MEMORANDUM ORDER NO. 2012-39
AUTHORIZING THE PHILIPPINE COCONUT AUTHORITY (PCA) TO FILLNINETY-SIX (96) REGULAR PLANTILLA POSITIONS.
WHEREAS, the PCA has requested for authority to fill one hundred fifty (150)regular plantilla positions as an exemption from the pertinent provisions ofExecutive Order (E.G.) No. 366, s.2004, and DBM Circular Letter Nos. 2009-13and 2011-14;
WHEREAS, the Governance Commission for GOCCs (GCG) pursuant toRepublic Act No. 10149 (R.A. No. 10149) mandates the GCG to "evaluate theperformance and determine the relevance of the GOCC, to ascertain whether suchGOCC should be reorganized, merged, streamlined, abolished or privatized, inconsultation with the department of agency to which a GOCC is attached";
WHEREAS, the Commission has determined that it is in the best interest ofthe State and the public to allow the PCA, in the latter's pursuit of its vitalprograms, to fill ninety-six (96) positions as enumerated hereunder;

RESOLVED, the request of the PCA to fill the following positions is herebyAPPROVED:

RESOLVED FURTHER, that theSUBJECT TO THE FOLLOWING:
authorization to hire the foregoing is
1. In case such positions are excluded in the staffing pattern under theapproved PCA Rationalization Plan, the appointees to these positionsshall exercise the options available under E.O. No 366;
2. Funds for the purpose shall be taken fully from the corporate funds ofthe PCA, included in its Corporate Operating Budget as approved byits Board of Trustees; and
3. The pertinent civil service, budgetary, accounting, auditing and otherapplicable laws, rules and regulations shall be complied with.
