affairs of the trust from tax and regulatory authorities in an ever growing list of countries. This panel discusses contentious regulatory issues offshore under current regimes for compulsory provision of information, with a focus on Tax Information Exchange Agreements (TIEAs). In addition to explaining how TIEAs operate offshore and what information they can be used to gain about offshore trusts, this session will deal with:
■ Trustees’ duties to their beneficiaries when confronted with Tax Information requests ■ Best practice in responding to requests ■ Legal challenges to requests ■ Current stances offshore on issues of privacy and wider access to information on beneficial ownership.
