ENSURING JUSTICE

2019

I’m writing this in late 2020, when the world remains sheltered in place as a result of COVID-19. I’ll reflect on 2019 in this letter, but I’ll also say some things about our reaction to COVID-19.

2019 was a great year for ILS. We served nearly 12,000 clients, providing extended service to more individuals and families than we’ve provided in any recent year. We gained $2,276,000 in benefits, judgments and other payments for our clients, and avoided $5,582,000 in claims against them in 2019.

We achieved other important gains for clients:

• In Rainbow Realty v. Lintner, the Indiana Supreme Court applied the landlord-tenant statute to “rent to buy” transactions, enlarging tenants’ rights and requiring predatory landlords to change their practices.

• We initiated litigation challenging Indiana’s decision to add work requirements to its Medicaid program, arguing that the change violated federal law; the state voluntarily agreed not to implement work requirements until the case is resolved.

• Our LGBT Project obtained two more Indiana Court of Appeals decisions vindicating the right to privacy

of transgender Hoosiers seeking legal name and gender marker changes.

Our programs expanded:

• Our Military Assistance Program received grant funds to add a lawyer to staff a clinic at the VA Hospital in Fort Wayne;

• Our Medical-Legal Partnerships, serving the legal needs of patients referred by health care providers, added staff to meet growing demand;

• The City of Indianapolis funded our Eviction Avoidance Project and a tenant assistance program to help those living in substandard housing;

• A new grant to provide legal help to those with HIV/AIDS through the state’s network of service providers for those individuals; and

• Our longstanding migrant farmworker project changed its name to Worker Rights and Protection Project, reflecting its broader role in representing human trafficking victims.

We had lots more changes – retirements, new hires, office relocations, new technology, statewide work with the Coalition for Court Access, and more.

At this time of COVID, we are all working from home while the courts are mainly operating remotely. We know that in 2021, there will be a flood of claims for Unemployment Compensation, efforts to obtain domestic violence protective orders, and likely thousands of new evictions of families that have lost their incomes and cannot pay rent. ILS’s work will be more important than ever during the weeks and months ahead.

Indiana Legal Services’ private attorney involvement program uses volunteer attorneys to provide pro bono services to ILS clients. These services include advice and brief service, extended representation, and legal information clinics. Matters referred include: family law, landlord/tenant, consumer, wills, mortgage foreclosures, employment, expungement, and other cases.
