description

Do you understand what your attorney means when he/she says that your priority date is not ‘current?’ What about when they discuss the Department of State Visa Bulletin, Visa cut-off dates, and employment and family-based preference categories? Immigration law is very complicated, as are the terms often used to describe important aspects of the immigration process. In this informative presentation, Bashyam Spiro attorneys will explain both priority dates and visa availability, and how those terms can impact how long your permanent residency case will take.

Page 12: Bashyam Spiro LLP Priority Dates And How It Impacts Residency Applications

HOW DOES IT WORK?

Total Number of Employment-Based (EB) Numbers Allocated as Follows:

EB-1 = 140,000 * 28.6% = 40,000 EB-2 = 140,000 * 28.6 = 40,000 EB-3 = 140,000 * 28.6 = 40,000 EB-4 = 140,000 * 7.1% = 10,000 EB-5 = 140,000 * 7.1% = 10,000

140,000 Visas are Divided Between all Five EB Categories

Now it’s Time to Allocate Them for Each Country!

Page 13: Bashyam Spiro LLP Priority Dates And How It Impacts Residency Applications

How Does It Work, Cont’d

There is a Per Country Cap in Each EB Category of 7%

EB-1 = 40,000 *7% = 2800 + unused EB-4 and EB-5 EB-2 = 40,000 * 7% = 2800 + unused EB-1 EB-3 = 40,000 * 7% = 2800 + unused EB-2 EB-4 = 10,000 * 7% =700 EB-5 = 10,000 * 7% = 700

Total = 9800 Per Country, Per Year
