Represented by counsel, theybring this civil rights action pursuant to 42 U.S.C. § 1983, on behalf of themselves andother similarly situated inmates, and have prepaid the $400 filing fee. Each of thenamed Plaintiffs is or has been incarcerated at Lawrence or Menard CorrectionalCenter under conditions they describe as "extreme isolation." They allege that theconditions of their confinement in administrative segregation violate their EighthAmendment rights, and that they have suffered a deprivation of a liberty interestwithout due process, in violation of the Fourteenth Amendment. They seek class actioncertification, and declaratory and injunctive relief. Under 28 U.S.C. § 1915A, theCourt is required to conduct a prompt threshold review of the complaint. AcceptingPlaintiffs' allegations as true, the Court finds that Plaintiffs have articulated a colorablefederal cause of action against Defendant for violations of their constitutional rights.Accordingly, pursuant to Local Rule 72.1(a)(2), this action is REFERRED to UnitedStates Magistrate Judge Stephen C. Williams for further pre−trial proceedings.Further, this entire matter shall be REFERRED to United States Magistrate JudgeWilliams for disposition, pursuant to Local Rule 72.2(b)(2) and 28 U.S.C. § 636(c), ifall parties consent to such a referral. 04/16/2020 214 ORDER: This case is set for oral argument on July 16, 2020 at 1:00 p.m. in the EastSt. Louis Courthouse before the undersigned. The following parameters are establishedfor the oral argument. Each party will be allotted sixty minutes of time to present theirargument. Plaintiffs may utilize all 60 minutes in their opening argument or they mayreserve time for rebuttal. However, no more than 15 minutes may be reserved byPlaintiffs for rebuttal. As the Court noted during the status conference, at this time theCourt hopes to conduct this oral argument at the Courthouse. However, given the fluidsituation surrounding the COVID−19 pandemic, a video conference oral argumentmay be required. The Court will carefully monitor the situation and keep the partiesapprised if changes become necessary. If oral argument proceeds in−person, it will beconducted in a large courtroom (given the number of counsel entered in the case) thatwill sufficiently allow for room to maintain social distance.
