'I'his documcnt <.Jontilin~ the procedures developed by the Feden,l Avi~tlon ~dminietr~tlon (FhA) a nd the Dlrrecion Nacional de Aeronavigabilid~d CDNA) , hereinafter rCferred to ae t he P3reics, to implement the Agreement between the Governmen t of the united S tates ot America (U.S.) and the Government of the Republic of Arg entina (ROA) concerning the airworthi ness certification, a pproval, or a cceptancc of imported aeronautical products affected by exc h a ng .. of note5 a t Buenos Aires , Argentina, June 22, 1989. and i~ intended to fac i li t a te the approval proce ss fo r aircraft and other a eronautical products bei ng imported or exported betwecn the U.S. and the ROA. I t m~ y b e j ointl y reviewed at a ny time at the. r equest of either the FAA or DNA and will be reviewed periodically, taking into account imprOVements, a dditions, or cha nges sugge~ted by either the FAA o r DNA , by U.S. ~ nd ROh aviation industry ussociations or their member ccmp~n ics, o r by othe r in terested parties, to assure that the procedur es rCJ:\ain Cll r rent. (cl To permit II; related product (e .g., engine, appl iances ) to be instal l ed on a n aircratt h aving a u . s . ~lrworthi ness certi fi cate.

The FAA will assign a higher prior i ty to applicat ions for type design approval or an import product when one of the above situat ions iz shown to exist. The FAA doe5 not generally grant type design lIpprovals f o r p roducts manufactured outside the U.S . which arc not intended tor U. S. ut i l i 1.ation, except for products to be i nstal l ed on U.S. - manufactured produet5. Theretore, non-

(c) To permit a rela ted product (e.g . , engine, appliances) t o be in~ta llcd on an aircraft having an ~rqcntine airworthiness cert ifica te.

On maj o r projects, as soon as practicable after t he application has been r ecei v ed and accept e d b y t he i mporting aut hori t y , a nd whe n the design 1.s s ufficiently de f ined , a f a miliariza tion briefing on t he prOduct may bQ requested by the importing authority . The b rief i ng shall be held at a mutually agreeable locat ion for attendance by t he import i ng authority , the expor ting auth oTity , and the appl i cant. '.rhe primary purpo~es ot the briefing will be to permit :

2 22. Estahllshment ot the t ype cer tification basl~ by t he. i mporting authori t y .

fa) The importing Oluthorlty shall establish a t ype c e r t ificatiOn bas iH t o r the product design in a ccordance with its own domestic ili rworthiness ~tandards tor a similar

product, giving consideration to the ctandards which were in effect In the importing State at the time that application wa5 received for the approval of the product type design by Ule e xporting authority.

(b) Once the importing authority's type cert ification ba~is ha5 been establi~hed , the airworthine~5 c tandards for type cert ification by the importing authority shall be agreed jointly by the iMportinq authority and exporting authori ty so as to:

( i) Give maximum credit to the exporting authority ' c domestiC certification 5ystem; and

(ii) Pr.ovide the importing authori ty a ba~is to find compliance with its own national a irworthines s standards or to find that equivalent criteria have been met, based on an exporting authority certification o[ compliance with the agreed ai rworthinccs standards.

(c) Thus, the airworthines~ stand,1rd~ defined by the importing authori t y will consi~t of the airworthine~~ stamlards a:l applied by the exporting authority und.er its aIm domestic certification ~ystem, plus any additional technical conditions specified by the importinq authority to est~blish an equiv(llent level or sufety with its OWn domesti c standin::ds tor II similar product.

223. Mditionai techn ica l conditions . The add ltional t echnical condit ions m"y jncluae dn y or al l of the followin 9 '

(a) Additional airworthiness conditions bi!l~ed on differences in the basic ai rworthiness stand.ards, interpretations, applications, policies, and guidance materials between the two States. In the case of the U.S . , the basic ~irworthine8s standards are set out in the Federal Aviation /oI.egu lations (YAH) P,n:ts 23 through 35. In the cas e ot Argentina, the basic airworthiness standards are set out in the DNAH 22 through 35.

(h) Special Conditions relating to novel or unusua l features of the product design which arc not covered by the airworthiness standards of the exporting authority ;

(e) Airworthiness condition s based. on an evaluation of equivalent safety [indinq~ and exemptions grant ed by the exporting authority to the applicant :!'or domestic c ertificat ion;

This l atter informat ion ~ill assizt an aircraft operator i n satisfying the impor ting authority that he has an acceptable maintenance specif ication tor hi s a i rcra tt opera t ion : and

(e) Actions deemed necessary for continued safe operation i n t he i mport ing Sta te as a resul t o f the importing author ity review o f the s ervi ce history a nd the actions taken by the exporting authority t o correct unsafe condit ions on products ot ~ typ~ d esign previously certific~ted by the export ing authori t y and h~ving accumulated ~ measurable service history.

224 . Data §ybmitt3l ~Dd dp~i9n review. Requ ired techni cal data repr esenting the product will vary with the type and complexity of the product involved. Preceding the i~suance of type certificat ion, the impor ting authority may request addition~l technical design data, may r evie w the p roduct , ,~nd may fly the product for faQili~rizat ion purpose~. Al so, wh~n dee~ed nccessary by both the e xport i ng author ity and thc importing authority, the importing authori t y m",y ny, or conduct II. det~i.led rev iew of, the product to assure c ompliance with t he additional technical conditions. 'rhe applicant shall submit all data t o the exporting au t hority fo r verl fic~t ion and t ranscmission t o t he i mporting ~ uthority. Reque~ts fo r addi tional technical data, reviews, and f l i ght tests uS deccribed h ere sh~ l l, in the ~pirit o( the BM, b .. the cinimum necessary to assure that the lI"porting authority a cquires the needed f<lmi liarity .

225. Technical mfeting;.. In addition to the init1<ll familiarization bri~flng , othe r techn ical meet i ngs may be necc~sary to ~ ssure that any addi t iollill technic~l conditions that have been communicated to the exporting authority are well understood , and tha t any outstanding tQchnical i~~ues are resolved. All technica l me~ting~ wi l l normally be arranged through the exporting authority. Location of the meet ing~ may vary, depend i ng on the ne eds and prioritie~ , and will nOrr.l.llly have imp orting authority/expor ting authority representa tives in attendance. Such nee.ting:l (and gu idel ines (or the me etings) mllY include'

(a) 'l'tlchnical meet ings requested by the applic a nt , the e xporting authority, or t he i~port ing authori ty ( or the p urpose of reporting new developments, r eviewing changes, or resolving teChnica l compliance ques t i ons:

Simila r ly, c orrespondence will generally be a nswered through, coordinated with. or copied to the export ing author ity.

deter.mining action considered necessary by the importing authority for the continued airworthine~~ of the product. The respective decision~ s to the final act ion to be t~ken lies solely with the importing authority.

52. Exchange of Informat ion on Standards and certificatlon System~. It is recognized that an essential factor in a smoothl y operating BAA is a thorough and up-to-date knowledge by the e xporting authority of the regulations, policies, pr~ ct ices, and interpretations of the importing authority. Early efforts shoul d assure that each airworthiness authority has in its possession a complete set of the other airworthiness authority'!> written regulations , guidance, policies, practices, and interpretations, or ha ve a source for such information. since such regulation~ , policie~, practicc~, and interpretations are continually undergoing review and revision, it is imperative that the exporting authority's maximum practicable involv ement i n the review and revision pr.ocess be permitted ~nd encouraged. This should take the form of early and direct notification of all comments re~ulting, and early notification of the text, i mpact , and effective date of any adopted changes.

CHAPTER 6. It is anticip~ ted th;)t u r g",.nt or unique respect to design, product airworthinec~ or acceptance, or technical ascictancc--which have not been specifica lly addre~~ed in this Schedule of Implementiltion Procedures, bu t which are anticipat",.d by the BAA. When such a situation arises, it shall be reviewed by the re~pective FAA and the DNA Aircraft Certification Director, and a procedure developed to address the situation. The procedure shall be I;Iutually agreed upon by the FAA and the DNA in a separate implementation document. If it is apparent that the situation is unique , with little po~~ibility of repetition , then the implement a t ion document shal l be of limited duration . Howe ver, if the situation will l ead to further repetitions, then thiz Schedule of Implementation Procedure~ shall be revized accordingly by the FAA Administrator and the DNA National Director. It should be noted that , when the unique or urgent situat ion falls within the rezpon~ibility of an FAA Aircraft Certit"ication Directorate Manager, that Manager wi ll be respons i b le for developing the necessary procedures.
