Karnataka High Court Order in the PIL filed by RASTRon Beggary Relief System

(WP9965/2011)

RASTR has since 2007 done a comprehensive study of Beggary / Destitution with a focus on

Karnataka State. The study, which discovered complete failure of the Destitute / Beggary relief

system in the state was published in July 2010, as A Public Audit of the Beggary Relief

System. Several representations were made to the government thereafter to rectify the

system and provide the relief and rehabilitation to beggars / destitute as intended under the

Karnataka Prohibition of Beggary Act, 1975. When the government failed to respond, RASTR

filed a public interest litigation (PIL) in the High Court of Karnataka in 2011. Besides directions

to the State Government to take steps to make Karnataka Beggary free, the petition sought to

cancel the transfer of 123.3 acres of prime land worth thousands of crores of rupees belonging

to the Central Relief Committee on Magadi road to BDA for commercial purposes.

The division bench of the Karnataka High Court disposed of the PIL on 03-Apr-2013 setting a

time limit of 3 months to implement the commitments made by it to the Bench to rectify

the failures of the Beggary Relief System in the state and provide true relief and

rehabilitation to the beggars/destitute as envisioned under the Karnataka Prohibition of

Beggary Act, 1975. A summary of the outcome of the PIL, which the government has to

The government has agreed to frame Rules to bring transparency in nomination of four

non-official members to the Central Relief Committee (CRC), the apex body for Beggary

relief in the state. It has committed to form a Screening Committee, headed by a retired

Judge of the Karnataka High Court to select one person each from the fields of Social

appointed to the CRC. This is expected to ensure professionalism by subject matter

experts and also enable participation of citizens in the functioning of the Beggary relief

system and make it responsive.

The government has appointed Local Relief Committees to all the 14 Nirashritara Parihara

Kendras (NPKs) (Destitute Relief Centers) in the state on 25-Mar-2013. This had not

happened for the past 38 years.

The government shall appoint the Board of Visitors from among the citizens to all the 14

Nirashritara Parihara Kendras (NPKs) in the state. This had not happened for the past 38

years.

The government shall ensure that the Beggary Cess is collected and deposited by the local

authorities without fail or any delays and the same shall be duly utilized for the relief and

rehabilitation of beggars/destitute in the state.

The government has already withdrawn the GO transferring 123.3 acres of land belonging

to the NPK Bengalooru on Magadi road to BDA for commercial exploitation.

The government shall publish the complete report of the beggars / destitute census that it

has conducted in 2012 according to which nearly 25,000 destitute / beggars were identified

in the state.

The government shall establish a functional toll-free helpline throughout the state through

telephones and the CRC Website / email for the public / citizens to report instances of

begging in public places. Currently, there is no resource available to citizens to air

grievances or take action if they come across cases of beggary.

Besides the above, the government has already implemented the following measures after it

was challenged through the PIL by RASTR.

Biometric identification of detained beggars is very important to identify repeat cases.

Finger print identification is now a part of the receiving process in NPK Bengalooru.

Aadhar (UID) cards have been issued to inmates of NPK Bengalooru, which is a very

important step to provide them identity and in bringing them back to the national

mainstream. Such a measure has happened for the first time in the country.
