Newsletter 2015-31 August 7, 2015 APPROVAL OF EMERGENCY RULE RESTORES CONSTRUCTION CHANGE ORDERS TO PREVIOUS PROCESS On Friday, July 31, 2015 at 2:58 p.m., Secretary of State Natalie Tennant signed Decision 8-15 to approve an emergency rule amendment to Title 148, Series1 – Purchasing Division --which clarifies that change orders related to government construction contracts do not require prior approval. For years, contracting agencies were required to file construction change orders with the Purchasing Division in a timely fashion, but prior approval was not required. This action effectively restores the approval process for construction change orders to the previous process. The emergency rule became necessary on July 1, 2015 when amendments to Series 1 went into effect, which govern, among other things, change orders for contracts approved by the Purchasing Division. The amendments provided that all change orders must be approved by the Purchasing Division and Attorney General (as to form) prior to commencement of work. If work was performed by a contractor prior to final approval, the contractor could not get paid for costs associated with the change order. The CAWV has been meeting with state officials since May to explain that, due to the unique nature of construction contracts, the required prior approval of change orders would require lengthy stoppages of work on active construction sites that would prove costly and unfeasible and would lead to increased costs for the taxpayer, state government agencies, contractors and others. While the emergency rule, filed July 23, 2015 by Secretary of Administration Jason Pizatella and signed July 31 by Secretary of State Tennant, makes it clear that change orders related to government contracts do not require prior approval, all change orders must be approved by the Purchasing Division and the Attorney General’s office before any money is encumbered. Therefore, contractors should be certain that change orders ordered by the architect/engineer and owner have a high probability of being approved and paid for before agreeing to perform any change order work. “I am appreciative of the efforts of a number of people who have worked to find a solution to this issue, including Secretary Pizatella, Secretary Tennant, Attorney General Patrick Morrisey, Legislative Auditor Aaron Allred, and state Purchasing and contracting agency officials,” said CAWV President Dan Cooperrider. “Without their help, the emergency rule could not have been developed and approved so quickly.” President Cooperrider noted that construction projects throughout the state could have come to a halt because contractors could not take the risk of not being paid for work performed on a change order. “No one benefits from having the project shut down while waiting for a change order to go through the prior approval process,” the president stated, “especially if there was a situation that required immediate action to address a safety or environmental issue, much like what we have on Abandoned Mine Lands (AML) projects.”

If the rule had not been changed, quantities at the end of the project could not have been adjusted. For example, if a project had estimated 500,000 cubic yards of excavation and actual yardage was 550,000, if a change order had not been approved prior to completion of the project the contractor would not have gotten paid for the additional 50,000 cubic yards. The only remedy was going to be to file with the West Virginia Court of Claims and hope the court would agree to the additional cost. Since all Court of Claims decisions must be approved by the West Virginia Legislature, contractors could be waiting over a year for their money. “I am glad this issue has come to a successful resolve,” said President Cooperrider. Spending units must not permit vendors to perform work that the spending unit anticipates will be added to a contract through a change order until such time as the change has been formally approved by the Purchasing Division and the Attorney General’s office, encumbered by the Purchasing Division, and mailed to the vendor. This subsection related to timing of work does not apply to government construction contract executed pursuant to W.Va. Code 5-22-1, et seq. HIGHWAY WORK ZONES..................CAUTION! CAUTION! CAUTION! Even when all traffic control measures are taken, a confused or unaware driver can crash through a work site, or a daydreaming worker can step into the path of a speeding vehicle. Some drivers take reckless chances by running stop signs or changing lanes without signaling. These unsafe acts jeopardize other drivers who may lose control of their vehicle while avoiding a collision. When work site involves moving traffic, safety awareness should be at its peak, to protect both the public and the crew. Some helpful tips to better prepare are: Planning: All traffic control must be carefully planned and approved by governing authorities before work begins. The person responsible for this planning should drive through the traffic pattern before any work starts to ensure that the public will understand how to control their vehicles appropriately. If there is any possibility of driver confusion in the pattern, change it. Signage: The Manual on Uniform Traffic Control Devices and local or state regulations should be followed for proper signage and barricading. Place initial warning signs a minimum of 1,000 feet from traffic revisions. All signs and related equipment should be in good condition and highly visible. In some cases, independent traffic safety contractors handle warning signs and barricades. Barricades: Devices which guide traffic such as cones, barrels, etc., should be highly visible and spaced relatively close together, so drivers will not deviate from an assigned traffic flow. All such barriers should be made of material that will cause little or no damage if a vehicle contacts it. Safety Gear: All employees should wear hard hats and must wear high-visibility orange or day-glow vests. When working at night, the vest should have light-reflective strips. Flaggers: Roadside construction sites must have at least one individual assigned to traffic control. A highly visible sign paddle should be used during daylight hours. It should be octagonal in shape, at least 18 inches across, and have letters at least six inches high that say STOP on one side and SLOW on the other. Flaggers should have two-way radios. When flaggers are present, a sign indicating this must be placed a minimum of 500 feet from the beginning of the detour. Vehicles: All construction vehicles should be equipped with backing alarms, two-way radios, and Slow Moving Vehicle signs when appropriate. Ideally, they should be painted a highly visible color and many jurisdictions also require flashing yellow beacons. All operators must be qualified and trained to operate the equipment they are using. If a vehicle is parked along-side the road, orange safety cones should be placed around it to alert drivers. Night Work: If work is done at night, the entire site must be illuminated. Increase warning distances in areas of fast-moving traffic as light fails. Flaggers should have orange-cone flashlights and barricades should be equipped with flashing lights. Any excavations or utility accesses should be taped off and barricaded with flashing warning lights. Training: All company employees and subcontractors involved in the project must receive an initial safety orientation, informing them of the potential hazards of the project, including traffic safety. Changes or unusual conditions should be communicated to workers immediately.

($ Amounts in Millions) SENATOR CREATES WEBSITE TO TACKLE ROAD CONCERNS A West Virginia legislator is taking a new approach to tackling road concerns. This week, Sen. Daniel Hall, D-West Virginia, is unveiling a new site called 'Fix the Roads WV.' He said the new site is designed to fast-track constituent complaints. "This is a way for me to document all of these concerns and keep them together. And then I can follow up with highways as we go to see when and where they're going to fix the problems," said Sen. Hall. Sen. Hall said he is fed up with pot holes and fallen rocks, such as those seen on Route 99, that are costing his constituents money many do not have to fix. "You go across there at your own peril. There are boulders falling across white lines that have been there for months.” For Sen. Hall, though, the website is just the beginning. He is already considering his next step. "I wonder if we need to just start privatizing going forward. If highways can't keep up, we need to start

WVDOH AUDIT CONTRACT TO BE AWARDED It is expected the West Virginia Legislature is about to award a $540,000 contract with Deloitte and Touche to conduct a performance audit of the West Virginia Division of Highways. The legislature passed a bill to require an audit of the DOH and its ten districts that must be completed by December 31. The firm is to conduct “an independent assessment of the DOH’s organizational structure, programs and operations, and determine whether they are operating effectively and efficiently in carrying out the mission of the DOH.” Some legislators have said it is premature to talk about additional highway funding until the audit is complete. The bill as it was introduced in the legislature had a completion date of February 1, 2016. The CAWV objected noting that there would not be enough time in the 2016 to implement any recommendations the audit may make, thus delaying funding action even further. The bill was amended to have the audit completed in this calendar year.
