Presenting yourself and your crew in a non-threating and conspicuous manner offers the owners an opportunity to address potential safety concerns as well as inform owners of your presence. The choice of a higher standard is left up to the registrant whereas the perception of a threat is at the whim of the public. Although there is no standard of care for appearance, there is a Right of Entry procedure defined in Arizona Revised Statute 33-104. Respecting the Public Health, Safety, and Welfare

The purpose of licensing is to protect the health, safety, and welfare of the public. The authority of the State recognizes certain minimum standards by which to compare the expected conduct of the registrant body. Registrants may and do exercise different levels of personal standards beyond the minimum expectations observed by governing bodies. The freedom to excel in professional practice is unlimited where governance offers no restrictions to higher standards of practice. Leading by example is the registrant’s opportunity to raise the standards of practice and distinguish the value of the service provided. The British author J.K. Rowling offers this insightful quote. “It is our choices…that show what we truly are, far more than our abilities.” I can’t imagine a better comparison between the actual practice of a higher standard of care versus a simple demonstration of minimum competency.

Board received against him. Then the cases were combined and organized and sent to the Board for review and action.

The Board submitted the seven complaints to the Office of Administrative Hearings (OAH) where eight days of formal hearings were held, beginning in December 2016. However, after the Board for-warded the seven complaints to OAH, it received four additional complaints against Mr. Padilla which could not be investigated in time to include them with the previously submitted seven complaints. One of the new complaints alleged that Mr. Padilla took money for a survey he did not complete correctly for a blind woman in Tucson.

The Board received the Administra-tive Law Judge’s (ALJ’s) recommended decision and order on June 8, 2017. At its June 2017 meeting, the Board revoked Mr. Padilla’s license to practice surveying in Arizona. I don’t believe anyone would argue that the Board’s action in this case was wrong.

However, the Board’s July 2017 action in a second case, described below, raised issues and concerns from the surveying community worthy of comment here.

A registered surveyor filed a complaint with the Board against another surveyor alleging that a survey he conducted violated State law, in that he failed to secure corners, document his rejection of existing monuments, and for making other surveying errors. The Board investigated the complaint and convened an EAC meeting. The members of the EAC analyzed the survey at issue and recommended that the Board consider imposing disciplinary action against him for what they perceived to be his viola-tions of the Board’s Practice Act.

After review of the evidence and the EAC recommendation, the Board members had a lively dialog about the case. A majority of the Board determined that the complaint was simply a boundary dispute and that it did not warrant their imposition of disciplinary action against the surveyor. The case was resolved with the Board issuing him a Letter of Concern.

After the decision, the Board received criticism from some members of the surveying community. Some of the criticism questioned the legality of the Board’s decision to reject the EAC recommendation. No matter how well reasoned an EAC report might be, the Board is the final decision maker in all investigative cases. Board members can, and sometimes do, approach their discus-sions about cases differently than EAC members because of their varied experience, perspective, and training. The Board can give evi-dence a different weight than the EAC members did. Differing opin-ions about matters before the Board is healthy and keeps the Board relevant.

The Board greatly values the contri-

butions of its EAC members and

often acknowledges that it couldn’t

do its statutorily mandated work

without the diligence and dedication

of its volunteers. But, as the final

decision maker, by law, the Board

can accept, modify, or reject

recommended decisions to resolve

investigations. Its members will not

always agree with investigative and

disciplinary recommendations, no

matter how well reasoned they may

be. For that reason, respondents have

the right to appeal final Board deci-

sions to Superior Court. The Courts

will then determine whether the

Board’s decisions were based upon a

preponderance of evidence and were

not made arbitrarily or capriciously.

Interesting Surveying Issues Before the Board

Since our last newsletter was published, the Board has revoked the license of a surveyor from Pima County and dismissed a case against a surveyor from Yavapai County. The cases posed very different questions about surveying and the capability and qualifications of surveyors in Arizona that I felt were worthy of note in this edition of the Board’s newsletter.

Between May 10, 2013 and June 11, 2015, the Board received an unprecedented seven complaints from consumers, other surveyors, and members of the public against Mr. Carlos Padilla, who was, at that time, a licensed surveyor working in Pima County. The complaints alleged that Mr. Padilla violated various Arizona Revised Statutes and Board rules, including but not limited to, taking money from clients and failing to perform surveys or refund the money, failing to perform surveys with the requisite technical knowledge and skill, and failing to record the results of surveys.

The Board’s investigative process was detailed and lengthy. Hundreds of documents were collected and analyzed. EAC meetings were held. Numerous witnesses were inter-viewed. Mr. Padilla was repeatedly asked to respond to the seemingly endless flood of allegations the

Besides being a BTR member, Jack

is also a member of the State Fire

Safety Committee, and a member of

Goodyear’s Water Conservation

Committee.

for 40 years and have two children

and employing a simple “take home” test designed to identify the applicant’s familiarity with Arizona Statute and regulatory procedures. Testing is designed to protect the public by metering subject matter knowledge.

The standard of testing is to determine a minimum level of competence among registrants. It is important for seasoned registrants to recognize their chosen personal standards may very well exceed the published standards of care as well as those incorporated in testing. That’s not a bad problem to have as a profession when the registrant body understands the goals of testing. Again, J.K. Rowling’s senti-ment regarding choices prevails.

We as registrants may not always

agree with our fellow professionals’ opinions. Regardless of those differences we have a obligation to respect a contrary opinion issued to the public. When evaluating another registrant’s work it is imperative to choose the appropriate yardstick. The professional obligation to review is aligned with the published laws and minimum standards. This is a hard pill for some well seasoned registrants to swallow. In effect there exists a dual standard of care. There are the normal “minimums” that are the baseline of the public protection and then there are the elevated and proprietary professional standards chosen individually in accordance with the highest level of service to the client. The former are regulatory in nature and the latter show what we truly are as

professionals. ●

Recreation Dept. and the City’s

Design Review staff. In 1981, Jack

joined GSAS Architects and

Planners as the Staff LA until 1987.

In February 1988, Jack Gilmore and

Ross Graves formed Gilmore

Graves, Inc., and that entity has since

evolved to Gilmore Planning &

Landscape Architecture (GPLA).

BTR Home Inspectors Best Practices Randy West CHI

Inspectors - does your report comply with the Standards of Professional Practice for Arizona Home Inspectors? There is an easy way to check. There is a Report Checklist Supplement available on the BTR website. Got to btr.az.gov, choose ‘resources’ at the top, then ‘forms’, then ‘other forms’. Scroll down to the Checklist.

The checklist is sort of a ‘summary’ of the Standards of Professional Practice for Arizona Home Inspectors, with infor-mation taken from the Rules and Statutes as well. The Checklist is organized by system (plumbing, heating, etc.), and has 84 numbered comments. Each comment has a space/line at the beginning. The intent is to go through your report and find the information required in each comment, and put the page number at the beginning of each section. If you find all the required information your report should be in compliance with the BTR requirements.

Page one of the checklist has specific advice and instructions. It is important to note that some information has to be in a written report, even if it’s not present. Other information is not required if it is not present. Page one explains that Checklist comments with an asterisk can be left out of a report if that item is not present or applicable. For example, if there is no crawlspace under the home than you are not required to report on crawlspace ventilation or insulation.

The checklist may be updated each year. If so, this occurs near the end of the calendar year.

You can check the date at the bottom of page one to see if a new Checklist is available (the current revision date is December 2015).

The BTR does not monitor or audit home inspector’s reports. It is up to each inspector to make sure his/her report is in compliance. If there is a complaint filed against you, however, your entire report will be reviewed by inspectors on the Enforcement Advisory Committee (EAC). They will not just check to see if the allegations are valid, they will use the Checklist to review your entire report.

There are dozens of different written report formats in Arizona. Some list GFCI protection on the Electrical page, others have this information in the Interior/Rooms sections. Garage/home fire separation walls can be in the Exterior, Garage or Interior sec-tion. So it’s a good idea to keep the Checklist you filled out. Include a copy with your response to any complaint to make sure the EAC member finds all the required information in your report.

Of course a better idea is to volunteer for the EAC Committee. You will review reports from Respondents (regarding a complaint) and Applicants. The more reports you review, the better you’ll know the Standards and the Checklist.

You need to read the Checklist sections for more detailed explanations. For example in the electrical section I frequently

find the “Compatibility” information missing. Line 51 in the Checklist states “…(report when breakers or fuses are oversized.) It is not acceptable to report the panels as simply satisfactory to address compatibility.”

Other examples include line 33, regarding functional flow, which states “…describe the method used to determine or have the term functional flow in the report.” Line 36, regarding waste lines, states you must describe the type of pipes specifically, not just plastic or metal. There are many other lines with specific requirements or advice.

Following is information frequently missing in written home inspection reports.

Functional flow and functional drainage: These are two different lines in the Checklist. Flow and pressure are different items- reporting good pressure has nothing to do with functional flow.

A heating and cooling source in each room: This is also two lines in the Checklist. Reporting on the type of distribution, e.g. “insulated ducts and floor registers”, does not describe a heat source in every room.

Heating system automatic safety controls: This can include thermocouples, blower compartment switches, TPR valves, etc. I have seen ‘none’ in reports, but I’ve never seen a heating system with no automatic safety controls. Even electric baseboard heaters have circuit breakers. Continued on Page 6

must go through to obtain fingerprints is cumbersome since an applicant would need to find a reputable fingerprint technician and make the time to sit for the ink only procedure. Tack on the time it takes to submit the fingerprints to the AZBTR, who must then submit the fingerprints to DPS, and you have a ‘bottle neck’ situation where applicants could be waiting and waiting for their application/renewal to be granted, all the while without being able to work solo during the interim (they were able to work under a licensed supervisor). Average turn-around time for this system, the time an applicant submitted their application and the time they became registered, could easily exceed a month in the worst of situations. If DPS found an issue with submitted fingerprints, the AZBTR would request court documents from the applicant. In this situation, the turnaround could be as long as 90 days.

All of this also cost the applicant’s money; applicants needed to pay a fee to have the fingerprints taken, needed to pay a fee to submit the fingerprints to the AZBTR ($42) every year, along with the application/renewal fee ($130) every two years.

This process was also cumber-some for staff. Fingerprint cards are confidential; once in the AZBTR’s possession, staff needed to file and secure all submitted fingerprint cards. For those who have never filed before, it takes time...a lot of time, and staff had to do it

correctly and completely before the annual fingerprint card audit conducted by the FBI. Destruction of fingerprint cards required two trained staff, staff had to complete an online FBI course to be considered adequately competent, and a small file shredder…you could not deposit the cards in a bin for shredding. In a small agency such as the AZBTR, fingerprint card destruction could easily detain 10% or more of the staff from regular duties over a number of days.

So how are things different now?

AZBTR staff still do not have the technical knowledge, access, and the time appropriate to verify an applicant’s submitted criminal background, so DPS is still involved. However, the new process allows applicants to apply for a fingerprint clearance card, which allows fingerprint technicians to send the applicant’s fingerprints electronically to DPS. DPS will then send the applicant their fingerprint clearance card and the applicant will send a copy to the AZBTR along with their application/renewal; this is all the proof the AZBTR needs to grant registration. Obviously, applicants will still need to have their fingerprints taken, but, through the DPS website, the process is streamlined. Applicants make an appointment online, have their fingerprints taken electronically at the appointed time and just wait for their card to arrive in the mail, assuming everything is fine. On August 9, 2017, the licensing requirements for alarm businesses, controlling persons, and alarm agents under A.R.S. § 32-122.05 and A.R.S. § 32-122.06 changed.

We at the Arizona Board of Technical Registration are excited for these new changes and believe the alarm agents of Arizona will agree. The process for applying and renewing is now cheaper and faster. Let us explain why.

The alarm agent occupation became a registered population in Arizona in 2013 vs letting each municipality enact individual registration requirements. The Arizona legislator gave jurisdiction of this newly formed registered population to the Arizona Board of Technical Registration. Due to the nature of the occupation, the drafting legislative body wrote language into statute to make sure the Board screened alarm agents for criminal activity; they also added language that the Board annually verify the alarm agent’s criminal activity. However, the Board’s staff did not have the technical knowledge, access, and the time appropriate to verify an applicant’s submitted criminal background. The Board therefore needed to submit the applicant’s information to a third party for screening. The Department of Public Safety was the ideal candidate.

In order for the Department of Public Safety to verify submitted background checks, a fingerprint card was required. As one could imagine, the process an individual

Piping supports and insulation: Insulation is often not present in a home, and supports are often not visible. But this is not an ‘asterisk’ item and it must be reported on, which could include ‘not required’ or ‘slab floor- not visible’.

Columns: This is an asterisked item and does not need to be reported on if not present. (I’ve heard the argument that ‘walls’ are columns, but walls are ad-dressed separately in the Structural section of the Check-list). I’ve seen many reports with no reference to columns, yet columns are clearly visible in the photos.

Fire separation (including doors) between a home and garage: This is on the interior section of the Checklist. Comments

near completion. The application process, which once took almost a month to complete, is now taking as little as a week.

In the past, alarm agent registration was good for two years and every year an alarm agent needed to submit fingerprints. Fingerprint clearance cards are good for six years after the issue date. With this in mind, the AZBTR has extended the registration period to three years. This means that an alarm agent only needs to submit a copy of their fingerprint clearance card when they first apply and six years thereafter.

In the end, this process costs the applicant less money than the

Overcurrent protection: Your report must state the type- fuses or breakers. Breakers are far more common now, but we all inspect older homes with fuse panels occasionally. I’ve seen reports refer to the ‘distribution panel’. A report must have the word ‘breaker’ (or ‘fuse’) somewhere.

Stairways, steps and railings: All must be reported on. I have reviewed reports on a 2 story building and no reference anywhere to stairs or railings.

It can be difficult to review a

report that you created, especially when you have created hundreds or thousands of very similar

reports. You know you check for

a heat source in every room and a fire resistant door between the

garage and home. But here’s another test you can use when reviewing your report. Will

someone else (like your client) reading your report know this?

previous process. Applicants still pay a fee to have the fingerprints taken, but only need to pay once every six years instead of annually. They no longer need to pay the $42 fingerprint card submission fee. Applicants renew once every three years ($195) instead of every two years ($130). Therefore, over a six-year period starting with the application pro-cess, applicants should save hundreds of dollars.

The new process is also less cumbersome for staff. Fingerprint clearance cards are not confiden-tial. Staff do not need to file and secure copies of fingerprint clearance cards; staff simply plac-es the copies in the registrant’s file. This means far less filling so

staff can focus on other tasks. Staff will eventually shred all fingerprint cards stored at the AZBTR as alarm agents renew under the new system, opening up much needed office space.

Andrew J. Puccino

Born and raised just a stones-throw from Harvard Yard and Boston Common, Andrew is a true Yankee. However, the many years of snow and Nor’easter’s finally had their toll, and in 1996 he and his husband Chris moved from Massachusetts to Phoenix. Andrew spent his first eight years in the Valley working in the Travel/Hospitality industry, while the next 10 were with a local medical device manufacturer as a product specialist/medical trade show representative. The combination of experiences culled from these positions have helped him to assemble a complete resume highlighting his exceptional customer service skills, his attention to regulatory/compliance adherence, and sound business practices.

Andrew began his employment with the Board of Technical Registration in November, 2014. Starting at the Front Desk, he soon moved on to work as an Administrative Assistant for the agency. Last month, he was promoted to Enforcement Assistant. Among the varied demands of this position, his main responsibility is to the Board’s investigative team, maintaining records and the compliance tracking of financial assurance, cancelations, consent agreements and hearing cases.

Away from the office, Andrew is a seasoned (no pun intended) chef. He also enjoys travel, the outdoors, museums, theatre, the many Native American tribes native to the Southwest, DIY home projects, and his four-legged kids, Dorrit and Lucca.

Liliana Ruiz

Liliana moved to Arizona in 2007, and is originally from California. She graduated from Grand Canyon University “Go Lopes” in 2013 with a Bachelor Degree in Business Administration. She joined the Board of Technical Registration in 2014. She started as the Records Clerk, and moved on to be the Renewals Specialist. She processes all professional and occupational renewals. She enjoys her job, helping others, and learning new things.

New Computer System Updates

For those of you who have not read earlier issues of the AZBTR newsletter, or monitor our website and Facebook page, the AZBTR has been working with GL Solutions for over a year to build a new computer system to better serve our registrants and the people of Arizona.

Staff began using the development site in July 2017 and collaborated with GL staff to work out bugs before launch. On August 14, 2017, the new system entered the stabilization phase. Here are some of the details:

1. Staff is using the new system as itsprimary database

Previously, the AZBTR used Microsoft’s CRM (Customer Relations Management) as its database. GL has transferred the data stored on CRM to its own system. No new information is being entered into CRM; all new data is being entered

into the GL database.

2. Public access is currently limited.

One of the most exciting elements of our future system is that it will provide the public with access to public records, registrant disciplinary history and more. At this time, said access is limited but in the works. We do not have an exact date at this time as to when we will exit the stabilization phase and go live, but we estimate sometime in the next six months.

3. This is going to be a great system

Once the system goes live, applicants and registrants will gain access to numerous online services. This includes, but is not limited to: applying for registration, including payments and uploading documents; renewing registration and certification, including payments,

uploading documents and email reminders to renew; and more. These changes should drastically reduce paper consumption for both the public and the AZBTR. The changes will also reduce filing immensely. A brand new website will go live concurrently with these changes.

We believe the new system will greatly help expedite the processes for applying and renewing.

Licensing

ARE 4.0 is retiring June 30, 2018. Exam applicants need to be aware of the deadline. Please plan accordingly so you can timely complete all of your exams. Please visit NCARB’s webpage for more information.

Home Inspectors still need to do fingerprints but they are not doing the ‘fingerprint clearance card.’ That change only applies to the alarm industry.

We are looking for Certified Home Inspectors to join our Enforcement Advisory Committee and help the Board review reports on Initial Home Inspector Applications. We are continuously trying to reduce the time it takes to process new applications and you can help.

Operations

AZBTR has entered the stabilization phase with the new computer system. Included in the upgrades are automated emails which will be sent reminding you to submit your renewal. If you do not receive the email, please go to our website to download the appropriate form.

During this stabilization phase of the new system you may receive strange emails. Don’t panic! Call or email our office and we will research your questions. Thanks for your support and cooperation.

Also, we now have the ability to display your photo on the website and pocket card. If you want to submit a photo with your renewal to be posted on the website, you can do so. Or you can submit a photo to the news inbox on our webpage and we will upload it. Must be a passport-type photo, include your name and license # with your submission.

Enforcement

The Board has experienced a surge in complaints related to illegal/unauthorized use of seals and signatures. A.A.C. R4-30-304(G) states the Registrant shall provide adequate security regarding the use of seal and signature. Be aware of electronic seals residing on firm servers. If you retire or become inactive, make sure your seal can’t be abused.
