Site Location

A

Site Visit and Scope of Works.

B The contractor is advised to visit and inspect the site and make himself thoroughly and completely informed as to thecondition of the site in its present state, the nature of theground and full extent and character of the Works to be executed, means of access and storage space, the conditionsaffecting the supply of labour and the availability and supply ofwater. No claim for extra payment above the Contract Sum will be paid to the Contractor for want of knowledge of any conditions affecting the execution of the Works.

C A brief outline of the scope of the works appears immediatelyinside the front cover of this document and the Contractor isto allow here any sum in respect of the scope of nature of theWorks.

Bills of Quantities.

D The pricing, Moneying out and totalling in these Bills ofQuantities is to be in INK throughout and is to be in NigerianCurrency. The bills of quantities shall not be used for orderingmaterials. Any discripances found between the quantities ordescriptions in the Bills and those to be ordered are reported tothe Quantity Surveyor immediately.

Drawings.

A The Contractor shall provide and do everything necessary forthe proper execution of the works according to the true intentand meaning of the drawings, whether the same may or maynot be particularly shown on the drawings, provided that sameis reasonably to be inferred therefrom. Figured dimensions are to be followed in preference to scaled dimensions.

B Allow for mounting one complete set of drawings on plywoodor other suitable rigid panels and keeping them on sitethroughout the Contract period.

C The Contractor shall give adequate advance notice to the Architect/S.O of requirements with regards to instructions, etc.and in the absence of advance written notification to the contrary it will be assumed that the progress of the Works isnot affected by the want of such notification.

Insurance Declaration

D On signing the contract, the Contractor shall obtain from hisinsurers and lodge with the Architect/S.O. a declaration thatthe insurance provided is strictly in accordance with clauses ofthe conditions of contract.

Setting Out

E The Contractor shall accurately set out the works and includefor providing all pegs, templates, instruments and labour necessary for so doing and as required by the Architect/S.Ofor checking this Works.

F Excavation shall not be commenced until the permission of theArchitect/S.O. is obtained.

G Allow for providing when required on the site a "Dumpy" orPrecise type level, complete with tripod and staff and allow for the free use of the leveling equipment by the Architect/S.O,Engineer or Quantity Surveyor.

Site Accommodation

H Allow for providing a suitable weather proof office on the sitefor the use of the Foreman-in-charge and other site staff andinclude for providing necessary furniture and lighting and clearaway on completion.

B The Contractor is to provide on site a First Aid Box or Cupboardprominently marked with the words "First Aid" for the purposeof treating any of his employees injured on site. The contents ofthis box or cupboard are to comply in all respects with the Factories Ordinance. The Contractor is to ensure that there is always adequate stocks in the First Aid Box or Cupboard whichis to be produced and opened for the inspection of the Architect/S.O. on request.

Watching and Lighting

C Allow for providing all necessary guards, day and night watchmen and lighting for the protection of the works and the safety of the public.

Hoardings and Barreirs

D Allow for providing all fans, gantries, hoardings guard rails, barriers, or any other form of special protection to all sides ofthe buildings and site as necessary to protect adjoining property,persons, vehicles and the like from injury.

Ordering of Materials

E Upon receipt of the order to commence the works, the contract-tor shall immediately place orders for all the required materialsand will be held responsible for any delays occurring due to thelate placing of such orders.

F The contractor shall, if so requested by the Architect/S.O. makeavailable to him all documents in connection with the orderingof materials for the works, showing agreed delivery dates,sources of supply and the like.

G If upon receiving quotations for any materials required for the works it appears that delivery by the dates quoted will delay theworks, the contractor shall inform the Architect/S.O. of this factbefore placing the orders.

Preliminaries.

Time and Progress

A The works shall be proceeded with in such sections andsequences as will affect completion of all works within the timefor completion or as directed by the Architect/S.O.

B Immediately upon signing the Contract, or before signing theContract, if requested, the Contractor shall in collaboration with Sub-Contractors submit to the Architect/S.O. for acceptanceprogrammed and progress charts to cover all activities on thesite and shall record progress thereon throughout the executionof the works.

C The Contractor shall arrange for representatives to attend sitemeetings as and when reasonably required by the Architect/S.O. and shall provide seating and other necessary facilitiesfor such meetings.

D The Contractor's attention is drawn to his responsibility for theco - ordination and programming of sub-contractor's work. TheContractor is expected to arrange suitable programmes with hissub-contractors and to check regularly that such programmes are adhered to. Where delays arise in connection with sub - contract works, the Contractor will be expected to have been awareof such at an early stage and to have taken appropriate actiondefined in the sub - contract document by the giving of such notices as may be required in preparation for determination of same. Determination shall not be affected without the priorconsent of the Architect/S.O. but requests for extensions of theContract period on the grounds of delay by sub - contractor willnot be considered unless the contractor can establishrequirements.

Materials found on the site

E Any sand, laterite, gravel, or other building materials discoveredon the site shall be property of the Employer and shall not beused in the construction of the Works without the prior writtenconsent of the Architect/S.O. The market price of the materials so used shall be allowed to the Employer by the Contractorand the Contract Sum adjusted accordingly. Precious articlesor antiquities found on the site shall be the property of theEmployer and shall be handed over to the Architect/S.O

D Allow for keeping such books, accounts and other documentsand records as are necessary to show the increases in costsincurred or the reductions obtained under Clause 31 of the Conditions of Contract and furnishing such books, accountsdocuments and records to the Quantity Surveyor or otherperson authorised to receive them at monthly intervals or asrequested throughout the duration of the Contract.

E In the event of adjustments arising under Clause 31 of theConditions of Contract, the Contractor shall submit monthlyfully priced out and totalled, statements showing the totaladjustments claimed, together with separate sheets relatingindividually to the various sub-contractors.

Protection of the works

F Allow for covering up and protecting from injury from weather orfrom any cause, all new work, also for supplying all temporarydoors, protection to windows and any other requisite protectionfor the whole of the works executed whether by the Contractoror special tradesmen or sub-contractors and any damage caused must be made good by the Contractor at his ownexpense.

G During inclement weather the Contractor shall suspend suchparts of the Works for such time as the Architect/S.O. maydecide and shall protect from injury all works then in the courseof erection.

Tests and Samples

A Allow for carrying out tests of any materials, either before orafter use in the works and for providing samples of all materialsand specimens of colours for approval as required by theArchitect/S.O. or Engineer before or application in the Works.

Covering Up

B No work shall be covered up until it has been examined andapproved by the Architect/S.O.

C In the case of work executed against provisional quantities inthe Bills of Quantities (and therefore subject to measurement) the Contractor shall notify the Quantity Surveyor before proceeding to cover up the Works.

Opening Up.

D The Contractor shall, at the request of the Architect/S.O. openup for inspection any work covered; and should the Contractor refuse or fail to comply with such request, the Architect/S.O.may employ other workmen to open up same. If the said workhas been covered in contravention of the Architect/S.O.'s Instructions and if on being opened up it be found not in accordance with the drawings or instructions of the Architect/S.O. , the expenses of opening up and covering up again,whether done by the Contractor or other workmen, shall beborne by, or recoverable from the Contractor or may be deductedas aforesaid. If the work has not been covered up in contravention of such instructions and be found in accordancewith the said drawings, etc. , then the expenses aforesaid shallbe borne by the Employer and be added to the Contract Sum.

Existing Installations

E Allow for protecting and maintaining all pipes, ducts and cablesmet in excavations, for keeping all ditches, gullies and channelsclear and unobstructed and for making good any damagedcaused to public or private roads, paths, kerbs and drains andpaying all costs and charges incurred.

Temporary Storm Water Drainage.

F Allow for ensuring that the whole of the site is kept free from therisk of stormwater flooding and providing such temporary ditches,gullies and the like as may be necessary and for subsequentlybackfilling such excavations and making good. Any damagearising from non-compliance with this clause is to be made good at the Contractor's own expense.

Prevention of Nuisance

A Allow for taking all necessary precautions with regard to theorder and method of execution of the work to avoid causingdisturbance or nuisance to the users and occupiers of existingbuildings and premises adjacent to the Works and for complyingwith any directions of the Architect/S.O. in this respect.

Access for Workmen

B The Contractor shall at all times give access to workmen employed by the Employer or by local or other authorities orany other parties and use of proper, sufficient, and if required,special scaffolding, hoists and ladders and provide them withwater and lighting, etc.

Delays

C The Contractor will be deemed to have made allowance for alldelays caused by difficulty in obtaining labour and materialsor suspension of part or the whole of the Works due to adverseweather conditions.

Overtime and Completion

D The whole of the Works are to be completed by the time statedin the Contract and no extra will be allowed in respect of overtime paid to achieve this.

E In the event of the Works falling behind programme for reasonsother than those which would entitle the Contractor to an extension of time under the Conditions of Contract, then theContractor shall, if so instructed by the Architect/S.O. arrange, at no extra cost, double-shift working on the site until such timeas progress on the site is in accordance with the programme.

F If overtime is specifically ordered in writing by the Architect/S.O.in respect of extra works, the net extra costs, over and abovenormal daily rates, will be paid to the Contractor.

Dismissal by Request

G The Contractor shall, on written request of the Architect/S.O. orhis representative on the site, immediately dismiss from the Works any person employed by him thereon who may, in the opinion of the Architect/S.O be incompetent or misconduct himself and such person shall not again be employed on the Works without the written permission of the Architect/S.O.

Imported Materials

A Where materials are to be supplied from outside Nigeria, thecost of such materials C.I.F., Apapa Docks together withlanding charges, duty and other Government taxes will be setagainst the P.C or Provisional Sum included in the Bills ofQuantities. The Contractor will be required to collect and clear the materials from Apapa Docks, handle, load and transportthem to the site and will be responsible for any loss or damageto the materials after they are landed; an item for this is included in the Bills of Quantities after the relevant P.C Sums.

Prime Cost Sums

B The following items in connection with prime cost sums are inaddition to the Contractor's obligations described elsewhere(for example, provision of scaffolding, etc.)

C Receipted vouchers for all articles for which prime cost amountsare included in the Bills of Quantities must be produced at thefinal settlement of accounts and the final certificate will not beissued until such receipts have been produced.

D The Contractor shall allow for checking Nominated Suppliers'invoices and quotations, etc., before placing orders in respectof P.C Items and shall be solely responsible for ensuring that allmaterials so ordered are sufficient and correct in quantity and contain due allowance for waste, etc.

E The Contractor shall allow for checking all materials suppliedby the Nominated Suppliers at the time of receipt on site,unpacking, re-packing and taking all necessary action in respectof insurance claims and the re-ordering of broken or damaged articles.

F Where the Contractor is required to 'Fix Only' materials suppliedby Nominated Suppliers or others, the rates inserted in the Billsof Quantities are to allow for taking delivery, stacking, storingand protecting until required, assembling as necessary andgetting into position before fixing.

Prime Cost Sums (cont'd)

A Where the term 'attendance' or 'attend upon' is used in the Billsof Quantities in connection with Nominated Sub-Contractor'swork, or work executed by others, the Contractor shall allow forthe use of standing scaffolding, canteens, sanitary accommod-ation, office accommodation, space for storage of plant andmaterials and for providing light and water and clearing awayrubbish and for taking delivery of all materials when received onthe site, unloading, handling, stacking or storing until requiredand hoisting into position. The Contractor shall allow for affordingmaximum co-operation in arranging that builder's work is carriedout, as far as possible to suit the convenience of the Sub-contractors.The Contractor shall obtain from the sub-contractors their require-ements for recesses, chases, holes and the like so that thesemay be formed correctly as the work proceeds. No extra chargewill be allowed for cutting chases, holes, etc., out of proper sequence.

Provisional Sums

B Work executed against provisional sums shall be measured andvalued in accordance with clause 11 of the Conditions of Contract with the exception that the cost of materials fallingwithin the scope of P.C items elsewhere in the Bills of Quantitieswill be offset against those P.C items.

Omission of P.C or Provisional Sums

C The Employer reserves the right to omit any P.C or ProvisionalSum from the Contract and no claim for loss of profit arising from such omissions will be entertained.

Direct Payment by Employer for Items covered by P.C orProvisional Sums.

D The Employer reserves the right to supply and pay direct for anyitems covered in this Contract by P.C or Provisional Sums.

E No adjustment will be made to the Contractor's profit and attendance on P.C Sums (whether expressed as a lump sum oras a percentage) should this right be exercised.

Advertisements

A The Contractor shall not display, or permit the display of anyadvertisement within the boundaries of the site or upon any temporary fencing, hoardings, plant, etc., save upon the writteninstructions of the Architect/S.O.

Site Board

B Provide and erect a site board showing the title of the Contract,names and addresses of the Consultants, Nominated Suppliersand Sub-Contractors and such other information as may berequired by the Architect/S.O who shall approve the design layout and colours of the board. Lettering shall be 'cut-out' plywood or plastic of an approved thickness, and shall be 100mm high for the main title, and 50mm or 38mm high elsewhere. The whole board shall be maintained in goodcondition, repainted as necessary, and removed when no longerrequired.

Clearing of Rubbish

C Allow for clearing away all shavings, cuttings and other rubbishas it accumulates from time to time during the progress of theWorks and on completion, including that of sub-contractors andspecial tradesmen and the disposal of all materials condemnedby the Architect/S.O.

Clearing on Completion

D Allow for cleaning down the whole of the premises includingcleaning glass both sides and cleaning off all floors, pavings,metalwork, finishings and fittings throughout, touching upgenerally and removing all stains, dirt and surplus materials andrubbish and leaving the Works and site in a clean and tidy condition and ready for immediate use, with all damage to property, roads, paths and drains, etc., made good to thesatisfaction of the Architect/S.O.

Defects after Completion

E Allow for inspecting the Works at the end of the Defects LiabilityPeriod and making good all defects in accordance with clause15 of the Conditions of Contract. Allow also for inspecting andmaking good such defects as may be of an urgent nature duringthe Defects Liability Period.
