Subject:- Disposal off of surplus/unserviceable/ obsolete items etc.

1. Properly sealed Tenders (PVC tape/wax) are invited by Divisional Engineer Telecom,

Telecom Project Division, Mangalore for and on behalf of Bharat Sanchar Nigam Limited (BSNL), from interested parties for the purchase of obsolete and unserviceable stores on “as is where is basis”.

A tentative list of items along with the quantity is available in tender document.

2. The term and conditions are as under:- i) The quotation addressed to the undersigned may be dropped in the tender

box kept at O/o DE, Telecom Project Division, 1st floor, Microwave Station Building, Ladyhil, Mangalore-06 latest by 02.08.2013 upto 13.00 hrs.

ii) Interested parties may send their quotation/tender in sealed cover marked “QUOTATION FOR THE PURCHASE OF OBSOLETE AND UNSERVICEABLE STORES”.

iii) The quotations/tenders will be opened in the presence of the Committee

Members and tenderers or their representatives who may like to be present.

iv) Interested parties may inspect the items physically at MICROWAVE STORE GODOWN AT LADYHILL, MANGALORE-575 006 on any working day from

18.07.2013 to 01.08.2013 between 10 AM to 5 PM.

v) The items can be removed only on acceptance of the bid of the successful bidder on the same day after depositing bid amount in the form of DD drawn in favour of Accounts Officer, O/o Sr. General Manager, Transmission Projects, Bangalore.

vi) A bank draft of Rs.500/- as earnest money in favour of Accounts Officer,

O/o Sr. General Manager, Transmission Projects, Bangalore drawn from any Nationalized Banks is to be enclosed with tender document.

vii) This Department reserves the right to reject any or all the quotations/tenders

without assigning/giving any reason thereof. The decision of the Competent Authority in this regard shall be final and binding on all tenderers.

viii) Tender Document can be purchased by producing DD from any Nationalised Bank for Rs. 105/- drawn in favour of Accounts Officer, O/o Sr.GM, TP, Bangalore (Non refundable) payable at Bangalore issued on or after the date of NIT. Non MICR DDs will not be accepted. Those who desire to get Tender document by SPEED POST/ REGD POST are requested to send Rs. 105/- in addition to the cost of the tender document towards postal charges. BSNL will not be responsible for any postal delay.

SECTION - II

SPECIAL TERMS & CONDITIONS:

1) BHARAT SANCHAR NIGAM LIMITED, the owner/seller will be hereinafter referred to as PRINCIPAL.

2) All the materials put up for sale will be on "As is where is basis" and "No Complaint Basis”. PRINCIPAL reserve the right to accept/reject any offer/bid without specifying any reason thereof. All quantities are only estimates and without any guarantee.

3) INSPECTION OF MATERIALS:

The interested parties in bidding may inspect the materials lying at the specified locations by producing their proof of identity. Inspection will be allowed by the Principal with prior appointment from the principal. Inspection will be limited to visual checking only. Any clarification required may be sought by the bidders at the time of inspection and no dispute regarding its physical conditions/location will be entertained thereafter.

4) VALIDITY OF BIDS: i) All Bids will be valid for acceptance by BSNL for a period of 180 (One Hundred and Eighty) days from the date of closing of open tender.

ii) The Bidder shall submit as a part of his bid, bid documents in original dully signed on each and every page establishing the conformity of his bid to the bid documents.

5) VALIDITY OF CONTRACT: Upto the validity period of the Delivery Order / Release

Order issued by PRINCIPAL or upto the extended period of validity of the Delivery Order / Release Order in case the Delivery period is extended by the PRINCIPAL on his sole discretion as the case may be.

6) SALE INTIMATION: Tenders received will be opened in the presence of available bidders on the date of opening. A committee will evaluate the tenders and the highest bidder will be declared, if the competent authority accepts the highest bidder’s quoted rate. Sale Intimation Letter (SIL) will be issued to the Highest Bidder advising him to deposit the prescribed Earnest Money Deposit (EMD) / Security Deposit (SD) within the stipulated time. However issue of SIL is only for record purpose and has no bearing on payment of post bid EMD/ SD.

6.1 Upon acceptance of the auction bid the buyer shall have to pay Earnest Money @ 25% (unless mentioned otherwise) against accepted bids positively within 7 days of confirmation of bid by Demand Draft on any Nationalized Bank in favour of AO, BSNL,O/o Sr.GM, TP, Bangalore. Demand Draft issued by any Co-operative Bank will not be accepted.

7) SECURITY DEPOSIT (SD):

7.1 Upon acceptance of the auction bid the buyer shall have to pay Security Deposit @ 10% against accepted bid positively within 7 days of confirmation of bid by Demand Draft on any Nationalised Bank in favour of AO, BSNL, O/o Sr.GM, TP, and Bangalore. The EMD / SD amount shall be adjusted with the material value of the final instalment.

7.2 All offers shall remain valid for a period of 180 (One Hundred and Eighty) calendar days from the date of close of tender which may be extended for any further period of time as may be mutually agreed upon.

7.3 UPON ISSUANCE OF ACCEPTANCE LETTER/SALE ORDER, FULL MATERIAL VALUE PAYMENT FOR EXISTING QUANTITY IS TO BE MADE.

7.4 Non-submission of EMD / SD within the stipulated time will lead to deactivation and deregistration of the concerned buyer and the registration fees shall be forfeited.

7.5 SD must be remitted by way of DD of any Nationalized Bank in favour of AO, BSNL, O/o Sr.GM, TP, Bangalore and it may be submitted to DE, TPD, Mangalore. SD is adjustable towards material value only after receipt of the balance material value along with

applicable duties & taxes within the due date. If the Security Deposit is not received within the due date, the sale will be treated as cancelled and the bidder will be barred from participating in similar tender under the division for 6 months and EMD given by such bidders shall be forfeited by and with BSNL. In case the successful bidder pays the SD but fails to pay the balance material value along with applicable Duties and Taxes within the due date, the SD will be forfeited. 8) PAYMENT OF BALANCE SALE VALUE/DUTIES/TAXES: 8.1 On receipt of SD by BSNL, Sale Order/Acceptance Letter will be issued by O/o DE, TP, Mangalore to the successful bidder advising him to deposit the balance material value along with all applicable duties and taxes within 21 (Twenty One) days from the date of confirmation of bid (including the date of tender)

8.2 Balance Payment for existing quantity along with Sales Tax/VAT, income tax as applicable at the time of lifting will be required to be made within 21 (Twenty one) days from the date of Confirmation of the bid in the form of Demand Draft in favour of AO, BSNL, O/o Sr.GM, TP, Bangalore. The Demand Draft must be deposited at O/o DE, TPD, Mangalore for issue of Delivery Order. In case, the last day of payment happens to be a Closed Holiday for BSNL or the Banking Institutions, the next working day will be taken as the day of payment without late payment charge.

9) DEFAULT IN PAYMENT: In case of default in making payment within the prescribed time limits specified herein above, the due payments may be made together with additional charge @1% (one percent) per week or part thereof on the material value, within a period of 14 calendar days from the date of the expiry of the free payment time. However, Principal reserve the rights to accept or not to accept sale value with additional charges after expiry of 14 days as mentioned above.

10) DELIVERY:

10.1 On payment of balance sale value along with applicable Duties and Taxes to BSNL, the Buyer shall obtain Delivery Order from O/o DE, TP, Mangalore on producing his proof of identity. Delivery Period will be 30 days from the date of issue of Delivery Advice by the Principal as per their sole discretion including the date of issue.

10.2. Ground Rent: @ 1% per week or part there of beyond 30 Days will be levied and up to 2 weeks maximum, provided written request is received before the expiry of 30 days free lifting period. If no such request for extension is received, the sale order stands cancelled & security deposit forfeited on completion of 30 days of free lifting period.

10.3 For delivery, buyers must report by 10.00 AM on working days in the respective unit of BSNL. In case the last day of delivery happens to be a Closed Holiday for BSNL, the next working day will be taken as the date of lifting without any Ground Rent. Buyers must produce the Delivery Advice issued by the Principal to the respective unit of BSNL at the time of taking delivery of the materials.

10.4 Purchasers are advised in their own interest to make appointment with the owner before placement of vehicles for taking delivery of the materials purchased by them within the scheduled date of delivery. The purchaser at his own cost will make his own arrangement of removal, dismantling, loading, transporting and he will not be entitled to claim any facility or assistance or cost on this account from BSNL.

10.5 The materials sold shall be removed by the buyer from any one side of the lot as per

the sole direction of the Principal and no segregation of items from the sold lots will be permitted.

10.6 In case any hot work permission is required for dismantling operations, the same will have to be obtained by the buyers from the Principal's authorized representative before lifting and it will be sole discretion of the Principal to allow such hot work permission.

10.7 For the purpose of removing the materials, the successful Bidder shall employ or engage only his/their own personnel and shall keep the representative of the Principal fully indemnified against any claims what so ever including claim for wage, injuries, compensation, death etc.

10.8 While removing materials, if any accident or damage to the property/life etc. arises

by reason of any act of negligence/omission/default or non compliance with any of the Terms & Conditions or statutory regulations or rules and regulations applicable within Principal's premises, on the part of the Bidder's/his representative or employees resulting in death or injury to any persons or damages to the property of Principal or any third party then in such an event the Bidder will have to pay compensation to any such person including the employees of Principal for such an event keep Principal indemnified from any demand, claims or proceedings made.

11) SALES TAX: Sales Tax as applicable must be deposited only in favor of AO, BSNL, O/o Sr.GM, TP, Bangalore (in separate DD) only as mentioned in Acceptance letter. 12) INCOME TAX: Income Tax @1% or as applicable on purchase price will be charged. Purchase price means base price + other taxes & duties. Exemption will be given

to manufacturers and processors on production of exemption certificate from the concerned assessing officer of the income tax department. Exemption is not available to retailers / traders. 13) FORFEITURE OF EMD/SALE VALUE : 13.1 In case the whole or any part of the goods sold remain uncleared, even after the authorized period stated in the delivery schedule, the purchaser shall have no claim whatsoever on the goods remaining un cleared and the amount paid to BSNL including EMD shall stand forfeited at the expiry of the said period. BSNL shall have the right to dispose of such goods in any manner it likes. The purchaser will have no right whatsoever to any compensation.

13.2 In case of non-submission of balance material value, the EMD shall be forfeited without further notice and the defaulting bidder will be deregistered and deactivated and the registration fee shall be forfeited. 14) DELIVERY OF THE MATERIALS: 14.1 The buyer(s) shall place their vehicle for scrap lifting by 10 am to 12 am as per

programme on working days and ensure that loaded vehicles are taken out from our scrap yard by 5 pm positively. Vehicle with scrap materials loaded on it will not be allowed in the scrap yard for night stay. In case the last day of delivery happens to be a Closed Holiday for BSNL, the next working day will be taken as the date of lifting without any Ground Rent. Buyers must produce the delivery order issued by BSNL at the time of taking delivery of the materials.

14.2 Purchasers are advised in their own interest to make appointment with the principal before placement of vehicles for taking delivery of the materials purchased by them within the scheduled date of delivery. The purchaser at his own cost will make his own arrangement for removal, dismantling, loading, transporting and he will not be entitled to claim any facility or assistance or cost on this account from BSNL. In the event of sufficient quantity of material is not available for delivery, BSNL shall refund all the amount received

from the bidders on ~Pro-rata basis~. No claim shall be entertained by BSNL for loss of profit, damage or interest. The segregation of material is not allowed. 14.3 If required, Weighment of empty and loaded trucks shall be done at weighbridge at random & weight in the printed weighment slip will be final for a particular truck and the same will be binding on the buyer.

14.4 BSNL, as the Seller has the sole authority to accept or reject any offer without assigning any reason whatsoever. 15) In case of any dispute regarding payment/delivery or any other matter relating to this open tender , the decision of BSNL shall be final.

16) DEFAULT IN LIFTING: In case the whole or any part of the goods sold remain

uncleared, even after the authorized period stated in the delivery schedule, the purchaser shall have no claim whatsoever on the goods remaining uncleared. It will be the sole discretion of the Principal to extend the lifting period with or without ground rent after expiry of the stipulated free lifting time depending on the merit of the case. In the event of the Principal not allowing any extension of lifting time, the sale of materials will be automatically cancelled and all the monies paid by the Bidder/Buyer will be automatically forfeited. The BSNL shall have the right to dispose of such goods in any manner it likes. The purchaser will have no right whatsoever to any compensation. If the lifting time is extended by the BSNL, the ground rent will be same as applicable for delay in making the due payments to BSNL.

17) STATUTORY PAYMENTS: The rate of Excise duty, Sales Tax or any other statutory Duty/Tax/Levy/Charge etc. will be applicable and payable by the buyer as prevailing on the date of actual physical delivery of materials. 18) N O T E: If the successful highest Bidder ( Confirmed or Provisional/Subject to Approval) fails to pay the EMD/Security Deposit in time from the date of issue of Sale Intimation Letter , then he shall be DEBARRED for a minimum period of 6( six) months from participating in all disposal sales by the division and his EMD/SD Fee will be forfeited.
