1. The prices listed are VAT excluded and EX-WORKS (EW)

2. The goods are transported at the buyer’s risk, even in the case of a free delivery agreement. Any possible damages during the

transportation have to be claimed and notified on the Transportation Document within seven (7) days from the goods receipt.

3. The goods are considered delivered on the day they left our premises.

4. Should the delivery date not be fulfilled due to any force majeure independent from the Calux Srl actions, the buyer will have

no right to claim for compensations or indemnities resulting from loss of earnings or penalties and damages suffered.

5. The payments, unless previous written different conditions, have to be made to the company Calux Srl, Via Paduni snc – 03012

Anagni (FR) – ITALY. For any overdue payment the company will be forced to invoice bank interests.

6. The buyer declares to know and accept the product weights, surfaces, shapes, dimensions and any data and technical charac-

teristics, as described on the documentation published by Calux Srl.

7. The company Calux Srl reserves the right, without any notification, to make product modifications that could bring any improve-

ment.

8. Should a manufacturing defect be verified and claimed according to the procedures and time limits laid down by law, the

company Calux will decide to repair or replace the product; the buyer shall not be entitled to claim for any other compensation

for transport costs or any other damages occurred.

9. Any controversy or claim arising out will be handled exclusively by the court having jurisdiction in the address place of the

selling company.

10. Any possible product to be given back shall be authorized exclusively by our Management; should the product be in a perfect

condition, 80% of the purchase price will be paid back, increased of the transportation costs.

11. No claim will be accepted after eight (8) days from the receipt of the goods, or if the product has been installed without

following the information reported on the installation and assembly schemes delivered with the packaging.

12. The transport costs are charged to the buyer.
