En su primer año de funcionamiento, FLORA ha involucrado en sus pro-gramas a más de un centenar de artistas de América Latina, Estados Unidos, Europa y África, y ha contado con la asistencia de más de 10,000 personas a sus eventos e inaugura-ciones. Todas nuestras actividades son gratuitas, así que dependemos de becas, convenios y de la genero-sidad de un grupo de benefactores y amigos para poder llevar a cabo nuestros programas.

La presente subasta silenciosa tiene por objeto recaudar fondos para las actividades del 2015, incluyendo la consolidación de nuestra planta física con la apertura de una biblioteca más amplia y completa, y doce estudios para poder ofrecer más becas a artis-tas y curadores emergentes.

Además de adquirir para su colección obras de excelente nivel, escogidas por FLORA y los artistas especial-mente para este evento (muchas de ellas obras claves de su producción y en consecuencia difíciles de conseguir en el mercado), su participación en esta subasta nos ayudará a consolidar nuestro trabajo y así brindar un mejor y más completo servicio a los artistas y la comunidad en los años que vienen.

In its first year of operations FLORA has involved in its programs over one hundred artists from Latin America, the United States, Europe and Africa. Its events and exhibitions have been attended by more than 10,000 visitors. All our activities are free, which means that we depend for our financing on scholarships, inter-institutional agreements and the generosity of numerous patrons and friends.

This year’s silent auction intends to collect funds for our 2015 year activities, which include the consolidation of our facilities with the opening of a more spacious and complete library and twelve artist studios that will permit us to offer additional scholarships to fledgeling artists and curators.

Apart from acquisitions for its collection of works of art of first class level, which have been selected by FLORA and the artists especially for this event (many of which are key works of the individual artist production), your participation at this auction will help us to enhance our work and provide a better and more complete assistance to the artists and the art community in the years to come.

Durante el mes de octubre de 2013 se desarrolló en Honda, Tolima, el proyecto Estación de campo Honda, un proyecto de dibujo realizado por el artista norteamericano Mark Dion en colaboración con Dana Sherwood y un grupo de ilustradores confor-mado por los artistas Diego Benavides, Margarita Besosa, Olga Lucía García, Juan Pablo Gaviria, María Paula Moreno y Eulalia de Valdenebro, luego de una expedición científico/artística en Honda, Tolima. Dion y el equipo permanecieron en Honda poco más de una semana.

Participation Participation will follow the dynamics of a silent auction in which the offers and counteroffers will be received in a written form. Participation may be in person, either at the auction room or by telephone, or in absentia, in which the bidder will set a value of a maximum he/she is willing to pay for the lot and trust the staff at the auction room to be increasing the bid until the maximum stipulated.

These offerings, both in absence and in person are tabulated and their values will be available during the day of the auction. Phone bids will be received upon previous registration, and must be re-confirmed within a written form. Offers are not revocable under the terms of Article 846 of the Commercial Code.

In order to participate, you must register as a bidder by filling up and signing the registration form, which may be done either personally or by e-mail. Every bid shall be recorded on each bidder’s form, previously signed by the bidder. Time will be of essence in case that two or more offers are received for the same amount: in this case the first shall have priority over the second one, and so on.

Bids are due on Thursday, October 9, 2014, from 10 am to 9.30 pm, when the event of awarding of the artworks will take place accord-ing with the best bid received for each piece.

The exhibition runs until Saturday, October 11 at 2 pm and artworks that are still available could be purchased for an additional 10% of the base value stipulated in the catalog.

Participación Para participar en la subasta silente, se requiere inscribirse como postor diligenciando y firmando el formato de inscripción, lo cual podrá hacerse presencialmente o en ausencia vía correo elec-trónico. Cada oferta se registrará en el formato correspondiente de su postor, con su respectiva firma. Se tendrá en cuenta la hora de recibo de las ofertas, para el caso en que se reciban dos o más ofertas por el mismo valor.

La participación se hará mediante la dinámica de la subasta silenciosa, en la cual se recibirán las diferentes ofertas y contraofertas por escrito. La participación puede ser en presencia, bien en sala o por vía telefónica, o en ausencia, es decir, estableciendo el valor de la oferta máxima que se está dispuesto a pagar por el lote y se confía al encargado en la subasta de ir incrementando hasta el máximo autorizado. Estas ofertas, tanto en ausencia como presenciales se irán tabu-lando y sus valores estarán disponibles durante el día de la subasta. Se recibirán ofertas tele-fónicas previa inscripción y siempre que estas sean reconfirmadas por escrito. Las ofertas son irrevocables conforme los términos del artículo 846 del Código de Comercio.

Se recibirán ofertas el día jueves 9 de octubre de 2014, a partir de las 10 a.m. hasta las 9.30 p.m., hora en tendrá lugar el evento de adjudicación de las obras, conforme a la mejor oferta recibida para cada pieza.

La exposición estará abierta hasta el día sábado 11 de octubre a las 2 p.m. y se podrán adquirir a título de compraventa las obras que quedasen disponibles, por un 10% adicional al precio base estipulado en el catálogo.

CondicionesTodas las obras tienen un valor comercial y un precio base. El primero corresponde al rango en que se comercializan las obras en el mercado y

A percentage of the total value of the awarded bids will be for the FLORA ars+na-tura Foundation as a donation, as previously agreed with each artist. The Foundation shall then generate a certificate of donation to the awarded bidder. The balance shall go to the owner/artist of the work as the product of a commercial purchase and might generate a 16% sales tax, depending on the latter’s taxpayer category.

During the exhibition and the day of the auc-tion, October 9-11, 2014, those interested in participating may request information on each artwork, the artists profile and auctions terms and conditions. Artworks will be auctioned as they are and any bidder can file no claim as to their condition at the time of the auction.

Payment for each piece must be carried out within three (3) days after the closure of the exhibition, October 16, 2014, at the latest. Check, cash, money order or bank transfer may do payment. For prices of pieces expressed in Dollars, the amount shall be estimated on the basis of the current exchange rate effective at the time of payment.

Purchases of art works during FLORA 2014 auction do not imply transfer of the author’s intellectual property rights to their new owners (reproduction, public communication, process-ing, distribution, etc.)

The Foundation reserves its right to withdraw any artwork from the auction, either before or during the sales proceedings, with no respon-sibility whatsoever over the consequences of their withdrawal.

Durante el tiempo de la exposición y el día de la subasta, entre el 9 y el 11 de octubre de 2014, los interesados podrán solicitar información sobre cada obra, los artistas y las condiciones de la subasta. Las obras se subastan en el estado en que se encuentran, por tanto no podrá haber reclamación en cuánto su estado por parte del adjudicatario.

El pago de cada obra deberá realizarse dentro de los tres (3) días siguientes al cierre de la muestra, a más tardar el 16 de octubre de 2014. El pago podrá hacerse en cheque, en efectivo, orden de pago o por transferencia bancaria. Para las obras cuyo valor aparece en dólares, el monto se liquidará a la TRM del día en que se realice el pago.

La adquisición de las obras durante la subasta FLORA 2014 no genera la transferencia de los derechos patrimoniales de autor de éstas a su nuevo propietario (reproducción, comunicación pública, transformación y distribución, etc.).

La Fundación se reserva el derecho de retirar cualquier obra de la subasta, antes o durante el proceso de venta, sin incurrir en responsabilidad alguna por el retiro.

Delivery of the artworksAfter the price of the awarded piece has been paid fully, the artworks shall be delivered at the FLORA site, to the winners, or to their repre-sentatives duly authorized by them in a written form. Due to space limitations, the awarded pieces must be withdrawn within the seven (7) following days of the closing date, on Friday October 17, 2014, at the latest. Otherwise, administrative, handling and insurance costs will be charged until the time of withdrawal.

Each artwork shall be delivered by the Foundation accompanied by the documents of each lot, donation certificate and purchase supports.

According to Sipla requirements, buyers must sign a document agreeing, if necessary, to state the source of the funds from which pay-ment was done, and provide their identification data for the Foundation’s records.

The Foundation does not hold itself respon-sible for the condition of the packaging, transportation or insurance of the artworks. However the possibility of sending the works to their final destination may be considered if requested. Costs resulting from this service shall be at the buyer/winner´s responsibility.

Additional CostsBy additional costs is meant those costs that must be added to the final price of each awarded work, and which must be fully cov-ered by the buyer before withdrawal of thework from FLORA. Such costs include taxes, costs of packaging, transportation, insurance, administrative charges, etc.

Authenticity Coming as they are directly from the artists, the authenticity of the artworks is guaranteed. Each awarded piece shall be handed over with its own certificate of authenticity.

Teniendo en cuenta las limitaciones de espacio, las obras deberán ser retiradas en los siete (7) días siguien-tes al cierre, a más tardar el viernes 17 de octubre de 2014; de lo contrario, generarán gastos de administración, manejo y seguro hasta que hayan sido retiradas.

Cada obra será entregada por la Fundación junto con los documentos de cada lote, certificado de donación y soporte de compra.

Cumpliendo con los requerimientos el Sipla, los compradores deben firmar un documento en el que se comprometen, si fuere el caso, a certifi-car el origen de los fondos y a dar los detalles de sus datos de identificación para el registro de la Fundación.

La Fundación no será responsable por el emba-laje, traslado o seguro de las obras. Sin embargo, si el comprador/adjudicatario así lo requiere, se podrá ver la posibilidad de enviar las obras a sus destinos finales, y los costos que este servicio genere correrán por cuenta del comprador/adjudicatario.

Costos adicionalesSe entiende por costos adicionales aquellos que se deben sumar al valor final de adjudicación de cada obra, los cuales deben ser cubiertos por el comprador/adjudicatario en su totalidad antes de retirar la obra de FLORA, tales como impuestos, costos de embalaje, transporte, seguros, costos de administración, etc.

AutenticidadDado que todas las obras provienen direc-tamente de los artistas, su autenticidad está garantizada, y se entregará con cada obra el certificado correspondiente de las obras que sean subastadas.
