ANNUAL REPORT ON PLANTATION LABOUR ACT 1951
WRITE UP ON THE DEVELOPMENTS MADE IN THE PLANTATION SECTOR
DURING 2016
The plantation inspectorate in kerala functions as a wing of the Labour
Commissionerate which includes Chief Inspector of Plantations and eleven
Inspector of plantations. There are 849 plantations &approximately fifty thousands
of workers are employed in these plantations. The main duty if the Chief Inspector
Of Plantations is to effective enforcement of plantation Labour act, Minimum
wage Act, Maternity Benefit Act ,Industrial Establishment(N&F) Holiday Act,
Equal remuneration Act, Payment of Wages Act and relevant rules etc in plantation
Industry. The Inspectors of Plantations are frequently visiting the plantations in
their respective jurisdiction and notices are served if violations are detected. These
violations if any found un-rectified then showcause notice will be issued and
further prosecution step will be launched against delinquent employers. During the
year 2016,645 inspections were conducted & 29 prosecutions were filed.
The social status of plantation workers when compared with other classes of
workers, who are generally dominant politically and economically, leaves a lot to
be desired. The Govt. of Kerala has taken collective action in times of tea industry
crisis when in it was severe in 2003 which created economic depression, un
employment and uncertainty among the plantation workers. The employers
abandoned the tea gardens and workers have been rendered jobless and their live
hood compromised during crisis period.
Plantation Workers Relief Fund Committe
Govt. of Kerala has set up 5 plantation Relief fund committees in Idukki.
Kollam, Wayanad, Thiruvananthapuram&Palakkad districts under the
chairmanship of District Collector and sufficient fund were allotted by the state
Govt. to help workers of Closed down plantations. These committees co-ordinates
several Govt. department and provide relief to the workers in the form of financial
aids to plantation workers students, they are studying various courses including
diploma and professional courses, financial aid to dependants of deceased workers
and financial help to marriage of workers girl children, supply of uniform, study
materials and nutritious food to school going children. At present plantation
Workers Relief Fund committees functions in Thiruvananthapuram, Idukki,
Palakkad, & Wayanad districts in Kerala, supporting the workers of closed down
plantations in 2016 an amound of Rs.55058/- were sanctioned and distributed to
the workers children for higher education and also an amount of Rs.830000/-
were sanctioned and distributed to the workers to financial assistances of marriage
of girl children of workers. List of closed plantations are given below

11.Manalaru Estate-(Cardamom Division)-Palakkad Dist
12.Bonakkad Estate-Thiruvananthapuram Dist
13.Nagamala Estate-Wayanad Dist
Plantation Workers Distress Relief Fund Scheme
Govt. have looked into the social responsibility for the benefit of plantation
society at large. A death relief fund scheme , “Estate workers Distress Relief
Fund scheme of 2013” was introduced. It offers a onetime financial aid of
Rs.25000 to the dependants of plantations workers upon natural/accident death
whilst in service. The scheme is open to all workers covered under Plantation
Labour Act and serves as an immediate relief to the dependant. During 2016 an
amount of Rs.1275000/- was disbursed to the dependant of the deceased workers.
Plantation Labour Committe
A plantation Labour committee of Kerala was constituted to discuss all
issues relating to plantation sector. The plantation labour committee is a tripartite
body of trade union leaders, Labour department officers and management
representatives. The plantation labour committee discuss all issues of plantation
sectors and also taken steps to fix & revise wages of the plantation workers. In
2016 minum rate of wages payable to the employees of the plantation sector is
revised as per Govt. order No 76/5/2016. Further chief Inspector of Plantations
and inspector of plantations ensure minimum wages fixed by the government.
Plantation Housing Scheme
Government have decided to implement LIFE Mission Scheme to
plantations workers for providing housing facilities. In 2016 Rs. 20crores was
allocated for implementing housing scheme to plantation workers. For
implementing this scheme a preliminary survey was conducted by this department
and identified approximately 32403 plantation workers benificiaries of the above
scheme.
