A.

OCCUPANCY AND USE

1. Villas shall be used exclusively for single-family residences only, not a business.

There shall be a limitation on the number of permanent occupants to five for any Bella Vista Unit. However, six persons may occupy a three-bedroom unit for a period not to exceed two weeks maximum.

2. No unit may be rented more than twice in any calendar year. There is a one-month

minimum rental period.

3. No unit owner or tenant shall do or permit any act or failure to act which shall cause any insurance policy on the villas to become void or suspended, or which would cause any increase in premiums payable by the Association.

4. No unit owner or tenant shall make or permit any noises that will disturb or annoy

the occupants of any of the units or permit anything to be done which will interfere with the rights, comfort or convenience of other unit owners/occupants.

5. Each owner/tenant shall be held responsible for the actions of his family members,

lessees or guests.

6. Each resident is expected to provide his own laundry and drying equipment. No visible drying of laundry will be permitted outside a villa.

7. No articles of any kind may be draped over or on any fence or common area.

8. No lot owner or other occupant shall in any way deface or change the color of the

exterior of his villa, the roof, the patio fence, or any other exterior surfaces. 9. No sign, notice or advertisement shall be displayed by residents or others in villas

or on any common areas. Exception: Open house directional signs may be displayed during an open house between the hours of 11:00 a.m. and 6:00 p.m. Open house directional signs still on the campus at 6:00 p.m. will be removed and discarded by the association. (Rev. March 2006)

10. Any damage to common elements, the recreation areas or equipment of the

Association caused by any unit owner/tenant, family member or guest shall be repaired or replaced at the expense of such unit owner/tenant.

11. No films, foils or any other material excepting neutral colored drapes, shades or blinds shall be placed on any windows of any villa.

12. No radio or television antenna, nor any wiring for any purpose, may be installed on

the exterior of the villa without the approval of the Board of Directors.

13. The breezeways and courtyards of a particular villa shall not be obstructed or used for any purpose other than ingress and egress to the respective villas. No articles of any kind (including, but not limited to, toys, furniture, recycling bins, etc.) belonging to villa owners/occupants will be kept in the common courtyard areas either temporarily or permanently. Villa owners may store bicycles and only bicycles under the overhang in the area between the courtyard privacy fence and their villa.

14. Each lot owner shall, at his expense and as part of the electrical system serving his

villa, be obligated to keep lighted the exterior wall light and trellis light adjacent to his villa. Electrical current shall be supplied to the light fixture at all times at the expense of the lot owner. The Homeowners Association shall maintain the light bulbs, fixtures and photoelectric cells in good working order.

15. Barbeques are permitted in villa private patio areas only and at the recreation

center in the specific designated area immediately adjacent and east of the racquetball courts.

16. SKATEBOARDS AND BICYCLES: a. Skateboarding or bicycle riding in the entrance courtyards is not allowed. b. No skateboarding after dark. c. No bicycling after dark unless bike is equipped with lights and/or

reflectors.

17. There shall be official bulletin boards located at the clubhouse and at each mailbox area on which all official notices will be posted. Notices from Bella Vista residents only will be permitted. Real Estate and commercial advertising notices are not permitted.

B. PETS

1. Pets may be kept in villas by unit owners only.

2. Pets shall be confined to the owner’s villa or be on a leash at all times when outside the villa as required by the leash law of the town of Jupiter.

3. No pet of any kind may be kept that, in the sole discretion of the Board of

Directors, creates a nuisance to the neighboring residents.

4. Pets shall be restricted to small domestic birds, fish or two animals (two dogs or two cats or one dog and one cat), each weighing 30 lbs. or less. (Rev. March 2007)

5. Owners of each pet are required to clean up after the pet in order to maintain the

common areas in good order and as a matter of common courtesy to other residents.

6. Those in violation of the above rules shall have 48 hours to comply after which a

fine of $50.00 per day will be imposed for each day of violation thereafter, as set forth in section H-1, page 8.

C. VEHICLES

1. All owners, renters or guests occupying a unit should register their vehicle with the Association. Parking permits will be issued to renters/guests and must be displayed on the vehicle dashboard for the duration of their stay.

The only resident owned or leased vehicles permitted in the community are passenger vehicles, mini-vans with windows and some SUV’s. Only these vehicle types are allowed with the limitation that no SUV may exceed a wheelbase of 119”. No resident may have an otherwise authorized vehicle displaying advertisement on the premises. Overnight parking (after 10:00 PM), anywhere in the complex, of the following is prohibited:

• Trucks, vans, boats, trailers or motor homes of any type. • Vehicles displaying any advertisement. • Vehicles deemed unsightly by the Association (such as, but not limited to,

severely rusted or wrecked, but drivable vehicles). (Rev. November 2007)

2. Unlicensed motor vehicles may not be operated or stored on the common areas or

paved areas.

3. No part of the villas common areas or parking areas or roadways shall be used for working on or maintaining automobiles except for normal automobile washing by a villa occupant of his/her vehicle.

4. Automobiles leaking oil, gas or other fluids should be removed from the parking

areas and kept off the site until the problem is corrected. All costs incurred in the cleaning and repair of the parking area will be assessed against the owner of the unit.

5. Vehicles may be parked only in the areas designated for that purpose. Each lot

owner is permitted the exclusive right to park in two particular spaces assigned to him for that purpose. No one else shall park in such parking space without the owner’s permission. Residents will confine parking of vehicles to the two spaces provided.

6. Parking on the grass, or overnight parking on the roadway is not permitted. All

owners, lessees and guests should be aware that the Association has the right to have the offending vehicles towed away at the owner’s expense after having attempted to notify the owners of such vehicles.

7. Maximum speed is 15 miles per hour. Speeding and careless driving will not be

permitted.

D. GROUNDS AND MAINTENANCE

1. Residents or owners desiring to plant any type plant, shrub or tree any place outside of their privacy patio must obtain approval through the Board

2. No irrigation connections for personal use can be made to the central irrigation system of the Bella Vista complex.

3. Only maintenance personnel will be permitted to handle the irrigation system.

4. Only Unit owners may request reservations of the clubhouse for their personal use. The secretary will make approval for use. At the time of notification of approval, the following monies will be collected:

a. A fee of $150.00 is required for use of the clubhouse for a private party. b. A damage deposit of $150.00 are required for the use of the clubhouse.

These fees will be refunded at the discretion of the Board of Directors.

E. SALE AND LEASE PROCEDURES

1. Within fourteen days of the time the owner enters into an agreement for sale or lease of his unit, he must notify the Homeowners Association secretary in writing and:

a. Have a Bella Vista homeowner’s official Application to Purchase or Lease Form fully completed and signed, accompanied by an application fee of $75.00 payable to the Bella Vista Homeowners Association.

b. The form for the purchase or lease will be in accordance with the established Bella Vista Homeowners Association documents and must be signed by the buyer/renter and the owner prior to lease agreement or closing of sale and submitted to the secretary of the Association two weeks prior to occupancy.

c. The application form will be acknowledged and approved by the Association when it is clear that all Association fees, assessments, penalties or other financial obligations of the seller/lessor/tenant have been satisfied.

2. A meeting with the welcoming committee of the Association is required for the

purpose of reviewing with the prospective tenants or new owners the amenities and the Rules and Regulations of Bella Vista prior to taking possession of the unit.

3. If a villa is to be occupied by relatives or friends in the owner’s absence, the owner

should notify the association in advance of occupancy using the residency notification form. (Rev. March 2007)

F. GARBAGE/TRASH

1. Disposition of garbage shall only be with the garbage disposal in the units, or in containers which must be kept within the assigned fenced enclosures. Each resident shall securely seal all garbage in plastic garbage bags, place inside assigned garbage cans and secure lid in place. Each resident is responsible and

accountable for the compliance of all family members and visitors. Garbage pickup is currently scheduled on Wednesdays and Saturdays.

2. Trash that will be placed outside of the trash area is to be placed no earlier than the

day before normal pickup. (Rev. March 2008)

3. General trash (i.e. appliances, rubbish, wood boxes, cardboard containers, furniture, carpeting, etc.) shall be disposed of by the resident by calling a commercial service for this purpose at his own expense or removing it from the Bella Vista premises himself.

4. Recycling items are to be disposed of in the recycling bins and should be placed

near the trash enclosures on Tuesday, and no sooner, for pickup on Wednesday.

5. Recycling bins must be kept within the villa privacy patio. G. ENFORCEMENT AND PENALTIES

1. If, after receipt of written notice by the Association of any violation of any Bella

Vista rule or regulation, and upon failure to immediately comply or to initiate a remedy for such violation, the Association shall have the right to impose a fine of $50.00 per day up to $1,000.00 on said unit owner. The owner has the right of appeal before a committee appointed by the Board in compliance with Florida statute 720.305. The funds shall be deposited to the general maintenance account of the Association. In the event the fine is not promptly paid (i.e. within 10 days), the Association shall have the right to seek appropriate legal action against said unit owner in order to obtain payment of the fine and, in addition, shall be entitled to a judgement for all fees and costs in such an action. (Rev. March 2007)

2. Failure of a tenant to conform to Bella Vista Rules and Regulations will be cause

for breach of the tri-party agreement permitting the Association to demand cancellation of the lease and eviction of the tenant.

3. Owners are accountable for the actions of all family members, guests or lessees

and shall be liable for any damages, fines, etc., incurred by them.

4. All fees or penalties must be paid in full in order to use Bella Vista recreational facilities.

5. A complaint filed with one witness shall provide sufficient evidence to the

Association for a violation and fine to be considered.

6. A security officer of the Association shall have authority to issue a Bella Vista citation or serve as a witness to a complaint.

H. ARCHITECTURAL STANDARDS

Board approval must be obtained prior to any and all exterior changes

to the units (includes fences and roofs)

1. Changes involving the incorporation of the existing covered patio as part of the living area by installing a new outside wall/glass doors: There shall be a minimum length of 20 feet of glass. Should additional storage units be included, they shall not extend beyond the fascia board of the roofline or beyond the interior of the fence line. Mullions (rectangular grid patterns) may be used on patio glass but may not be used on any other unit windows. (Rev. November 2009)

2. Replacement courtyard doors are to be a 36" wide impact type door, white in color. Door inserts and side-light replacements are also to be impact type. (Rev. December 2016)

3. New outside windows:

a. Kitchen maximum size is 36” x 36” b. Bedroom maximum size is 72” x 36”

4. Soffit vent replacement - When replacing soffit vents, vents are to be painted the

same color as the soffit. The following replacements are acceptable. (Rev. March 2017)

a. Impact resin vent 4” x 12” b. Aluminum vents 8’ x 16” c. When replacing soffits, 4-1/2 in. x 8 ft. continuous vents may be used.

5. Unattached storage sheds on the patio must not extend above the fence line.

Portable items such as umbrellas are the only items allowed to extend above the fence line. EXCEPTION: With BVHOA Board approval, units on the property line will be allowed additional privacy screening (an arbor or trellis which does extend above the fence line) where units in neighboring condominiums have the ability to look down into the patio. (Rev. October 2006)

6. Outside patio decking of wood will no longer be allowed. Replacement and new

decking shall be masonry construction. The reason for this action is our problem with rodent control.

7. Gutters: When gutters extend the full length of the patio, there must be a

downspout at each end and elbows at the bottom directing water away from the building. Proper splash blocks must be provided.

8. Hurricane storm shutters: Permanent shutters, if the accordion style and not the

concealed type, must be bronze color to match the window trim. Design must be approved by the Board of Directors. Permanent window shutters may not be left closed or removable shutters left up when no hurricane warnings are in effect. External shutters inside the patio may be left closed at any time. (Rev. April 2007)

9. All visible exterior surface colors should conform to Bella Vista color schemes.

10. Refer to existing Bella Vista Homeowner Association by-laws regarding any

construction in your villa.

11. Where villa siding panels need repair only full panel replacement, not patching, will be allowed.

12. Patio Fences – (Rev. November 2013) Originally the patio fences were built with

unpainted cedar boards and no top cap. Since the fences are now painted and the price of cedar has escalated, cedar is no longer required. The caps and baseboards have been made of various types of wood. This specification standardizes the changes.

Specifications a. Height – Top of fence must be between 23” and 25” below the soffit (the

underside of the roof overhang) b. Framing – pressure treated, fastened with hurricane clips

- Posts --- 4” x 4”, buried one half the above-ground length (approximately 3’); optionally, set in 2’ of concrete

- Cross members --- three 2” x 4” c. Boards – cedar or pressure treated pine/fir 1” x 10” x 5’- 5 ½“ (see

Specification i on height), with 2 ½” spacing, fastened with galvanized ring shank nails (preferred) or epoxy-coated drive screws; optionally 1” x 8” pressure treated boards (less likely to warp or split) with 1 ¾” spacing

d. Cap - Top board --- pressure treated 1” x 8” (overhang of ½”) - Side boards --- 1” x 4” cedar or pressure treated pine

e. Base Board (optional) – pressure treated 1” x 8”

13. Roof Replacement Specifications – Homeowners wishing to replace their roofs are subject to the following

a. Tiles must be Entegra Rustic Shake tiles - custom color BellaVista Sandstone OR Sandstone w/black antiquing.

b. If an incursion into a neighboring roof is to take place, written permission from the affected roof owner is to be provided to the HOA board for such incursions.

c. Prior to applying the acquired shake tile, a sample tile must be presented to the Board for color approval.

The following are the recommended specifications. (Developed by Jack Brown and Associates).

Scope of Work

a. Remove all existing roofing and flashing down to the wood substrate and discard

in a legal disposal on a daily basis.

b. Inspect and re-nail existing sheathing to current High Velocity Hurricane Code requirements.

c. Remove and replace any rotten, deteriorated or termite damaged wood sheathing to match existing. Ensure smooth sheathing transitions. Repair any damaged 2X structural members. Replace any rotten fascia with like kind and size.

d. Replace any rotten or damaged Masonite soffits with CDX plywood of matching thickness. Re-use or replace the soffit venting as needed and caulk all joints to prevent bug and vermin intrusion.

e. Furnish and install Code required PT 1X2 at the perimeter edges. This shall be included in Roofer's bid.

f. Tin-tag one ASTM D226 #30 to sheathing per High Velocity Hurricane Zone

Section of the current Florida Building Code using 1 5/8 inch tin tags and 1 1/4 inch ring shank nails.

g. Install 16-ounce copper 3 X 3 eaves drip using stainless steel ring shank nails

h. Remove and replace crickets only where two adjoining unit roofs are being

replaced. Install 16-ounce copper break metal in cricket/valleys. Hot-mop one smooth modified ply and one Flintlastic GMS Cap Sheet. Extend this detail up 18-inches on each side of the cricket. If the adjoining unit is not being replaced roofer shall clean and prime the existing cricket metal and hot-mop one smooth modified ply and one Flintlastic GMS Cap Sheet. Extend the new modified up the neighboring units slope as close to the tile as possible. Leaving the crickets in place

has been approved by the Building Dept. due to the homeowner's documents.

i. All metal to be primed and plastic cement applied between the laps.

j. Install all new lead plumbing stack flashings. All plumbing stacks shall be

provided with a removable heavy mesh screen cover such as manufactured by Southern Sheet Metal or equal to act as a rodent barrier.

k. Hot-mop one Flintlastic GMS granular surfaced cap sheet over the anchor sheet

using domestic Type IV asphalt and back nailed using tin-caps and ring shank nails per the NOA and Code.

l. Install cement tile in strict accordance tile manufacturer’s published installation

specifications from the Miami/Dade Product approval, the foam adhesive manufacturer’s specifications, the current edition of the Florida Building Code, High Velocity Hurricane Zones sections, and RAS. Bid Entegra Rustic Shake tile (custom color Bella Vista Sandstone) to match existing as closely as possible. Tile shall be set in a large paddy of 3M Roof Tile Adhesive two-part Polypro AH160 expanding tile adhesive foam, and any Code required stainless steel screw fasteners.

m. Be sure not to install new tile too low into the crickets so as to restrict drainage.

n. Roofer shall use tile Manufacturer's metal pre-finished eave riser at roof perimeter to raise the tile. Seal all fasteners with plastic cement.

o. Secure each tile with one stainless steel screw in addition to the foam on the sections of the roof over 7 in 12 pitch.

p. Hip and ridge tile shall be installed using the adhesive foam over mechanically

attached 26-gauge galvanized ridge boards with slots in the top or Top-Notch ridge Boards installed in a continuous bed of Polyfoam Polyset per RAS 120. If metal ridge board is used, the metal must be thoroughly cleaned of all oils and all fastener penetrations sealed with modified plastic cement. Point up with color matching mortar.

q. Plastic cement shall be placed to seal all tile fastener or metal accessory

penetrations. Stainless steel fasteners shall be used on all copper flashings.

r. All asphalt shall be domestic ASTM Type IV, and plastic cement shall be compatible with the modified bitumen roofing materials where appropriate.

s. Remove and dispose of Gutters and downspouts. At owner’s request, remove and

reinstall existing gutters.

t. Clean up and remove all roof debris DAILY.

u. At job completion, provide owner/s with mitigation forms for the roof.

I. PROCEDURES GOVERNING THE INSPECTION AND

COPYING OF HOA RECORDS (Rev. November 2005)

1. Requests for the inspection of HOA records must be submitted in writing (handwritten, typed, printed) to the Secretary or President of the Bella Vista HOA. That officer will, in turn, notify all other board members of the request. The association secretary will maintain a file of any such requests.

2. The right to HOA records by an individual homeowner (the requestor) shall be

limited to one 8-hour business day per month. The records requested will be provided for review in the HOA/CFC office in the Bella Vista maintenance building.

3. OFFICIAL RECORDS

a. If requested, the requestor or their authorized agent shall be provided copies of HOA records, including:

§ Association bylaws & amendments. § Association articles of incorporation and amendments § Declaration of restrictions & amendments § Current HOA rules and regulations

4. He/she will be given for inspection, upon request, the following records:

§ The minutes of all meetings of the board of directors and of the members, for the previous seven years.

5. The treasurer, or his designee, shall be present during the inspection of financial

records to monitor and assist in the review.

6. COPIES

b. Copies of up to 25 pages will be provided the requestor at cost, not to exceed 50 cents per page. If more than 25 copied pages are requested, the association will have the copies made by an outside vendor and the actual cost (time and material) of providing the copies will be paid by the requestor or his/her authorized agent on receipt of the copies. (Rev. November 2005)

c. J. BOARD POLICY ON ASSESSMENTS, INTEREST AND

LATE FEES

1. Owners who do not pay assessments and installments on them, in full, by the specified deadline will incur a late fee of $25 or 5% of the unpaid balance (whichever is greater). Furthermore, any portion of assessments, equal to or in excess of $250, unpaid after an additional 15 business days will bear interest at the rate of 18 percent per year from the due date until paid and will be subject to collection costs.

2. Any payment received by the association shall be applied first to any interest

accrued by the association, then to any administrative late fee, then to any costs and reasonable attorney's fees incurred in collection, and then to the delinquent assessment. The foregoing shall be applicable notwithstanding any restrictive endorsement, designation, or instruction placed on or accompanying a payment, as per Florida statute.

3. Maintenance fees are due on the 1st of each quarter.

a. If unpaid by 5:00 p.m. on the first business day of the following month, the amount will be increased by a late fee of $25 or 5% (whichever is greater) and,

b. If the amount is $250 or more, the homeowner will be notified by certified mail from the bookkeeper that the account must be paid within 15 business days or the account will be turned over to the Association Attorney for collection. This action will add legal fees to the amount owed.

4. Special Assessments

a. A late fee of $25 or 5% of the unpaid balance (whichever is greater) will be added to the assessment if not received by 5:00 p.m. on the due date noted.

b. Any homeowner whose assessment is unpaid thirty (30) days after the due date will be notified by certified mail from the bookkeeper that the account must be paid within fifteen (15) business days, or if the amount is $250 or

c. As always, the board may consider special circumstances before

K. Dumpster Regulations

1. A written request from the unit owner must be submitted to the Bella Vista Board of Directors for review and approval prior to bringing a trash dumpster onto Bella Vista property. The request will include the reason(s) for and dates (not to exceed five days) which the trash dumpster will be on Bella Vista property.

2. Vendor supplying the trash dumpster must submit a certificate of insurance naming Bella Vista Homeowners Association as additionally insured.

3. The trash dumpster will not exceed the LENGTH and WIDTH of a single parking

space (16 feet long and 9-1/2 feet wide) assigned to the owner of the unit requesting the trash dumpster. A fee of fifty dollars ($50.00) will be assessed to the unit owner for the trash dumpster to be on Bella Vista property for the requested period.

4. If the requested period, (or five day period) submitted to and approved by the Bella

Vista Board of Directors, is exceeded, a fee of fifty dollars ($50.00) per day will be assessed the unit owner until the trash dumpster is removed from Bella Vista property.

5. All areas around and near the trash dumpster will be kept clean and free of debris.

6. Any trash dumpster placed on Bella Vista property will not block or impede the

movement of Bella Vista residents.

7. Upon removal of the trash dumpster from Bella Vista property, areas where the trash dumpster was placed will be cleaned and any damage to Bella Vista property where the trash dumpster was placed will be assessed to the unit owner.

8. Any non-compliance with this regulation while bringing a trash dumpster onto

Bella Vista property will result in a fine of one hundred dollars ($100.00) per day (not to exceed $1,000.00) to the unit owner until the situation is remedied.

A. OCCUPANCY AND USE

1. Any damage to common elements, the recreation areas or equipment of the CFC caused by any owner, or any owner’s tenant/family member or guest, shall be repaired or replaced at the expense of such owner.

B. VEHICLES

1. Trailers or habitable motor vehicles of any nature, motorcycles, mopeds, boats, jet skis, skidoos, golf carts, inoperable vehicles, vehicles without current tags, vehicles which are an eyesore (in the discretion of the Board), vans and trucks (other than those of a type, if any, expressly permitted below), pick-up trucks, service vehicles, vehicles having printing or advertising on exterior surfaces (other than auto dealer’s license frames) or visible from the exterior, commercial or construction vehicles or equipment are not allowed on the property at any time. Vehicles that are for the sole purpose of working on Bella Vista property whether for the CFC, HOA, COA, or for homeowners and condo owners will be allowed during normal working hours.

Permitted Trucks - Trucks that are considered sports utility vehicles (SUV) are permitted, but not including any that may have the appearance of a sport utility vehicle but have a flat bed or an enclosed flat bed of any kind.

Permitted Vans - For the purpose of this rule, a vehicle is not deemed to be a prohibited van if it meets all of the following criteria: has permanent enclosed seating for at least five (5) persons, windows on both sides to the rear of the driver and right front passenger seat, and does not exceed the manufacturers standard length, height and width of a custom conversion van.

“Overnight” - For the purpose of the governing documents of the Association, the term “overnight” shall mean the parking of any vehicle at any time between the hours of 10:00 p.m. and 6:00 a.m. of the following day. ALL OWNERS AND OTHER OCCUPANTS OF UNITS ARE ADVISED TO CONSULT WITH THE ASSOCIATION PRIOR TO PURCHASING, OR BRINGING ONTO THE PROPERTY, ANY TYPE OF VEHICLE OTHER THAN A PASSENGER CAR INASMUCH AS SUCH OTHER TYPE OF VEHICLE MAY NOT BE PERMITTED TO BE KEPT WITHIN THE PROPERTY. The use of a vehicle cover does not cure a violation as to any vehicle parked in violation of these rules.

2. Maximum speed is 15 miles per hour. Speeding and careless driving is not permitted.

3. Parking on the grass, or overnight parking on the roadway is not permitted. All owners, lessees and guests should be aware that the CFC has the right to have the offending vehicles towed away at the owner’s expense after having attempted to notify the

owners of such vehicles. 4. Unlicensed motor vehicles may not be operated or stored on the common areas or paved areas.

5. Motorcycles of any type, including moped and ATC’S (all terrain cycles) are not permitted on Bella

Vista property at any time.

C. RECREATIONAL FACILITIES 1. The recreational facilities are reserved for residents only (i.e. owners, lessees or guests of residents who reside in Bella Vista).

2. The clubhouse and courts are closed for use between the hours of 11:00P.M. and 7:00 A.M. 3. THE POOL CLOSES AT SUNDOWN

4. There shall be no swimming in the Lake

5. POOL HOUSE

a. The Pool house is for the use of all residents, lessees and guests of residents. b. An adult must accompany children under 12 years. c. Food and drinks are allowed in the Pool House only. It is the responsibility of each guest to clean up any debris after you finish. d. There is no smoking in the pool house. e. No furniture from the Pool House may be removed for use without the permission of the Board, and then must be returned immediately after use. f. Books are donated by the residents and are free for the use of the residents. We ask that you return the book when you are finished. Please do not leave magazines, tapes, videos or cds. g. Anyone wishing to reserve the pool house must apply to the Property Manager and gain CFC Board approval. Please see SECTION D for Pool House Reservation Rules.

a. No animals on courts b. No skates, skateboards, bicycles, etc. TENNIS & PICKLE BALL ONLY c. Do not hang on nets. d. TENNIS SHOES ONLY. Proper attired required e. One-hour time limit when others are waiting or if court is racqueted (i.e. place your racquet against fence and notify players you have done so to remind them of the one hour time limit.) f. Children MUST be supervised otherwise adults have priority. No children under 12 years are allowed unless supervised by an adult.

8. BOCCE AND HANDBALL COURTS a. Please remove all chairs, equipment and debris brought to the courts, before leaving. b. If chairs are brought to the Bocce Courts from the Pool House, Please return them to the Pool House upon leaving.

D. POOL HOUSE RESERVATIONS 1. Only the pool house may be reserved for a private party – not the pool. 2. Only owners in residence may request reservations for the pool house for their personal use. An owner may not reserve the Pool House for a renter or guest. The CFC will make approval for this use. 3. At the time of notification of approval, the following monies will be collected:

i. A fee of $150.00 is required for use of the clubhouse for a private party. Ii. The reservation can only have a maximum of 25 people. iii. A damage deposit of $150 is required for the use of the pool house. These fees will be refunded at the discretion of the Board of Directors. GENERAL USE: The Bella Vista Pool House is to be used only by the COA and HOA residents, guests of Residents with the Resident in attendance. The Association’s property manager will be responsible for taking reservations for the use of the meeting and entertainment facilities. A deposit will be required for all activities other than those sponsored by the Association. Any person or persons authorized to hold a private affair in the Pool House will be responsible for leaving the facilities clean and in the same condition as it was found. EQUIPMENT: The Pool House tables, chairs or common equipment of any kind shall not be removed from the premises. No radios, cd players, or any other type of music player, will be allowed in the pool house, unless they are used during a supervised recreational activity of a private rental.

HOURS: Pool House rental hours are from 8:00AM TO 10PM. The maximum rental is 8 hours. Owners of Bella Vista COA or HOA can reserve the Pool House on any given day, except Public Holidays. Consecutive rentals are not permitted on Saturday or Sunday except with Board approval. ATTIRE: Shoes and shirts must be worn in the Pool House at all times. CHILDREN: Children under twelve (12) years of age must be accompanied by an adult while using the Pool House and all its amenities. CONDUCT: Abuse of the Pool House facilities will constitute grounds for restriction of any further use of the Pool House by the Resident deemed responsible. Any person(s) authorized to use the facility will be liable for the cost of repair resulting from damage caused directly or indirectly by themselves and/or their guests, to any property inside or adjacent to the Pool house, including landscaping. The Board of Directors of the CFC retains the right to suspend the use and privileges of any Resident for any violation of these Rules and Regulations. 1. 1ST VIOLATION: Courtesy warning letter for not complying with any provision of the declaration, the Association bylaws, or reasonable rules of the Association.

2. 2nd VIOLATION: for not complying with any provision of the declaration, the Association bylaws, or reasonable rules of the Association $100 fine

Any subsequent continuing violations will be $100 fine per day up to the $1,000 maximum per Florida statute 720.305(2) and/or potential 60 day suspension to common areas and facilities for the failure of the owner of the parcel or its occupant, licensee, or invitee to comply with any provision of the declaration, the Association bylaws, or reasonable rules of the Association.

I understand that I will be responsible to make certain that this facility is properly locked after my use.

I understand that Bella Vista CFC shall not be responsible for any accidents or injuries arising from my use of this facility. I further agree to indemnify and hold the Association harmless from any liabilities or any injury, damage or accident to any Resident of the Association, a guest, invitee or any other person or to any third person and for any damage to the property, arising out of or in course of the usage of this facility.

The hours for rental of the Pool House will be from 8:00 A.M to 10:00 P.M. 8 HOURS MAXIMUM RENTAL

COMUNITY EVENTS: Pool House may be used for organized events and parties

FUNDRAISERS: The Pool House is NOT available for fundraisers or events of a political, religious or promotional nature, except that candidates for public office may be invited to speak provided all candidates for the office are invited.

AVAILABILITY CRITERIA: Reservations will be through the Association's Property Manager and will be made on a first come first served basis. Reservations are available to Bella Vista Condo and HOA members only, and should be made not less than 30 days in advance.

Residents will need to complete an application and pay a Rental and Security deposit.

The Pool House will not be available for private parties on the following days:

New Years Eve New Years Day Easter Sunday Independence Day Labor Day

Memorial Day Halloween Thanksgiving Day Christmas Eve Christmas Day

Consecutive rentals are not permitted on Saturday or Sunday except with Board approval. Application of the exclusive use of the Pool House as follows:

*Association sponsored recreational/community activities authorized by the Board of Directors, no maximum allowable and no charges or deposit due.

Any Owner’s private meeting using the facilities for parties, dinners, or special functions; 25 maximum allowable, $150.00 fee and $150 Security deposit CATERERS: The Association must be provided a copy of their license and insurance. RESPONSIBILITIES: The Resident is responsible for setting up and arranging the room for his / her function, which includes setting up tables and chairs and returning same to the area where they were located in the Pool House. CANCELLATION: Cancellation may be initiated by the Applicant, the Association Board of Directors or the Management Company.

LIABILITY: No high-risk activities, as determined by the Association or its Property Manager, will be allowed to be conducted in the Pool House. The liability for any personal injury and/or property damage resulting from improper or unauthorized use of property, facilities or equipment by any Resident or guest, is the responsibility of the Resident applicant to whom the application is issued. The Owner applicant is responsible for all guests complying with the CFC rules and regulations.

PARKING: Parking is very limited; carpooling is recommended.

There is absolutely no parking on the grass or in any private car space. Cars may not hinder or block the roadways. PLEASE READ THE VEHICLE RESTRICTIONS IN THE BELLA VISTA CFC RLES AND REGULATIONS. Owners may be fined for any of these parking infractions.

I have read and understand the Bella Vista CFC Association rules and regulations, Pool House restrictions and allowances, and agree to abide by them.
