P.W. 2269/23.WHEREAS it is provided by Section 233 of "The RoadDistricts Act, 1919," that rates throughout a districtshall be uniform, except in so far as a Board may fixthe rates for any townsite or any area defined for thatpurpose by proclamation at a higher figure within thelimits in the said section set forth: And whereas it isdesirable to approve of and define the area hereinafterdescribed as an area within which the Bruce Rock RoadBoard may rate at such higher figure: Now therefore

the said Governor, by and with the advice and con-sent of the Executive Council, do hereby approve of anddefine the following area, viz.:

All that territory being portion of Kwolyin A.A. No. 6174/22.WHEREAS by Section 42 of "The Land Act, .1898,"it is made lawful for the Governor to direct- that anyReserve shall vest in and be held by an Municipality,Road Board, or other person or persons to be namedin the order, in trust for any of the purposes set forthin Section 39 of the said Act, or for the like or otherpublic purposes to be specified in such order: ,Andwhereas it is deemed expedient that Reserve No. 18927(Wadderin Hill), _should vest in and be held by theHonourable the Minister for Water Supply, Sewerage,and Drainage, in trust for the purpose of Water: Now,therefore, His Excellency the Governor; by and withthe advice and consent of the Executive Council, clothhereby direct that the before-mentioned Reserve shallvest in and be held by the Honourable the Minister forWater Supply, Sewerage, and Drainage, in trust for thepurpose aforesaid; subject, nevertheless, to the powersreserved to him by Section 41 of the said Act.

No. 1756/90.WHEREAS by Section 43 of ''Time Land Act, 1,898,"it is made lawful for the Governor, by Order in Council,without issuing any deed of grant, to place any Reserveunder the control of 'any Municipality, Road Board, orother pm-son or persons, as a Board of Management, andto empower such Board to make, repeal, and alter by-laws for the control and management of such Reserves,and prescribe fees for depasturing thereon, and forother piirposes, .. such by-laws to be approved by theGovernor and published in the Government Gazette:And whereas it is deemed expedient that Reserve 1755for the purpose of a watering place for travellers andstock, near Jennacubbine, should be placed ,under thecontrol of the Goomalling Road Board, as a Board ofManagement: Now, therefore, His Excellency the Lieu-tenant-Governor, by and with the advice and consent ofthe Executive Council, doth hereby place the befere-mentioned Reserve under the control of the GoomallingRoad Board, as a Board of Management, and doth em-power Such Board to make, repeal, or alter' by-laws forthe control and management of the said Reserve; forprescribing fees for depasturing thereon; for directingthe manner in which such fees shall be imposed, paid,collected, and disposed of, and to impose penalties notexceeding in any case £5 for any breach thereof, and £2a day for a continuing breach, but not more than £20in the aggregate.

Proposed Loan of £5,000.NOTICE is hereby given that the Bayswater DistrictRoad Board proposes to borrow the amount of Fivethousand pounds sterling (£5,000).

This amount is proposed to be raised by the sale ofdebentures repayable Twenty-five (25) years after thedate of issue thereof, and bearing 'interest at the rateof Seven pounds per cent. (£7 per cent.) per annum,payable half-yearly.

The amount of the said debentures and interestthereon is to be paid at the office of the BayswaterDistrict Road Board, Bayswater.

A sinking fund is to be provided at the rate of twoand one-half pounds per cent. (£2 10s. per cent.) perannum of the amount of the said loan, in accordancewith the provisions of " The Road Districts Act, '1919."

No person shall construct or cause to be constructed aSeptic Tank or bacteriolytic system; for the treatment ofsewage which does not comply with the following con-ditions:

A sketch plan showing the design, situation andconstruetiou together with all connections, shallbe submitted to and approved, by the LocalAuthority, and a copy of same deposited withthe Local Authority.

(b) Every tank shall he of brick, lined with cement,or of some impervious material approved by theLocal Authority.

Every tank shall be sufficiently covered to thesatisfaction of the Local AuthOrity.

Every tank shall be provided with a manhole withgastight cover composed of iron, slate, stone, orother approved impervious material, so placedas to allow of ready inspection.

(e) The aerobic portion of every tank shall be pro-vided with an approved method of ventilation,and the openings of all tanks shall be mademosquito proof by means of brass wire gauze.

All drains, fittings and connections of tanks shallbe in conformity with the regulations of theMetropolitan Sewerage and Drainage Depart-ment.

The effluent of every tank shall be discharged intoa soak well constructed in accordance with By-law No 25, or otherwise disposed of to thesatisfaction of the Local Authority.

(11) Water closets, slop sinks, and urinals only shallbe connected with any tank.

(i) No persons shall allow any stormwater or surfacedrainage to enter any tank.

CD No person shall allow any rubbish, disinfectant, orinsoluble matter to enter any tank, or to be de-posited in the pan of any water closet or urinalconnected with any tank.

REGULATIONS UNDER "THE WORKERS' COMPENSATION ACT,1912-1924."

1. Every medical cmtiticate to the effect that a worker is free from pul-monary tuberculosis, pneumoconiosis, and miners', phthisis, as required by Section7, Subsection 11 of "The Workers' Compensation Act, 1912-1924," shall be inForm A,.

2. Notice that a worker is suffering from a disease mentioned in theThird Schedule of "The Workers Compensation Act, 19124921," shall he sub-mitted by the employer to the Registrar in form B. Wherever the disease suf-fered by a worker is one which is marked in the Third Schedule with an asterisk,notice of such disease shall be submitted in duplicate by the employer (Sec-tion 8 (1.)).

3. Notice that a pal hint is suffering from a disease mentioned in the ThirdSchedule to "The Workers' Compensation Act, 1912-1924,- shall he submittedby the medical practitioner to the Commissioner of. Public Health, in form C.(Section 8 (2.)).

4. Notice of an accident to a worker shall be submitted by the employerto the Registrar in form D. (Section 8 (3.) ).

5. (1.) Every application for, exemption from the provisions of Section 10oil ''The Workers' Corulieu.a I ion .Act, 1912-1924," shall be in form F. Such appli-Cation, shall be accompanied by the sum of I:5,000 or a bond or guarantee of aninsurance company or bank, in form F, or such securities (to the value of £5,000)as the Registrar. with the approvaror the Minister, may accept. In accordancewith "The Insurance Companies Act, 1918," interest on cash deposited at theTreasury shall be paid at the rate of 41/2 Per cent, per annum. Each bond or guar-antee shall be for a period of at least twelve mouths and shall be deposited withthe Colonial Treasurer. Every application for exemption shall state in respector the business to be exempted:

(a) The amount oil the Fund.(b) The number of employees.(c)The, annual amount or wages or Salaries of the employees v,ming. within

granted and it shall not have any force or effect beyond that period.(I. Each employer who has obtained exemption from the provisions of Sec-

tion 10 of the Workers' Compensation Act shall, not later than 1st September ineach year, submit such particulars of the accidents sustained by workers andthe compensation paid during tile twelve months preceding the last 30th day ofJune as the Registrar may require..

(2.) A worker in receipt of weekly payments shall not be required, after aperiod of one month has elapsed from the date on which the first payment ofcompensation was made, to submit himself, against his will, for examination bya medical practitioner provided by the employer except at the following: inter-vals:Once a weel«luring the secend, and once a month during the third, fourth,fifth and sixth months, after the date, of the first payment, and thereafter oncein every two months.

Provided that where, after the second month, an application has been madeto a Local Court for a review of the weekly payment, the worker may be required,pending and for the purposes of the settlement of the application, to submithimself to an additional examination.,

References to medical referee.8. (i) A worker who has procured such a certificate as is mentioned in

Subsection (8) of Section 7 of the Act shalt forthwith furnish a copy thereofto the employer. When any employer disputes such a certificate he may, withinseven days after receiving a copy thereof, apply to the Clerk of the Local Courtfor the matter to be referred to a medical referee: Provided that it shall he withinthe discretion of the Clerk, on good cause being shown, to extend in any case bynot more than ten days the period within which the application is to be made.Such extension may be granted although the period of seven days shall have ex-pired.

(2.) An application under this section shall be in writing and shall be ac-cording to the form G hereto and shall he accompanied by a copy of the certificateof the medical referee.

(3.) The Clerk shall forthwith refer the matter to the medical referee andshall forward to him the relative documents.

The Clerk shall also deliver or send, by registered post, to both parties con-cerned a copy of the reference, and shall also -send to the worker copies of theother documents forwarded to the medical referee.

9. (1.) The medical referee shall, on receipt of a reference under the lastpreceding regulation, send a notice to both parties concerned according to form11 or I in the schedule., and in fixing any time or place for the examination thereferee shall pay due regard to the condition or alleged condition of the worker.

(2.) Before giving any certificate the medical referee shall personally examinethe worker, and shall consider any statements that may be made or submitted byeither party.

The certificate given by the medical referee shall be according to the Form"J" in the Schedule hereto, as the ease may require, and shall be forwarded bythe referee to the Clerk of the Court from whom he received the reference, andthe clerk shall send the parties notice that he has received such report.

10. The following shall be the scale of fees to be paid to medical referees inrespect of references under the Act:

(1) For a first reference (to include all duties performed in con-nection therewith) .. .. .. .. . ..

(2) 1"or a second or subsequent reference to the same medical re-feree in the same ease .. .. .. .. .. ..

(3) Where, in order to examine the injured or sick worker, the medi-cal ,referee is compelled to travel to .a place distant more thantwo miles from his residence or surgery, in addition to theabove fees, for each mile exceeding two miles .. .. ..

(4) When the medical examination is held within the magisterialdistricts of Kimberley bast, Kimberley .West, KimberleyGoldfields; Broome,, Roebourne, Pilbara, Port Eedland, Ash-burton, Peak Hill, Gascoyne; Mureliisou, Murchison East, Mt.Margaret, Yalgoo, Coolgardie North, Broad Arrow, Coolgar-die, North-nisi, ceolgardie East, Yilgarn, Dundas, PhillipsRiver, or .Esperance Hie fees under items (1) ana (2) shall,respectively, be increased by .. .. 0 10 0

Appeals.

11. (1.) An appeal to a Medical Board under Section 14, paragraph (b), ofthe First Schedule to the Act shall be brought by the party appellant giving noticeto the other party and to the Clerk of the Court wifliin 10 days after the reportof the medical re!'er-e has lmcn lodged with the Clerk. statilm. tir't !c; is dissatis-fied with such re Pori, and desires to apreal therefrom to a.'Meaical Board.

(2.) The Clerk shall forthwith send notice to the Registrar that such, appealhas been instituted, and request to be informed of the names of the persons whoconstitute the Board and of the time and place when such Beard will hear theappeal.

(3.) The persons to constitute such Board shall be such as are approved bythe Minister, and the time and place of the sitting shall be fixed by the Board,and the Registrar' shall furnish information oi' the names of the members of theBoard and of the time and place of the sitting to the Clerk of the Court in accord-ance with the Clerk's request.

(4.) On receipt of a reply from the Registrar giving the names of the mem-bers of the Board and the time and place of sitting, the Clerk shall notify theparties thereof.

(5.) The part 4,5', shall attend before the lloard it the time and place appointed,amid shall mch evidence as they .may, respectively, desire the Board to hear,and the Board ii 1! its own motion Call ally evidence and require any examin-ation to be made, and in Formation to be procured vIle1 it may consider necessary.

(7.) The Board, shalt embody its decision in a report-, which shall he signedby the members of the Board, and shall be forwarded to the Clerk of the Court,who shall communicate the contents thereof to the parties.

Enforcing charge on property.12. (1.) The eharge created by Section 20 of the Act may be enforced by

sale of the property, subject to the charge, at such times, in such manner, andsubject to such conditions as the Court awarding compensation or damage orders.

(2.) For the purpose of this Regulation, the Court may make orders fromtime to time either on its own motion or on the application of the party entitledto compensation.

Fees.

13. All fees which may be received by the Registrar under or by virtue ofthese Regulations shall be paid into the Treasury to the credit of the generalrevenue.

Modification of forms.1.4. When anything is required to lie in any of the forms in the Schedule, it

shall be sufficient if it be to the like effect and any of such forms may be modifiedto suit particular cases.

Submission of statutory declaration as to amount of salaries mid .wages paid.15. Every employer who has not obtained exemption from the provisions of

Section 10 of the Act shall furnish to the approved insurance office with whom heis or was insured, or desires to effect an insurance, a statutory declaration show-

ing the amount of salaries and wages paid to, and the value of keep provided for,the employees engaged in the business described in the policy and coming withinthe provisions of the Act.

Such declaration shall he in form "K," and in the ease of a company shallbe made by the secretary, and in the case of a firm shall he made by one of thepartners.

Such declaration shall be made by(1) The employer who is insured within one month after the expiration of

each period for which the policy was effected or renewed.(2) The employer who desires to effect an insurance at the time of effecting

such insurance.16. These Regulations may be cited as "The Workers' Compensation Regu-

lations, 1925."
