cour exercise its preexisting authority to hear the bond case. Indeed, 8 CFR. 100319(a)directs the reader to the regulation in which n mmigration Judge's auority to hear bond casesis delineated-8 CFR. 1236 The regulation at 8 C.FR. 1236(d), in , states that migration Judge is "auhorized to exercise the authori in ection 23 6 of the Act (or section241(a)(l ) of the Act as designated prior to April 1, 1997 in the case of an alien in deporation

proceedings) to detain the alien in custody, release the alien, nd determine the amont of bond... (emphasis added). This lguage makes clear that the authority to hear bond cases comesom the statte itself Section 236 of the Act contans no lnguage lmiting n ImiaonJudge's authority to hear a bond case due to e geograpic location of the alien. Rather noutlining the mmigration Cous juisdiction, the regulations at 8 CF R 100319(c) merelydictate where the alien should le a request r a custody redeterminaon

However, he records of ts agency indicate that the respondent received a bond hearing ate Lumpkin mmigration Cou at the Stewar Detention Center on March 27, 2014, aer theDS moved him to that location The respondent did not appeal om e March 27, 2014, bonddecision rendered by an Immigration Judge at the Lumpkn Immigration Cor in the StewaDetention Center. Thus, his ealier application r a bond heaing bere the ChrloeImmigration Cor is now moot Accordingly the llowng order will be entered

ODER: e respondent's appeal is dismissed as moot.

    FOR THE BOARD

1 Wile the regulations suggest that a bond hearing will usually be held in the location where ealien is detained, policies related to the scheduling of bond hearings, including determinng thelocation of the heaing, are properly wit the province of the Ofce of the Chief migrationJudge (OCI).
