TERMS & CONDITIONS

“ASSURE EARN MULTIWAYS PVT. LTD.” hereinafter Called “ The Company” and the undersigned applicant called the “TheApplicant” agrees as under:-

1. 2. Agency/Distributership with the Company and to abide by all the rules, regulations, policies and producers as detailed herein and amended by the Company from time to time at its sole discretion.3. The applicant upon joining known as “Independent Associate” is an independent Contractor (for all purpose, legal purpose, including income tax and otherwise), and is not an Employee/Legal Associate/Agent of the company or any other Independent Associate, nor a partership is created between the Independent Associate and the Company or any other Independent Associate by the agreement.4. That the Independent Associate is purchasing a membership which entities him to commissions/incentives as per the marketing plan of the company. That the various types of memberships offered are as per the brochure of the company. This membership entities him to the benefits as described in the marketing Plan/Brochure of the company solely dependent on the types of membership he/she purchses from the company. No guarantees as to the amounts of income are given or intended to be given by the company. Incentives/Commision if any, earned by the independent Agent are solely linked to the efforts put by him in marketing the membership of the company.5. Payment by applicant should be made only by way of draft/credit card/scratch card (issued by the company) in favour of “ ” payable at Jammu. The payment once made is refundable only as per refundASSURE EARN MULTIWAYS PVT. LTD policy of the company as outlinked in clause No. 6.6. The company reserves the right to refund any money recieved by it on any account. However no application for refund of any money shall be entertained after 24 hours from the time the person has purchased the membership. In case a refund is accepted by the company the company will issue a Reliance Policy in lieu of the refund.7. The Independent Associate shall not use the trade mark, patents or any other intellectual property like bussiness

information/literature for purpose other than promotion of bussiness of the company.8. The applicant is joining the company as Independent Associate as per his/her own understanding of the company’s products and the

company’s marketing plan and without personal obligation to any one. The applicant agrees that he/she has understood thecomplete bussiness plans and also understands that the company doesn’t owe him/her any money in the future in respect of his/herjoining.

9. In the event of death of the Independent Associate, all the rights and liabilities stand passed on to the nominee, if specified or in caseno nominee is mentioned to the nominee as per law. The nominee/successor will be bound by the terms and conditions of the originalindependent associate.

10. The Company holds the right to carry out changes in the bussiness plan, products range on sale, services etc., in the interest of the company and the independent associate shall abide by the changes affected.

11. Independent Associates shall pay all types of charges including service charges, meeting fess promotion charges, advertisement charges and any other fess or service charges as required by the company for the mutual betterment of the company and the independent associates.

12. The Company shall have the right to reject any application of distributorship without assigning any reason at any point of time and thecompany holds the right to terminate the independent associate if any statement or information made in the application form is foundto be false or misleading.

13. The Company holds the right to take strict action including warning, suspension and termination of Distributorship, if any independentassociate is found guilty on any of the following grounds i,e.

a) If any Independent Associate acts against the interest of the company or any other independent associate,b) If any Independent Associate is found to be engaged in any other multi-level marketing/networking marketing company or similar

schemes,c) If any Independent Associate is engaged/starts a litigation against the company or any other Independent Associate,d) If any Independent Associate is found guilty of re-introducing/fleeching/trying to fleece by giving any false promises or any other way,

any person introduced into the company by another Independent Associate within 3 months of the first introduction.e) Is found guilty of misrepresentation/fraud about the claims or the membership of the company.14. The right of the terminated Independent Associate to receive incentives/commission ceases immediately from the date of

termination. The right of a suspended associate to receive incentives shall be as decided by the company on a case to case basis.15. The company does not issue any kind of units, shares debentures to any Independent Associate.16. The company does not accept any deposits from any Independent Associate nor are any interest payments made.17. The Parties to this agreement do not owe any criminal liabilility onn account of entering into this agreement.18. The Distributorship rights of the Independent Associate cannot be sold, assigned or transferred to any other person without the prior

written consent of the company.19. Every independent associate understands that althrough he/she may refer other people to the program and earn, but the company

does not make any promises or guarantees of income flowing to the independent associate, apart from what he derives from hisefforts by working according to the program and the bussiness plan being propagated by the company.

21. This agreement is for a fixed period of one year from the date of the acceptance of the application by the company. The companyreserves the right to renew the same after the said period of one year either by charging any renewal fees or otherwise.

22. Any dispute between the company and the independent associate shall be referred for arbitration under the arbitration &concilialition act 1996, to the sole arbitrator, who shall be appointed by the company for the said purpose. The independent associateshall not raise any objection on the ground that the arbitrator so appointed is a person employed or in connection with the company.The award made by the sole arbitrator shall be final and binding on both the associate and the company. The venue of arbitrationshall be a Jammu only.

23. The company reserves the right to issue post dated chequea as advance commission. The said cheques will be solely at the discretion of the company and the clearing of the same will be dependent on any terms and conditions that the company may levyfrom time to time. The applicant agrees that if he does not fulfill such terms and conditions, he forfeits his right to proceed legallyagainst the company for any stopping/non-clearing of the cheques.

24. The Independent associate acknowledges that he/she has read and understood the terms and conditions set forth in this agreementand agrees to abide by the same.

The application once accepted, will create a binding on the said applicant to operate his/her own bussiness i,e.,major eligible applicant The should be a and also otherwise to enter into contact.
