Schofields Road upgrade: Tallawong Road to Railway TerraceInvitation to comment
Schofields Road is currently a 4.8 kilometre long two lane, two way rural road that connects WindsorRoad at Rouse Hill to Railway Terrace at Schofields. The RTA proposes to upgrade 2.8 kilometres ofSchofields Road between Tallawong Road and Railway Terrace to four lanes with the provision of a widemedian to allow for further expansion to six lanes in the future. The proposal includes the upgrade of anumber of intersections, bridges and culverts, as well as designated turning lanes, off-road shared pathsfor cyclists and pedestrians, and bus priority access.
The proposal forms part of the overall upgrade and extension of Schofields Road to provide an eightkilometre long major east-west connection between Windsor Road and Richmond Road. This upgrade isin response to the increase in traffic volumes that are expected to occur in the area as a result of thedevelopment of the North West Growth Centre. The upgraded Schofields Road would operate as atransit boulevard, and would service the Rouse Hill Regional Centre in the east, the proposed MarsdenPark town centre and industrial precinct in the west, and the new Schofields Railway Station andadjacent town centre.
The proposal represents Stage 2 of the overall Schofields Road project. Stage 1 involves the upgrade ofSchofields Road from Windsor Road to Tallawong Road and is currently in the detailed design phase.Stage 3 comprises a new 3.2 kilometre section of Schofields Road from Railway Terrace to RichmondRoad, which has been subject to strategic planning studies and consultation associated with theSchofields Road corridor.
A Review of Environmental Factors will be prepared for the proposal to fulfil the requirements of Part 5 ofthe Environmental Planning and Assessment Act 1979. The REF will assess the potential environmentalimpacts associated with the proposal and make recommendations regarding measures to minimiseidentified impacts.
It is anticipated that the REF will be supported by the following specialist studies:

Statutory Consultation
Statutory consultation is an integral component of the REF process as it allows relevant governmentagencies to be informed of the proposal and provides an opportunity for agencies to provide feedback onthe proposal.
We are now seeking comments and/or feedback from relevant agencies and authorities. It would beappreciated if you could advise of any issues that you feel should be addressed in the REF, statutory orotherwise, by no later than Friday 5 August 2011.
A copy of a Community Update from February 2011 is enclosed for your information. The CommunityUpdate relates to Stages 2 and 3 of the overall Schofields Road project, and details refinements made tothe design following community comments. Also enclosed are plans showing the post consultationdesign for the proposal (Stage 2).

Roads and Maritime Services (RMS) is proposing to undertake works for the Schofields RoadUpgrade between Tallawong Road to Railway Terrace.
Blacktown City Council’s involvement throughout the project development to date has providedvaluable feedback. This letter has been issued to fulfil the consultation requirements under theState Environmental Planning Policy (Infrastructure) 2007, clause 15, development on flood liableland. The proposal will also impact existing Council infrastructure/services (refer ISEPP Clause 13)though it is noted that these impacts are in line with the North West Growth Centre DCP.
Plans are enclosed showing an indicative for the proposal. Project information is also availableonline at RMS projects website:http://www.rta.nsw.gov.au/roadprojects/projects/sydney_region/western_sydney/schofields_road/index.html.
It would be appreciated if you could provide any comments regarding this proposal by 16December 2011.

Thank you for your letter of 13 July (INW11/21347) seeking requirements for the Review of Environmental Factors for the proposed works from the Department of Primary Industries. This is a combined response from the Agriculture and Fisheries divisions of DPI.
Agriculture
A recent publication by the Department of Primary Industries – Agriculture provides a reference for agricultural issues for your information.

Fisheries
DPI-Fisheries is responsible for ensuring that fish stocks are conserved and that there is no net loss of key fish habitats upon which they depend. To achieve this, DPI-Fisheries ensures that developments comply with the requirements of the Fisheries Management Act 1994 (FM Act) (namely the aquatic habitat protection and threatened species conservation provisions in Parts 7 and 7A, respectively), and the associated Policy and Guidelines for Aquatic Habitat Management and Fish Conservation (1999).
In addition to the broader Policy and Guidelines, I would refer you to the following guidelines specific to waterway crossings: Policy and Guidelines for Fish Friendly Waterway Crossings 2004, and Why Do Fish Need to Cross the Road? Fish Passage Requirements for Waterway Crossings (both are available at: http://www.dpi.nsw.gov.au/fisheries/habitat/protecting-habitats/toolkit).
Those three documents outline the impact assessment procedures of DPI-Fisheries, as well as advice to mitigate those potential impacts. As a minimum, the REF must provide:
• Recent (within 6 months of lodging application) clear colour photographs of the site adjacent to, and upstream and downstream of the proposed works area identifying the types of available fish habitat, particularly as they relate to existing structures and/or the position of the proposed structures. • Details on the area and methods of construction/restoration, including plans in both plan view (i.e. as viewed from vertically above) and longitudinal view (i.e. horizontal view). • Details of how these works may impact the aquatic environment either directly or indirectly (examples of indirect impacts include changes to localised water movements caused by structures).

• Details of mitigation measures proposed to minimise impacts on the aquatic environment, e.g. use of bridges instead of pipes or culverts, silt curtains, construction site delineation, sediment fences. • Consideration of threatened species listed under the Fisheries Management Act 1994 that could be affected (see: http://www.dpi.nsw.gov.au/fisheries/species-protection/conservation/what-current). NB: If the habitat is suitable for threatened species, assume they are present.
Finally, under section 199 of the FM Act, the Roads and Traffic Authority is required to consult with DPI-Fisheries prior to authorising any dredging or reclamation works on public water land. Submission of the REF will be deemed to have satisfied s.199 of the FM Act.

Stage 2 waterway crossingsYour emails, associated information and our site inspection last week have satisfied theRTA's requirement under section 199 of the FM Act to consult with DPI-Fisheries prior toauthorising any dredging works on public water land. Further to our discussions during thesite inspection, this is a stand alone response from DPI-Fisheries, and a separate responsewill be sent from the DPI-Office of Water.
The alterations to the waterway crossings to a bridges 3-cell box culverts are a vast improvement onthe fish passage capacity of the current pipes and so are consistent with our policies and guidelinesfor waterway crossings of this size and our broader policies and guidelines for management of fishhabitat. In addition, the waterways are not within the distribution and/or provide habitat for anythreatened species under the FM Act and most provide limited fish habitat in their current state. Assuch, there are no specific requirements for Stage 2, other than to implement the intent andprinciples of the "Blue Book" with respect to erosion and sediment control and minimising potentialfor pollution of the waterway at the works sites.
Please notify me and Paul Schuetrumpf (email is fine) the week before the works commence, sothat we are aware of the works program in the event of queries from the public
Also, in the unlikely event of a fish kill at the site, please call me and Paul Schuetrumpf(0419185363) immediately
Second Ponds Creek 'dredging'As discussed during the site inspection, I don't believe that it is necessary to "drill, bore or dredge"or use similar destructive techniques to determine the location of utilities beneath or within SecondPonds Creek. The RTA will have to provide significant justification as to why such techniques wouldbe preferred over alternate technologies, particularly seismic detection techniques that are not asinvasive nor require the removal of areas of remnant vegetation or streambed modification. I amhappy to discuss RTA's options in more detail, and in the mean time recommend that the RTAconduct an in-depth analysis of the options that clearly identifies the pros and cons of each so as toinform any such discussions with DPI-Fisheries.

Hi Jim,the notes are a reasonable representation of our site meeting and discussion.The RTC bridge width I note is still a minimum of 40m, the actual riparian corridor is over60m and then plus a buffer. After reviewing what was done by the GCC for the riparian areasand the significance of the vegetation outside of the proposed road footprint, the width of thesplit bridge should be around the 50m.
Also to clarify matters, I am now fully with Office of Water and not OHN (the email addressis a hangover of this recent change) and confusing to many unfortunately.So as you are likely to be using the meeting outcomes in your REF, it is best to have the rightagency quoted...........................Regards Greg

I have put together my recollection of the outcomes of the meeting today as a draft.Please let me know if any changes/additions needed.
1) OverviewAn overview was provided of the precinct rezoning plans (now rezoned) includingthe Alex Avenue Stormwater Management Strategy with Online Basins.The project was summarised as upgrading the existing 20 m rural road corridor to a43m urban road to be developed as a four lane road with wide verges and mediansand with future capacity for widening to six lanes within the median. Whendeveloped to four lanes the median would be 15m wide and reduced to 9m ifdeveloped to six lanes.
All bridges will be twin bridges with separation consistent with median widths.
It was noted that further discussions would be held with the Department of Fisheriesnext week.
It was noted that any detention basins for the road would be primarily focussed onconstruction management. Any water quality treatment is proposed to be limited togross pollutant traps.
2) First Ponds TributaryThis creek is identified to be realigned under the precinct plans. The proposalwould result in some encroachment to the existing pond south of the alignment. Atriple box culvert is proposed and is likely to be diagonally skewed under the roadand would then follow the proposed northern verge westwards until rejoining theexisting creek. There is the potential for additional skewing at the join. Furtherinvestigation to confirm that the proposed alignment is within the REF footprint.Colm to advise potential alignment - one week?
Care will be needed to align the culvert away from unsuitable material.
Ultimately Hambledon Rd would need to be extended northwards. This may involvefurther realignment outside of the Hambledon Road footprint but this would be theresponsibility of future private developers and Council in providing consent.
Office of Hawkesbury Nepean (OHN) concurred with this approach.
3) Junction St TributaryA triple box culvert is proposed. No proposal for creek realignment.
4) BridgesTwo bridges are proposed at First Ponds Creek (FPC) and also at the Railway Tcecrossing (RTC).
An overview was provided confirming that this section of Schofields Road would bedesigned as 'secondary' flood evacuation route for the 100 year ARI. It is proposedto undertake as sensitivity analysis for the PMF in relation to bridge heights. Bridgestructures would be designed to allow for overtopping for the 2000 year ARI.
It was agreed that the proposed bridge separation would provide for sufficient lightand it was noted that the bridges would at a height sufficient for maintenanceaccess but not pedestrian access. It was agreed that appropriate creek treatmentwould be provided management strategies identified in the REF. The REF wouldbe displayed for public and stakeholder comment.
It was agreed that there is no requirement for riparian buffer zones for this project.
It was advised that the flood design would require a 30m bridge at FPC. This wasagreed to be sufficient to also cater for riparian corridor requirements.
At the RTC it was identified that flood requirements dictated a minimum 40m bridge.It was noted that the fenced 'fauna and flora' area would be almost entirely underthe proposed alignment. RTA agreed to provide OHN with drawings of proposedalignment. OHN advised it would review and confirm riparian corridor requirementsfor this crossing.
5) Underpass drainageRTA identified that it is likely for the future rail underpass to be permanentlypumped out. There is potential for gravity drainage which is to be investigated. - Iffeasible the drainage line would follow a path between the railway corridor and theproposed realigned Railway Tce and could potentially include in-line detentionbasin(s). These are expected to be within the REF footprint but connection to thetributary feeding from the Railway Tce crossing would be beyond the REFfootprint. Agriculture If the proposed road route bisects current farms in particular intensive agriculture farms - coordination of works with the farms harvesting time to reduce production impacts and the replacement of infrastructure, damaged or removed will need to be considered. Compensation for loss of commercial agricultural production and removing permanently production areas should form part of the mitigation proposed. The relevant agricultural issues to consider when preparing and / or assessing infrastructure proposals are set out in the Department of Primary Industries (DPI) Guideline: http://www.dpi.nsw.gov.au/__data/assets/pdf_file/0020/359030/infrastructure-proposals-on-rural-lands.pdf. The guideline also documents recommended project design and mitigation responses. Fisheries DPI-Fisheries recommend that waterway crossings are designed according to the following Departmental documents available from http://www.dpi.nsw.gov.au/fisheries/habitat/protecting-habitats/toolkit#Policies-&-guidelines: - Policy and Guidelines for Fish Friendly Waterway Crossings - Why Do Fish Need to Cross the Road? Fish Passage Requirements for Waterway Crossings Fish friendly crossing requirements will be most applicable on affected waterways that have been mapped as Key Fish Habitat (KFH) by this Department. These waterways are Narellan Creek, Lowes Creek, Thompsons Creek and Badgerys Creek. As a public authority the Roads and Maritime Services (RMS) will need to formally notify DPI-Fisheries under s.199 of the Fisheries Management (FM) Act 1994 of dredging activities within the banks of creeks considered to be KFH. Alternatively, RMS may prefer that construction companies obtain a dredging and reclamation permit under s.201 of the FM Act under the company name. It is recommended that erosion and sediment control measures are implemented during construction and that, where possible, fish passage within KFH is not blocked during construction. methods and materials � map(s) of the development area and adjacent areas - this should include
nearby waterways and land use � clear photographs of the site, including photographs of any riparian
vegetation present � a clear description of the physical and hydrological features of the
development area (which may extend upstream and downstream of the development site in the case of flowing rivers or tidal waterways)
� a clear description of aquatic environments including: � including threatened and protected species, populations, ecological

possible indirect effects of the proposal on species/habitats in the area surrounding the subject site: for example, through soil erosion or pollution.

Aquatic habitat assessment The aim of the aquatic assessment should be to define the presence of ‘key fish habitat’ within the study site, adjacent areas. Some points to consider include: � description of the water quality (e.g. discolouration, sedimentation,
turbidity, pH, dissolved oxygen, nutrients), � types of surrounding land use (e.g. agricultural, urban, aquaculture), � description of aquatic habitat components such as stream morphology, in-
stream and riparian vegetation, flow characteristics. � presence of any listed threatened or protected aquatic species or ‘critical
habitat’ under the FM Act and EPBC Act. C. Assessment of likely impacts • indicate the location, nature and extent of habitat removal or modification
(both direct and indirect) which may result from the proposed action; • discuss the potential impact of the modification or removal of habitat
(potential direct and indirect sources of impact are stated in the letter to this attachment);

Thanks for your invitation to comment on the Schofields Road upgrade – Tallawong Road to RailwayTerrace. I apologise for not getting back to you within the requested time frame.
The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) protects matters ofnational environmental significance, including nationally listed threatened species and ecologicalcommunities, and migratory species, among others. Matters of national environmental significancewith are relevant in the Schofields Road area include the threatened ecological communityCumberland Plain Shale Woodlands and Shale-Gravel Transition Forest (critically endangered) and anumber of threatened flora and fauna species.
Generally, a person proposing to take an action that is likely to have a significant impact on a matterof national environmental significance must refer their proposal to the Department for assessmentand approval in accordance with Part 9 of the EPBC Act. However, I am aware that the proposedroad upgrade falls within the area covered by the Western Sydney Growth Centres strategicassessment which is being undertaken by the Australian and NSW Governments in accordance withPart 10 of the EPBC Act.
On 20 December 2011, the Minister Burke endorsed the program document Sydney Growth CentresStrategic Assessment: Program report . The endorsement of this program allows the minister toconsider giving approval to classes of actions that are taken in accordance with the endorsedprogram.
My understanding is that Minister Burke’s approval for classes of actions to taken in accordance withthe endorsed program is likely to be given within the next few months. This means that, onceapproved, individual referrals will not be required for developments within the Growth Centre,including the upgrade of Schofields Road.
