RTI Act, 2005.

Sir,

Kindly find enclosed a copy of D.O.No. 19/3/2010-CIC-MoRe dated 31st

March, 2011 on the above mentioned subject which is self-explanatory. In

accordancewith provisions of Sections 25(2) and 25(3) of the RTI Act, the public

authorities under the control of Ministries/Departments of Government of India are

required to submit their annual return to facilitate the Commission to prepare its

Annual Report. Accordingly, the public authorities are required to upload the return

on quarterly basis ifi the year 2010-2011; directly after getting password from theirrespective Ministries/Departments. Therefore, a password has been created and

assignedto the public authorities which come under the aegis of Ministry of Labour

& Employmentwhich is "nic@6789". A copy of 1st Quarterly Return Form is also

enclosed.

3. It is, therefore, requested to kindly upload the quarterly

returns for the year 2010-2011(1 st, 2nd,3rd, & 4th Quarter) with respect to

the public authority under your administrative control/charge positively

by 5th May, 2011. It is further requested to also update the list of Public

Authorities pertaining to your organisation and give your recommendations andsuggestions with respect to implementation' of RTI Act, 2005. A copy of the

quarterly returns as well as recommendations/suggestions may also be forwarded

to the Ministry.

Apropos the subject mentioned above, in accordance with the mandate uls 25(1) of

the RTIAct, 2005, the Central Information Commission prepares itsAnnual Report for every

Financial Year regarding implementation of the Act. The report for the year 2010-11 has tobe tabled in the Parliament in the Monsoon Session. The Public Authorities under the

control of Ministries/Departments of Government of India are required to submit their

annual return in accordance with provisions of sections 25(2) and 25(3) of the RTI Act to

facilitate the Commission to prepare its Annual Report. Every Ministry/Department is

responsible to ensure submission of Annual Returns in respect of Public Authorities under

its control. The Commission, has provided a facility for uploading the returns pertaining to

the implementation of RTI Act through its software known as "RTI Annual Return

information system". This is available on the website of the Commission .

The public authorities were required to upload the return on quarterly basis in the

year 2010-11. The individual Public Authorities were also requested to submit the returndirectly after getting password from their respective Ministries/Departments,

Notwithstanding the fact that three quarters have already elapsed; it is seen that large

number of Public Authorities have still not uploaded returns for the last three quarters. A

list of defaulting Public Authorities under your control is enclosed herewith. It would be

seen that the statutory obligations, as stipulated in the Act, are yet to be fulfilled.

The last date for uploading the returns by all the Public Authorities has been fixed as

30tll April, 2011; and it does not seem possible to grant any extension beyond this date. In

case of failure to upload the return by 30th April, 2011, the name of the concerned

Ministry/Department will figure in the list of defaulters in the report, to be laid do~ in

In view of above, I solicit your kind intervention in the matter and request you to
