The meeting opened at 11.30 on Thursday, 24 January 2013 (a little late due to the overrun of the formal opening session) in the Plenary Hall of the Chamber of Deputies of the former Chilean Congress, under the joint chairmanship of Fausto Lupera Martínez (Parlandino, Ecuador) and Jean-Pierre Audy (EP, PPE), Co-Chairs.

1. Adoption of draft agenda OJ - 101.298v05-00

The draft agenda was approved as recorded in these minutes.

2. Election of Committee Bureau members

The Latin American component presented Rodrigo Cabezas Morales (Parlatino, Venezuela) as the sole candidate for the post of Co-Vice-Chair of the Committee. He was elected unanimously.

3. Approval of minutes of the previous meeting PV- AP101.064v01-00

The draft minutes of the meeting of 9 November 2012, held in Cádiz (Spain), were approved without change.

4. Co-Chairs' announcements

The European Co-Chair pointed out that the main aim of the meeting was to present the Joint motion for a resolution 'EU-LAC Trade in raw materials'. After that, a period of amendments to the text would begin, with a view to the committee meeting scheduled for July 2013 and, in the Assembly plenary session in 2014, the amended resolution would be considered and voted on. The Co-Chair said that he would take

the opportunity in the meeting also to consider the working documents on 'Food security from the EU-LAC perspective' in order to prepare for consideration of the revised working documents at the July 2013 meeting.

5. Joint motion for a resolution: 'EU-LAC trade in raw materials'

EP Co-rapporteur: Catherine Grèze (Verts/ALE) LAC Co-rapporteur: Óscar Arboleda (Parlandino, Colombia)

Alberto Adrianzén (Parlandino, Peru) made an initial statement standing in for Óscar Arboleda, who was absent. He highlighted three fundamental issues which, in his view, summed up Mr Arboleda's motion for a resolution: the need for a new pattern in trade and investment relations between the EU and Latin America; the advisability of developing an extractive culture that was less predatory and more environmentally friendly, and the importance of moving towards greater transparency and greater compliance of foreign extractive companies with the ordinary legislation of host countries.

Ms Grèze, meanwhile, highlighted the magnitude of the challenge posed by raw materials to both continents, considering that the current extraction model was not sustainable. Among the economic recommendations she regarded as the most relevant, she stressed the need to transform the production systems of Latin American countries through greater diversification of their economies and by promoting the production of higher value-added goods.

6. Topic for debate: 'Food security from the EU-LAC perspective'EP Co-rapporteur: Esther Herranz García (PPE) LAC Co-rapporteur: Fausto Lupera Martínez (Parlandino, Ecuador)

Ms Esther Herranz spoke first, stressing the need for the committee to permanently adopt the term 'food sufficiency' rather than 'food security', which, according to the co-rapporteurs, does not adequately capture the concept of security of food supply, which is the aim of the report. During her statement she highlighted, amongst other things, the need for the EU to promote greater reciprocity in the trade agreements it negotiates.

Mr Fausto Lupera then pointed out a range of measures that had been taken in Latin America, most notably in Brazil and Mexico, in relation to food security. He also said how important it was that governments should devote a greater amount of funding to food security problems.

After a lengthy debate on the appropriateness of the terms 'food security' and 'food sufficiency' for the report, Co-Chair Audy proposed that the views expressed on the

title of the report should be forwarded to the EuroLat Executive Bureau – through the Co-Secretariat – so that the Bureau could decide. The Co-Chair also pointed out that at the next committee meeting the working dcouments revised by the co-rapporteurs would be considered.

7. Current issue: exchange of views with Mr Mario Cimoli of the Economic Commission for Latin America (ECLAC)

Mr Cimoli, Director of the Division of Production, Productivity and Management, ECLAC, summarised the main points of the report 'European Union and Latin America and the Caribbean: Investments for growth, social inclusion and environmental sustainability', with which ECLAC had contributed to the preparatory process of the EU-ECLAC Summit of Heads of State and Government. He highlighted two issues, in particular: firstly, ECLAC's concern over the economic asymmetry between the two regions and the possible implications this could have on trade and trade policy; and secondly, with regard to raw materials, he highlighted the prominent role of Chinese investment in the Latin American mining sector – investments with quality standards well below those provided by European companies.

8. Other business

Co-Chair Audy took the opportunity to congratulate Mr Rodrigo Cabezas Morales on his appointment as Co-Vice-Chair of the Committee and to thank Mr Pedro Valente, member of the EP Secretariat, who was resigning from his post in the committee secretariat to take up a new post.

9. Date and place of next meeting

In accordance with the Assembly's programme of activities for 2013, the next ordinary meeting of the Committee on Economic, Financial and Commercial Affairs would be held in July 2013 in the EU.

Trade in raw materials between the EU and Latin America

The Euro-Latin American Parliamentary Assembly,

– having regard to the Commission Communication of 4 November 2008 entitled ‘The raw materials initiative – meeting our critical needs for growth and jobs in Europe’ (COM(2008)0699),

– having regard to the European Parliament’s resolution of 13 September 2011 on an effective raw materials strategy for Europe,

– having regard to the Durban agreement on climate change,

– having regard to the recommendations adopted by the International Labour Conference,

– having regard to International Labour Organization Convention No 169,

– having regard to the UN Declaration on the Rights of Indigenous Peoples,

– having regard to the Dodd-Frank Wall Street Reform and Consumer Protection Act (Pub.L. 111-203, H.R. 4173),

– having regard to the Inter-American Court of Human Rights’ judgment of 28 November 2007 in the case of the Saramaka People v. Suriname,

A. whereas the Latin American and Caribbean (LAC) region is the world’s main source of raw materials, and whereas 13 of the countries in the region number among the world’s top 15 providers of mineral resources;

B. whereas, owing to their relative scarcity and to high global demand, raw materials have seen a boom as well as volatile prices, and whereas this has led to a ‘re-primarisation’ of production structures in the region, meaning that raw materials now account for around 40% of exported goods;

C. whereas, as a result of this, there is still a reliance on long-established LAC-EU trading structures, which are characterised by a one-way flow of raw materials into Europe and an unequal trade of natural resources for manufactured products with high added value;

D. whereas, generally speaking, LAC countries are seeing high levels of economic growth; whereas, however, this comes at a high environmental and social cost as there are not enough proper regulatory systems or procedures for planning, land use planning and the distribution of wealth, as only a very small proportion of the population enjoys the benefits of this growth; whereas the ‘curse of natural resources’ is causing irreparable damage to ecosystems and extensive social conflict;

E. whereas the finite nature of natural resources, the undesirable effects of the current extractivist system where democratic accountability is concerned, the very low levels of job creation, the insufficient revenue for national exchequers, land pressures, deforestation, water shortages, air and water pollution, loss of biodiversity, climate change, displacements and poverty belts in major population centres all mean that a new partnership between the EU and the LAC countries is needed in order to ensure that

relationships include systems that shift the focus towards diversifying the range of exports, and in order to adjust the balance where profits are concerned and develop a sustainable model for manufacturing and trade in the future;

F. whereas in this respect, from a purely economic point of view, it is also important to strengthen the manufacturing system itself, develop regional agriculture and food policies that tailor agricultural production first and foremost to the continent’s food needs, foster coordination on production and the manufacturing of goods with higher added value, and diversify the economy and thus overcome the risks involved in a purely extractive economy;

G. whereas this challenge is manifold and involves issues connected with democratic order and political institutions, technology, resource efficiency, investment regulation, a review of both international and bilateral legislation in pursuit of an appropriate model of production which requires short- medium- and long-term action negotiated between both regions with public participation that is as broad as possible;

1. Emphasises the need to create a new EU-LAC partnership based on shared responsibility in the interests of the survival of the planet, and the need for change to ensure the sustainable management of finite resources, in particular non-renewable raw materials; also emphasises the need for appropriately targeted, productive investment that generates large-scale, high-quality employment, the need for profits to be taxed and for the public to be involved in democracy, with the aim being to establish a balance between interests and rights;

2. Emphasises that the partnership needs structural changes to be made in both regions to foster trade and investment that minimise the predatory impact that the current situation is having, shift the focus of economies onto reducing dependence on raw materials and their use and onto recycling and reuse in both continents; emphasises, furthermore, that the key challenge and precondition in this context is that of finding solutions that both make life better for the public and boost the protection of the natural environment;

3. Calls for swift action to be taken to revise the bilateral agreements between Latin America and the EU and for those currently being negotiated and prepared to be reviewed to ensure that they address the need to preserve the physical situation for the future and develop a production model that takes account of the fact that natural resources are indeed finite and that appropriate answers need to be found to address this; in this context, supports the strengthening of regional industrial networks;

4. Where technology is concerned, proposes ‘leap-frogging’ strategies, skipping stages that include obsolete technologies and industries; insists that, in order to make the transition to production structures that are founded on resources stemming from knowledge-based societies, sufficient financial resources are needed, as well as a root and branch review of policies relating to tax and royalties, intellectual property and technology transfer;

5. Calls for all trade agreements to include the Extractive Industries Transparency Initiative (EITI), which ought to be made compulsory, paving the way for the EITI++ model proposed by the World Bank and for the introduction of regulations such as country-by-country reporting, in the wake of the Dodd-Frank act and its implementing provisions in the US, which covers cooperation between members as regards transparency on tax

policy and banking supervision;

6. Also calls for such agreements to contain joint mechanisms to oversee both investment practices and production conditions, and calls for the trade in metals and hydrocarbons produced using slave labour or in other illegal ways, or sourced in protected areas, to be excluded;

7. Expressly calls for the inclusion in the agreements of clauses based on anti-corruption conventions and for tax havens to be excluded from their scope;

8. Emphasises the importance of ensuring that the trade agreements are compatible with multilateral agreements on the environment and on the right to water as a human right, in line with the UN stance;

9. Welcomes the case-law of the Inter-American Court of Human Rights with regard to the case of the Saramaka People v. Suriname, which sets out the application of ILO Convention 169; emphasises that there is a need to comply with the obligation of consulting or gaining the free, informed prior agreement of indigenous peoples, providing detailed, appropriate information, with consultations occurring before the decision-making stage is reached; takes the view that it is vital to ratify and implement the relevant ILO Conventions and include them in agreements which are being negotiated or reviewed, and make the relevant monitoring mechanisms binding and ensure compliance therewith;

10. Proposes that European companies and their subsidiaries should be subject to ordinary legislation in the host country, with victims having the right to appeal to courts in the country in which the parent company is based;

11. Proposes that the criteria relating to the new Latin American Investment Fund be redefined with a view to ensuring that it makes an effective contribution to combating inequality, poverty eradication, and the achievement of objectives relating to the sustainable exploitation of resources;

DRAFT MOTION FOR A RESOLUTION

Food sufficiency from the EU-LAC perspective

The Euro-Latin American Parliamentary Assembly,

– having regard to Regulation (EC) No 1905/2006 of the European Parliament and of the Council of 18 December 2006 establishing a financing instrument for development cooperation,

– having regard to the Communication from the Commission to the Council and the European Parliament entitled ‘A thematic strategy for food security: Advancing the food security agenda to achieve the MDGs’ (COM(2006) 21) adopted on 25 January 2006,

– having regard to the Communication from the Commission to the Council and the European Parliament on ‘An EU policy framework to assist developing countries in addressing food security challenges’ (COM(2010) 127) adopted on 31 March 2010, and the Council conclusions adopted on 10 May 2010,

– having regard to the report of the Committee on Development of the European Parliament of 19 July 2011 on an EU policy framework to assist developing countries in addressing food security challenges,

– having regard to the Communication from the Commission to the Council and the European Parliament on ‘Humanitarian Food Assistance’ (COM(2010) 126) adopted on 31 March 2010, and the Council conclusions adopted on 10 May 2010,

– having regard to the Rome Declaration on World Food Security adopted in 1996 at the World Food Summit organised by the Food and Agriculture Organisation of the United Nations (FAO),

– having regard to the 2011 FAO annual report on the State of Food Insecurity in the World,

– having regard to the January-March 2012 edition of the Food and Nutrition Security Bulletin of the FAO Regional Office for Latin America and the Caribbean,

– having regard to the Los Cabos Declaration by the G20 leaders of 19 June 2012 and the report by the G20 deputy agriculture minsters adopted in Mexico City on 18 May 2012,

A. whereas point 1 of Article 25 of the 1948 Universal Declaration of Human Rights recognises that everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food in particular,

B. whereas at the World Food Summit (Rome, 1996) the leaders of 185 countries reaffirmed in the Rome Declaration on World Food Security their commitment to work towards food security, i.e. the situation where ‘all people, at all times, have physical and economic access to sufficient, safe and nutritious food to meet their dietary needs and food preferences for an active and healthy life’,

C. whereas the 2006-2008 food crisis led to serious food emergencies in 39 countries, most of them in Africa and Asia, which necessitated the provision of urgent outside supportand which had major consequences for the most vulnerable members of society in all the countries concerned,

D. whereas the number of food emergencies has doubled over the last 30 years and the trend is set to continue in coming decades as a result of a combination of factors, including: climate change and more extreme weather phenomena; the increase in the global population and strong growth in emerging economies; changes to consumption habits and patterns in traditional societies; distortions in the functioning of the food supply and marketing chain; increased energy prices; more widespread use of biofuels; and growing financial speculation on commodities,

E. whereas, despite progress in recent decades, efforts to combat hunger and malnutrition have stagnated in most regions in the last five years, owing to commodity price inflation, among other factors,

F. whereas the problem of food insufficiency severely affects vulnerable members of society in particular, who see their purchasing power decline, thus forcing the poverty line upwards; whereas malnutrition in children and young people has a serious and permanent impact on physical and intellectual development, and therefore limits people's potential in the long term,

G. whereas hunger and poverty in Latin America are particularly acute in rural areas, where small local producers practise subsistence agriculture on sub-standard and relatively unfertile land and whose incomes are dependent on any surplus crops they can produce and sell,

H. whereas, despite its strong agricultural sector and status as a net exporter of commodities, Latin America as a whole has not benefited from the high commodity prices on international markets,

I. whereas food insufficiency is not only a serious humanitarian problem but a major threat to stability, peace and global security,

J. whereas the developments outlined above have increased global awareness of the problem in recent years, providing the impetus for enhanced cooperation and international governance in the field,

K. whereas more and more European farmers are giving up farming on account of price volatility and a loss of competitiveness in international markets, among other factors,

L. whereas some of the bilateral trade agreements that the Union has concluded with third countries are jeopardising the viability of European farms, causing more and more farmers to give up farming,

M. whereas European farmers incur very high production costs as a result of the EU’s stringent environmental, food security, animal welfare, and social and labour standards,

N. whereas in the last few years the gradual rolling back of EU market support measures has

exacerbated price volatility, and producers are finding it very difficult to cope with price fluctuations,

O. whereas unfair trade practices cause imbalances in the food supply chain and primary producers tend to be the first victims of those imbalances,

P. whereas only 6 % of farmers in the EU are currently under 35 years of age and more than 4.5 million farmers are planning to retire over the next 10 years,

Q. whereas the FAO has already warned about the possible consequences of excessive biofuel production from energy crops and the EU has taken a very cautious approach to this issue,

1. Urges the EU Member States and the countries of Latin America and the Caribbean (LAC) to continue their efforts towards the achievement of the first Millennium Development Goal (MDG), the aim of which is to halve, between 1990 and 2015, the proportion of people whose income is less than USD 1 a day and the proportion of people who suffer from hunger; stresses the close link between a lack of food, on the one hand, and poverty, on the other, and is concerned that substantial progress still needs to be made with regard to the objective, given that more than a sixth of the global population is currently living in hunger and poverty;

2. Is concerned at the current high food prices in both regions, and at the FAO's forecasts that this trend, of increasing food prices and increasing price volatility, is set to continue in the coming decades;

3. Is aware of the growing consensus around the structural, rather than cyclical, nature of the fundamental changes to food supply and demand at global level that are leading to increased food price inflation; agrees that this structural imbalance is the result of a wide variety of phenomena, both real and financial;

4. Shares the dismay felt by many international organisations at the increasingly close links between the agrifood and financial markets; also shares the conviction that the major investments made by investment and pension funds in the commodity derivatives markets have been a key factor in market instability and distortion in recent years;

5. Notes that, although it is difficult to put a precise figure on the amount of land involved, the number of large-scale purchases of agricultural land has increased exponentially in Latin America in recent years, facilitated by a boom in food prices and the prospect of higher profits; emphasises that whilst these types of deals can be profitable for both buyers and sellers, the difference in bargaining power between the parties can be detrimental to small producers, and lead to indigenous communities losing their land and to the concentration of land ownership among fewer people, often foreigners;

6. Urges the EU-LAC Governments to continue to work together in multilateral governance bodies to address the issue of food sufficiency and to use bilateral dialogue forums to align and coordinate their positions; recommends that, in their search for global solutions, both regions consult all sectors of civil society and, in particular, agricultural organisations and indigenous communities;

7. Advocates sustainable and long-term solutions to the food insufficiency problem; acknowledges, at the same time, the need to strengthen the food aid and fund transfer programmes in order to deal with food emergencies; reiterates its firm commitment, therefore, to the United Nations World Food Programme on account of its effectivenessin ensuring that vulnerable people receive food promptly during food emergencies; calls also for the establishment as a matter of urgency of emergency food reserves, which should be coupled with effective transport and information systems and strategically located to minimise response times;

8. Calls for efforts to be focused on the search for ways to boost rural development and increase productivity, on the basis of policies which seek to promote the expansion of the agricultural sector, wherever possible; emphasises the importance of improving production methods and land conditions, and of research and development concerning crops, seeds and genetically modified products; in order to tap into that growth potential, stresses the need to invest in training for farmers through specific capacity-building programmes and in rural infrastructure that improve business opportunities for small farmers and help to revitalise local markets;

9. Recommends that particular emphasis be placed on policies designed to change patterns of commodity production and consumption, favouring the cultivation of varieties which are best suited to the food needs of local people and to weather and soil conditions; also stresses the need to avoid unsustainable practices that contribute to land degradation, and the value of implementing crop diversification policies as an alternative to monocultures, which are vulnerable to weather-related risks, pests and price fluctuation; takes the view that such measures, along with efforts to ensure that more people are food-aware, would safeguard traditional food crops, thereby broadening the food base and improving people’s diets;

10. Calls on the governments to take specific measures to support family farming, especially measures to develop effective risk management systems and to facilitate access to loans; emphasises that, in general, family farming has not benefited from high food prices, owing to reduced competition in the markets, high supplies prices and unpredictable income levels, but, rather, has been very badly affected by price volatility that has made planning difficult, acted as a disincentive in investment decisions and limited access to credit;

11. Calls for the reform of the EU Common Agricultural Policy (CAP) to guarantee the lasting stability which will encourage farmers to continue working the land, to support young farmers, to ensure effective risk management in accordance with rural development provisions, and to promote investment in production methods which boost agricultural productivity;

12. Calls on the EU and its Member States to continue their efforts in the field of development cooperation, even at this time of budgetary austerity; also notes that the EU and its Member States account for more than half of official development aid at global level and that a substantial proportion of that aid is used for food sufficiency programmes, particularly in countries which are considered to be most vulnerable in terms of food resources, notably Honduras, Nicaragua, Cuba and Haiti; highlights the effectiveness of the Food Facility (EUR 1 billion) with which the EU responded to the 2006-2008 food crisis;

13. Welcomes the adoption, in June 2011, of the Action Plan on Food Price Volatility and Agriculture by the Ministers for Agriculture of the G20 countries and, in particular, the implementation of the Agricultural Market Information System (AMIS); in this respect, recognises the important role that better information and market transparency play in reducing volatility in the commodities markets;

14. Calls on the governments to adopt the measures needed to combat excessive speculation, abuse and manipulation in the commodities markets; stresses that, to be effective, efforts to regulate the financial markets must be pursued at the global level; in this regard, endorses the recommendation of the G20 that improvements need to be made to the regulation and supervision of commodity derivatives markets, and supports the Principles for the Regulation and Supervision of Commodity Derivatives Markets presented by the International Organisation of Securities Commissions (IOSCO) in September 2011; calls on IOSCO to ensure that recommendations are drawn up promptly on how those principles could be applied;

15. Recognises that each country needs to have its own food sufficiency strategies, which strike a suitable balance between support for national production and provision for food needs through trade; stresses that, in order to make progress towards food sufficiency and increased agricultural productivity, it is essential to have a trade system that is stable, predictable, free from distortion and transparent;

16. Calls on the national governments, in line with the FAO's recommendations, to avoid adopting restrictive trade policies when dealing with internal food insufficiency problems, given that such practices lead to an escalation in prices and to volatility in international markets; calls on the governments, therefore, to endorse the agreement concluded at the G20 to eliminate once and for all restrictions on the export of foodstuffs and the special duties imposed on food acquired for humanitarian and non-trade purposes by the World Food Programme; calls on the governments to continue negotiations to transform that agreement into a binding global commitment under the auspices of the World Trade Organisation;

17. Is aware of the study carried out by the World Bank which shows that the sharp increase in logistics and transport costs in recent years has been a major factor in commodity price inflation; urges both parties, therefore, to place greater emphasis on policies to facilitate trade and to deregulate transport, both at intra-regional level and between the EU and LAC countries;

18. Calls on the governments to incorporate food sufficiency into their policies and to ensure coherence between their agricultural, trade, energy and development policies; recommends, therefore, that the most developed EU-LAC economies give careful thought to the measures they could take in order to guarantee in the future a secure food supply, more stable incomes for farmers, and fair prices for consumers;

19. Warns that the rolling back of support for EU farmers could have disastrous consequences for farming in the Union, given that this support is needed to prevent huge numbers of farmers leaving the land and to avert an increase in food dependency, which could have a negative impact on food prices, hitting the poorest people in the EU hardest;

20. Calls for the current reform of the CAP to improve market management and agricultural crisis prevention instruments in order to tackle price volatility more effectively;

21. Considers excessive the new crop ‘greening’ requirements which the European Commission is planning to impose on European farmers, on the grounds that the latter already have to comply with the world's strictest environmental, food security and animal welfare standards;

22. Urges that the current reform of the CAP should make it easier for young people to take up farming, by means of measures under the direct support scheme and rural development policy;

23. Calls on the European Commission, when negotiating bilateral agreements between the Union and Latin American countries, to ensure that both parties make balanced concessions which do not undermine the livelihoods of farmers in either region and which provide for greater reciprocity when it comes to environmental, food security, animal welfare, and minimum social and labour standards;

24. Stresses the need to place more emphasis on the development of biofuels, such as 'second-generation' biofuels, which are made from raw materials whose cultivation has no impact on food production;

25. Advocates the introduction in the EU of measures to improve the negotiating position of farmers in the food supply chain and calls for rules to be established to put an end to unfair trade practices;

26. Instructs its Co-Presidents to forward this resolution to the Presidency of the EU-LAC Summit, the Council of the European Union and the European Commission, the parliaments of the EU Member States and of all the countries of Latin America and the Caribbean, the Latin American Parliament, the Central American Parliament, the Andean Parliament, the Mercosur Parliament, the Office of the Secretary-General of the Andean Community, the Commission of Permanent Representatives of Mercosur, the Office of the Permanent Secretary of the Latin American Economic System, and the Secretaries-General of the OAS and UNASUR.
