promotion of human rights in Lebanon
The Lebanese parliament
• The Parliamentary Human Rights Commission (1994).• The Parliamentary Committee on Women and Children (2000).• The National Human Rights Plan.• The Independent National Commission for Human Rights. (Law Bill)
The council of Ministers
The National Strategy for the Precaution and Protection of Children against All Forms of Violence and Exploitation (prepared by the Higher Council for Childhood and approved by the Council of Ministers on 12/12/2012).• The National Commission for Lebanese Women: Established in 1998 in accordance with the decisions of the Beijing Conference. It involves strategies and action plans concerning Lebanese women in all means, in cooperation with official departments and NGOs.• The Permanent National Authority for the Care of the Elderly: the national reference for all matters related to the issues and affairs of the elderly in Lebanon (Council of Ministers Resolution No. 31 in 17/2/1999 and its amendments. The Minister of Social Affairs decided to reconstitute the Commission No. 1077/1 in 20/8/2010).

• Directorate of International Organizations, Conferences and Cultural Relations.• Center for Legal Consultations, Research and Documentation.
Ministry of Justice
National strategy to transferred the authority of prisons administration to the Ministry of Justice: Decision of the Council of Ministers No. 34 dated 07/03/2012.• The law of determining the prison year by nine months: Law No. 216 dated 30/03/2012.
Ministry of Social Affairs
• Family Affairs Department (Women's Affairs Department, Family Affairs Department), Decree No. 5734 of 29/9/1994.• Disability Authority (Disability Rights Insurance Program, National Disability Authority, Model Center for Persons with Disabilities).• Social Welfare Department (Juvenile Protection Department).• The Higher Council for Childhood: established by Cabinet Resolution No. 29 of 01/09/1994. It represents the national framework for the integration of the official and private sectors of childcare and development in accordance with international conventions, especially the Convention on the Rights of the Child.• National program to support the poorest families: The program was launched on 17/10/2011, and aims to help 80,000 Lebanese families (about 400,000 people) from the eligible
groups to build their capacity.• National Program for Adult Education: Decision of the Minister of Social Affairs No. 246/1 dated 8/2/2011.• National project to support mine casualties: established by the Ministry of Social Affairs under Decision No. 1826/1 dated 18/12/2012. It undertakes the task of addressing the social consequences of cluster bombs and mine. It also provides care for the affected families and organizing courses for training and vocational training courses.
Ministry of Labor Follow up the implementation of the International Labor Organization and the Arab Labor Organization conventions, especially the once related to human rights.• National Committee to Combat Child Labor: The Committee was established by Decree No. 5137 dated 01/10/2010 and its task is to combat child labor.• Professional Relations Service (Labor Inspection and Safety Department, Investigation and Labor Affairs Department, Department of Professional Relations and Trade Unions).• General power Department (Vocational Training Department, Family Protection and Associations, Employment Department and Foreign Workers Surveillance Department).• The Child Labor Control Unit (established in October 2001, which is concerned with combating and eliminating child labor gradually and spreading awareness of the dangers of this work).
The Ministry of Education and Higher Education
• Educational Center for Research and Development.• The Specialized Education Unit of the Directorate of counseling and Guidance, which was established by Decision No. 27 / M / 2012.• Committee for activating the rights of persons with disabilities in education (formed in 2002).
Ministry of Interior and Municipalities
Directorate General of Internal Security Forces:1. The Strategic Plan of the Internal Security Forces (2012): It included the vision and priorities of the institution, foremost of which is respect for human rights and public freedoms.2- Human Rights Section in the General Inspectorate of Internal Security Forces (Decree No. 755/2008).3- Special committee to follow up the issue of torture in prisons, eyeglasses, detention centers and investigation in the Internal Security Forces (2010).4. Code of Conduct for the Internal Security Forces: The Code was launched at an official ceremony at the Government Palace in January 2012.• Directorate General of Public Security:5. Division of Organizations and Humanitarian Affairs (in coordination with associations, humanitarian organizations, civil society institutions and international organizations concerned with human rights).6. Organizing courses for military personnel who carry out investigative tasks to train them on how to deal with detainees, especially in terms of compliance with the legal provisions that
sponsor the arrest and interrogation process, as well as respect for the Universal Declaration of Human Rights.
Ministry of Public Health
The follow-up of mother and child rights and the right to health and life.
Ministry of Culture
Follow up of intellectual property rights, especially the rights of literary and artistic intellectual property, and the right to participate in cultural life.
Ministry of Economy and Trade
Monitoring intellectual property rights, especially industrial and commercial intellectual property.
Ministry of Information
To preserve and protect the right to express opinion, freedom of expression and dissemination of information on human rights and related activities in Lebanon, and to establish, activate and guarantee the work of public and private media institutions, trade unions and associations concerned with public opinion, the press,
Ministry of Youth and Sports
The establishment of sports facilities, support to sports clubs and encouraging sports among youth, children, women and the elderly.
Ministry of Finance
Ensure equality between men and women in benefiting from tax cuts and benefiting from family allowances.
Ministry of Tourism
Monitoring the prohibition of child labor in nightclubs.Provide exemptions for elderly from fees of access to archaeological sites.
National Council for Scientific Research
Encouragement of scientific research in public and private universities and research centers.

The security forces are committed to:Professional Duty: ...
• To maintain the security and order, protect public freedoms, ensure the application of laws and regulations, ensure the public safety and preserve the public and private properties.• Respect of human dignity and protection of human rights.
Neutrality: ...• Deal equally and fairly with everyone during the implementation of the law.• It is prohibited to exercise racial, ethnic, sectarian or territorial discrimination, or on the basis of national origin, sex, age, social status or any other basis.
Behaviour:…• Refrains from any act of torture and cruel treatments, or inhuman and degrading treatments, or the ignorance or encouragement of application of such treatments during the course of investigations• Takes into account the situation of people with special needs and victims.
Protection of the rights of suspects and detainees: ...• It is prohibited to detain the freedom of any person except in accordance with the law.• The suspect or plaintiff shall be immediately informed of his rights under article 47 of the Code of Criminal Procedure and the procedure shall be documented in the record, and the period of detention shall be complying with the rules as provided by law.• Adopts legal methods and scientific techniques during interrogation without the option of any inhumane methods.• Ensures the medical access and essential needs of the people detained in the centers of the security forces and take immediate measures to do so.• Facilitates interviews of detainees and their families or legal representatives or representatives of consulates of their countries, if they were foreigners, in accordance with the law.• In case a juvenile was brought to investigation, his/her family, guardian or responsible shall be immediately informed, if possible, and works on separating them (juveniles) from other detainees, and treat them in a thoughtful way and are not handcuffed except in exceptional cases.
And there was mentioned in the code of conduct, under the title the behaviour:“5-2 during duty, security forces must avoid all types of aggression that is not necessary, and shall not exercises any type of torture or human degrading treatment or condoning it, especially to intimidate or force a person to extract a confession about a crime or to provide information about it(Convention against Torture adopted by the General Assembly of the United Nations on 10/12/1984, ratified by the parliament under Law No. 185 dated 24/05/2000 and Article V of the Universal Declaration of Human Rights and article VII of the International Covenant on Civil and Political Rights, and article 225 of law No. 17 of 06/09/1990 and article 401 of the Penal Code)
And relying on scientific techniques with the help of the offices of the Department of Scientific Investigation (DNA analysis - fingerprint comparison - line emulation ...) ”
It is also stated in the explanatory note to the Code of Conduct under the title of Rights of Suspects and Detainees:"8.1 Everyone has the right to liberty and individual security. No one shall be subjected to detention or Arbitrary arrest or exile or deprivation of liberty except in accordance with the (Article 8 of the Lebanese Constitution and Article 9 of the Universal Declaration of Human Rights). Any employee who violates the liberty of a person shall be punished in accordance with the provisions of article 367 of the Penal Code."8.2 Security forces shall inform the suspect or plaintiff immediately upon his detention of his rights stipulated in article 47 of the Criminal Procedure Code No. 328 of 02/08/2001:
7 - Contact a member of his family or the employer or a lawyer of his choice or one of his relatives.8. Interview with a lawyer appointed by a statement, and to document on the record without the need of organizing agency.9 - The use of translator on oath, if he does not understand the Arabic language.10 – submit a direct request or through his agent or family members to the Attorney General to presenting him to a doctor for examination.
And everything must be documented in the record.
"8.3 The security force members shall apply the principle of presumption of innocence that every defendant is innocent until proven guilty by the court (Article 11 of the Universal Declaration of Human Rights), take into account the special needs of witnesses and ensure that all persons in their custody are treated in a human and dignified manner. And, emphasizing on the non-use of violence or pressure as a method of investigation, whatever was the type of the crimes attributed to them, and the reliance on the legal methods and scientific techniques in obtaining confessions or to prove the commission of the offense (Article 401 of the Penal Code, General Comment No. 31/204, p. 4 dated 10/02/1996).
"8.4 The security force members shall take the necessary measures to protect the health and safety of the arrested persons and to provide them with the necessary medical care whenever necessary; to facilitate their interview with their relatives and to provide them with the necessary needs in accordance with the laws in force.
"8-5. The security force members shall immediately inform the family, guardian or the responsible, if it is possible, when a juvenile was caught in act of a criminal offense, and Contact authorized social representative and invite him to attend the investigation. The investigation may not begin unless authorized social representative is present. The security force members must treat the juvenile in human manner and no use of violence or verbal abuse. As well as the removal of iron handcuffs from his hands while listening to his testimony and allowing him to sit and separate him immediately from all other adult detainees. (Article 34 of Law No. 422 of 06/06/2002 Protection of Juveniles in Violation of Law or at Risk and General Memorandum No. 207/204, No. 4 dated 11 October 1999) ».

Annex XIIPresentation of some steps taken by the Lebanese authorities to ensure
respect of the rights of detainees, convicts and prisoners(1994 - 2015)
1994 Establishment of the Human Rights Committee in the Parliament
2001 Law No. 328 of August 2, 2001 on Criminal Procedure (Including special articles on the respect of innocence presumption and the rights of detainees and the stating the duration of detention, non-coercion during interrogation), amended by the Law No. 359 of 16/8/2001, which abolishes Law No. 328 dated to 18/9/1948).
2002 The General Directorate of the Internal Security Forces circulated the rights of suspects to all detention and interrogation centers (These rights include: the right to a telephone call with a person chosen by the detainee, interviewing a lawyer appointed by the detainee, without an organized agency, applying for medical examination, informing the detainee of his rights, etc.).
2007 The Council of Ministers issued Resolution 91/2007 on the approval of the construction of an additional building in Roumieh prison, which accommodates 240 people; to be completed in 2014.
2007 The rights of suspects and plaintiffs in the Code of Criminal Procedure have been circulated to all the Internal Security Forces centers in Lebanon in Arabic, French and English.
2008 Establishment of the Human Rights Section in the General Inspectorate of the Internal Security Forces, whose mission is to spread the knowledge of human rights among security forces members and to work to prevent violations of these rights.
2009 A working group was established in the General Directorate of the Internal Security Forces to prepare a strategic plan that takes into account international human rights standards and identified the priorities of the Directorate General of Internal Security Forces for the next period with respect of human rights and the protection of freedoms. The plan has also defined the vision of the institution to meet citizens’ expectations and gain their confidence.
2009 The Council of Ministers has issued Resolution No. 12/2009 on the approval of the construction of two new prisons; the first in the North and the second in the South, each accommodating 650 people. (This was not accomplished because of the lack of funding).
2009 In December 2009, the Ministry of National Defense has established the Office of International Law and Human Rights in the Lebanese Army Command, which is responsible for disseminating and teaching the principles of international humanitarian and human rights law in the Lebanese Army.
2010 The Ministry of Justice has issued in June 2010 with the technical assistance of the United Nations Office on Drugs and Crime (UNODC) "Guide to inspecting
Lebanese prisons" prepared by Dr. Omar Nashaba.
2010 The Establishment of the "Special Committee to follow up the subject of torture in prisons, eyeglasses, detention centers and interrogation in the Internal Security Forces".
2011 The Ministry of Internal affairs and Municipalities has issued a book entitled of the "Comprehensive National Report on Prison Conditions in Lebanon: Conclusions and Recommendations of 2011".
2011 The Ministry of Justice issued in November 2011 with the technical assistance of the United Nations Office on Drugs and Crime (UNODC) "Manual on the Implementation of Penalties" Law No. 463/2002, as amended by Law 183/2011.
2012 The Directorate General of the Internal Security Forces issued a booklet entitled: «Code of Conduct for Internal Security Forces». The booklet specified the legal and ethical standards to be complied with, and which expose ISF elements to disciplinary and judicial prosecution when breached. (Started in late 2014, the Code was amended and developed in coordination with the Office of the United Nations High Commissioner for Human Rights in the Middle East (UNOHCHR) in Beirut to cope with local legislations and international standards in all matters relating to human rights.
2012 The Ministry of Interior and Municipalities requested the General Directorate of the Internal Security Forces and the General Directorate of Public Security on 22/2/2012 to report on the allegations of torture in its segments, which includes the current situations and proposals on how to stop it.
2012 The Council of Ministers issued Resolution No. 34 dated 7/3/2012, which adopted the national strategy to transfer the authority of the prison administration to the Ministry of Justice. A judge has been assigned the task of organizing the Directorate of Prisons and developing the necessary legal texts, and appended 35 judicial assistants to justice to be established in prisons to facilitate the trial and review the order.
2012 The House of parliament has passed Law No. 216 dated 30/3/2012 under the title: « Defining the prison year by nine months».
2012 The launching of the National Human Rights Plan (2014-2019) on 10/12/2012. The plan address many issues, many issues like: "The origins of investigation and arrest", "torture and inhuman treatment", "prisons and places of detention", etc.
2012 The Ministry of Justice issued a technical report from the United Nations Office on Drugs and Crime (UNODC) with funding from the European Union (EU) with the title: "The situation of inmates in prisons in figures: 2010-2012", prepared by Judge Maroun Abu Jouda, under the project "Developing Criminal Justice in Lebanon".2013 The Minister of Justice announced on 8/4/2013 the completion of the construction of a special building for a large court within the prison of Roumieh to try
hundreds of those who have been designated as Islamic detainees and defendants whom are responsible for the events of 2007-2008, the decision of the judicial investigation has been taken against them, and trials will be proceedings. He also announced the construction of four new prisons. He also announced the construction of four new prisons.
2013 Establishment of a Division for the Organizations of Humanitarian Affairs of the General Directorate of Public Security. Its mission is to cooperate and coordinate with international organizations, non-governmental organizations and civil society institutions working in the field of human rights.
2014 The Parliamentary Human Rights Committee and the Administration and Justice Committee of the House of Parliament have adopted on 08/04/2014 a proposal for the establishment of the National Independent Commission for Human Rights (NHRI). It also includes the formation of an independent permanent national committee for the prevention of torture (NPM).
2014 A unified system of complaints against members of the Internal Security Forces (ISF) has been approved for torture charges. It was officially launched from the headquarters of the Internal Security Forces in the presence of representatives of embassies and donors in Lebanon, as well as non-governmental organizations working in the field of human rights. Moreover, It was circulated to all elements of the internal security forces and published on the website of the General Directorate of the Internal Security Forces (ISF) www.isf.gov.lb , in order to alleviate the burden of those who wish to file a complaint against the elements and in accordance with the principle of transparency and objectivity.
2014 On 16/06/2014, the Minister of Interior and Municipalities set the cornerstone for the building of prisoners with security specialty in Roumieh prison. The building was completed in mid-2015.
2014 A major trial courtroom was set up in the locale of the Roumieh prison to speed up trials on important cases.
2014 The Lebanese Army Command inaugurated a special training course for officers, officers’ doctors and civilian doctors, who are contracted with the army and in charge of military prison. The course included several topics example:Minimum standards for the treatment of prisoners, medical care standards in prevention and treatment, ethics and behaviors of the profession to protect prisoners and the relationship with the outside.
2014 The Army Command formed a permanent committee to verify allegations of torture received from international organizations and any violations or abuses of international humanitarian law in the military and to visit military prisons.
2015 Special training for physicians in the Internal Security Forces was conducted in coordination with EU experts and Lebanese experts on the use of the Istanbul Protocol of the investigation and documentation of cases of torture.2015 The General Directorate of the Internal Security Forces (ISF) renewed on 21/08/2015 the office of the human rights department at the central prison in
Roumieh. The office was headed by an officer from the human rights department at the General Inspectorate of Internal Security Forces.
2015 The General Directorate of Public Security, supported by the United Nations Interim Force in Lebanon (UNIFIL), has established new custody center for detainees, including a set of 25 square meters of prefabricated rooms with a square-meter window, multiple toilets, separate shower areas, ready rooms for the clinical use and a restaurant for the detainees.
2015 The International Humanitarian Law and Human Rights Office in the Lebanese Army Command has been transferred to a Directorate with new tasks, including review of complaints and allegations of torture and all violations of international humanitarian law and human rights law in the army. Verification and correction of the violation plus conduct visits to prisons of the Ministry of National Defense to ensure Conditions of detainees, conditions of detention and see to what extent human rights are respected.
2015 The Minister of Justice and the Ambassador of Italy to Lebanon signed on 28/09/2015 an agreement to improve the conditions of prisons in Lebanon with funding from the Ministry of Foreign Affairs and International Cooperation of Italy. The agreement is expected to be implemented within the framework of cooperation between the Ministry of Justice and the United Nations Office on Drugs and Crime (UNODC) in Beirut by October 2016. The agreement includes the improvement of nutrition, health and hygiene system and assisting prisoners suffering from mental illness. It also provide better care for the 300 Syrian juveniles in the Roumieh prison.
Over the past few years, the Lebanese judiciary has issued judgments against a number of members of the judicial police who have been accused of torture in detention centers.
~ The House of parliament is discussing a bill to amend the Penal Code to add articles that criminalize torture and considers that all statements made as a result of any violent practice can not be used as evidence in trials.
