Non-technical Summary

This report has been prepared by MLM Consulting Engineers Limited (MLM) for Anglian Water Services Ltd, and relates to a proposed new bridge across Ecton Brook at the Great

Billing Minerals site. The purpose of the survey is to ascertain the presence of otter

(Lutra lutra) on site, and if present, the likely frequency of use.

The aim of this report is to describe the results of a walkover survey and camera trapping

undertaken at the site.

Walkover surveys were undertaken on 18 May, 8 June, and 22 June 2016 to check for signs

of otter along the brook and at the bridge crossing location. The survey found a number

of fresh spraints at various locations across the site, at the same locations as recorded

during previous surveys. Camera traps were placed at two location on the Ecton Brook,

upstream and downstream of the proposed crossing point, shown on drawing 773939-

DWG-ENV-001. The cameras were left on site for 5 weeks between 18 May 2016 and 22

June 2016. The camera trapping did not record otters on site. Dusk and dawn watches

were also undertaken on three occasions (a dusk survey on 18 May, and dawn watches on

8 and 22 June) and otters were not seen. It was concluded that the site is used infrequently

by otter as part of its territory.

During the period that the cameras were left out for, there was an extreme rainfall event

which flooded one of the cameras. This occurred towards the end of the monitoring period,

so between the last two June visits to site. When the pictures were downloaded for this

period it was clear that the camera (Spypoint) had stopped functioning once it became

flooded with water. The second camera was functioning correctly and was not impacted

by the weather.

1 Introduction

1.1 Purpose

This report has been prepared by MLM for Anglian Water Services Ltd.

This report relates to a proposed new bridge crossing across Ecton Brook, as part

of a larger development at the Great Billings Minerals Site. The proposed new

bridge location and design is shown on Drawing Nos. 617276-DWG-CIV-005 and

617276-DWG-CIV-006.

The purpose of this report is detail the results of the surveys undertaken to ascertain

further information on frequency of the use of the site by otter, to ensure

appropriate mitigation measures are incorporated during bridge design and

construction.

1.2 Site Location

The location of the site surveyed is near Ecton, Northampton and may be located

by national grid reference (NGR) SP 83061 62098. The survey area included the

banks of Ecton brook flowing through the Great Billing Minerals site, and the banks

of the River Nene to the south of the site, as shown in Drawing No. 773939-REP-

ENV-001.

The site itself comprises arable fields with areas of tall ruderal vegetation along the

field boundaries and within disused fields and pockets and strips of broad leaved

woodland. The Ecton Brook flows through the site in a north – south direction and

tributes to the River Nene, flowing east-west to the south of the site.

To the north of the site, the site is bordered by Lower Ecton Road, and the A45, to

the east by broad leaved woodland and arable fields, to the south by flooded gravel

pits that are used as private fishing lakes and to the west by Anglian Water

Treatment Works.

1.3 Previous Surveys

Surveys undertaken by MLM during 2015 (ref.1) identified signs of otter (spraints,

footprints and feeding station) at the bridge crossing point. Surveys undertaken in

2011 (ref, 2) identified a suspected otter holt approximately 380m south of the

proposed bridge crossing point.

1.4 Current UK Legislation

The main legislation that applies to otter within England and Wales are:

The Wildlife and Countryside Act 1981 (WCA) Schedule 5, animals which are

protected. Otter are protected under Section 9, which prohibits the

intentional killing, injuring or taking of this species (9.1). It is also prohibited

to possess the species listed or any part of (9.2), or trade (9.5a) including

advertising the sale of any species listed (9.5b). The species listed also have

protections from disturbance through prohibiting actions which disturb or

obstruct places they use for shelter (9.4).

The Wildlife and Countryside Act 1981 (WCA) Schedule 6, animals which may

not be killed or taken by certain methods. These methods include self-

locking snares, bows, crossbows, explosives (other than ammunition for a

firearm), or live decoys. The species listed in this act are also protected

from protected from the following activities: trap, snare or net, electrical

device for killing or stunning, poisonous, poisoned or stupefying substances

or any other gas or smoke, automatic or semi-automatic weapon, device for

illuminating a target or sighting device for night shooting, artificial light,

mirror or other dazzling device, sound recording, and mechanically propelled

vehicle in immediate pursuit.

The Habitats Directive 1994 (EC Directive 92/43/EEC) makes it an offence

to intentionally kill, capture or disturb a European Protected Species, or to

destroy or damage the breeding site or resting place of a species listed. This

is transposed into law in the UK through the Conservation of Habitats and

Species Regulations 2010.

In addition, otters are a Priority Species within Northamptonshire and are

listed on Schedule 41 of the Natural Environment Research Council (NERC)

Act (2006).

2 Methodologies

2.1 Walkover survey

A walkover of the Ecton Brook within the site, shown on drawing 773939-DWG-

ENV-001 was undertaken on the 18 May, 8 June, and 22 June 2016 by Senior

Ecologist Emily Greenall MCIEEM and Senior Ecologist Gemma Hannant MCIEEM.

The two surveyors walked the banks of the Ecton Brook and connected

watercourses within the site, and the River Nene to the south of the site, looking

for signs of otter to include spraints, footprints, mammal tracks, feeding remains,

otter slides, holts (underground dens), couches (above ground sites where otters

rest during the day). The surveys were undertaken during appropriate weather

conditions, avoiding days when it was raining or had recently been raining.

2.2 Camera Trapping

Two camera traps were set up following the walkover survey, on 18 May 2016.

The purpose of deploying the cameras was to help determine the frequency with

which the site was used by otter.

The cameras were set up at locations shown on drawing 773939-DWG-ENV-001,

these locations were chosen based on the proposed bridge crossing location across

the Ecton Brook (drawing nos. 617276-DWG-CIV-005 and 617276-DWG-CIV-

006). One camera (Bushnell Natureview Cam) was placed downstream of the

proposed crossing point, and another camera (Spypoint Force 11 trail Cam) was

placed upstream of the proposed crossing point.

The cameras were deployed on 18 May and checked on 8 June and the data

downloaded. The cameras were then re-deployed at the same locations, on 8

June, before being retrieved on 22 June 2016.

2.3 Dusk and Dawn Vantage Point Watches

Vantage point watches were undertaken from two vantage points at the locations

shown on drawing 773939-DWG-ENV-001, downstream of the proposed crossing

point. Watches were undertaken at dusk on 18 May and 8 June, and at dawn on

22 June 2016. Surveyors sat at the vantage point location and watched the river

with binoculars checking for signs of otter. The dawn and dusk watches were

undertaken for two hours duration, either at sunrise or at sunset,

3 Results

3.1 Walkover Surveys

The initial walkover survey on 18th May 2016 identified spraints at various locations

along the Ecton Brook within the site, as shown in drawing 773939-DWG-ENV-

001. T he closest spraint to the crossing point was approximately 20m to the north

of the crossing point. Subsequent walkover visits confirmed the spraints were still

present at the same locations, but there were no fresh spraints or new signs

recorded on the subsequent visits.

3.2 Camera Trapping

The camera trapping did not identify any otters throughout the duration of

recording. When the cameras were checked (and data downloaded) on 8 June

2016, there was evidence that the Spypoint camera (camera situated upstream of

the proposed crossing point) had been inundated with water and had stopped

working. This was likely due to heavy rainfall event at the end of May. The

Bushnell camera (situated downstream of the proposed crossing point) was

working fine throughout the duration. No signs of otter were captured on the

cameras.

3.3 Dusk and Dawn Vantage Point Watches

The vantage point watches did not identify any signs of otter during any of the

watches. Other species recorded during the vantage watches included barn owl

(Tyto alba) from vantage point 1 looking east and kingfisher (Alcedo atthis) from

vantage point 2 looking south.

4 Evaluation

The evaluation in this section is based on the otter surveys undertaken during 2016.

For purposes of the assessment it is assumed there has been no change in the

condition of the site since the site surveys. The surveys confirmed the presence of

spraints on the Ecton Brook, showing that otters use the site as part of their

territorial range. The spraints recorded were recorded on the first walkover visit,

with no fresh spraints subsequently recorded on the remainder of the walkover

visits.

No holts or couches were observed during the survey. The camera trapping and

vantage point watches did not confirm any sightings of otter. Given the information

gathered, it is considered that the site forms part of otter territory, and otters in

the catchment infrequently use the site and the Ecton Brook for foraging. Given

the lack of sightings over the course of the 5 weeks there is no evidence to suggest

that otters are frequently using the Ecton Brook, and therefore, otters, whilst using

the site infrequently, are unlikely to be impacted by the proposed works.

5 Conclusions and Recommendations

The walkover surveys undertaken identified signs of otter in the form of spraints.

No further signs of otter were observed during the walkover, camera traps, or

vantage point watches.

The survey results would suggest that the site is used by otter as part of their

territory, but the frequency of use is low. It is unlikely that the works will impact

upon otter at this location.

Precautionary measures should be adopted, to minimise potential disturbance, to

include avoidance of artificial lighting along the banks of the Ecton Brook and

avoidance of work outside of daylight hours.

Should otters be observed on site then all works should stop and a suitably qualified

ecologist should be contacted for advice.
