ESKOM HOLDINGS SOC LIMITED UPGRADE OF THE GRASSRIDGE–SUNNYSIDE–MELKHOUT 132 KV POWERLINE BACKGROUND INFORMATION DOCUMENT 1 INTRODUCTION JG Afrika (Pty) Ltd has been appointed by Eskom Holdings SOC Limited (Eskom) to conduct the Environmental Authorisation Application Process for the proposed upgrade of the Grassridge – Sunnyside – Melkhout 132 kV powerline. The powerline proposed for upgrade runs from the Grassridge Substation in the Addo area, past the Sunnyside Substation in the Port Elizabeth area, and on to the Melkhout Substation located outside Humansdorp. The application for Environmental Authorisation will be conducted in accordance with the Environmental Impact Assessment (EIA) Regulations (2014) promulgated under the National Environmental Management Act, 1998 (Act 107 of 1998) (NEMA) (as amended) which came into effect on 8 December 2014. 2 AREA UNDER INVESTIGATION The area under investigation is contained within the existing powerline servitude, which measures 31 m in width (15.5 m to either side of the centre line of the powerline. The route of the powerline, which measures 93 km in length, starts at the Grassridge Substation, located within the Nelson Mandela Bay Metropolitan Municipality, runs past the Sunnyside Substation, and terminates at the Melkhout Substation, both of which are located within the Kouga Local Municipality. A map indicating the route of the powerline under investigation is included, labelled as Figure 1. Affected municipalities are indicated in Figure 2.

3 THE PROPOSED UPGRADE The following activities are proposed to be undertaken to upgrade the existing 132 kV powerline: Replacement of the existing Chicadee conductor with Kingbird conductor, which is a slightly thicker and heavier conductor, and therefore has the capacity to conduct higher current loads; Replacement of the existing All Dielectric Self Supporting (ADSS) optic cables with 10kA greased Optical Ground Wire (OPGW). The proposed OPGW can perform the dual function of providing an electrical groundwire for the network, whilst the optical fibres within the cable create an independent telecommunication system; Strengthening of the existing poles by installation of stay brackets on the intermediate structures as well as additional middle stays on strains, to accommodate the additional weigh of the proposed conductor; Installation of additional stays, possibly requiring the construction of new stay foundations, on both intermediate and strain structures; and Establishment of temporary roads to allow access to the powerline by heavy trucks during the construction phase. The existing structures currently in use on the line comprise guyed monopoles. These structures will be retained, and no new structures will be introduced. 4 LEGISLATIVE REQUIREMENTS The following Listed Activities, contained in GN R 985 (Listing Notice 3) of the EIA Regulations (2014) are triggered by the proposed development: NUMBER AND DATE OF RELEVANT NOTICE ACTIVITY NO DESCRIPTION
GN R 985, 4 December 2014 (as amended) 4(a)(i) (ee) and (gg) The development of a road wider than 4 meters with a reserve of less than 13.5 meters, in the Eastern Cape, outside urban areas, within critical biodiversity areas as identified in systematic biodiversity plans adopted by the competent authority or in bioregional plans; and in areas within 10 kilometres from national parks or world heritage sites or 5 kilometres from any other protected areas identified in terms of NEMPAA or from the core areas of a biosphere reserve, excluding disturbed areas… GN R 985, 4 December 2014 (as amended) 12(a)(i) & (ii) The clearance of an area of 300 square metres or more of indigenous vegetation except where such clearance of indigenous vegetation is required for maintenance purposes undertaken in accordance with a maintenance management plan, in the Eastern Cape, within any critically endangered or endangered ecosystem listen in terms of section 52 of the National Environmental Biodiversity Act (NEMBA) or prior to
the publication of such a list, within an area that has been identified as critically endangered in the National Spatial Biodiversity Assessment 2004; and within critical biodiversity areas identified in bioregional plans... As such, the proposed development requires Environmental Authorisation subject to a Basic Assessment process. 5 PROJECT TEAM The role players in the project are: APPLICANT Eskom Holdings SOC Limited ENVIRONMENTAL ASSESSMENT PRACTITIONER JG Afrika (Pty) Ltd COMPETENT AUTHORITY National Department of Environmental Affairs (DEA) 6 DESCRIPTION OF THE RECEIVING ENVIRONMENT 6.1 Vegetation The powerline section under consideration passes through numerous vegetation types, as indicated in Figure 2.

Associated with each of these rivers are numerous drainage lines and wetlands which will be identified and assessed through the Basic Assessment process. 6.3 Protected Areas The powerline proposed for upgrade is routed along the boundary of two protected areas, namely the Swartkops Valley Nature Reserve and the Van Stadens River Wildflower Reserve. Both of these protected areas fall under the management of the Nelson Mandela Bay Metropolitan Municipality.

It will be necessary to implement measures during the construction phase to ensure the protection of these areas. this will require an identification and assessment of impacts arising, as well as the determination of measures to prevent, control and mitigate such impacts. 7 ENVIRONMENTAL SCOPE OF WORK The required Basic Assessment process will be undertaken in accordance with the requirements of NEMA and the EIA Regulations (2014). The EAP is required to conduct the environmental application process and manage the public participation process, which is currently underway. As part of this process, JG Afrika (Pty) Ltd will perform the following: 1. Identify and notify key stakeholders, authorities and municipalities, environmental groups and interested or affected parties, hereafter referred to as IAPs; 2. Compile a detailed Background Information Document (BID) for the proposed development (this document), providing details to IAPs of: a. The listed activities that trigger the Environmental Authorisation process; b. The scope of work; c. The locality and current land use at the site; d. A detailed site description; e. The Basic Assessment process to be followed; and
f. The opportunity for IAPs to comment on the project. 3. Advertise the environmental application in a newspaper applicable to the region; 4. Place a notification poster/posters on and surrounding the site; 5. Obtain consent from the landowner to undertake the application process (if necessary); 6. Attend Public Liaison Committee (PLC) meetings and workshops, where necessary; 7. Host a Public meeting, if necessary, providing details of issues identified by the EAP, stakeholders and IAPs; 8. Record all comments of IAPs and present such comments, as well as responses provided by JG Afrika (Pty) Ltd, in a full Comments and Responses Report, for inclusion into the Basic Assessment Report which will be submitted to DEA for decision-making; and 9. Circulate all IAP comments to the project team. The Basic Assessment Report will be made available to all relevant stakeholders and registered IAPs for comment, before being submitted to the DEA for review and decision-making. 8 HOW DO I PARTICIPATE Every proposed development has the potential to significantly affect the natural, social and economic environments, both at, as well as in the areas surrounding the proposed site. For this reason, it is imperative that you as a stakeholder or an IAP comment on the proposed project and highlight any issues or concerns that you feel need to be considered during the proposed planning and implementation process. E3 – COMMENTS AND RESPONSES REPORTS
Summary of main issues raised by I&APs Summary of response from EAP Godfrey Murrel – Acting Director: Environmental Management Sub-Directorate.
• The proposed development is a linear activity which is 93km long with a 31m width. The proposed activity will include clearance of indigenous vegetation and license from the Department of Agriculture, Forestry, and Fisheries (DAFF) must be obtained.
• Clearance of indigenous vegetation will require intense studies by Ecological specialists.
• The proposed development will cross six rivers that are listed as National Freshwater Ecosystem Priority Areas. A hydrological specialist will be required to conduct impact studies, which are triggered by the proposed activity and it is necessary to involve the Department of Water and Sanitation (DWS).
• An Archaeological study will also be necessary to investigate any heritage sites to be impacted upon by the proposed development.
• Should the need to destroy and protected trees arise, a permit will be applied for from the DAFF, in line with the requirements of the National Forests Act, 1998 (Act 84 of 1998).
• It must be noted that much of the vegetation affected by the proposed development has a low conservation threat status (i.e. less than Critically Endangered or Endangered). In addition, the area of vegetation that will be cleared will be very small, limited only to those areas where it is necessary to install an additional stay line to provide additional structural support to an existing powerline mono-pole, or those areas where bush is too thick to allow access to the line. On the basis of this reasoning, it is submitted that the proposed development will have a very insignificant impact on indigenous vegetation and does not warrant the undertaking of a costly and time-consuming specialist assessment which would add nothing to the process.
• The powerline is existing and already crosses the six watercourses mentioned. No additional work will occur within these systems and they will experience no additional impact as a result of the proposed upgrade activity. it is deemed unnecessary therefore, to appoint a hydrological specialist to conduct an impact assessment.
• The activity proposed is the upgrade of an existing powerline, and not the establishment of a new line. There will be limited

• The Zwartkops Conservancy want to be registered as an IAP. We are especially concerned about the impacts on the Swartkops Nature Reserve and the Swartkops River/Estuary. Where the power line crosses is also the boundary of the proposed Ramsar world wetland site, which we plan to have from this section downwards. We are in the process of having the area declared a Protected Environment, which is a prerequisite for Ramsar status.

• Within protected areas (e.g. Zwartkops & Van Stadens NRs) and areas with intact indigenous vegetation, additional vegetation clearing should be avoided by utilizing existing service tracks. I fail to see why new roads will be required for this project over & above what was used during construction of the original line & what is currently used for maintenance of the line.
• Bird flight diverters must be placed on the new ground wire (I assume this will still be the highest placed conductor) in areas where bird collisions are likely (e.g. open grassland / veld, near wetlands, over valleys, etc)

• I&AP Notification: First notification of the current EIA, as described in the 04 October 2017,
• Our understanding is that the “first phase” was an upgrade
emailed correspondence from JG Africa, regarding the Second Phase of the upgrade activities by Eskom, was received by the affected private landowner,on 04 October 2017. The ‘First Phase’ of the same project, by Eskom, commenced on Farm 447 (and adjacent land parcels), in 2015 and was completed in 2016;
• Existing land use issues: Current Eskom infrastructure, located on the Sanctuary Farm 447, does not comply to the demarcations described in the Servitude Agreement/Title Deed. These issues are recorded and were identified in 2015, during the previous upgrade, and have not been mitigated to date. (existing encroachment of existing infrastructure, onto the private agricultural land parcel, and beyond the Registered Servitude);
• Rehabilitation of the areas affected by the previous ‘Upgrade’, conducted between 2015 and 2016, has not been completed, and/or re-instated in accordance with the approved Mitigation measures;
• Access to the Eskom servitude exists via the African Dawn Bird & Animal Sanctuary, via a gravel track developed during the previous ‘upgrade’ activities, and no access is permissible through JAMSLAND, Sanctuary Farm 447.
• It is recommended that a Site specific EMPr is compiled prior to any activities undertaken on the affected private land parcel.

• Noted. It is the duty of the Eskom to provide drawing plans of the locations of the structures and to maintain those positions described in the plans. To date, we have not received drawings from Eskom. The issue of the infrastructure not complying with the demarcations need to be lodged with Eskom and the Contractor who worked on the upgrade.
• The Contractor and/or Eskom needs to be called back to the site and rehabilitate accordingly. Our suggestion would be to contact the Quality and Environmental Management Section of Eskom, and the non-conformance be brought to their attention. The company assigned to conduct the ECO work should have done a shutdown audit as well as a post rehabilitation audit. Those two audits would have detailed non-conformances of the Contractor and Eskom, who would be obliged to fix their non-conformances on site.

• An EMPr for the powerline proposed for upgrade was submitted in conjunction with the DBAR and conditions set out in the EMPr are specific for all the properties affected by the proposed upgrade servitude.
Mantwa Mathebula – Enel Green Power
• The actual scope of work could be argued not to trigger a listed activity, did you consult with the relevant authority and maybe try to motivate for an EMPr to address the impacts?
• Have you conducted a public participation meeting as yet or not deem it critical?
• The report is dated September 2016, when did this project commence as its currently under the 2017 regulations?
• September 2016 still doesn’t align with the EIA (30) timeframes, the PP should end in October and not November 03rd.

Kevin Taylor – Hopewell Conservation Estate
• I notice on a quick flip through the documents that the maps indicate “section 3 of 6” which traverses thorough Hopewell Conservation Estate is correct however in the corresponding tables of affected farms we are not listed?
• Secondly does this upgrade of the conductor pertain to which powerline, there are two that run parallel to each other?
• I will add your details to the corresponding tables for correction before the Final Basic Assessment Report is submitted. The tables were set up with data from GIS databases where coordinates of properties were used in identifying landowners. Unfortunately, there appears to be missing data in the database.
• The powerline proposed for upgrade can be seen in Appendix B, Photo 2 and Photo 5. Alternatively, the coordinates of the line closest to the Hopewell Conservation Estate (approximately 1km according to Google Earth) are as follows: 33°52'58.85"S, 25°22'8.17"E.
Marisa Bloem – Department of Water and Sanitation
• This Office acknowledges the receipt of the Draft Basic Assessment Report for the aforementioned project.
• The report has been thoroughly evaluated in relation to Section 21 (c) & (i) water uses in terms of the National Water Act, 36 of 1998. The project involves the upgrading of an existing powerline that crosses drainage lines and within 500m from the boundaries of wetlands. In that regard, the project triggers section 21 (c) & (i)

Public Participation Process (PPP)

• Proof of correspondence with the various stakeholders must be included in the final BAR. Should you be unable to obtain comments, proof should be submitted to the Department of the attempts that were made to obtain comments. The Public Participation Process must be conducted in terms of Regulations 39, 40, 41, 42, 43 & 44 of the EIA Regulations 2014.
Identified Alternatives for the proposed Activity
• Please provide a description of any identified alternatives for the proposed activity that are feasible and reasonable, including the advantages and disadvantages that the proposed activity or alternatives will have on the environment and on the community that may be affected by the activity as per Appendix 1 (2) (e) and 3 (1) (h) (i) of GN R.982 of 2014.
• Alternatively, you should submit proof of an investigation and motivation if no reasonable or feasible alternatives exist in terms of Appendix 1.
Undertaking under oath or affirmation by the EAP
• The department has noted that the submitted application form has an undertaking under oath or affirmation by the EAP. However, the aforementioned oath was not included in the draft BAR. Please note that the draft BAR must also have an undertaking under oath/ affirmation by the EAP.
Based on the above, you are therefore required to include an undertaking under oath or affirmation by EAP (administered by a Commissioner of Oaths) as per appendix 1 (3)(r) or the EIA Regulations, 2014, which states that the BAR must include: “an undertaking under oath or affirmation by the EAP in relation to:
(i) The correctness of the information provided in the reports;
(ii) The inclusion of comments and inputs from stakeholders and I&APs;
(iii) The inclusion of inputs and recommendations from the specialist reports where relevant; and
(iv) Any information provided by the EAP to interested and affected parties and any responses by the EAP to comments or inputs made by interested and affected parties”.

I fail to see why new roads will be required for this project over & above what was used during construction of the original line & what is currently used for maintenance of the line. 2. We are especially concerned about the impacts on the Swartkops Nature Reserve and the Swartkops River/Estuary. Where the power line crosses is also the boundary of the proposed Ramsar world wetland site, which we plan to have from this section downwards. We are in the process of having the area declared a Protected Environment, which is a prerequisite for Ramsar status. Feedback on your comments are seen below in blue. - I&AP Notification: First notification of the current EIA, as described in the 04 October 2017, emailed correspondence from JG Africa, regarding the Second Phase of the upgrade activities by Eskom, was received by the affected private landowner,on 04 October 2017. The ‘First Phase’ of the same project, by Eskom, commenced on Farm 447 (and adjacent land parcels), in 2015 and was completed in 2016; - Our understanding is that the “first phase” was an upgrade of a different line occurring in the same vicinity of the proposed upgrade. - Existing land use issues: Current Eskom infrastructure, located on the Sanctuary Farm 447, does not comply to the demarcations described in the Servitude Agreement/Title Deed. These issues are recorded and were identified in 2015, during the previous upgrade, and have not been mitigated to date. (existing encroachment of existing infrastructure, onto the private agricultural land parcel, and beyond the Registered Servitude); - Noted. It is the duty of the Eskom to provide drawing plans of the locations of the structures and to maintain those positions described in the plans. To date, we have not received drawings from Eskom. The issue of the infrastructure not complying with the demarcations need to be lodged with Eskom and the Contractor who worked on the upgrade. - Rehabilitation of the areas affected by the previous ‘Upgrade’, conducted between 2015 and 2016, has not been completed, and/or re-instated in accordance with the approved Mitigation measures; - The Contractor and/or Eskom needs to be called back to the site and rehabilitate accordingly. Our suggestion would be to contact the Quality and Environmental Management Section of Eskom, and the non-conformance be brought to their attention. The company assigned to conduct the ECO work should have done a shutdown audit as well as a post rehabilitation audit. Those two audits would have detailed non-conformances of the Contractor and Eskom, who would be obliged to fix their non-conformances on site. - Access to the Eskom servitude exists via the African Dawn Bird & Animal Sanctuary, via a gravel track developed during the previous ‘upgrade’ activities, and no access is permissible through JAMSLAND, Sanctuary Farm 447. - Noted. - It is recommended that a Site specific EMPr is compiled prior to any activities undertaken on the affected private land parcel. - An EMPr for the powerline proposed for upgrade was submitted in conjunction with the DBAR and conditions set out in the EMPr are specific for all the properties affected by the proposed upgrade servitude. The powerline proposed for upgrade can be seen in Appendix B, Photo 2 and Photo 5. Alternatively, the coordinates of the line closest to the Hopewell Conservation Estate (approximately 1km according to Google Earth) are as follows: 33°52'58.85"S, 25°22'8.17"E.
