The Preferred Alternative for the US 550 South

Connection to US 160 is Alternative Revised G

Modified—a realignment of US 550 that connects

to US 160 at the recently constructed Grandview

Interchange’s main overpass bridge. This alternative

has been identified as the one that best meets

purpose and need and has the fewest environmental

impacts, following a year-long Supplemental

Environmental Impact Statement (EIS) process that

CDOT conducted with the Federal Highway

Administration (FHWA). The agencies have

produced the Supplemental Final EIS (SFEIS),

which is now available for review.

What US 550 alternatives were considered

during the recent study?

The study reevaluated several alternatives from the

original 2006 US 160 EIS, as well as several new

alternatives developed to avoid or minimize impacts

to the historic Webb Ranch, including those to the

west (Western Realignment), east (Eastern

Realignment) and several along the existing US

550, with input from Webb Ranch representatives

(R Alternatives). Screening presented in the recent

study identified three alternatives (shown on reverse

side) that met the project purpose and need and

practicability screening criteria (costs, logistics or

other environmental consequences). Alternatives

that were eliminated due to not meeting the above

criteria are: (1) the Western Realignment, and (2)

all alternatives along the existing US 550 alignment,

including the R Alternatives. These included

signalized intersections, as well as partial and full

interchanges.

What comments were received on the

Supplemental Draft EIS and how have these

been addressed?

FHWA and CDOT released the Supplemental Draft

EIS (SDEIS) for public review on October 14,

2011. During the 45-day public comment period, a

public hearing was held with approximately 100

people in attendance. Five agencies and 83 people

commented on the document, either at the hearing

or via letter, email, the project web site or fax. The

majority of the comments focused on estimated

traffic volumes, existing alignment alternatives and

opposition to the Eastern Realignment Alternative.

Many expressed support for the draft Preferred

Alternative (Alternative Revised G Modified), and

many expressed interest in an alignment that would

utilize the existing US 550 alignment. CDOT and

FHWA responded to each comment received. Some

comments resulted in changes to the Draft SEIS,

which are reflected in the SFEIS.

How was the decision on the Preferred

CDOT, Federal Highway Administration Announce Preferred Alternative for a US 550 at US 160 Connection in Grandview

LA PLATA COUNTY – The Colorado Department of Transportation (CDOT) and Federal Highway Administration (FHWA) announce the findings of the alternatives evaluation for a US 550 connection to US 160 in Grandview. The Supplemental Final Environmental Impact Statement (SFEIS) is available for public viewing through August 27, 2012, at locations listed below. The Preferred Alternative for the US 550 South Connection to US 160 is Alternative Revised G Modified—a realignment of US 550 connecting to US 160 at the Grandview Interchange. CDOT and FHWA evaluated all newly identified impacts to historic and archaeological sites and any other changes in impacts related to the connection of US 550—both natural and manmade, including regulatory updates. Issues evaluated in this study included—but were not limited to—environmental impacts, private property impacts, highway safety, mobility and traffic patterns both current and projected. Of all the alternatives analyzed, the Revised G Modified Alternative was identified as the one that best meets project purpose and need for capacity, safety and access control, and has the fewest environmental impacts.

Analysis for this final document has been underway since the FHWA and CDOT released the Supplemental Draft Environmental Impact Statement (SDEIS) for public review on October 14, 2011. During a 45-day public comment period that followed, a public hearing was held with approximately 100 people in attendance. Screening presented in the recent study identified three alternatives, Revised F Modified, Revised G Modified, and Eastern Realignment, that met the project purpose and need and practicability screening criteria (costs, logistics or other environmental consequences). These included signalized intersections, as well as partial and full interchanges. Once the availability period for the SFEIS ends on August 27, 2012, a Record of Decision (ROD) can be issued. The ROD will identify the decision made on the proposed action and the reasons for that decision. Although there will be no formal response to comments made on the SFEIS, all comments will be considered during preparation of the ROD.   History of the study: CDOT and FHWA began the environmental process for the Supplemental Environmental Impact Statement in early 2011. The study has looked at only the alignment and connection of US 550 to US 160, not the entire US 160 corridor. The document supplements the existing 2006 US 160 Environmental Impact Statement to address the newly identified impacts to historic and archaeological sites and any other changes related to the connection of US 550—both natural and manmade. Abstract: Nonconformance penalty (NCP) provisions allow a manufacturer to introduce into commerce heavy-duty engines, heavy-duty vehicles and/or light-duty trucks which fail to conform to certain emission standards, upon payment of a monetary penalty. The information collected from manufacturers electing to utilize NCPs includes a description of their product(s) and test data to verify compliance. This information is collected by the Diesel Engine Compliance Center (DECC) in the Compliance Division (CD), Office of Transportation and Air Quality, Office of Air and Radiation (OAR), of the U.S. Environmental Protection Agency. DECC uses this information to ensure that manufacturers are in compliance with Clean Air Act and EPA regulations and are paying the appropriate penalties. Besides DECC, this information could be used by the Office of Enforcement and Compliance Assurance and the Department of Justice for enforcement purposes. Non- Confidential Business Information (CBI) information may be disclosed upon request under the Freedom of Information Act to trade associations, environmental groups, and the public.

Burden Statement: The annual public reporting and recordkeeping burden for this collection of information is estimated to average 23 hours per response. Burden means the total time, effort, or financial resources expended by persons to generate, maintain, retain, or disclose or provide information to or for a Federal agency. This includes the time needed to review instructions; develop, acquire, install, and utilize technology and systems for the purposes of collecting, validating, and verifying information, processing and

maintaining information, and disclosing and providing information; adjust the existing ways to comply with any previously applicable instructions and requirements which have subsequently changed; train personnel to be able to respond to a collection of information; search data sources; complete and review the collection of information; and transmit or otherwise disclose the information.

Based on past and current experience, EPA now estimates that only one manufacturer will use NCPs with a total of 4 engine families. The average burden per response has decreased slightly, reflecting an increase use of electronic methods for reporting and recordkeeping.

Is Bridge to Nowhere heading to somewhere? Official: ‘We think we’re good to go,’ awaiting final record of decision

The Colorado Department of Transportation announced Friday it plans to realign U.S. Highway 550 across a private ranch and connect it to U.S. Highway 160 by a $47 million interchange that includes the so-called “Bridge to Nowhere.”

It is the same decision CDOT reached in 2006 before the agency hit snags in trying to cross the Webb property. Since then, CDOT has undergone an entirely new analysis that takes into account a gas well and the ranch’s historic designation that were not previously considered.

“We’ve done everything everybody has asked us to do,” said Steve Parker, CDOT commissioner for District 8. “We’ve studied the alternatives that the other folks suggested and didn’t find any reason to go forward with those. We think we’re good to go, and we’re eagerly awaiting the record of decision to come down, hopefully this fall.”

The record of decision is the final blessing from federal authorities.

The proposed 1½-mile realignment would cost an estimated $78 million. It would upgrade the highway from two lanes to four lanes and route it across the Webb ranch east of Farmington Hill.

The existing Highway 550 on Farmington Hill would be abandoned. It is too early to say what would become of the abandoned road: local cycling and hiking group Trails 2000 has expressed interest in using it, or it could be revegetated, said Tony Cady, planning and environmental manager for CDOT.

The realignment would connect with the Grandview interchange, which has received little use since its completion last year.

The interchange includes a foot path, a roundabout, access ramps, six retaining walls, a new westbound lane and four bridges – three of which span Highway 160 – including the Bridge to Nowhere.

It is one of three interchanges proposed for the Grandview area: one is planned for the Three Springs intersection and another is planned at the Elmore’s Corner intersection. CDOT also plans to upgrade the 13-mile stretch of Highway 160 between Grandview and Bayfield from two lanes to four lanes.

The Grandview interchange has received considerable criticism from residents, who have said it is oversized and a waste of taxpayer money. Even Denver media outlets have investigated the project, which cost $28.5 million in state funds, $14.4 million in federal funds and $3.6 million in stimulus funds.

Durango lawyer Daniel Gregory, who represents the Webb ranch owners – Chris Webb and his sister, Martha Coutinho – said only time will tell whether his clients and CDOT can reach an agreement on providing a right of way across the ranch.

CDOT needs to acquire about 64 acres, including about 42 acres from the Webb ranch.

Gregory said his clients hope to reach a “collaborative resolution,” but any legal action could take years to resolve.

CDOT rejected several alternatives in favor of one that “bisects the heart of the Webb ranch” and connects with the Bridge to Nowhere, Gregory said.

“We think it’s an amazing coincidence ... they still come back to the design that justifies the ill-thought-out bridge that they decided to build years ago,” Gregory said.

CDOT said the realignment across the Webb ranch is the best alternative when considering

capacity, safety, cost and environmental impacts.

The realignment will impact five archaeological sites, said Kerrie Neet, transportation director for Region 5. Two other alternatives that received serious consideration would have affected seven and eight sites, she said.

The final environmental impact analysis is available for public viewing until Aug. 27. CDOT then hopes to receive a formal “record of decision” from the Federal Highway Administration to proceed with the project.

If the administration gives its stamp of approval, CDOT will seek funding for the project next year, Neet said. No construction date has been set.

Until then, the Grandview interchange will continue to receive minimal use.

CDOT said the interchange was built with the future in mind. In 2009, an average of 27,875 vehicles passed through the corridor. A traffic study has suggested that number could triple to 85,910 vehicle trips per day by 2030, if Grandview develops.

Even if Highway 550 never connects to the interchange, the Federal Highway Administration determined the project has “independent utility,” which allowed construction of the project to commence even though it was uncertain if Highway 550 would connect.

The Webbs’ attorney questioned this.

“I don’t think anybody who is applying common sense to looking at this really believes that that bridge has independent functionality,” Gregory said. “But that is what they’ve claimed.”

In addition to needing to obtain rights of way to cross the Webb ranch, CDOT must remove 1.6 million cubic yards of dirt before it can connect Highway 550 to the interchange. That is equal to 80,000 big-belly dump truck loads, or enough earth to fill the lap pool, leisure pool and spa at the Durango Community Recreation Center 732 times.

The realignment was deemed necessary to replace the existing two-lane highway on Farmington Hill, which has steep switchbacks, an abrupt drop-off and has been blamed for several trucks jackknifing.

II. Background On March 20, 2012, The Center for

Food Safety and International Center for Technology Assessment submitted to the EPA an ‘‘Emergency Citizen Petition’’ on behalf of 27 individuals and non-governmental organizations requesting that the EPA suspend registrations for the insecticide clothianidin for the four following reasons: (1) To cure clothianidin’s unlawful conditional registration; (2) to prevent an imminent hazard to pollinating insects and the agricultural interests they support by suspending the registrations and initiating special review and cancellation proceedings; (3) to stop the sale of misbranded clothianidin products; and (4) to address Endangered Species Act consultation obligations for clothianidin. Given the emergency nature of the request and the harm asserted, the EPA has addressed on an expedited basis the request to suspend clothianidin registrations to prevent an imminent hazard. This notice announces the availability of the EPA’s petition response on that issue. The EPA will address the remaining three issues in the petition after receiving and considering public comments on the petition. After reviewing the petition and the supporting documentation, the EPA is denying the request to suspend clothianidin registrations based on the assertion that an imminent hazard exists because the petition and supporting documentation reviewed by the EPA do not demonstrate a substantial likelihood of imminent, serious harm that would justify the suspension of this pesticide under the FIFRA standard. The EPA is posting both the petition (including exhibits and supplemental filings) and its response to the imminent hazard claim for 60 days for public comment on

its Web site and in the public docket at regulations.gov. After reviewing the public comments on the petition the EPA will respond to the remaining issues in the petition. In addition, the EPA will determine in connection with that review whether the comments received support the reconsideration of this partial response.

EPA is switching to all- electronic reporting using CDX because it is simple, cost effective, and will improve the availability and integrity of data. As of August 31, 2012, parties will no longer be permitted to submit reports via portable electronic media, such as CDs or diskettes. I. Does this notice apply to me?

This action affects regulated parties who submit information to EPA under fuels programs governed by 40 CFR Part 80, including the reformulated gasoline, anti-dumping, gasoline sulfur, ultra-low sulfur diesel, and benzene programs, as well as the renewable fuel standard. This action also affects regulated parties who submit information to EPA related

to the greenhouse gas reporting requirements of 40 CFR part 98, subparts LL and MM. The specific programs and forms affected are discussed in Section III—What Reports Must Be Submitted via CDX? Reports due or submitted to EPA on or after August 31, 2012 must be submitted to the OTAQ Fuels Reporting System via the EPA Central Data Exchange (CDX). As of that date, regulated parties will no longer be permitted to report by submitting portable electronic media, such as CDs or diskettes. This notice also affects the resubmission of any report to EPA, if the resubmission occurs on or after August 31, 2012. II. Why is EPA switching to all- electronic reporting using CDX?

EPA’s Central Data Exchange (CDX) enables fast, efficient, and secure submission of data to EPA. Among the advantages offered by CDX are the following features, which will improve fuel reporting under 40 CFR Part 80 and greenhouse gas reporting under 40 CFR part 98, subparts LL and MM. CDX allows regulated parties to:

• Submit data through one centralized and secure point of access;

• Receive confirmation from EPA when submissions are received;

• Submit data in a variety of formats including Excel and flat-file; and

• Reduce costs associated with submitting and processing data submissions.

EPA does not charge the regulated party to set up a CDX account. Virtually all regulated parties subject to 40 CFR part 80 already have CDX accounts and EPA’s primary reporting instructions already specify the submission of compliance reports using CDX. However, to date we have permitted submission of CDs or diskettes as an alternative to CDX reporting under certain circumstances. Starting with reports due or submitted on or after August 31, 2012, these alternative options for submitting reports will no longer apply.

There are several reasons for eliminating alternative submission options. Parties often submit CDs without properly ‘‘burning’’ data to them, so that no report is submitted. EPA staff must then notify the regulated party that they must re-submit using CDX or by sending a CD that actually contains the required data. This type of reporting error cannot occur with a CDX transmission.

US 550 SOUTH CONNECTION TO US 160

PROJECT UPDATE

WHAT HAS CDOT BEEN DOING SINCE 2012?During the 2012 Supplemental Final Environmental Impact Statement (SFEIS) public comment period for the US 550 South Connection to US 160 project, an alternative was submitted by Webb Ranch representatives called R5. CDOT hired an independent team of engineers and planners to evaluate this alternative and other potential alternatives. This work also included collection of updated data and outreach to La Plata County, Durango, the Growth Fund Real Estate Group and property owners in the area.

WHAT ARE THE DETAILS OF THE R5 ALTERNATIVE?The R5 alternative was developed and evaluated. It was found to be not reasonable because:

• It has safety issues associated with its location at the base of Farmington Hill and the sharp curve and bridge immediately before a traffic signal.

• It has maintenance issues because of the 90-foot-high retaining walls on slopes prone to erosion.

• It has twice the amount of wetland impacts as other alternatives.

• It has more endangered species impacts.

• It requires the relocation of three residences and one business.

• The construction cost is twice that of the other alternatives.

• It takes twice as long to construct.

• Construction is more complex and poses a greater risk to the traveling public.

IS THERE A NEW PREFERRED ALTERNATIVE?The Preferred Alternative in the SFEIS was called Revised G Modified. During the recent work by the independent team, this has been refined to an alternative called Revised G Modified 6 (RGM6). The RGM6 Alternative is located farther west than Revised G Modified. It has several advantages when compared to Revised G Modified, including:

• Less visual impact

• Less impacts to irrigated farmland

• Less noise impact

• Less right-of-way required

• Impacts to fewer acres of the two historic ranches

Alternative RGM6 is the new Preferred Alternative because:

• This alternative more completely addresses the purpose and need element of safety. It provides safer operations than the other reasonable alternatives studied in the 2012 SFEIS and carried forward during this reevaluation (Eastern Realignment and

Revised F Modified) because it has a roundabout (eliminating left-turn and broadside accidents) rather than a signalized intersection.

• This alternative more completely addresses the purpose and need element of capacity. For the year 2030, the roundabout overall, and each roundabout approach, is expected to operate well at Level of Service A during the morning and evening peak periods.

• This alternative uses three Section 4(f)1 properties, which is the lowest number of Section 4(f) properties used. The other feasible and prudent alternatives analyzed will impact six properties with the Revised F Modified Alternative and four properties with the Eastern Realignment Alternative.

1 Section 4(f) is an FHWA regulation that governs the use of land from publicly owned parks, recreation areas, wildlife and waterfowl refuges, and public or private historic sites for Federal highway projects. The Section 4(f) evaluation requires two findings that must be demonstrated through coordination with FHWA and the State Historic Preservation Office (SHPO): (1) That there is no feasible and prudent alternative that completely avoids the use of Section 4(f) property; and (2) That the project includes all possible planning to minimize harm to the Section 4(f) property resulting from the transportation use (See 23 CFR 774.3(a)(1) and (2).

• This alternative impacts the lowest total acreage of Section 4(f) property: 55.8 acres compared to 63.6 acres with the Eastern Realignment and 95.4 acres with the Revised F Modified Alternative.

• This alternative impacts the least amount of historic ditch property: 488 feet compared to 3,007 with the Revised F Modified and 2,101 with the Eastern Realignment Alternative.

• This alternative impacts the least amount of irrigated farmland (8.9 acres) compared to 31.3 acres with the Revised F Modified Alternative and 33.7 acres with the Eastern Realignment Alternative.

• This alternative requires the least amount of new right-of-way (66.9 acres) compared to 106.2 acres with the Revised F Modified Alternative and 133.0 acres with the Eastern Realignment Alternative. Similarly, this alternative requires no residential or business relocations, while the Revised F Modified Alternative requires four residential relocations and the Eastern Realignment Alternative requires six business relocations and one business relocation.

• This alternative impacts the fewest dwelling units by increased noise. Only 103 dwelling units and 69 receptors are impacted compared to 108 dwelling units and 73 receptors with the Revised F Modified Alternative. The Eastern Realignment Alternative impacts 117 dwelling units and 83 total receptors.

• This alternative results in the least impact to visual character and scenic integrity because it is shorter than the other reasonable alternatives and would be seen by fewer residents. It is also located along the edge of Farmington Hill, so it has less of a visual impact to historic ranches.

• The potential spread of noxious weeds and potential for surface disturbances affecting water quality are less with this alternative because only 68.5 acres of new land disturbance is required, compared to 106.2 acres with

the Revised F Modified Alternative and 133 acres with the Eastern Realignment Alternative.

• This alternative results in the least adverse effect determinations to archaeological sites: six compared to seven with the Revised F Modified Alternative and eight with the Eastern Realignment Alternative.

• This alternative is consistent with local zoning and land use plans, including the City of Durango Grandview Area Plan (City of Durango, 2004). The other two alternatives are not consistent with this plan.

• This alternative has the least impacts to wildlife habitat, elk winter/severe winter ranges, mule deer winter/severe winter ranges, and bald eagle winter range. It takes advantage of natural drainageways to provide more wildlife crossings (thereby lessening the possibility of automobile/vehicular conflicts). It also removes US 550 pavement along its current alignment, which enhances high-value wildlife habitat along Wilson Gulch.

WHAT ARE THE NEXT STEPS? CDOT is in the process of finalizing the National Environmental Policy Act documentation for the overall project. This will culminate with a Record of Decision, documenting the final CDOT and Federal Highway Administration decision on the project. The document is scheduled to be finalized in spring 2015. While no construction schedule is available at this time, the next steps for the project are (all pending available funding):

• Right-of-way acquisition

• Final design

• Construction

After more than a decade of planning and three years after the completion of the Grandview Interchange, the realignment of U.S. Highway 550 is moving a critical step closer to completion.

Stakeholders have come to an agreement on the route the realignment will take in achieving the Colorado Department of Transportation’s long-term goal to eliminate narrow, windy, steep Farmington Hill in favor of a safer, higher capacity interchange to move traffic up on Florida Mesa more smoothly.

“Everyone was there today: landowners, the city of Durango, the (Southern Ute Indian) Tribe,” said Nancy Shanks, communications manager for Region 5 of the Colorado Department of Transportation, late Friday afternoon. “The independent engineering firm we hired presented the newest iteration of their U.S. 550 design alternative – it was very positive. We’re taking it through the environmental process now.”

There is still a long way to go, Shanks said. CDOT hopes to issue a final record of decision in the spring, and then it will be all about the funding: funding to acquire the needed rights of way, funding for the engineering of the complicated project and funding for construction.

Cost estimates are preliminary. A phased option would start with $75 million to build a two-lane highway, Shanks said. The phased option still would include acquiring all the rights of way, completing the full design and doing the earthwork for an eventual four-lane highway. Completing the project at once would cost an estimated $91 million for a four-lane highway.

Jim Davis, director of public works for La Plata County, said the county commissioners have written a letter to the executive director of CDOT requesting funding that will be made available through Senate Bill 228 for the project. SB228 comes into play when personal income growth exceeds 5 percent annually, anticipated to happen this year, which could trigger a transfer of funds from the Colorado General Fund to CDOT for the Strategic Transportation Project Investment Program. The U.S. Highway 550 realignment is one of the strategic projects on the list. It’s not certain if that funding amount would be substantial, however, as the Taxpayer’s Bill of Rights would kick in if the growth reaches 6 percent.

Why are the project estimates so much more expensive than the $77.5 million estimated for the original route?

“Two years have gone by,” Shanks said. “Construction materials have gone up by 25 percent, and a U.S. 160 wildlife underpass, always part of the Environmental Impact Study, was also included in this recent estimate.”

The costs are in addition to the $46.5 million spent on the interchange, which included $28.5 million in state funds, $14.4 million in federal funds and $3.6 million in stimulus funds.

The route has been a longtime coming, with a number of options analyzed by consulting firms Amec and Muller, who partnered on the project. They confronted problems with wetlands, archaeological sites and property owners who didn’t want a highway cutting through the middle of their ranches.

CDOT hired consultant teams to perform an independent review of traffic projections for the year 2035, Shanks said. The projections anticipate an almost three-fold increase in traffic in the area by 2035 and confirmed the need for an interchange at the two highways’ intersection.

“We’re quite happy with it,” said Pat Vaughn, president and CEO of Growth Fund Properties Group, which is developing Three Springs. “This came about because of a lot of negotiations with the property owners and a lot of time out on site with the engineers. Our role was trying to broker a deal, which we saw value in for the entire community, rather than seeing them fight it out in court. If we hadn’t done it, shame on us.”

Eagle Block, which is at the top of Farmington Hill, will be accessed by a remnant of the current route of U.S. Highway 550 that will essentially become a service road.

“We’ve known about this for awhile, and it will be nice to have it done,” said Rita Anderson, a member of the Piccoli family, which owns and operates the business. “We have all these semis coming into the yard and turning around, and people fly around these corners at the top of the hill.”

Lots of area residents turned out Monday afternoon at the Durango Library to see Colorado Department of Transportation's new preferred alternative route to connect the "Bridge to Nowhere" exchange at the bottom of Grandview Hill to Highway 550 south.

The route, referred to as RGM6, skirts the west edge of the mesa top, crossing a small part of the historic Webb Ranch. Ranch owners had resisted an original route that went through the middle of their property.

Visitors at the Monday open house could examine maps with the original and new preferred route, also several other routes that were analyzed over the past several years.

According to CDOT, the RGM6 route does not displace any homes or businesses, unlike

some of the other routes. It also has the fewest impacts on affected properties and on wildlife, and requires the smallest amount of new right-of-way acquisition, at 66.9 acres.

CDOT is still completing National Environmental Policy Act documentation for the entire project, with a Record of Decision with the Federal Highway Administration scheduled to be finalized in spring 2015.

Finalizing a route doesn't mean the work will happen any time soon. It's anybody's guess when it will happen, CDOT representative Nancy Shanks said.

CDOT Region 5 Director Kerrie Neet added, "There's identified funding that hasn't been formally approved. It's less than 1 percent of the project."

The money could be used for right-of-way acquisition, but there's no money for construction, they said.

The cost estimate for four-lane design and construction of the RGM6 route is estimated at $91 million, or $75 million for a two-lane road including the cost of right-of-way for the full four lanes.

In late September, Neet and other CDOT representatives told the La Plata County Commissioners that current funding priorities are for "shovel-ready" projects and to preserve the condition of existing roads rather than saving up money for very expensive projects.

Colorado Transportation Commissioner Sidny Zink from Durango said then that CDOT had been anticipating an additional $200 million a year statewide for the next five years, but that could be cut in half if state revenue growth triggered a TABOR Amendment requirement for refunds of "excess revenue" to taxpayers.

As of November, that prospect was looking more likely. Associated Press reported that Gov. John Hickenlooper's proposed budget for the next fiscal year included almost $137 million set aside for taxpayer refunds in 2016.

Who will show them the money? ‘Bridge to Nowhere’ gains definition

The various stakeholders tentatively have agreed on a route for the realignment of U.S. Highway 550 – something some locals who call the first stage of the project “The Bridge to Nowhere” – doubted ever would happen.

“Instead of a perfect storm, we ended up with a perfect opportunity to solve the problem,” said Chris Webb, managing member of the Marie J. Webb Ranch.

The original preferred route essentially would have cut the Webb Ranch in half.

“With a new leader in Kerrie Neet and independent engineering consultants who said, ‘Let’s reason this out together,’ one good thing led to another,” Webb said.

But now the Colorado Department of Transportation faces an even larger problem regarding the Grandview interchange project: How do we pay for it? The project will cost an estimated

“We had high hopes when the governor’s budget office said it was likely Senate Bill 228 would kick in,” Colorado Transportation Commissioner Sidny Zink said. “But now it looks like the refund will kick in.”

The bill will kick in when personal income growth exceeds 5 percent annually, which happened in 2014. The bill authorizes the transfer of up to $200 million into CDOT’s Strategic Transportation Project Investment Program, and the realignment of U.S. Highway 550 to eliminate Farmington Hill is on the list of projects identified in the program.

“We wouldn’t just do the projects on the list blindly, but being on the list is helpful,” Zink said.

But there is a catch: If personal income growth hits 6 percent or higher, the Taxpayer’s Bill of Rights kicks in, requiring an automatic taxpayer refund. That seems to be the current status, and it is a bit of a Catch-22. Personal income growth always is good, but too much growth and the money isn’t available for much-needed infrastructure projects.

“I’m going to the Colorado Forum next week, and the TABOR refund issue will be one of the main topics,” Zink said at a CDOT open house last week.

Understanding CDOT’s budget is a key part of the puzzle. Zink said the department’s entire budget is about $1.2 billion annually.

“We get $3.5 million in discretionary funds for priority projects covering all 15 counties in Southwest Colorado,” said Neet, the Region 5 director for the transportation department. “And the majority of that goes to maintaining the system we currently have.”

The other problem is that the U.S. Highway 550 realignment isn’t the only project in the Strategic Transportation Project list. There are 27 other projects across the state clamoring for funding.

“The elephant in the room is the planned I-70 viaduct,” Zink said. A viaduct is a long bridge of short spans supported on piers, usually to carry a road over a valley. “It’s planned to go from downtown out to Peña Boulevard, which goes to Denver International Airport, and the cost for its three phases is close to $1 billion over three to five years.”

What about federal money? It is a U.S. highway, after all.

“Who knows?” Zink said. “Congress put a Band-Aid on the Federal Highway Trust Fund, so when and if any money would be available is a big question.”

It does not appear that Congress will address the reauthorization of the Federal Highway Funding Bill any time soon. In August, Congress approved a short-term fix of $11 billion to keep the fund solvent through next May. No further action on a long-term solution of keeping the fund solvent has been taken.

There is no clear avenue to funding, Neet said, but for the short term, she thinks the funding to begin acquiring rights-of-way and the engineering might be available as early as 2016.

“There’s nothing in Colorado’s budget for a project this large. so some kind of bonding initiative might be a way to find financing,” she said.

The road is an important artery.

“If people understood the importance of highways to the economy of rural Colorado, they might understand how key this project is,” Neet said. “It’s the only thing we have, and it’s a lifeline. This project would have a big impact.”
