MEMORANDUM OF AGREEMENT
between
The Village of Salmo
and
Canadian Union of Public Employees, Local 2087
This Memorandum of Agreement between the parties constitutes final settlement of all outstanding collective bargaining issues with respect to the new Collective Agreement.
All of the terms and conditions of the previous Collective Agreement will remain in effect except as set out in this document.
This Memorandum of Agreement is subject to ratification by the principals of the parties hereto and both parties agree to recommend, to their respective principals, acceptance of all terms and conditions herein.

ARTICLE 1 - RECOGNITION OF THE UNION
1.14 Access to Personnel Files
An employee shall be entitled to review records kept in his or her personnel file, both paper and electronic form, during the Village's regular office hours and by appointment with the Chief Administrative Officer and in the presence of the Chief Administrative Officer.

ARTICLE 3 - TECHNOLOGICAL CHANGE AND AUTOMATION
3.05 Training Programs
The Village encourages the development and training of its employees.
a) Where an employee decides to enter into a training program which is of potentially benefit to the Village, the Village may, at its discretion, provide training assistance in the form of time off with pay, or tuition, or books and related teaching aids, or any combination thereof.
b) Where an employee decides to enter into an apprenticeship program in a trade where the Village employs a licensed journeyman, the Village may, at its discretion, provide assistance as defined in this paragraph.
c) On being accepted as a journeyman apprentice by the appropriate provincial authorities, the employee's job classification shall be ''(name of the
trade) Apprentice" and the pay grade shall be that of "Utility Operator in i§> Training~" for the duration of the apprenticeship. The Village shall
maintairrthe income level of a journeyman apprentice during the required ~etendance at the vocational school. An apprentice shall accrue seniority
/~ and shall be entitled to Superannuation and to all other benefits enjoyed by the Village bargaining unit employees.

ARTICLE 11 - HOURS OF WORK, OVERTIME AND WAGES
11.01 'Norks Department
The regular hours of v.;ork for the vli'orks department shall consist of avo distinct weekly schedules to be '/v'orked in alternating cycles.

at-P1onday to Friday, 8 hours per day worked beaveen 1 AP1 and 3:30 PP1 with a 30 minute lunch break. In addition at some point bea\'een the hours of 2:00 PP1 Saturday and 10 AP1 Sunday, an employee on 'Neek "A" shall perform a prescribed inspection of the Village sewer treatment facility and perform such maintenance 'lv'ork at the sewage treatment plant as may be indicated by such inspection. The inspection and related maintenance work shall be deemed to have a duration of 2 hours. In the event that an inspection and related maintenance 'Nork shall exceed a total of 2 hours, the time in excess of 2 hours shall be paid at the applicable overtime rate.

Summer Schedule April 1-October 31st
Hours of Work: Monday to Friday 7:00 am to 3:30 pm with a thirty (30) minute lunch break and two fifteen (lS) minute rest breaks. These hours are subject to change for operational requirements.

ARTICLE 11 - HOURS OF WORK, OVERTIME AND WAGES
11.02 Administration Department
The regular working week for the Office Staff is five (5) days per week, 8 hours per day worked between 8 AM and 4:30 PM during which period employees are entitled to two (2) fifteen (15) minute rest breaks and witft a thirty (30) minute lunch break, for a total of forty (40) hours per week.

ARTICLE 11 - HOURS OF WORK, OVERTIME AND WAGES
11.05 All time worked in excess of the hours of work stipulated in articles 11.01 and 11.02 shall be considered as overtime.
All overtime shall be paid for at the rate of time and one half (1112) for the first four (4) hours in any day and double time (2x) thereafter.

ARTICLE 12 - STATUTORY HOLIDAYS AND ANNUAL VACATIONS
12.09 Vacation Usage
Vacations shall be taken during the calendar year following the year in which vacation credits were earned.
Employees must book their vacation on or before the first day of May in each year, vacations must be scheduled in such a manner as to ensure that no more than one employee in a department (administration or public works) is absent on scheduled vacation at the same time. If employees fail to reach a voluntary vacation schedule, the Village shall prescribe the vacation schedule for the year, and the Village's schedule shall be final.
If an employee is unable to schedule their vacation, the employee will have the option to carry-over up to five (S) days of his vacation or get paid out for the vacation entitlement.
Vacation arranged as carry-over is paid at rate and under conditions applicable when vacation is taken.
Employees will notify the Village in writing by December 1 if they intend to carryover or be paid out for their vacation entitlement.

ARTICLE 13- GENERAL PROVISIONS AND CONDITIONS OF EMPLOYMENT
13.01 Public Works Clothing Allowance
The Village shall pay each full time public works emplo)'ee a safety clothing and FoOBvear allmvance not to exceed UNO hundred dollars ($200.00) in each 'lear of this agreement.
A Public Works employee shall, on presentation of an invoice for repairs or proof of purchase, be entitled to an annual safety boot allowance to a maximum for two hundred and seventy five ($275.00) dollars.
All employees shall be supplied with all necessary safety tools and equipment as required. The Employer will supply safety gloves, safety goggles and hard hats as required. The Employer will provide coveralls to those employees working outside including garage and treatment plant operators, and shall provide a washer and dryer for cleaning and will be responsible for repair and replacement of the coveralls provided.

13.04 Use of Personal Vehicle
When employees are required to use their personal vehicles for village business they shall be reimbursed at ~ fifty ($O.50) cents per km or as per village bylaw whichever is greater.

ARTICLE 14 - SICK LEAVE
14.03 Sick Leave Pay
In the event of illness as defined in article 14.01, a full-time or regular part-time employee shall receive pay at the base rate (exclusive of all differentials) received on the last working day prior to such illness.
Sick leave will accrue from the date of hire but cannot be taken until after the probationary period.

ARTICLE 16 - BENEFITS AND HEALTH CARE PLANS
16.05 Medical Plan: Vision Care Benefit
All eligible full-time and regular part-time employees shall be entitled to participate in a vision care benefit as part of the Extended Health Benefit Plan. The benefit shall provide prescription coverage of three hundred and fifty dollars ($350) five hundred ($500.00) dollars every eighteen (18) months. 24 months.
The Village shall contribute 100% of the total cost of the premiums for the Vision Care Benefit including the cost of the exam.

ARTICLE 16 - BENEFITS AND HEALTH CARE PLANS
NEW 16.11 Regular Part-Time and Casual employees who are not eligible for
benefits shall be entitled to fourteen (14) percent premium on every pay cheque in lieu of benefits. Such benefits include: vacation pay, statutory holiday pay, sick leave, bereavement, group life, disability, medical, extended health and dental coverage.

ARTICLE 19 - WAGE SCHEDULES, ATTACHMENTS AND ADDENDUM
19.03 Ambulance Attendants
The Employer agrees that an employee required to provide emergency ambulance services shall not suffer a loss of seniority.
With the exception of extreme emergencies, an employee required to provide emergency ambulance services shall not be on-call for the ambulance during their regular hours of work.

Summer Student
When the public works foreman or the Chief Administrative Officer are absent from their regular scheduled hours of work, the highest qualified employee in that department shall assume acting responsibilities, and shall be paid $1.50 $2.00 per hour in addition to his or her regular rate of pay.

UTILITY OPERATOR IN TRAINING
ACCOUNTABILITY Reporting to and taking direction from the designated supervisor.
SCOPE Learn and perform the operation and maintenance of the municipal water and sewer systems, municipal infrastructures and assets.
QUALIFICATIONS Course for Operator in Training Valid B.C. class 3 drivers license with air brake endorsement. Knowledge of Workers Compensation safety regulations. EOCP Water Distribution Level I Certification. Working experience in the operation of heavy eqUipment. Competence in the use of construction tools. Thorough knowledge of municipal infrastructure and utility systems.

PUBLIC WORKS FOREMAN
ACCOUNTABILIlY
SCOPE Reporting to and taking direction from the Chief Administrative Officer.
Providing direction, being accountable for, and participating in the operation and maintenance of the municipal water and sewer systems, municipal infrastructure, and municipal assets.
QUALIFICATIONS Valid B.C. class 3 drivers license with air brake endorsement. Knowledge of Workers Compensation safety regulations. EOCP Water Distribution Level II Certification. EOCP Wastewater Treatment Level II Certification. EOCP Wastewater Collection Level I Certification. Working experience in the operation of heavy equipment. Competence in the use of construction tools. Thorough knowledge of municipal infrastructure and utility systems. Report writing. Project planning.
SPECIFIC DUTIES Supervision of public works employees and contractors. Write and submit such reports on the Public Works activities, municipal services, and infrastructure conditions as may be required from time to time. Assist in the preparation of Annual O&M and Capital Budgets. Responding to the public inquires concerning public works matters and relaying these inquires to the Chief Administrative Officer.

The Village and CUPE agree that ~4s. S8'ovatsky, retired Deputy Clerk Treasurer, will continue to 'o'o'ork for the Village of Salmo's Administration in the capacity of an independent contractor to the end of April 2008. ~4s. Sa'o'o'atsky is not an employee of the Village of Salmo and is therefore not subject to the Village's Collective Agreement 'o'o'ith CUPE.
The Village and CUPE agree that the case of ~4s. Sawatsky is exceptional and that any and all other persons to be employed by the Village 'o'o'ill be employed pursuant to the terms and conditions of the Collective Agreement.

RE: Public '.''lorks Supervision
CUPE aclmo'Nledges that the Village is in the process of evaluating the manner by which supervision should be provided for the Public Works Department.
Council antiCipates that this evaluation 'Nill be completed by the end of April 2007. Council and CUPE agree that, once the Village has completed this evaluation, the staffing aspects of the Public 'Norks Department's supervision 'v'v'ill be negotiated by the Village and CUPE, and the terms VII'ili be incorporated in the Collective Agreement.
Until the matter of Public ',Norks Supervision has been resolved, the acting pay provision of Schedule "A" shall not apply to the Public VVorks Department.
The Village and CUPE are committed to negotiate this matter in good faith. HO'vvever, should the parties nonetheless fail to reach an agreement by September 30, 2007, the parties agree to resolve their differences through arbitration.

RE: Mr. Fritz Gramm
The Village and CUPE agree that Mr. Gramm, Public Works Foreman, will remain in the position of Public Works Foreman.
The Village requires Mr. Gramm to complete his EOCP Water Distribution Level II, EOCP Wastewater Treatment Levels I & II, and his EOCP Wastewater Collection Level I, as per the qualifications for the Public Works Foreman position.
The Village of Salmo will enrol Mr. Gramm in Wastewater Treatment I from February 28-March 4th in Cranbrook. Should Mr. Gramm fail to qualify for this required certificate in his second attempt, he will be deemed to no longer hold the required qualifications for the Foreman position, and will be returned to the position of Operator-in-Training. (as per Article 13.03 of the Collective Agreement). Upon successful completion of Wastewater Treatment I on his next attempt, the Village would then enrol Mr. Gramm in the next required course. Should Mr. Gramm fail to qualify for these required certificates in his second attempt, he will be deemed to no longer hold the required qualifications for the Foreman position, and will be returned to the position of Operatorin-Training. (as per Article 13.03 of the Collective Agreement).
The Village and CUPE agree that Mr. Gramm's wage shall be "red-circled" and stay at the current rate until he holds the certification required for his position.
The Village and CUPE agree that the case of Mr. Gramm is exceptional and that any and all other persons to be employed by the Village will be employed pursuant to the terms and conditions of the Collective Agreement.

RE: Hours of Work for Lyn Lewis Deputy Clerk/Treasurer
The Village of Salmo and CUPE Local 2087 hereby agree that Lyn Lewis will work in the position of Deputy ClerkjTreasurer thirty-two (32) hours a week from Tuesday to Friday with the following provisions:
1. This position will be maintained as a forty (40) hour work week as per the Collective Agreement.
2. Lyn Lewis will be eligible for all benefits as per the Collective Agreement.
3. Regular vacation pay will be as per the Collective Agreement.
4. Regular sick leave will be as per the Collective Agreement.
It is agreed by both Parties that this Letter of Understanding may be terminated by either Party with thirty (30) days notice and the hours of work in the Deputy Clerk/Treasurer will be forty (40) hours per week as per Article 11 of the Collective Agreement.
