The District Collector welcomed the gathering present at the public hearing meeting.

He informed that public hearing is conducted for enhanced production of limestone mine of

M/s. The India Cements Limited at Ramayanpatti Village, Tirunelveli District, for which the

project proponent will now explain about the Environmental Impact and Management

report. He requested the public to inform their Name and village before expressing their

views on the project. The District Collector requested the project proponent of M/s. The

India Cements Limited to explain about the proposed expansion project and summary of the

Environmental Impact Assessment.

Thiru Giri, M/s. Creative Engineers & Consultants, Chennai

He informed that mining was done as per GO. Ms. No. 813 of Govt. of Tamil Nadu

which is adjoining with other mining issued under GO Ms. No. 526. The particular mine

was started in 1962 which is owned by The India Cements Ltd., and applied for Terms of

Reference from the Ministry of Environment and Forests, Delhi for the enhanced production

of 2.52 lakh tonnes per annum. He explained on the Topo Plan, location with rainfall,

sensitive area located nearby like the Gangaikondan Deer Park at 8.7 KM, life of

mine, etc. The present state of Environment as base line data is also explained with respect

to Air, Water and Soil. He cited that no appreciable impact is expected. On the socio-

economic measures, he informed that the unit has proposed to take need based assessment

with an expenditure of Rs.100 lakhs for the next 5 years with priority of works. He

expressed hope to have less impact due to the enhanced mining.

PUBLIC OPINION:

Mr. S.P. Muthuraman, Environmentalist, Sankarnagar

He informed that before 2006, there was no Public hearing meeting and because of

Environmental Impact Assessment Notification, Public Hearing becomes possible and for

that he thanked the Ministry of Environment and Forests. The India Cements Mining were

operated with enhanced production even before ten years back without obtaining prior

Environmental Clearance. He questioned whether inspection was carried out by Tamil

Nadu Pollution Control Board officials in the violation period. He also questioned how the

CTO was issued for the mining and the permission was obtained illegally. The Ministry of

Environment and Forests does not know the fact and instructed to proceed legal action. The

Tamil Nadu Pollution Control Board has permitted the mining without prior Environmental

Clearance. The District Collector should initiate action to include the right offenders who

were left to safeguard the Industry Administration and without correctly mentioning the

offenders, report has been forwarded to Delhi and so the Terms of Reference was issued.

The then District Environmental Engineer fully supported the industry and action shall be

taken against him.

The Office Memorandum dated 27.06.2013 opens the back door for obtaining the

Environmental Clearance illegally. The Hon'ble National Green Tribunal stayed the Office

Memorandum and the Terms Of Reference was issued on 08.10.2014 in violation of the

stay granted. He also informed a petition has been given to the District Environmental

Engineer before 20 days to include the right offenders. The right offenders shall be

informed to the Ministry of Environment and Forests and this Terms of Reference shall be

reviewed. He also informed that a petition has been filed before the District Environmental

Engineer to allow the individual to visit the mining site for which no reply is received yet.

The height of the ramp is much increased like a hill. In the social welfare activities,

the Rajakkamangalam Village is totally neglected. Other mines also operated nearby He

also accused that no CSR activity is properly done in nearby villages. He also informed that

heavy blasting is carried out and Rajakkamangalam Village is affected. He also informed

that the mining is carried out even below the ground level which affected the ground water.

He also cited that other mining owned by other institutions are also in operation and so the

grazing of the cattle of the local villages is greatly affected. Regarding Green Belt, he

informed that the trees are developed only for the name sake and the unit is discouraging the

entry of the public within the mining area and the cement division. He also said that there is

no employment generated and the already employed people are indirectly forced to go on

voluntary retirement.

Mr. S. Dakshinamoorthy, DGM (QA & Envt.), The India Cements Ltd., Sankarnagar

He informed that in 1992, a combined consent granted by Tamil Nadu Pollution

Control Board for of all limestone mines of ICL located in Tirunelveli district with the

consented quantity of 8.16 Lakh MT per annum. While appraising our project, the Ministry

has observed that the five mining leases only will be considered in isolation for granting

Environmental Clearance. Due to the variation on the production level noted from 1993 -

2014 with respect to the 5 mining leases for which the applications were submitted. It was

concluded by the Committee as a case of violation and the Ministry has directed to adhere

the Office Memorandum issued by the Ministry of Environment and Forests for further

consideration. In adherence to the Office Memorandum, the Board of Directors of ICL had

passed a resolution informing that such violations will not be repeated in future. Also the

Tamil Nadu Pollution Control Board initiated credible action as suggested in the Office

Memorandum and the proceedings is pending before the Hon’ble Judicial Magistrate

Court-V, Tirunelveli. He also informed that variations cited in the mining of Limestone is

not altered and it is verifiable with the royalty paid statement and District Collector’s

proceedings. Under the circumstances the petitions submitted by TNPCB did not alter the

violation period. He claimed that all steps upto this point of time is in adherence to the

procedures laid by the Ministry, hence there is no need to review the ToR already issued.

Regarding trespassing in the mining area, he said that road is being used by the

public and there is no restriction. For entering into the leasehold area the permission is very

much required so as to ensure the safety of the visitors. In the Cement Plant area, he

informed that necessary permission shall be obtained to visit the cement plant. In future he

expressed their desire to meet the local people directly. The schools and polytechnic

managed by India Cements is not only meant for their employees and since the inception of

the educational institutions the management is extended these facilities to the local residents.

This fact is well supported by the present strength of these educational instituions at the tune

of around 2500 in the school and 500 in their polytehcnic college. Already CSR activities

were carried out for about Rs. 190 Lakhs and for the next five years about Rs.100 Lakhs

already allocated to spend for 5 leases covered in Sethurayanpudur, Ramayanpatti and

nearby villages. He also expressed that the villagers can approach the industry for their

needs and the same will be considered within the financial allocation made. He also

expressed to participate in the schemes along with the Government through Self Supporting

Scheme.

Mr. P. Ramasamy, AVP(Mines), The India Cements Ltd., Sankarnagar

He informed that the waste dump can have a maximum height of 30 Metres from the

ground level as per the rules and regulations. But at present, waste dump height is around 17

to 23 metres only. Regarding heavy blasting, he informed that the blasting is carried out as

per the guidelines of Director General of Mines Safety which prescribes the standard of

vibration level for various structures. For domestic area the acceptable limit is 15 mm per

second. He also informed that regular measurements taken within 300 to 400 meters

distance which shows a vibration level of 3 to 4 mm per second only. Under these

circumstances with due adoption of controlled blasting, he rejected the accusations of

vibrations in the area. He also invited the public to be present at the time of taking

measurements in future. Even the reputed Institutions carried out the vibration study.

Regarding ground water, he informed that the reputed institution has certified that the rocks

available in the mining is a compact one and there is a least possibility for the seepage of

ground water into the mining area. The rain water is only accumulated in the mine pit. The

Public Works Department which monitors the three observation wells located in the nearby

area and reported that there is no appreciable variation in the ground water table level and on

consideration of the facts and observations, this area is declared as safe zone. He also cited

that the ground water depletion is not because of the mining activities carried out at the site.

Regarding Green Belt, he informed that 3500 saplings are planted recently along the dump

slopes etc. and the same is maintained as mentioned in the Environment Management Plan.

Mr. S. Dakshinamoorthy, DGM (QA & Envt.), The India Cements Ltd., Sankarnagar

He informed that the mining is in operation since 1962 over an extent of 28.43

hectares and no additional land will be acquired for the said production enhancement. He

requested the public not to have any fear on this.

Mr. S.P. Muthuraman, Environmentalist, Sankarnagar

He informed that only the Ministry of Environment and Forests has found the

violation in the mining. He also informed that the public can file a criminal case under

section 19b and under this provision, he filed a case against the India Cements Management

and the unit has obtained a stay in the Hon'ble High Court citing that the company was not

included as a party. On the India Cements Captive Power Plant, he questioned that whether

the company was included as a respondent.

Mr. Devendran, Pallamadai

He questioned that how many people are employed in the organisation since 2010.

He also informed that more employees were working earlier in the company and at present

they have been sent with retirement money to their home. He doubted about the educational

help given by the India Cements Limited and informed that in the Schools and Polytechnic

run by the unit, only the seats are given for the known and supporting people. The coolie

people in this area now started to give higher education to their wards, which is not because

of this company's educational help. In Naranammalpuram village, which is located at 1.5

KM away, the vibration due to blasting is high. In his native village which is 5 to 6 KMs

away, he feels heavy noise and expressed the noise will be very high within 1.5 KM. This

blasting vibration results in miscarriage of woman. The Mangamma Salai is destructed and

so they have to travel a long distance to reach their destination. He questioned the area

occupied by the mining is under actual lease or encroached. Regarding the cement plant, he

said that the dust and smoke causes disease. Trees are having white leaves. He requested to

control the dust emission and safeguard the existing trees. He also informed that he has seen

tree plantations in the unit area which is not watered properly and the saplings were already

dead. He also informed that the Manur and Pallamadai tanks are depleted of its water

because of the mining activity and the unit restricted the revamping activity by the Public

Works Department. Because of the intervention of the District Collector recently, he

informed that ponds are full with water. He also informed that the Semboothu, Nariyuthu,

Pooliyuthu and all other water resources are destroyed. He questioned the number of

graduates employed from this local villages in this cement plant since 1946 and informed

only the Coolies are taken for the company. He expressed that the unit is in the process of

its enhanced production when local public expects closure of the unit. He requested the

District Collector to form High Level Committee to investigate and close the mines.

Mr. S. Dakshinamoorthy, DGM (QA & Envt.), The India Cements Ltd., Sankarnagar

He informed that India Cements is having 247.64 Hectares of patta land for mining

operations and its allied activities in this area. No encroachment is made for carrying out the

mining operations. He assured to clear the obstruction if any, in the Mangamma salai as

stated. This area normally receives rainfall during the North East Monsoon and he informed

that the overall rainfall gradually decreased. So the water resources are diminishing and not

because of the mining activity. He informed to carry out the Manur Tank channel

revamping through participative scheme and there is no intention to affect the basic needs of

the public.

Mr. Sahul, Thalaiyuthu

He requested the public present at the meeting to approach the issue scientifically

rather than emotionally. Sankarnagar Cement Industry is existing for the last 60 years and

the nearby people expect schemes both from the Government on the one side and the India

Cements on the other side. It is right for the nearby villages to approach the cement industry

for their infrastructure facility and informed that the Tenkalam quarry road was extended for

1.5 KM length at a cost of Rs. 1 crore which is used by more than 95 % of the public

transport only. This cement road will exist for the next 50 years. The Sankar Polytechnic,

an Institution of the company is serving for the local villages. He expressed that his kids are

studying in the nearby school by paying Rs. 200/- only as annual fee. He also informed that

water tanks are constructed and opened by the cement industry authorities. He also

informed that for the development of the nation, the cement price should be under control.

Even if there are shortcomings on pollution control, he expressed that benefits through

Polytechnic, School etc. are extended regularly.

Mr. Devendran, Pallamadai

He informed that the public welcome more industries in Tirunelveli District. But

The India Cements pollutes the environment in an alarming level. He also informed that

the unit exploits national resources. He expects assurance from the unit to revamp the

Manur and Pallamadai tanks or otherwise mining shall be closed.

At this stage, Thiru. Sahul, Thalaiyuthu stood up to speak again for which certain section

of public jointly opposed to express the opinion by the said individual in support of the

project. The other people generally tend to express their opinion also stood up in the

meantime. The District Collector and the District Environmental Engineer, TNPCB

pacified the crowed to keep calm and to occupy themselves in chair. At this juncture

certain section of the crowed left the hall voluntarily. This event lasted for about 5

minutes and then the Public Hearing was continued.

Mr. Venkatachalam, FEDCOT, Representative

He informed to keep all the norms issued by the Government during mining and to

ensure no impact for the nearby deer sanctuary. He cited the cement price is less in Kerala

against the high price in Tamil Nadu.

Mr. S. Dakshinamoorthy, DGM (QA & Envt.), The India Cements Ltd., Sankarnagar

He informed that the deer sanctuary is within 10 KM from the project site and as per

the EIA notification, the proponent submitted application to get NOC from the National

Board of Wild Life. He also informed that Rs. 57.24 Lakhs is nodded for the management

of wild life in the deer sanctuary as part of the requirement for obtaining this NOC from

National Board for Wild Life (NBWL) and also for carrying out the enhanced production

activity.

Public of Sethurayanpudur Village

He informed that the impact of India Cements is high and the water channel is

encroached. He also said that the Public Transport in the Sankarankoil Main Road is

stopped during blasting timing and the nearby new buildings are cracked because of

blasting. There is no rain due to mining. Since Mangamma salai and the Sankarankoil

roads are encroached, the transport becomes tougher. He also accused that the Polytechnic

run by the India Cements is not serving the rural students and there is no employment for the

educated youth. Only the Talaiyuthu area people are enjoying the benefits. The rain water

channels are destructed. The explosives in 40 feet depth drillings were used and necessary

instructions shall be made. The unit is not paying tax for Sethurayanpudur and there is no

use for the public of this area. The encroachment shall be removed which obstructs the

transportation and requested to ban the mining industry.

Mr. S. Dakshinamoorthy, DGM (QA & Envt.) The India Cements Ltd., Sankarnagar.

He informed that the Mangamma salai will be opened if at all any obstruction found

and necessary fencing will be provided so as to ensure the safety for the public. Blasting is

carried out as per the guidelines issued by the authorities concerned. He also assured to take

corrective measures if any, for life support, infrastructural development will be taken to the

notice of the management. He also said that the allegations made by the public are very

general in nature without mentioning anything specific. He also cited necessary inspections

are carried out by various Government Departments which ensures there is no rule

violations. The reputed institutions were engaged to carry out the field studies and certified

and recommended the steps to carry out the mining operations. He also assured to meet the

people of the rural villages directly in future and requested the public to make comments

scientifically.

Tmt. Aruna Packiaraj, Nanjankulam

She informed that her husband met with an accident while he was working in the

India Cements Cement Mill and admitted in the High Ground Govt. Hospital. She

expressed that the education of their children was ruined because of the non support from

the India Cements and spent lot of money to keep her husband in good health after accident.

She said that the Mill is not approaching the right people in the nearby villages. She also

said that the India Cements Ltd., does not encourage to employ her son who was qualified in

I.T.I. under compassionate ground in cement mill even after repeated entry into the mill.

She said that serious and severe restrictions were made at the India Cements Plant main gate

while entering and said that only Rs. 800/- was paid as pension. She also said that she has

not filed any suit against the company with the hope to obtain employment for her son. She

requested the mill management not to approach individuals in the nearby public, but to call

the general public for discussion. She also informed that management has given only Rs. 7

Lakhs as compensation whereas she spent Rs.15 Lakhs for her husband's medical expenses.

She is not able to pay the fees to the Polytechnic for her son. She expects to support the

revamping of the Manur tank which will improve agriculture in the nearby areas. She

expressed that Rs. 300/- per month is required for her husband's medical expenses. She also

said that no tax is paid to Nanjankulam, and the company is not supporting to buy subsidised

cement bags at lesser price for lessor quantity requirement like 20 numbers of cement bags.

She also informed to revamp the Mangamma salai.

Mrs. Saraswathy, Nanjankulam

She said that the houses are affected because of blasting and more difficulties are

faced by the local public.

Mr. Pasupathy, Nanjankulam

He said that the villages are affected and the Nanjankulam village is more affected.

He cited that the removal of waste dumped from the land owned by Captain Rathinam who

speaks English very fluently but the same is not happening for other common people. He

requested to reduce the blasting in intensity and not to consider the opinion expressed in

support of the project. He also requested to conduct this Public Hearing in every village and

to restrict the mining depth. He cited four people only were employed in the cement plant

and no good activity is done by the India Cements.

Mr. S. Dakshinamoorthy, DGM (QA & Envt.), The India Cements Ltd., Sankarnagar

He informed that notice to pay tax has not been received from Nanjankulam Village

Panchayat and on receipt of the same this will be paid.

Mr. P. Somu, Nanjankulam

He said that mining is in the name of Nanjankulam. But the tax is not paid. In the

Polytechnic, the scheduled caste students are not admitted. These students from poor family

cannot afford to pay the fees. The India Cements Ltd., have developed the road only for

their lorry transportation and not for the public transportation. He said that the adverse

impact is more and entire public roads in Manur Panchayat Union are affected. He invited

the District Administration to have direct inspection and informed that both the Government

and The India Cements Ltd have not repaired the road. He informed that Mangamma salai is

affected and Manur tank is not revamped because of the objections raised by India Cements.

Mr.Sebastin, Tirunelveli Town:

He said that the cement produced in Tirunelveli are sold in the entire Tamil Nadu

including Chennai. But the adverse impact is only to Tirunelveli District. In contrast, the

cement price is high in Tamil Nadu than in Kerala. The Tirunelveli District lose its basic

life to help the other people to live in luxury. But the happenings in Andhra Pradesh is

different. He expects to reduce the cement price in Tirunelveli District.

Mrs. Padmarani, Panchayat President, Nanjankulam

She cited the improper handling of the accident victim of the earlier speaker Mrs.

Aruna Packiaraj. She informed that the facilities extended by the India cements are less and

requested to consider to provide 60,000 Litres overhead water tank facility. She also

requested to improve employment opportunity and to revamp the Mangamma salai. She

requested that the schools run by the India Cements Ltd., shall admit more students from

these villages and during blasting the vibration should be less. She also expects that there

should not be any adverse impact during the enhanced production.

Mr. Thangaraj, Office bearer of nearby Spiritual Organisation

He said that his organisation is located in between Sethurayanpudur and

Ramayanpatti. He informed that the situation becomes worse in the last 5 to 10 years. He

also stated that no new buildings, improved transportation have come in this area and the

greeneries are starved without water. Though the India Cements scientifically explained on

the vibration and the noise, he said that practically the noise, pollution and vibration are felt

in their buildings along with the depletion of ground water.

Mr. Gurunathan, Veppankulam

He said that there are lot of difficulties in establishing an institution which improves

the economic status of the area. He also said that the CSR activities are carried out by other

industries and it is not the intention of the cement industry to give hardship to the people.

He said that the people should approach the cement industry for the welfare activities. He

cited that more number of industries have closed down in recent years and informed that it

is easier to close down the unit and so he expressed support for the enhanced production.

Mr. Viswasam, Naranammalpuram

He expressed that the company employs 3000 labours at present and without the

India Cements Ltd., the area will be only a grave yard. He cited that the closure of the mills

in the nearby villages in the recent years and because of the new SIPCOT established, the

area is surviving at present. He also said the Rajavallipuram Hospital is well maintained by

the India Cement Ltd. and the support of giving stone and soil for necessary welfare activity.

He supported the enhanced production even though there are problems associated with it.

Public of Sankarnagar

He informed that the India Cements Ltd., developed schools, polytechnic and doing

CSR activities in this area. He requested to provide the same to all and requested the public

He said that there is no impact due to blasting and no noise is observed. He also said

He said that to ensure the safety measures while carrying out the blasting in specific

noon hours as prescribed by the authorities concerned, there is need to stop the movement of

vehicle in the said period so as to ensure the safety at a larger extent. He also mentioned that

the management is not restricting the usage of their roads for the public use and all the

people are using this road years together and the same will be continued. Hence the question

of restricting the public to use the quarry road is baseless.

Mr. Krishnan, Venkalapottal

He said that his village is located at about 1 KM away from the cement industry and

informed that ground water is not available even after 450 feet. The assurance to provide

well, Samathuvapuram and the pump were not provided by the India Cements. In

Madavakurichi and Venkalapottal and other villages, grazing is totally affected.

Mrs. Aruna Packiaraj, Nanjankulam

She said that there is no necessity to close down the company and requested that the

company to address the people directly instead of meeting the important people only. She

asked the unit authorities to meet the village public by forming a team. She also requested

India Cements Ltd., to issue subsidised cement even for lesser quantity and to meet the

common public to find some solutions and in the absence of the possible solution, they wish

Mr. S. Dakshinamoorthy, DGM (QA & Envt.) The India Cements Ltd., Sankarnagar

He expressed that since the public elected representatives are considered as the

authorised personnel, the social welfare activities are done through them as a practice as

being followed across the country. He also said that more of the welfare activities are done

by the company did not go to the light of the public. He requested the District

Administration to help the management to authorise a village committee from each village

so as to channelize Social Welfare Activities through them. Regarding Manur tank channel,

he informed that the subject is pending for over 12 years and within the budget allocated for

CSR activities, the company is ready to support the de-silting works under the self

supporting scheme. He also informed to meet the village public directly in future to ensure

the benefit goes to the public directly provided after the formation of village committee.

Mr. Gopalakrishnan

He said that 200 loads of soil is used for developing certain infrastructure and he

does not know whether this work is done through India Cements Ltd., or through the Village

Panchayat Administration. He also said that the bore is dry without water.
