:

a) The structure to be demolished and all its components shall be maintained in a stable and safe condition at all stages of the demolition work. Temporary bracing, guys, shoring or any combination of these, shall be added for stability where necessary.

b) Precautions are taken to ensure that the stability of all parts of the structure and the safety of persons on and outside the site are maintained particularly in the event of sudden and severe weather changes. Severe weather changes refer primarily to the localised high winds. In these circumstances loose debris can become airborne, particularly if it is in sheet form.

c) The site shall be secured at all times against the unauthorised entry of persons or vehicles.

d) Utility services within the structure not required to be maintained during the demolition work shall be properly disconnected and sealed off before any stripping or demolition commences.

Dust control 19. The techniques adopted for stripping out and for

demolition are to minimise the release of dust into the atmosphere. a) Before commencing work, any existing

accumulations of dust are to be collected, placed in suitable containers and removed. Selection of appropriate collection techniques, such as vacuuming or hosing down, shall take account of the nature of the dust and the type of hazard it presents (eg., explosive, respiratory etc).

b) Dust generated during stripping or during the breaking down of the building fabric to removable sized pieces shall be kept damp until it is removed from the site or can be otherwise contained. The use of excess water for this purpose is to be avoided.

environments and under certain stimuli, deposits of combustible dust on beams, machinery and other surfaces may be subject to flash fires, and suspensions of combustible dusts in the air can cause them to explode violently (see NFPA Handbook).

Removal of hazardous

waste 20. Removal of dangerous or hazardous materials shall be

carried out in accordance with the provisions of all applicable State legislation and with any relevant recommendations published by the National Occupational Health and Safety Commission (Worksafe Australia). a) Only competent persons, or competent and

registered persons shall carry out removal. b) Removal of asbestos or materials containing

asbestos fibres, shall be in accordance with the NOHSC Code of Practice.

c) Precautions to be observed and procedures to be adopted during the removal of dangerous or hazardous materials other than asbestos, shall be in accordance with the relevant State regulations pertaining to those materials.

Sarking 21. In the event of a bushfire, to assist in the prevention of

ember entry to the roof area, fire grade sarking should be used (flammability index not greater than five) under all roofing.

Timber cladding 22. To minimise risk from loss of property to bushfire,

timber wall cladding should be painted, smooth faced and have an interlocking profile. Where the cladding is overlapped in lieu of being interlocked, fire grade sarking must be incorporated immediately behind the external wall cladding.

Openings 23. Any opening including vents on walls etc., should be

sealed with maximum 2mm wire mesh. The opening of a chimney flue or air handling equipment can remain unprotected as long as ceiling access holes are large enough to provide fire fighting access to the roof cavity and command a clear view of the entire roof space.

a) the roof / wall junction should be constructed so that the eaves or the gaps between rafters are effectively sealed.

b) ridge capping must be sealed. Skylights 25. Skylights should be constructed of thermoplastic

sheets in metal frames with a diffuser at ceiling level of 6mm thick wired or other safety glass, retained in a metal frame. The skylight shaft should be lined with fire-rated plasterboard, if it is not a vaulted or cathedral ceiling.

Doors 26. To eliminate the possibility of embers entering the

building in a bushfire situation, all external doors are to be fitted with draught seals.

Landscaping/

Screen planting 27. a) Landscaping shall be carried out in accordance

with the plan prepared by R & L Starr Architects numbered 0029/05A and dated June 2001.

b) Additional screen planting shall be provided along the northern and western boundaries as shown in red on the approved plans. These plants shall be large evergreen shrubs or small trees, capable of attaining a height of 3.6 metres and shall compliment the other landscaping proposed for the site.

c) All plants, other than those of native species, must be in an advanced stage of growth at the time of planting (minimum 50 litre container for trees and 25 litre container for shrubs). Trees must not be less than 2 metres in height.

d) Any plants and landscaping on the site are to be maintained at all times. Any plants that die or are removed, must be replaced with plants of the same species and of a similar stage of growth.

Fencing 28. To ensure an adequate level of privacy is afforded to

occupants of the development and to adjoining properties, 1800 mm high lapped and capped timber, or other approved decorative fencing, shall be provided along the northern, eastern and western boundaries of the site and between each unit as shown on the approved plans. NOTE: Fencing along the eastern and western boundaries should be reduced to 1 metre in height where it is located within the front building setback.

drained in a manner that will not be detrimental to adjoining properties or the environment. All disturbed areas are to be topsoiled and turfed or spraygrassed. Where batters exceed a ratio of 3 horizontal to 1 vertical, retaining walls or terracing is required.

Protection of vegetation 30. To preserve the natural site features and limit site

disturbance, ground covers and trees within driveway areas and 3 metres or more from the outermost projection of the buildings are to be retained. Remaining vegetation must be protected by suitable guards / barriers to prevent damage as a result of the construction phase.

Engineering conditions 31. INTERNAL

a) All roof surfaces, car parking access and

paved areas are to be drained by pits and pipes. Drainage is to be subject to engineering design in accordance with ARR 1987. Discharge from the site is to be restricted to predevelopment flows for a range of storms up to and including the 1:100 yr ARI. Accordingly discharge from the site is to be in accordance with the approved drainage plan prepared by Jeff Moulsdael & Associates titled Proposed On Site Stormwater Detention System 17 Glendarrah Street, Hazelbrook drawing number CW01, Issue A, dated May 2001 subject to the amendments in red to reflect the location of the new proposed interallotment easement.

b) All access roads and car parking areas in the

development site are to be formed, paved and sealed, together with any necessary drainage, retaining walls and works to make the construction effective. All access driveways and car parking areas are to have a 100mm high concrete kerb. The paving is to be a heavy duty construction with a featured surface.

EXTERNAL

a) The construction of standard roll top concrete

kerb and gutter, shoulder seal and pavement construction is to be completed for the full frontage of the development site in Glendarrah Street and is to extend east for approximately 2m to match the existing kerb and gutter fronting No 11 Glendarrah Street. The alignment of the new kerb and gutter is to match the existing roll top kerb and gutter fronting No 11 Glendarrah Street. The footway area is to be topsoiled and turfed (Kikuyu is not be used). The construction is to include any necessary work to make the construction effective, including a splay seal for the western end of the new kerb. Engineering design plans and specifications are to be submitted to Council for consideration and approval under the Roads Act (1993) prior to the issue of the Construction Certificate. Prior to the issue of the Construction Certificate the appropriate engineering plan approval fee is to be paid in accordance with Council’s Schedule of Fees and Charges.

b) For the driveway across the Glendarrah

Street footpath area the construction of a new 7.5 metre wide heavy duty layback and concrete apron crossing. This construction is to include any necessary work to make the construction effective. The design for the driveway and crossover is to be included in the kerb and gutter design.

drainage system that extends from the OSD system in 17 Glendarrah Street through Lot 2 DP 232147 (3 Birdwood Parade) and connects into the Council approved drainage system for the approved subdivision of Lot 2 DP 232147 (3 Birdwood Parade), reference S96/0102. The design shall be in accordance with ARR 1987. The minimum pipe size shall be a 375mm diameter reinforced concrete, rubber ring jointed, pipe and the design shall be in accordance with Council Standards and Specifications.

The new Council drainage line is to begin

with a 1.8m wide kerb inlet pit in the new Kingsway extension. A Council standard junction pit is to be constructed at every change in direction of the pipe.

The pipe is to follow the proposed pathway

and join into the proposed subdivision drainage system. Engineering plans are to be submitted to Council for consideration and approval prior to the issue of a Construction Certificate. The plans are to be accompanied by the appropriate engineering plan approval fee in accordance with Council’s Schedule of Fees and Charges.

The construction of the trunk drainage system extending from the On Site Detention on the subject property to the Council approved drainage system for the approved subdivision to the north, shall be completed prior to works commencing on construction of the buildings on the site.

d) Any relocation or alteration of public utilities

or any existing services made necessary as a result of this development are to be carried out at no cost to Council with satisfactory arrangement being made with the authority concerned and a certificate of clearance obtained from each relevant authority.

Management Plan is to be prepared by a suitable qualified person and submitted to and approved by Council. i) The Management Plan is to address but

not be limited to the following: safety of the public, materials storage and handling, deliveries and construction traffic and parking.

ii) Safety devices such as signs, barricades, barriers, warning lights, etc shall be placed where works affect Council roads and shall be in accordance with Australian Standard 1742 ‘Manual Of Uniform Traffic Control Devices’ and RTA Manual ‘Traffic Control at Work Sites 1998’.

iii) Details prepared by a suitably qualified person shall be submitted to and approved by Council with the Traffic Management Plan.

iv) The contractor shall submit to Council the names of the proposed traffic controllers with a signed declaration that they are appropriately trained in the duties of traffic controllers and RTA accredited.

f) An on site meeting is to be arranged with

Council’s Supervising Engineer prior to commencement of work in Council’s Road and prior to works commencing on the proposed drainage system for the purpose of a preconstruction meeting. Prior to the issue of the Construction Certificate the inspection fee of $700 is to paid.

g) All contractors working in the road reserve

shall be covered for worker’s compensation insurance and public liability insurance to the amount of $10 million. The policy shall specifically indemnify Council from all claims arising from the execution of the works. Written evidence of this insurance shall be supplied to Council’s Supervising Engineer at the preconstruction meeting.
