Avanti would like to at least get a sense of the degree of Nisga’a open mindedness to exploring the possibilities with Avanti. 2) The Nisga’a are open for business, economic development is a big priority to the extent that social and environmental considerations can be properly developed. The thought of mine development is quite concerning due to the legacy of the mine tailings issues, and the impact on social, cultural and economic considerations. It is important for both sides to listen and to express clearly the issues and concerns. NLG feels this meeting was good start; more discussions are needed. NLG will debrief leadership and endeavour to ensure they have an audience with the leadership. The technical and administration staff do not presuppose the leadership decisions. NLG will get back to Avanti.

Clean water will always be kept separate from tailings water. 4) Draft Protocol Agreement: NLG prepared a draft. Avanti requested some clarification. Revised document will be discussed by NLG Executive the following week. 5) Tripartite Meeting: Avanti would like to hold a meeting between Avanti, NLG and the BC Government (MEMPR). The combination of the Project Description and the Environmental Work Plan documents are the basis for the Terms of Reference. Avanti has prepared a brief Draft of a Terms of Reference for a Technical Working Group. Avanti will look at setting up an FTP site for the information. Avanti presented the draft plan for community engagement and conceptual-level Benefits Agreement. Logistics regarding NLG work plan and budget were also discussed. 2) NLG has no real concerns about the water license application for the possible camp site. It is NLG policy to respond directly government to government. However, they do not see any huge concerns and don’t anticipate communicating any major concerns to the BC government. NLG are not prepared to provide Avanti with a response until NLG is satisfied that this approach complies with the Chapter 10 approach. If consultants could review the project description and ensure the language dealing with NLG is the same as in the PEA that will be helpful.

1) Provided an update of the mineral tax revenue sharing policy. The BC Governments’ target date is to reach agreement in principle by September of this year on the revenue sharing formula. BC MEMPR's mandate follows revenue sharing principles that have been established by Cabinet. These principles are ’Cabinet confidential material’ so Avanti could not get them. Generally speaking, the mandate sets limits on the amount that can be shared and the revenue will be a share of the mineral tax only. Some key points of the revenue sharing framework include: must be a major project; must be new revenues; revenue sharing agreements are not legally required, but will count as accommodation; and sharing will only take place once a revenue stream is established (no front loading). 2) NLG asked for a link to the source for the information.
