On a Motion by Ms. Lerret, seconded by Ms. Defillo, with all in favor, the Board of Supervisors approved the Minutes of the Board Supervisors Meeting held on August 19, 2019, for Avalon Park West Community Development District.

Maintenance Expenditures for August 46 and September 2019 47

48 Mr. Huber presented the Operation and Maintenance Expenditures for August and 49 September 2019 to the Board of Supervisors. 50 51

On a Motion by Ms. Lerret, seconded by Ms. Defillo, with all in favor, the Board of Supervisors approved the Operation and Maintenance Expenditures for August 2019 in the amount of $5,356.69 and September 2019 in the amount of $5,604.76, for Avalon Park West Community Development District.

52 FIFTH ORDER OF BUSINESS Consideration of Series 2019 Bond 53

Anticipation Notes 54 55 Mr. Brizendine reviewed the Final Special Assessment Allocation Report, 56 explaining that the Bond Anticipation Notes have been issued. The assessments will 57 initially be levied on acreage basis for the unplatted land and the assessment levels in 58 the report are based on the existing development plan of 903 residential units. 59 60

On a Motion by Ms. Defillo, seconded by Mr. Halle, with all in favor, the Board of Supervisors accepted the Final Special Assessment Allocation Report, as discussed, for Avalon Park West Community Development District.

Mr. Babbar reviewed the resolution for the Board noting that it essentially ratifies the 65 execution of the documents associated with the Serie 2019 Bond Anticipation Notes. 66 67

On a Motion by Ms. Defillo, seconded by Ms. Lerret, with all in favor, the Board of Supervisors approved Resolution 2020-01the assessment resolution for Avalon Park West Community Development District.

On a Motion by Mr. Lerret, seconded by Ms. Defillo, with all in favor, the Board of Supervisors accepted Marta Pierluisi’s resignation as Board Supervisor for Avalon Park West Community Development District.

Mr. Babbar reviewed updated policies and fees for the Amenity Center and a brief 87 discussion ensued. Mr. Babbar noted that a public hearing would need to be held before 88 a formal vote on the policies could be made. 89 90

On a Motion by Mr. Halle, seconded by Ms. Lerret, with all in favor, the Board of Supervisors approved the proposed amenity center policies and fees in substantial form and set the public hearing for January 6, 2019 at 10:00 a.m. for Avalon Park West Community Development District.

91 TENTH ORDER OF BUSINESS Consideration of Resolution 2020-02 92 Re-Designating the Fiscal Year 93

2019/2020 Meeting Schedule 94 95

A brief discussion was held regarding the revised meeting dates, with a request 96 being made that the December meeting be cancelled and one set for January 6th at the 97 same time. It was stated that the Board would like to move all meetings to the Avalon 98 Park West Amenity Center, located at 5060 River Glen Boulevard, Wesley Chapel, FL 99 33545. 100

On a Motion by Ms. Defillo, seconded by Mr. Halle, with all in favor, the Board of Supervisors approved Resolution 2020-02, re-designating the fiscal Year 2019-2020 as discussed and authorized Staff to submit the required publication for Avalon Park West Community Development District.

109 Mr. Babbar reviewed the resolution for the Board and a brief discussion was held 110 regarding varying the percentages due for each of the dates. 111 112

On a Motion by Ms. Defillo, seconded by Ms. Lerret, with all in favor, the Board of Supervisors approved Resolution 2020-02, Amending Due Dates for Direct Bill Components of Debt Assessments, as amended, for Avalon Park West Community Development District.

113 TWELFTH ORDER OF BUSINESS New Business 114 115 Discussion was held regarding obtaining a key box, and a bulletin board for the 116 Amenity Center, installing a combo lock on the pool gate. RESOLUTION 2020-03

A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE AVALON PARK WEST COMMUNITY DEVELOPMENT DISTRICT ADOPTING RECREATIONAL FACILITIES POLICIES (INCLUDING ACCESS CARD FEES, RENTAL RATES, AND NON-RESIDENT USER FEES); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the Avalon Park West Community Development District (the “District”) is a local

unit of special-purpose government created and existing pursuant to Chapter 190, Florida Statutes; WHEREAS, the District owns, maintains, and operates certain recreational facilities;

WHEREAS, the Board of Supervisors of the District (the “Board”) is authorized by Sections

190.011(15) and 190.035, Florida Statutes, to establish policies and adopt rate and fee schedules for its recreational facilities;

WHEREAS, the Board held a noticed public hearing on January 6, 2020 to receive public comment

on the proposed “Recreational Facilities Policies”, which includes access card fees, rental rates, and non-resident user fees; and

WHEREAS, after hearing and considering public comment, the Board has determined that the Recreational Facilities Policies should be adopted.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD:

1. Adoption. The Board hereby adopts the Recreational Facilities Policies and the rate and fee

schedules included therein, as finalized in the form attached hereto as Exhibit A.

2. Conflicts. All District resolutions or parts thereof or other adopted policies in actual conflict with this Resolution are, to the extent of such conflict, superseded and repealed.

3. Severability. If any section or part of a section of this Resolution is declared invalid or unconstitutional, the validity, force and effect of any other section or part of a section of this Resolution shall not thereby be affected or impaired unless it clearly appears that such other section or part of a section of this Resolution is wholly or necessarily dependent upon the section or part of a section so held to be invalid or unconstitutional.

4. Effective Date. This Resolution shall become effective upon adoption. PASSED AND ADOPTED ON JANUARY 6, 2020.
