INTRODUCTION  

The  Jeanne  Ann  Clery  Disclosure  of  Campus  Security  Policy  and  Campus  Crime  Statistics  Act  requires  publication  of  an  annual  report  that  includes  important  information  concerning  campus  safety  and  security.  1  Copies  of  the  report  are  available  from  the  HCC  Police  Department,  3200  Main,  Houston,  Texas  77002,  during  normal  business  hours,  or  online  at  the  HCC  web  site.  

The  Houston  Community  College  Police  Department  administrative  office  is  located  at  3200  Main,  Houston,  Texas,  77002,  across  the  street  from  HCC’s  District  Office  Building.  Office  hours  are  8:00  a.m.  –  5:00  p.m.,  Monday  through  Friday.  The  police  department  provides  service  24  hours  a  day,  7  days  a  week.

CAMPUS  CRIME  STATISTICS  

The  Clery  Act  measures  2013  crime  using  definitions  from  the  FBI’s  Uniform  Crime  Reporting  System  and  the  federal  Violence  Against  Women  Reauthorization  Act  of  2013.  The  data  should  be  viewed  with  caution  since  Clery  definitions  do  not  include  common  offenses  such  as  burglary  of  a  motor  vehicle,  theft,  public  intoxication,  or  simple  assault.  For  more  information,  please  contact  the  HCC  Police  Department.  

Beginning  with  this  report,  incidents  of  domestic  violence,  dating  violence,  and  stalking  are  also  reported  in  the  Annual  Security  Report.  2  The  Director  of  HCC’s  Office  of  Institutional  Equity  (“OIE”)  is  HCC’s  Title  IX  Coordinator.  Since  OIE  manages  Title  IX  gender-­‐based  discrimination  complaints,  they  were  asked  to  report  relevant  referrals  for  this  report.  Under  Title  IX,  sexual  violence  and  sexual  harassment  are  forms  of  discrimination.

Data  regarding  disciplinary  referrals  was  reported  by  HCC  Student  Services.  For  Clery  reporting,  a  disciplinary  referral  is  a  “referral  of  any  person  to  any  official  who  initiates  a  disciplinary  action  of  which  a  record  is  kept  and  which  may  result  in  the  imposition  of  a  sanction.”  3

DEFINITIONS  AUTHORIZED  BY  THE  CLERY  ACT  

Murder  –  “The  willful  (nonnegligent)  killing  of  one  human  being  by  another”.  

Sexual  Assault  -­‐  “Penetration,  no  matter  how  slight,  of  the  vagina  or  anus  with  any  body  part  or  object,  or  oral  penetration  by  a  sex  organ  of  another  person,  without  the  consent  of  the  victim.”  

Robbery  –  “The  taking  or  attempted  taking  of  anything  of  value  from  the  care,  custody,  or  control  of  a  person  or  persons  by  force  or  threat  of  force  or  violence  and/or  by  putting  the  victim  in  fear.”  

Aggravated  Assault  –  “An  unlawful  attack  by  one  person  upon  another  for  the  purpose  of  inflicting  severe  or  aggravated  bodily  injury.  This  type  of  assault  usually  is  accompanied  by  the  use  of  a  weapon  or  by  means  likely  to  produce  death  or  great  bodily  harm.”  

Burglary  –  “The  unlawful  entry  of  a  structure  to  commit  a  felony  or  theft.”  

Motor  Vehicle  Theft  –  “The  theft  or  attempted  theft  of  a  motor  vehicle.”  

Hate  Crime  –  “[O]ffenses  in  which  the  victim  is  intentionally  selected  because  of  the  actual  or  perceived  race,  gender,  religion,  national  origin,  sexual  orientation,  gender  identity,  ethnicity,  or  disability  of  the  victim.”  

Arson  –  “Any  willful  or  malicious  burning  or  attempt  to  burn,  with  or  without  intent  to  defraud,  a  dwelling  house,  public  building,  motor  vehicle  or  aircraft,  personal  property  of  another,  etc.”

Liquor  Law  Violations  “The  violation  of  state  or  local  laws  or  ordinances  prohibiting  the  manufacture,  sale,  purchase,  transportation,  possession,  or  use  of  alcoholic  beverages,  not  including  driving  under  the  influence  and  drunkenness”.  

Drug  Abuse  Violations  –  “The  violation  of  laws  prohibiting  the  production,  distribution,  and/or  use  of  certain  controlled  substances  and  the  equipment  or  devices  utilized  in  their  preparation  and/or  use.  The  unlawful  cultivation,  manufacture,  distribution,  sale,  purchase,  use,  possession,  transportation,  or  importation  of  any  controlled  drug  or  narcotic  substance.  Arrests  for  violations  of  state  and  local  laws,  specifically  those  relating  to  the  unlawful  possession,  sale,  use,  growing,  manufacturing,  and  making  of  narcotic  drugs.”  

Weapons  Violations  –  “The  violation  of  laws  or  ordinances  prohibiting  the  manufacture,  sale,  purchase,  transportation,  possession,  concealment,  or  use  of  firearms,  cutting  instruments,  explosives,  incendiary  devices,  or  other  deadly  weapons.”  

Domestic  Violence  –  “Felony  or  misdemeanor  crimes  of  violence  committed  by  a  current  or  former  spouse  or  intimate  partner  of  the  victim,  by  a  person  with  whom  the  victim  shares  a  child  in  common,  by  a  person  who  is  cohabitating  with  or  has  cohabitated  with  the  victim  as  a  spouse  or  intimate  partner,  by  a  person  similarly  situated  to  a  spouse  of  the  victim  under  the  domestic  or  family  violence  laws  of  the  jurisdiction  receiving  grant  monies,  or  by  any  other  person  against  an  adult  or  youth  victim  who  is  protected  from  that  person’s  acts  under  the  domestic  or  family  violence  laws  of  the  jurisdiction.”  

Dating  Violence  –  Violence  committed  by  a  person-­‐  (A)  who  is  or  has  been  in  a  social  relationship  of  a  romantic  or  intimate  nature  with  the  victim  and,  (B)  where  the  existence  of  such  a  relationship  shall  be  determined  based  on  a  consideration  of  the  following  factors:  (i)  The  length  of  the  relationship.  (ii)  The  type  of  relationship.  (iii)  The  frequency  of  interaction  between  the  persons  involved  in  the  relationship.”  

Stalking  –  “Engaging  in  a  course  of  conduct  directed  at  a  specific  person  that  would  cause  a  reasonable  person  to  –  (A)  fear  for  his  or  her  safety  or  the  safety  of  others;  or  (B)  suffer  substantial  emotional  distress.”

REPORTING  CRIME  AND  EMERGENCIES  OCCURRING  ON  CAMPUS  

Crimes  or  other  emergencies  on  campus  should  be  reported  to  a  HCC  police  officer  or  to  HCC  Police  Dispatch.  

HCC  Police  Dispatch  is  staffed  24  hours  a  day,  seven  days  a  week,  by  police  telecommunication  operators.  The  telephone  number  is  713/718-­‐8888  or  8-­‐8888  from  a  campus  phone.  HCC  Police  Dispatch  also  receives  transfers  from  the  Greater  Harris  County  9-­‐1-­‐1  Emergency  Network  and  City  of  Houston  9-­‐1-­‐1  Emergency  Network.  4  

Be  prepared  to  stay  on  the  line  with  the  emergency  dispatcher,  who  is  trained  to  process  your  emergency  call,  and  who  will  be  asking  you  a  series  of  questions.  

Be  prepared  to  tell  the  dispatcher  the  location  where  the  emergency  is  occurring,  your  phone  number,  any  suspect  or  vehicle  descriptions  (including  color,  make,  model,  and  license  plate  number),  weapons  involved,  etc.  

Remain  calm  and  stay  on  the  line  until  told  to  hang  up  by  the  dispatcher.

POLICY  FOR  MAKING  TIMELY  WARNING  REPORTS  TO  THE  CAMPUS  COMMUNITY  

When  an  offense  or  other  emergency  occurs  on  campus  that  represents  a  continuing  threat  to  students  and  employees,  then  a  press  release  will  be  distributed  to  local  media  and  a  crime  bulletin  will  be  posted  on  HCC’s  web  site.  5    

HCC  has  an  emergency  alert  system  for  mass  notification  by  phone,  email,  and  text  message.  6  All  students  and  employees  are  encouraged  to  keep  their  contact  information  in  PeopleSoft  current.  

POLICY  FOR  PREPARING  THE  ANNUAL  DISCLOSURE  OF  CRIME  STATISTICS  

The  HCC  Police  Department  is  responsible  for  compiling  data  for  the  Annual  Security  Report.  7  HCC  Student  Services  and  HCC’s  Office  of  Institutional  Equity  also  contribute  data.  

TO  WHOM  STUDENTS  OR  EMPLOYEES  CAN  REPORT  CRIMINAL  ACTIVITY  

Criminal  offenses  may  only  be  reported  to  the  HCC  Police  Department.  Victims  and  witnesses  may  not  confidentially  report  crimes  for  inclusion  in  the  annual  disclosure  of  crime  statistics  to  any  person  or  organization  except  the  HCC  Police  Department.  Since  the  Clery  Act  was  amended  last  year,  new  procedures  for  confidential  reporting  will  be  distributed  when  complete.  

CURRENT  POLICIES  CONCERNING  SECURITY  AND  ACCESS  TO  CAMPUS  FACILITIES  AND  SECURITY  CONSIDERATIONS  USED  IN  THE  MAINTENANCE  OF  CAMPUS  FACILITIES  

HCC  Board  policy  requires  comprehensive  safety  and  emergency  response  protocols.  Design,  implementation,  and  promotion  of  the  protocols  are  the  responsibility  of  the  HCC  Police  Department.  8    The  planning  documents  include  the  three  year  statutory  security  audit,  annual  progress  reports,  and  a  Multi  Hazard  Emergency  Operations  Plan.  9

IDENTIFICATION  REQUIREMENT  

All  HCC  students  and  employees  are  required  to  have  identification  cards.  HCC  police  may  refuse  to  allow  persons  having  no  legitimate  business  to  enter  on  HCC  property,  and  may  eject  any  undesirable  person  from  the  property  if  they  refuse  to  leave  peaceably  on  request.  10  

ACCESS  CONTROL  AND  ALARM  SYSTEMS  

HCC  identification  cards  integrate  with  HCC’s  electronic  access  system.  Access  may  be  added,  restricted,  or  tracked.  HCC  also  uses  traditional  locks.  Installation,  maintenance,  and  replacement  of  locks  and  keys  are  managed  by  the  HCC  Locksmith  Department  in  conjunction  with  campus  officials.  The  electronic  access  control  and  alarm  system  is  monitored  and  managed  by  the  HCC  Police  Department  and  an  independent  contractor.  

VIDEO  SURVEILLANCE  

The  HCC  Police  Department  manages  and  monitors  a  sophisticated  video  surveillance  system.  Video  cameras  are  strategically  deployed  and  operated  in  conjunction  with  the  HCC  IT  Department  and  an  independent  contractor.  

ELEVATOR,  CLASS  ROOM,  AND  PARKING  FACILITY  TELEPHONES  

Telephones  are  installed  in  all  elevators  and  the  majority  of  classrooms.  Some  campus  parking  facilities  also  have  blue  phones  that  connect  to  HCC  Police  Dispatch.  The  phones  are  installed  and  managed  by  HCC  IT  Department  and  HCC  Facilities  Management.  

CRIME  PREVENTION  AND  ENVIRONMENTAL  DESIGN  

All  HCC  properties  are  designed  and  maintained  to  promote  safety.  For  example,  landscape  and  external  lighting  issues  are  addressed  during  construction  and  as  a  component  of  ongoing  maintenance.  Requests  for  repairs  are  processed  and  managed  by  HCC  Facilities  Maintenance  and  campus  officials.  

POLICIES  CONCERNING  CAMPUS  LAW  ENFORCEMENT  AUTHORITY  

Police  officers  employed  by  the  HCC  Police  Department  are  vested  with  all  the  powers,  privileges,  and  immunities  of  Texas  peace  officers.  They  are  authorized  to  make  arrests  and  enforce  all  laws  of  this  State.  11  Except  for  a  small  number  of  plain  clothes  assignments,  all  HCC

police  officers  wear  dark  navy  blue  uniforms  and  are  armed.  The  shoulder  patch  and  badge  identify  the  officer  as  a  police  officer  for  HCC.  

Security  officers  employed  by  HCC  wear  light  French  blue  shirts  and  navy  pants.  All  HCC  security  officers  are  commissioned  by  the  Texas  Department  of  Public  Safety.  They  are  not  police  officers  and  primarily  observe  and  report.  However,  they  are  authorized  to  issue  parking  citations  on  HCC  property.  The  security  shoulder  patch  and  badge  identify  them  as  a  security  officer  for  HCC.  They  are  not  armed  but  do  carry  two-­‐way  radios.  

REPORTING  CRIMINAL  ACTIVITY  

All  HCC  students  and  employees  are  encouraged  to  accurately  and  promptly  report  all  crimes  to  the  HCC  Police  Department.  In  some  cases,  misconduct  may  be  reported  through  HCC  Human  Resources  and  HCC  Student  Services  that  also  violates  criminal  statutes.  However,  the  activity  will  not  be  included  in  the  campus  crime  statistics  unless  the  information  is  disclosed  to  the  HCC  Police  Department.  

All  HCC  employees  including  but  not  limited  to  HR  Generalists,  Licensed  Professional  Counselors,  and  Internal  Auditors  are  trained  and  expected  to  report  crimes  to  the  HCC  Police  Department.  

PROGRAMS  DESIGNED  TO  INFORM  STUDENTS  AND  EMPLOYEES  ABOUT  CAMPUS  SECURITY  PROCEDURES  AND  PRACTICES  

During  new  student  and  new  employee  orientations,  HCC  police  present  important  information  regarding  safety  and  security.  Active  Shooter  and  Disruptive  Person  videos  are  posted  on  the  HCC  web  site.  In  person  training  is  offered  at  faculty  convocations  and  employee  training  sessions.  Fire  drills  and  fire  warden  training  courses  are  routinely  offered  by  the  HCC  Safety  Office  in  conjunction  with  local  fire  inspection  programs.  

PROGRAMS  DESIGNED  TO  INFORM  STUDENTS  AND  EMPLOYEES  ABOUT  THE  PREVENTION  OF  CRIME  

The  HCC  Police  Department  use  statutory  brochures  and  posters  regarding  family,  household,  and  dating  violence.  Crime  prevention  information  is  disseminated  through  government  initiatives  regarding  traffic  safety,  personal  safety,  online  safety,  and  substance  abuse.  The  HCC  Police  Department  also  publishes  information  on  the  college  web  site  and  in  the  Student  Handbook.  

MONITORING  AUTHORIZED  STUDENT  ORGANIZATION  AND  ACTIVITIES  OFF-­‐CAMPUS  

All  recognized  student  organizations  have  faculty/staff  sponsors  so  they  would  monitor  student  activity  at  campus  and  off-­‐campus  events.  As  an  adjunct,  the  HCC  Police  Department

participates  in  the  National  Law  Enforcement  Data  Exchange  Network  (N-­‐DEx2)  and  the  Houston  Fusion  Center  Network.  If  off-­‐campus  criminal  activity  was  reported  to  law  enforcement,  HCC  would  likely  be  notified.  

STATEMENT  OF  POLICY  REGARDING  ALCOHOL  AND  SUBSTANCE  ABUSE;  ENFORCEMENT  

HCC  is  a  designated  alcohol  and  drug  free  work  place.  12  The  HCC  Police  Department  enforces  all  laws  regarding  alcohol  and  drug  violations.  13  The  legal  age  in  Texas  to  purchase,  consume,  or  possess  alcoholic  beverages  is  21.  14    

DESCRIPTION  OF  ALCOHOL  AND  DRUG  ABUSE  EDUCATION  PROGRAMS  

HCC  Student  Services  coordinates  student  wellness  issues.  They  offer  access  to  licensed  professional  counselors,  referrals,  and  education  programs.  HCC  Human  Resources  coordinates  presentations  for  employees  and  makes  referrals  through  an  employee  assistance  program.  

STATEMENT  OF  POLICY  REGARDING  PREVENTION  AND  INVESTIGATION  OF  SEXUAL  ASSAULT  

Sexual  assault  is  investigated  by  the  HCC  Police  Department.  Investigators  are  equipped  and  trained  to  process  scenes  and  collect  evidence.  HCC  investigators  will  coordinate  with  the  appropriate  law  enforcement  agency  if  a  student  is  assaulted  off-­‐campus.  

After  an  assault,  the  HCC  Police  Department  should  be  notified  as  soon  as  possible  so  the  case  is  investigated  properly  and  the  victim  is  afforded  their  rights  as  crime  victims.    15  HCC  Student  Services  will  change  a  victim’s  academic  situation  after  an  alleged  offense  if  requested,  and  will  discuss  options  for  those  changes.    

If  a  campus  disciplinary  action  follows  a  sexual  assault,  the  accuser  and  the  accused  are  entitled  to  the  same  opportunities  to  have  others  present  during  the  proceeding.  Both  the  accuser  and  the  accused  are  entitled  to  know  the  outcome  of  the  proceeding.  Sanctions  for  violating  the  Student  Code  of  Conduct  include  suspension  and  expulsion.  16

HCC  does  not  tolerate  dating  violence,  domestic  violence,  or  stalking.  

A  collaborative  effort  is  underway  by  HCC  officials  to  harmonize  2013  Clery  amendments  with  existing  law,  policy,  and  procedures.  As  new  policies  and  procedures  are  prepared,  they  will  be  broadly  published  online  and  on  campus.  

Until  then,  HCC  police,  counselors,  and  human  resource  professionals  will  continue  vigorously  investigating  and  prosecuting  violations  of  existing  statutes  and  policies  that  prohibit  dating  violence,  domestic  violence,  and  stalking.  

REGISTERED  SEX  OFFENDERS  

Chapter  62  of  The  Texas  Code  of  Criminal  Procedure  authorizes  the  Texas  Sex  Offender  Registration  Program.  Some  sex  offenders  may  attend  HCC  classes  after  they  register  with  the  HCC  Police  Department  and  are  approved  by  the  HCC  Registered  Sex  Offender  Screening  Committee.  The  web  address  for  the  Public  Texas  Sex  Offender  Registry  is:  https://records.txdps.state.tx.us/SexOffender/  

STATEMENT  OF  POLICY  REGARDING  EMERGENCY  RESPONSE  AND  EVACUATION  PROCEDURES  

Authorities  for  the  following  protocol  are  Sections  51.217  and  51.218  of  the  Texas  Education  Code  17  and  HCC  Board  Policies  B.2.1.1  Safety,  B.2.1.2  Emergencies,  and  B.2.2.1.  College  Police  Department.    

The  HCC  Police  Department  will  use  Blackboard  Connect  to  immediately  notify  the  campus  community  upon  the  confirmation  of  a  significant  emergency  or  dangerous  situation  involving  an  immediate  threat  to  the  health  or  safety  of  students  or  employees  occurring  on  the  campus;  

The  HCC  Police  Department  will  confirm  that  there  is  a  significant  emergency  or  dangerous  situation.  

The  HCC  Police  Department  will  determine  the  appropriate  segment  or  segments  of  the  campus  community  to  receive  a  notification;  determine  the  content  of  the  notification;  and  initiate  the  notification  system.

The  HCC  Police  Department  will,  without  delay,  and  taking  into  account  the  safety  of  the  community,  determine  the  content  of  the  notification  and  initiate  the  notification  system,  unless  issuing  a  notification  will,  in  the  professional  judgment  of  responsible  authorities,  compromise  efforts  to  assist  a  victim  or  to  contain,  respond  to,  or  otherwise  mitigate  the  emergency.  

The  HCC  Police  Chief  or  their  designee  may  initiate  the  emergency  notification  system  and  disseminate  emergency  information  to  the  larger  community.  

The  HCC  Police  Department  will  test  the  emergency  response  and  evacuation  procedures  on  at  least  an  annual  basis,  including—  

(i)  Tests  that  may  be  announced  or  unannounced;  

(ii)  Publicizing  its  emergency  response  and  evacuation  procedures  in  conjunction  with  at  least  one  test  per  calendar  year;  and  

(iii)  Documenting,  for  each  test,  a  description  of  the  exercise,  the  date,  time,  and  whether  it  was  announced  or  unannounced.
