Baltimore, Md., Tuesday, June 1st, 1937. THE STATE BOARD OF FUNERAL DIRECTORS AND EMBALMERS OF MARYLAND, 508 Old Town Bank Building The special meeting of the Board was called to order by President Levinson at 12:26 A.M., with the following members present:: Mr. Sol Levinson, President, Mr. J. Jerome Framptom, Treasurer, Mr. George A. Farley, Mr. Andrew K. Coffman, Mr. John Ullrich, Mr. John M. Weber. President Levinson immediately called for the election of a vice-president, said office having been created under the new law which took effect today. President Levinson requested Mr. Coffman to take the chair, and Mr. Coffman upon taking the chair immediately called for nominations for the office of vice-presidency. Mr. Levinson nominated Mr. George A. Farley for the office of vice- president, seconded by Mr. Weber. Mr. Ullrich then moved, seconded by Mr. Weber, that the nominations then be closed, and that the Secretary be instructed to cast anunanimous vote of the Board for Mr. Farley for office of Vice-President. SO ORDERED. Mr. Delosier, the Secretary, then cast a ballot. President Levinson then resumed the chair and. declared Mr. Farley the duly elected Vice-President for the remainder of the two year term for which the Board has been appointed. Mr. Coffman moved, seconded by Mr. Farley, that an annual fee of three dollars ($3.00) be required of applicants for funeral director's apprenticeship registration. SO ORDERED. Mr. Coffman moved, seconded by Mr. Farley, that an annual fee of three dollars ($3.00) be required for embalmer's apprentice- ship registration. SO ORDERED. THE STATE BOARD OF FUNERAL DIRECTORS AND EMBALMERS OF MARYLAND, 508 Old Town Bank Building

The special meeting of the Board was called to order by President Levinson at 12:26 A.M., with the following members present::

THE STATE BOARD OF FUNERAL DIRECTORS AND EMBALMERS OF MARYLAND, 508 Old Town Bank Building.

The special meeting for discussion of reciprocal agreements between border line States was called to order by President Levinson at 12 o'clock noon, with the following members present:

Mr. Sol Levinson, President, Mr. George A. Farley, Vice-pres., Mr. J. Jerome Framptom, Treasurer,

Mr. John M. Weber. The following men attended:

Mr. Frank C. Stover, Strasburg, Virginia, Mr. M. A. Hoff, New Cumberland, Pennsylvania, Mr. Levin, Pennsylvania.

After a thorough discussion on reciprocity it was unanimously decided that the border States would issue to funeral direotors and embalmers of those States, upon receipt of application from their State Boards, a registration card which would entitle them to em­balm, conduct, arrange and inter bodies in said States, but will not permit them to advertise in those States, have agent or establish­ment. A fee of $5.00 was agreed upon for registration and the Secretary of the Maryland Board was instructed to draw up necessary permits for application and identification cards for same.

THE STATE BOARD OF FUNERAL DIRECTORS AND EMBALMERS OF MARYLAND, 508 Old Town Bank Building.

The special committee meeting of the Board was called to order by President Levinson at 4:00 P.M., with the following members present:

Mr. Sol Levinson, President, Mr. George A. Farley, Vice-President,

Mr. William Cook, Mr. John Ullrich, Mr. John M. Weber.

Mr. Cook presented the case of Howard H. Hubbard, Robert W. Robertson and Clarence D. Fullem, and after hearing a explana­tion of their cases, in that all three of the above named men had made application prior to June 1, 1937 for registration as embalmer's apprentices, Mr. Farley moved, seconded by Mr. Ullrich, that the registrations of Howard H. Hubbard, Robert W. Robertson and Clarence D. Fullem be considered as filed prior to June 1st, upon payment of the required fee of $5.00 each. SO ORDERED.

Mr. Farley moved, seconded by Mr. Weber, that the summons received by the Board together with file of correspondence of Raymond F. Saville, be turned over to the Attorney General's office for answer. SO ORDERED.

Mr. Walter Penn appeared and was given an explanation of why his application for embalmer's registration had been refused.

The meeting then adjourned.

The regular meeting of the Board was called to order by Mr. Andrew K. Coffman at 8:00 P.M., with the following members present:

Mr. George A. Farley, Vice-President, Mr. J. Jerome Framptom, Treasurer, Dr. Wm. H. F. Warthen, Ex-Officio,

Mr. Andrew K. Coffman, Mr. John Ullrich, Mr. John M. Weber.

Mr. Coffman, acting as President pro-tern, opened the meeting and upon arrival of Mr. Farley, Vice-President, turned the meeting over to him.

Mr. Ullrloh moved, seconded by Mr. Framptom, that the minutes of the previous meeting be approved as read. SO ORDERED.

Mr. Weber moved, seconded by Mr. Ullrich, that the oase of J. Harvey Williamson be investigated. SO ORDERED.

Applications of David R. Martin, John J. Cowan, J. Liston Wiedefeld, William G. Durisoe, Lydia G. Chase, Samuel W. Sullivan, Jr., George G. Kelson, Joseph G. Locks, Jr., Arthur B. Simms, Goals Wilson, William A. Jackson, Roland A. Brown, Louis P. Daven­port, Hazel P. Kelson and Isaiah L. Brown, Jr., were read and refused.

Mr. Coffman moved, seconded by Mr. Weber, that the applica­tion of Lottie Gross to conduct the business under the name of Mrs. R. C. Gross be approved. SO ORDERED.

Mr. Framptom moved, seconded by Mr. Ullrich, that the application for continuation of the firm name of Philip Herwig Sons be approved. SO ORDERED

Letter of Clarenoe E. Umstot was read and the Secretary was instructed to communicate with the Board of Education of West Virginia, as to the status of the school mentioned in Mr. Umstot's letter.

Mr. Ullrich moved, seconded by Mr. Weber, that the applica­tion of Marion L. Patterson -be considered as of March 1st, pro­viding that at the time Mr. Patterson makes request for examination, he has all the necessary requirements under the new law. SO ORDERED.

Mr. Weber moved, seconded by Mr. Framptom, that the Secretary obtain an opinion from the Attorney General in regards to applications for funeral directors' examination, who live out

out of State and have previously taken examination but failed, as to whether or not they will be eligible for future examinations. Opinion as to how long this Board must recognize applications for funeral director's and embalmer's licenses from people who have previously been in business in Charles, St. Mary's and Calvert Counties. Opinion on status of persons who have never been actively engaged in business in these three oounties. Opinion as to issuing corporation license to applicants who applied after June 1st, but incorporated prior to June 1st. Opinion on status of licensees whose licenses have been revolked. Opinion on Gladhill status on mis-statement of age. SO ORDERED.

Mr. Weber moved, seconded by Mr. Framptom, that the Secre­tary draw on the Treasurer in the amount of $1,600.00 for advance expenses for attending conference in Minneapolis. SO ORDERED.

Letter of Lewis U. Iglehart was read to the Board and the Secretary was instructed to notify Mr. Iglehart that his applica­tion can only be considered as having been filed after June 1st, and that he must be considered under the new law.

The special meeting of the Board was called to order by President Levinson at 8:00 P.M., with the following members present:

The committee immediately started a general discussion of the recent Attorney General's opinion pertaining to registration of funeral directors and embalmers in Charles, St. Mary's and Calvert Counties. Also verbal opinion of the Attorney General's against issuing licenses to corporations that were incorporated prior to June 1st but failed to file application for license until after June 1st. Also status of applicants for funeral directors' examination from out of State who failed at the last examination.

The meeting then adjourned.

THE STATE BOARD OF FUNERAL DIRECTORS AND EMBALMERS OF MARYLAND, 508 Old Town Bank Building.

The regular meeting of the Board was called to order by President Levinson at 8:00 P.M., with the following members present:

Mr. Sol Levinson, President, Mr. George A. Farley, Vice-President, Mr. J. Jerome Framptom, Treasurer,

Mr. Andrew K. Coffman, Mr. John Ullrich, Mr. John M. Weber.

There being no corrections the President ordered the minutes of the meetings held on Friday, Aug. 13th and Thursday, Sept. 9th, be approved as read.

Mr. Coffman moved, seconded by Mr. Framptom, that the President appoint a committee to see the Attorney General, and ob­tain his opinion in regards to apprenticeships, and also the status of J. Harvey Williamson in regards to his apprenticeship under Mr. Clarence W. Adams. SO ORDERED.

Mr. Ullrich moved, seconded by Mr. Weber, that no appren­ticeship registrations be issued without first being presented to and approved by the Board. SO ORDERED.

Application of Joseph Kasinskas, Inc., for change of office from 694 Washington Boulevard to 902 Washington Boulevard read and approved by the Board.

Application of Archibald Augustus Gaddis for branch at 35 East Avenue, Turner Station, Maryland read and approved by the Board.

Letter of Mrs. Carrie Davis read and the Secretary was in­structed to notify Mrs. Davis that the licensed funeral director who purchases her place is permitted, under law, to use his name and follow same by,"successor to J. Walter Davis".

Letter of Vigliato Funeral Home, Inc., read and the in­spector was instructed to inspect premises and report back to Board.

Letter from Virginia Board read and the Secretary was in­structed to remind Virginia Board of agreement.

Mr. Coffman moved, seconded by Mr. Ullrich that James I. Dennis, Jr., be permitted to take examination for funeral director and embalmer providing he files affidavits substantiating his apprenticeship as having been served, and also have his other

Upon the President putting the motion, the Board voted u--nanimously to permit same with the exception of Mr. Farley, who voted no.

Mr. Farley moved, seconded by Mr. Ullrich that the Secretary have printed official list of funeral directors and embalmers and include new law. SO ORDERED.

Application of Mr. Ellis S. White for change of office from 2554 Madison Avenue to 2840 Gold Spring Lane read and approved.

Mr. Weber moved, seconded by Mr. Coffman, that the applica­tions of Martin F. Sweeney and Albert V. Dixon be accepted and the Secretary issue registration for same. SO ORDERED.

Mr. Farley moved, seconded by Mr. Framptom that the affi­davits filed in behalf of James F. Soarpelli be accepted, and that he be declared eligible for the coming examination provided he has the ofher necessary requirements. SO ORDERED.

Mr. Farley moved, seconded by Mr. Framptom, that the appli­cation of Pinkney E. Sewell be accepted, and the Secretary issue funeral director's license to said Pinkney E. Sewell, under recent ruling of the Attorney General in which he stated that up to June 1st, 1937, Calvert, St. Mary's and Charles Counties were not covered by past funeral director's and embalmer's law. SO ORDERED.

Mr. Farley moved, seconded by Mr. Ullrich that Lillian R. Quade's application be accepted, and the Secretary issue funeral director's and embalmer's licenses to said Lillian R. Quade, under recent ruling of the Attorney General in which he stated that up to June 1, 1937, Calvert, St. Mary's and Charles Counties were not covered by funeral director's and embalmer's law. SO ORDERED.

Mr. Farley moved, seconded by Mr. Ullrich that the appli­cation of Leona E. Quade be accepted, and the Secretary issue funeral director's and embalmer's licenses to said Leona E. Quade, under recent ruling of the Attorney General in which he stated that up to June 1, 1937, Calvert, St. Mary's and Charles Counties were not covered by funeral director's and embalmer's law. SO ORDERED

Mr. Farley moved, seconded by Mr. Weber, that the applica­tion of Elmer Quade be accepted, and the Secretary issue Embalmer's license to said Elmer Quade, under recent ruling of the Attorney General in which he stated that up to June 1, 1937, Calvert, St. Mary's and Charles Counties were not covered by funeral director's and embalmer's law. SO ORDERED.

Mr. Farley moved, seconded by Mr. Ullrich, that the applica­tion of James I. Mattingly be accepted, and the Secretary issue funeral director's and embalmer's licenses to said James I. Mattingly, under recent ruling of the Attorney General in which he stated that up to June 1, 1937, Calvert, St. Mary's and Charles Counties were not covered by past funeral director's and embalmer's law. Welch, under recent ruling of the Attorney General in which he stated that up to June 1, 1937, Calvert, St. Mary's and Charles Counties were not covered by past funeral director's and embalmer's law. SO ORDERED.

Mr. Weber moved, seconded by Mr. Framptom that the applica­tion of Pius B. Robinson be accepted, and the Secretary issue funeral director's and embalmer's licenses to said Pius B. Robinson, under recent ruling of the Attorney General in which he stated that up to June 1, 1937, Calvert, St. Mary's and Charles Counties were not covered by past funeral director's and embalmer's law. SO ORDERRD.

Mr. Weber moved, seconded by Mr. Farley, that no more applications for funeral director's or embalmer's licenses, without examination, from Charles, Calvert and St. Mary's Counties would be considered by this Board, residents of these three counties having had four months to make these applications, and therefore the Board had given plenty of time. SO ORDERED.

Letter from John B. Cain, Jr., was read and the Secretary was instructed to write Mr. Cain for affidavits substantiating number of years of apprenticeship that he has served.

Letter from Eckels College of Embalming was read and approved by the Board. This letter requested the Board's ruling as to whether or not an apprentice could serve part of his apprentice­ship, then attend embalming school, and finish his apprenticeship period after attending embalming school.

Mr. Weber moved, seconded by Mr. Framptom, that the letter of Ri.chard F. Curley, President of Richard F. Curley, Funeral Di­rector, Inc., in which he requested that license for Richard F. Curley, Funeral Director, Inc., be revoked by this Board, be accepted, and that the Secretary be instructed to strike off the name of Richard F. Curley, Funeral Director, Inc., from the official list of funeral directors. SO ORDERED.

Mr. Farley moved, seconded by Mr. Ullrich, that the appli­cation of Leonard Whalen for reinstatement be refused. SO ORDERED.

The Secretary was instructed to investigate the actions and conduct of Walter L. Penn and report same to the Board.

Mr. Ullrich moved, seconded by Mr. Farley that the meeting now adjourn. SO ORDERED.

Report of committee appointed to interview Charles T. LeViness, 3rd, assistant Attorney General, at the Attorney General's office, 19th floor Baltimore Trust Building.

The committee consisted of President Sol Levinson, Vice-President George A. Farley, John Ullrich and Charles E. Delosier, Secretary.

After explaining apprenticeship applications to Mr. LeViness, he ruled that for an apprentice to complete his time, as required by law, he would be required to serve his apprenticeship at that place of business from which the principal work was conducted by the funeral director or embalmer under whom said apprentice was serving his apprenticeship; and that to serve an apprenticeship, in the meaning of the act, an apprentice would be required to serve full time and not part time.

After explaining the Williamson case to him, he stated that the law has no control over who owns the building in which a busi­ness is conducted, or who owns the rolling stock and equipment used in the business, as long as the business is run under a licensed funeral director and he has charge or supervision over all work done by said place of business.

After explaining surrender of license of Richard F. Curley, Funeral Director, Inc., the Assistant Attorney General stated that the President had no right to surrender license for a corporation unless authorized to do so by the vote of the Board of Directors, neither has the Board the right to cancel the license of a corpora­tion unless authorized to do so by the Board of Directors. There­fore, unless Richard F. Curley is a principal stock holder in the corporation and has the Board of Director's vote to surrender license, he has no authority to surrender same.

After showing him application of People's Funeral Home, Inc., he ruled that the Board could not cancel said license because they had registered within the meaning of the act, even though they had not completed form of registration correctly.

The Board appeared in the City Court, part #2, before Judge Frank in answer to a writ of mandamus in behalf of J. Liston Wiedefeld, Isaiah L. Brown, Hazel P. Kelson, Lydia G. Chase, Samuel W. Sullivan, Jr., George P. Kelson, Joseph G. Locks, Arthur B. Simms, Goals Wilson, William A. Jackson, Roland A. Brown and Louis P. Davenport.

After hearing petition of Attorney General for dismissal of proceedings, Judge Frank ruled in behalf of the Board.

Mr. Clarence B. Wilson of Emmitsburg, Maryland, appeared, accompanied by Mr. Solomon Allison of Fairfield, Pennsylvania, and Mr. Patrick Joseph McGrath of 604 Edgewood Street, Baltimore, Mary­land, and after making the following statement that he came to this office for the purpose of applying for another examination for undertaker in May, 1937, but was instructed by this office that same was not necessary, and that he would be eligible for under­taker's examination in 1938. The above statement was substantiated by Mr. McGrath.

Mr. Coffman moved, seconded by Mr. Ullrich, that Mr. Wilson be permitted to file application for coming funeral directors' ex­amination, and upon receipt of same he shall be declared eligible for the next examination provided he pays the necessary fee.

SO ORDERED.

Mr. Farley moved, seconded by Mr. Coffman, that the motion made at the meeting on October 8th, whereby Richard F. Curley, Funeral Director, Incorporated, license was revoked shall be rescinded. SO ORDERED.

Mr. Farley moved, seconded by Mr. Coffman, that we have five hundred additional official lists of funeral directors and embalmers printed, and that one be mailed to each local registrar in Maryland. SO ORDERED.

Letter of Arthur E. Simmons, Jr., was read and the Secre­tary was instructed to quote him the law.

Application of Knight-Hunt, Incorporated, for change of address from 1120 Druid Hill Avenue to 2554 Madison Avenue, was approved.

Mr. Ullrich moved, seconded by Mr. Farley, that application of Harold T. Wood for funeral director's apprenticeship be approved.

Mr. Farley moved, seconded by Mr. Coffman, that application of William W. Chambers, Jr., for funeral director's and embalmer's apprenticeship registrations be returned, and inform him that Mary-law law requires that an apprenticeship must be served under a Maryland licensed funeral director and embalmer whose principal place of business is in the State of Maryland. SO ORDERED.

Mr. Framptom moved, seconded by Mr. Ullrich, that application of Carl S. Griffith, for funeral director's apprenticeship, be re­fused due to the fact taat he is not serving a full time apprent­iceship within the meaning of the law. SO ORDERED.

Mr. Farley moved, seconded by Mr. Ullrich, that Mr. Allen R. Slade be notified to discontinue the date advertised, unless he used the actual date that his license was issued. SO ORDERED.

Mr. Farley moved, seconded by Mr. Framptom, that the appli­cation of Arthur B. Simms for embalmer's apprenticeship be approved.

SO ORDERED.

The Secretary reported that he had visited the Vigliato Funeral Home, Inc., and found that 1546 N. Gay Street does run through to 2029 E. Federal Street, and that this Building really has two streeet numbers. After making the above report the Secre­tary was instructed to notify the Vigliato Funeral Home, Inc., that they rcould use only one address.

Mr. Farley moved, seconded by Mr. Framptom, that Walter L. Penn's funeral director's and embalmer's licenses be restored.

Mr. Farley moved, seconded by Mr. Framptom that a voucher for expenses incurred for the special meeting of the court com­mittee in the amount of $16.50, and the expenses of the meeting of November 12th, in the amount of $25.00, be sent to the State Comptroller for reimbursement. SO ORDERED.

Mr. Cook moved, seconded by Mr. Ullrich, that upon payment of the required fee of $5.00, Sol Levinson & Brothers be issued copartnership license, same having not been issued due to a mis­understanding in our office. SO ORDERED.

After reading letters of Henry Tyson Wheeler and others, the Secretary was instructed to answer said requests as follows: if the applicant can show by affidavits that he has been serving a regular apprenticeship, within the State of Maryland under a Maryland licensed funeral director, prior to the passage of this act, he will be given credit for same, providing he applies for such credit before period is up, whereby he would be eligible for an examination had he applied for registration as an apprentice after the passage of this act.

Letter of Honor D. Hartzler regarding eligibility for embalmer's examination was read, and the Secretary was instructed to request a ruling from the Attorney General.

Mr. Cook moved, seconded by Mr. Coffman, that the Board request a ruling from the Attorney General as to whether or not special examinations may be given by this Board, as provided in Article 4, Section 1 of the by-laws, or whether the Board can give only one examination annually, as provided in the law under Article 43, Section 300. " SO ORDERED.

Application of Richard F. Curley, Funeral Director, Inc., for change of name to Eastern Funeral Chapel, Inc., was approved.

Mr. Farley moved, seconded by Mr. Ullrich, that the Board use Conference questions for the next embalmer's examination, and that the Secretary write the Secretary of the Conference request­ing copies of questions so that the Board can select what questions they would use for the coming examination. SO ORDERED.

Mr. Weber moved, seconded by Mr. Ullrich, that the Secretary request reimbursement in the amount of $27.75 for Board's expenses for meeting December 10th, 1937. SO ORDERED.

Mr. Farley moved, seconded by Mr. Ullrich, that the meeting now adjourn. SO ORDERED.
