Payment
Unless otherwise agreed in advance in writing, payment is due for the threesale Sessions as follows:
(A)London Session I: Lots 1 to 199 in British Pounds(B)Rome Session II : Lots 200 to 399 in Euros(C) NewYork Session III: Lots 400 onwards inUnitedStatesDollars
In all cases, payment is due immediately after the auction and no propertywill be released unless and until we have received payment in full in clearedfunds.The purchase price will consist of the sum of the hammer price plus thebuyer’s premium plus any applicable sales or VAT taxes or other fees androyalties (such taxes and feesmay vary between the three Sessions subject tothe buyer’s location and the legislation in each of the three Session locations).You are requested to pay either a bank debit card, in cash (up to the limitallowed for by reference to the regulations in the three Session locations), bywire transfer, or by a check drawn on a bank account, and to have establisheda bank reference with us before the sale. Please note that buyers areresponsible for all bank fees. In the case of LondonSession I andRomeSessionII only you may also pay by European issued credit card (Visa and Mastercardonly) subject to an additional surcharge of 3%. Unless we have agreed inadvance inwriting, wewill not accept payment for any lot from any party otherthan the buyer of record for the lot.
ShippingAs a courtesy to our clients, we are happy to provide shipping quotes fromour adjunct shipper for books and photographs. For any lots requiringextensive packing or special export permission, we are happy to suggestoutside shipping companies.
SalesTax &VAT
(A)London Session I: VAT at the rate of 17.5% will be applied to the buyer’spremium. Lots which are daggered (†) in the catalogue are subject toVATon the hammer price as well as the buyer’s premium. Lots marked with anasterisk (*) have been imported from outside the EU to be sold at auction,and therefore the buyer must also payVAT at the reduced rate of 5% onthe hammer price.
(B)RomeSession II: VATat the rateof 20%will beapplied to thebuyer’spremiumon all lots.
(C)NewYork Session III: Purchases that are collected in NewYork or deliveredto an address in NewYork state may be subject to NewYork state salestax, which we will collect and remit. Property shipped outside NewYork
state may be subject to compensating use tax, and it is the buyer’sresponsibility to ascertain and pay all such taxes as may be due. Buyersclaiming exemption from NewYork state sales tax must supply us withthe appropriate supporting documentation prior to the release of anypurchased property.
Storage Charges
Please be advised that a storage charge of £30/€35/$50 per lot permonthmaybe levied on all purchases that you do not pay for, pick up or have shippedwithin 7 working days of the auction. In addition, after 7 working days, weaccept no responsibility for loss of or damage to any purchased property.

Every attemptis made to ensure the accuracy of the subsequent catalogue description, butthe descriptive information is not encompassed within in our LimitedWarranty. Where a lot is attributed to an artist then it is our opinion that thework may be by that artist but cannot be definitively determined to be so.
TitleWhere the title is known or inscribed on the print it is described in ItalicType,otherwise it representsacommondescriptionof the imageor simplyadescriptivetitle given by BloomsburyAuctions to describe thework.
DatesWhen only one date is given it indicates that the print is vintage.A vintage printis onemade at around the same time as the negative either by the artist or canbeconsideredas the artist’s earliest representationof thenegative.Non-vintageprints are denoted by two dates (if known); the first representing the date of thenegative and the second the approximatedate of printing.Where aprintingdatecannot be estimated thedenotation ‘printed later’ is used.BloomsburyAuctionsdoes not guarantee the dates within the general description.
MeasurementMeasurements refer to the image only and are described in centimetres(rounded to 1 decimal point) and inches (rounded to the nearest 1/8 inch)showing the height of the image followed by the width.
MediumWhere indicated, this refers to Bloomsbury Auction’s opinion on thephotographic technique thatmost closely describeshow theprintwasproduced.
FramingOnly photographs that are described in the catalogue as framed will be soldtogether with their frames though Bloomsbury Auctions takes noresponsibility for the condition or suitability of the frame. All otherphotographs are sold unframed.
Additional Information and ReferencesWhere the description lists signatures, other insignia or stamps these willusually be accompanied with information describing their location. ‘On therecto’ refers to the front of the print within the image, ‘in themargin’ refers tothe front of the print outside the image, ‘on the verso’ refers to the back of theprint and ‘on the mount’ or ‘on the reverse of the mount’ refers to the front orback of the board or othermaterial ontowhich the photograph is permanentlymounted. Nel 1967 la musicista e poetessa Patti Smith si trasferì a NewYork dove, a seguito di una serie di circostanze, incontrò Robert Mapplethorpe.Nella sua recente biografia Just Kids (2010) Patti Smith descrive l’inizio del legame sentimentale e di amicizia con Mapplethorpe,alimentato dalla comune passione per l’arte e la poesia. In 1967 singer-song writer Patti Smith moved to NewYork and through a series of events met Robert Mapplethorpe. In her recentlypublished memoir Just Kids (2010) Smith describes the start of a romance and lifelong friendship with Mapplethorpe, which was arelationship fueled by a passion for art and writing.This portrait of Smith by Mapplethorpe reveals not only her guarded vulnerability,but also her dual role as both muse and the inspired.

Quoting Victoria Olsen in From Life: Julia Margaret Cameron and Victorian Photography: “Cameron would have been interested inthat notion of the holy family as working class, humble, peasant people. She used her maid Mary Hillier as Mary Madonna, and twolocal children as John the Baptist and Jesus. These Conditions of Sale and Business are applicable to all three saleroomsunless explicitly varied herein and constitute the contract betweenBloomsburyAuctions (the “Auctioneer” as defined for each saleroom immediately below)and the seller, on the one hand, and the buyer on the other. By bidding at theauction, you agree to be bound by these terms.The “Auctioneer” is definedas follows:

(C ) NewYork Session: The Auctioneer is Bloomsbury Auctions Inc., 6 West48th Street, NewYork, NY 10036.
1. The Auctioneer is the agent for the seller. The auctioneer is acting asagent for the seller, except asmay be otherwise indicated.The contract forsale of any property is between the seller and the buyer.
2. Seller’s warranty of title. The seller warrants to the buyer that he isauthorized to sell the property and is able to transfer good andmarketabletitle, free and clear of any liens, claims or encumbrances of any third party.
3. All lots sold “as is”. Except as set forth in the limitedWarranty, below, allproperty is sold “as is.” It is the buyer’s responsibility to examine theproperty personally, and to ascertain for himself that he is satisfied withthe lot’s condition and with any other matters described in the catalogueentry. Neither the auctioneer nor the seller make any representation,warranty or guaranty about the property except as described in thelimitedWarranty, and no statement in the catalogue, a condition report, orany other oral or written statement shall constitute such a representation,warranty, guaranty or any other form of assumption of liability. Estimatesof selling prices are not to be relied on as any representation that theproperty will sell for that price, or as a representation of the value of theproperty for any other purpose. Neither the auctioneer nor the seller shallbe responsible for any errors or omissions in the catalogue, except asprescribed by the limitedWarranty.
4. Where the Auctioneer has an interest in a lot. Lots in which theauctioneer has any interest – direct or indirect, whole or partial (other thanthe selling commission) are designated by the symbol [o]. Such financialinterests may include, among other things, ownership of the property,guarantees, or non-recourse advances secured only by the property beingoffered for sale.
5. Bidder registration. Any prospective buyers must complete ourprescribed registration process in order to participate in the auction,whether he intends to bid in person at the auction, by phone, by absenteebid, or online. Upon registration, the buyer will be required, among otherthings, to provide his name, permanent address, proof of identity, and, ifrequested, the details of the bank from which payment will be made.TheAuctioneer reserves the right in its sole and complete discretion to denyentry to the auction, to refuse permission for a prospective buyer toparticipate in the auction, and to reject any bid.
6. Auctioneer’s discretion. The auctioneer has sole and complete discretionto refuse any bid, to advance the bidding as he sees fit, to withdraw ordivide any lot, to combine any lots, and, in the case of error or disputeduring or after the sale, to determine the successful bidder, to continuethe bidding, to cancel the sale or to reoffer and resell the lot. If any disputearises after the sale, the records of the auctioneer shall be conclusive.
7. Absentee Bidding. As a courtesy to potential bidders who will not bepresent at the auction in person or by agent or by phone, we will usereasonable efforts to execute written bids received by us prior to theauction, and to purchase the property on the bidder’s behalf at the lowestpossible price keeping in mind other bids and the reserve. Such absenteebids must be received by us no later than the day before the auction andmust be in the currency of the relevant saleroom. If we receive more thanone identical absentee bid on the same lot, and at the auction these arethe highest bids, the lot will be sold to the bid that we received first.Execution of written bids is a free service offered as a courtesy, and we donot accept any liability for any error or failure that may occur in theexecution of written bids.
8. Telephone bidding. If a prospective buyer makes arrangements with usat least one day prior to the sale, we will use reasonable efforts to contactthem and to allow them to participate in the auction by phone. We offerthis free service as a courtesy, and do not accept liability for failure toreach the prospective buyer or for errors or failures in the execution oftelephone bids.
9. Internet bidding. At certain of our sales, bidders may choose toparticipate in the auction online. Prospective buyers who elect to bidonline are solely responsible for assuring that the equipment and softwarethat they are usingmeet the technological requirements for the use of theservice. We offer this free service as a courtesy and do not accept anyliability for (i) errors or failures in the execution of bids, (ii) technologicalfailures of any kind, whether on the Auctioneer’s or the bidder’s side.Online bids are subject to these conditions of sale and Business, as wellas the Bidder user’s terms and conditions available on ourWebsite.
10. Reserves and estimates. Unless otherwise indicated as described below,all lots are sold subject to a reserve, which is the confidential minimumprice below which the lot will not be sold. In no event will the reserve behigher than the low pre-sale estimate for the lot.TheAuctioneer may openthe bidding on any lot at any price below the reserve by placing a bid onbehalf of the seller. The Auctioneer may continue to bid on behalf of theseller, either by placing consecutive bids or by placing bids in response toother bidders, up to the amount of the reserve. No-reserve lots; where lotsare being sold without reserve, unless there are already competingabsentee bids, the Auctioneer, in his discretion, will generally open thebidding at approximately 50% of the low pre-sale estimate for the lot. Ifthere are no bids at that level, the auctioneer will reduce the bid until thereare responsive bids, and will then continue up from there. Absentee bidson no-reserve lots will, absent any higher bid, be executed atapproximately 50% of the low pre-sale estimate, or at the actual bid,whichever is lower. If there is no bid on a no-reserve lot, the auctioneermay deem the lot unsold. Estimates are provided as a guide only (save inrelation to the reserve as defined above) and are expressed in bold in thecurrency of the sale Session below each lot in the catalogue. For thebuyer’s additional convenience, and only as a guide, we also showindicative currency equivalents of the estimate in light type under each lot.These currency equivalents are rounded and based on the followingapproximate exchange rates at the time of the catalogue going to print($1.5450 = £1 = €1.1350)
11. Successful buyer and transfer of risk. Subject to the auctioneer’sdiscretion, the highest bidder recognized by the auctioneer will be thebuyer, and the fall of the hammer constitutes the conclusion of a contractof sale between the seller and the buyer. Risk and responsibility for thelot passes to the buyer 7 calendar days from the date of the auction, or oncollection or receipt by the buyer or his agents for shipping, whichever isearlier. In no event will the auctioneer be responsible for any damage topicture frames or glass contained therein. Any lot not paid for in full incleared funds and picked up or shipped within 7 days after the auctionare held by us at the buyer’s sole risk.
12. Payment. Buyer will pay as the purchase price the sum of the hammerprice, plus a buyer’s premium of 22% of :
(A) in Session I, the first £300,000; (B) in Session II the first €350,000; (C) inSession III the first $500,000 of the hammer price and in all Sessions 12% ofthe remaining amount of the hammer price and for the entire buyer’spremium, any applicable sales, VAT (as described in 13 below), use or othertax or fee (see section 24 belowwith respect to EuropeanArtist Resale Rightscharges). Payment in full, including all relevant taxes and fees must be madein cleared funds immediately after the auction, unless we have agreed inwriting to a different payment schedule. Any lot not paid for in full in clearedfunds and picked up or shipped within 7 days of the auction will be subject toa storage charge of £30/€35/$50 per month. In the event of late payment, theauctioneer also reserves the right to charge the buyer interest on any amountdue, which interest shall accrue at the rate of 1.5% per month, or the highestrate allowed by applicable law, whichever is lower.Title to the property will notpass to the buyer until all amounts due to us have been paid in full in goodcleared funds, even if we have agreed to release the property prior to receiptof payment.
13. VAT in London and Rome only. In addition to the hammer price the buyerwill be subject to the followingVAT charges:
(A) London:VAT at the rate of 17.5% will be applied to the buyer’s premium.Lots which are daggered (†) in the catalogue are subject to VAT on thehammer price as well as the buyer’s premium. Lots marked with anasterisk (*) have been imported from outside the EU to be sold at auction,and therefore the buyer must pay VAT at the reduced rate of 5% on thehammer price in addition toVAT of 17.5% on the buyer’s premium.
(B)RomeSession: VATat the rate of 20%will be applied to the buyer’s premium.
Where a buyer resides outside the EU and the purchased lot is to be directlyexported outside the EU it may be possible for him to reclaim some or all ofthe VAT due on either the hammer price or buyers premium (or both, asapplicable) and such reclaims are to be the sole responsibility of the buyerand the Auctioneer shall not be liable for the same.

14. Bidder is responsible. Unless the auctioneer has agreed in writing inadvance that a bidder is acting as an agent for a disclosed principalacceptable to the auctioneer, by bidding at the auction the bidder acceptspersonal liability to pay the full purchase price, as described in paragraph12, above.TheAuctioneer will only look to the buyer of record for paymentof the purchase price, and will only accept payment from the buyer ofrecord.
15. Compliance Matters. The buyer agrees to comply with any requests orinquiries that the Auctioneer may make to assure compliance withapplicable laws and regulations, including but not limited to compliancewith money laundering laws. Failure to comply may result in cancellationof the sale, at the sole discretion of the Auctioneer.
16. Payment required for release of purchases.TheAuctioneer reserves theright to retain sold items until payment in full in cleared funds has beenreceived of any amount owing to the Auctioneer or to any of its affiliatedor parent entities worldwide.
17. Liability of Auctioneer for inability to deliver purchased property.. In theevent that we are prevented by fire, theft or any other reason fromdelivering purchased property to the buyer, our liability to the buyer, if any,shall be limited to the purchase price paid by the buyer. Under nocircumstances shall we be liable for any compensatory, incidental orconsequential damages.
18. No liability for third parties. We do not accept any liability for the acts oromissions of third parties with respect to the packing, handling, shippingor storage of property, whether or not we have suggested them to thebuyer.
19. Customs issues. It is the sole responsibility of the buyer to ascertainwhether any item of property is subject to any export or similarrestrictions, and to obtain any necessary licenses or permits.The inabilityor failure to obtain any necessary licenses or permits to be able to exportproperty shall not affect the buyer’s obligation to pay for the property. Norshall it constitute a basis to rescind the sale of the property or to recoverany expenses, fees or damages from the auctioneer. With respect to theRome Session II, we draw buyers’ attention to the following: the Buyer,with respect to the lots declared of significant interest by the Italian State,shall comply with the provision set forth in the Legislative Decree No. 42of January 22, 2004 (so called “Codice dei beni culturali”). The export oflots by Buyers, both resident and not resident in Italy, is governed by theabove mentioned provisions of law and are also subject to customs,currency and tax-regulations in force. The Auctioneer shall not be heldliable for any restrictions on export of the sold lots or for any licenses orpermits that the Buyer must obtain under Italian law. In the event that theItalian State exercises the right of pre-emption, the Buyer shall not beentitled to receive either from theAuctioneer or from the Seller any refundof the interest on the sale price and on the commissions already paid tothe Auctioneer.
20. Failure to pay. if the buyer should fail to pay for property that hepurchases, theAuctioneer and the seller will have all of the rights allowedunder law, including but not limited to the following: (a) to charge interestas set forth above (b) to cancel the sale (c) to re-sell the property as wesee fit and to recover from the buyer any shortfall between the totalamount originally due to us, and the price on re-sale, plus any costs andexpenses of any kind arising from the default or the resale (d) to hold thebuyer responsible for the total amount due and to commence legal actionagainst the buyer to recover the full amount (e) to set off the outstandingamount owed by the buyer against any debt that we, or any of our affiliatedor parent entities worldwidemay have to the buyer (f) to apply any amountreceived from the buyer to discharge any amount owed to us by the buyer,regardless of how the buyer would prefer to allocate the payment (g) todeny the buyer the right to participate in any auction held by us or by anyof our affiliated or parent entities worldwide, or to require the buyer toprovide a deposit before being permitted to bid (h) to exercise all of therights of a person holding security over any property in our possessionowned by the buyer, whether by way of pledge, security interest or in anyother way, to the fullest extent permitted by the law of the place wheresuch property is located. The buyer will be deemed to have granted ussuch a security interest and we may retain such property as collateralsecurity for the buyer’s obligations to us (i) to pay the seller the totalamount originally due to him, or any portion thereof, in which event, wewill have the rights of the seller to pursue the buyer for that amount.
21. Copyright.As a general matter, the buyer will not acquire the copyright orreproduction rights in any purchased property, and neither theAuctioneernor the seller make any representation or warranty that the buyer willacquire any such rights.The copyright to the text of the auction catalogue,as well as the digital images and the illustrations in the catalogue belongto theAuctioneer.Youwill not reproduce or permit anyone else to reproducesuch text, images or illustrations without our prior written approval.
22. Severability. If any of the parts of these conditions of Sale and Businessshall be found by any court to be unlawful or unenforceable, such findingshall not affect the validity of the remaining provisions, which will remainbinding and valid to the fullest extent permitted by law.
23. Governing law and courts. These conditions of Sale and Business andthe respective rights of the buyer, the seller and theAuctioneer hereunder,or relating in any way to the conduct of the auction, will be governed andconstrued in accordance with:
(A) London; the laws of England andWales (B) Rome; the laws of the Republicof Italy (C) NewYork; the laws of the state of NewYork. By bidding at theauction, whether in person, by phone, on-line or by absentee bid, each biddershall be deemed to have submitted for the benefit of the Auctioneer, to theexclusive jurisdiction of the courts as detailed immediately above.
24. Artist’s Resale Right for London and Rome only. Lots marked with adelta symbol (δ) are subject to the Artist’s Resale Right European Law.The buyer agrees to pay theAuctioneer an amount equal to the applicableresale royalty and wewill pay such amount to the artist’s collecting agent.Resale royalty applies where (A) for London Session I lots the hammerprice is €1,000 or more and (B) for Rome Session II lots the hammer priceis €3,000 or more. The amount is calculated as follows with reference tothe hammer price and the total royalty amount per lot cannot be morethan €12,500:
4.00% up to €50,000 plus
3.00% between €50,001 and €200,000 plus
1.00% between €200,001 and €350,000 plus
0.50% between €350,001 and €500,000 plus
0.25% in excess of €500,000
Invoices will be issued in the currency applicable to each saleroom. For thepurposes of calculating the resale royalty threshold and amount for theLondon lots the £/€ rate of exchange will be the European Central Bankreference rate on the day of the sale.
LIMITEDWARRANTY FOR PROPERTY
1. TheAuctioneer warrants for a period of 5 (five) years from the date of theauction that the creator of each lot, the period, culture or origin identified(collectively the “authorship”) is as set forth in the BoldType heading atthe beginning of the catalogue description of such lot, as amended by anyoral or written saleroom notices or announcements, and any such noticesor announcements will be deemed to have altered the warrantyaccordingly. The Auctioneer makes no warranties whatsoever, whetherexpress or implied, with respect to any material in the catalogue entrythat is not in BoldType. Prospective bidders should refer to the GlossaryofTerms for an explanation of terms used in BoldType.
2. The warranty is not assignable. It is only available to the original buyer ofrecord (the “Buyer”), and is conditioned on: (i) the Buyer still being theowner of the property, (ii) the Buyer notifying the auctioneer in writingwithin three months of the Buyer’s having become aware of informationthat would call into question the accuracy of the warranted information;and (iii) the return of the property to the auctioneer by the Buyer in thesame condition as at the time of the sale to the Buyer.
3. Buyer’s sole and exclusive remedy under the warranty will be therescission of the sale and the refund to the Buyer of the original purchaseprice paid by the Buyer for the property, without interest.The Auctioneershall have the right to require that the Buyer obtain and provide to theAuctioneer the written opinions of two experts in the field acceptable toboth the Buyer and theAuctioneer, before the auctioneer decides whetherto cancel a sale pursuant to the warranty.
4. This limited warranty does not apply where (1) the authorship identified inthe catalogue is consistent with general scholarship at the time of theauction, or where the catalogue discloses that there is division amongstscholars; (2) the determination of the inaccuracy of the authorshipidentified in the catalogue requires the use of a scientific process thatwas not generally accepted at the time of the auction, or, in theauctioneer’s sole discretion, would have been unnecessarily expensive ormay have caused damage to the lot.
