BE IT ENACTED AND ORDAINED, and it hereby is enacted and ordained, by the Board of Supervisors of the Township of Douglass, County of Berks, Commonwealth of Pennsylvania, as follows:

REVISIONS TO SUBDIVISION AND LAND DEVELOPMENT ORDINANCE 1988-3 DOUGLASS TOWNSHIP, BERKS COUNTY

SECTION 509 WATER SUPPLY ~

A. Where an existing public or approved community system for water supply is I geographically and economically accessible to a proposed subdivision or land

The water distribution system shall supply water flow to each lot at such pressure and with such main sizes and fire hydrant locations that comply with the specifications of the State Insurance Services Office (ISO), or a successor agency thereto recognized by the Township and the PA Department of Environmental Protection Public Water Supply Manual Part 11, latest edition. The cost of connection to the system shall be borne by the developer.

B. When an existing public or approved community system for water supply is approved to provide water supply and distribution to a proposed subdivision or land development, water storage facilities shall provide sufficient capacity to meet domestic demands and fire protection demands that comply with the specifications of the State Insurance Services Office (ISO), or a successor agency thereto recognized by the Township. The cost of providing storage shall be borne by the developer.

New Paragraph E.

E. Where a public system or an approved community system for water supply is not feasibly accessible, or where such system cannot supply the proposed subdivision or land development with water at the required volume and pressure, the developer shall evaluate the feasibility of creating a community water supply system for the proposed project. The community water system feasibility study shall be submitted to the Township for review. If such a community water system is provided, it shall be approved and permitted by the Pennsylvania Department of Environmental Protection (DEP) and shall further be capable of supplying water flow and water storage including domestic and fire protection to each lot at such pressure and with such main sizes and fire hydrant locations that comply with the specification of the Insurance Services (ISO), or a successor agency thereto recognized by the Township. The developer shall bear the cost of constructing such system and shall provide assurance of proper operation and maintenance of the system.

The provisions of this Ordinance are severable, and if any of its provisions shall be held to be illegal, invalid or unconstitutional by any court of competent jurisdiction, the validity of any of the remaining provisions of this Ordinance shall not be affected. It is hereby declared by the Board of Supervisors as the legislative intention that this Ordinance would have been adopted had such illegal, invalid or unconstitutional provision not been included herein.

This Ordinance shall be effective immediately upon enactment or as provided by law.
