In his email Mr. Zietlow indicated the EXNI had been sent through the mail as well. On July 3, 2019, I reviewed the EXNI and provided Mr. Zietlow with a list of procedural completeness items. Below are the emails I sent to Mr. Zietlow requesting additional information. NOTE: No formal response letter was sent to Wharf in response to the EXNI submittal, all subsequent information was submitted July 22-24 and has been date stamped into the file.  From: Hudson, Roberta Sent: Wednesday, July 3, 2019 10:23 AM To: Holm, Eric ; Zietlow, Matthew Cc: Hudson, Roberta Subject: RE: [EXT] EXNI  Matt, I also forgot to mention under 45-6C-9 maps are required to have a scale no greater than 1:25000. This will most likely result in the need to submit numerous maps to cover the entire expanse of the area you have defined.

Please note there are a few procedural completeness items we noted in this submittal:

    1. SDCL 45-6C-7(5): You will need to include an estimated size of the proposed drill pads for reclamation. Will mud pits be utilized in the drilling procedure? You will also need to include the estimated length of reclaimed roads or trails that will be disturbed and need to be reclaimed as part of the exploration project. We also need to know the number of drill holes you will be drilling. You may want to consider allowing for additional buffer on the depth of the holes.

    2. SDCL 45-6C-8(2): Please provide a reclamation timetable and seed mix approved through the Lawrence County Conservation District.

    3. SDCL 45-6C-9: The map provided is good for general public consumption but does not meet the requirements established under this statute. The map needs to include the proposed exploration area and the surrounding one-half mile area. It should include the location of known springs, lakes, ponds, reservoirs, water pipelines, earthen dams, private and public water wells, and buildings. For the proposed exploration activities, the map should also include proposed or existing roads or trails, and tentative test hole locations within one-fourth of one-fourth of a section. If holes are more closely spaced an outline can be provided of the area in question.

    Please note, the information above is generally needed to ensure a proper bond calculation (which is not necessary here) but is also utilized to ensure proper restrictions may be in place for historic and/or culturally significant sites as well as protection for sensitive, threatened or endangered plant and wildlife that may be known to be present within the area.     Staff Signature: \s/ On July 8, 2019, we received the paper copy of Wharf’s proposed Exploration Notice of Intent. We noted the Certification of Applicant form was not submitted at that time. Once we noted the form was missing I sent Mr. Zietlow the following email requesting he send this document to us.   From: Hudson, Roberta Sent: Monday, July 8, 2019 2:29 PM To: Holm, Eric ; Zietlow, Matthew Subject: RE: [EXT] EXNI  Matt, We received the paper copies for this EXNI in the mail today. We noted another item missing in the application. Please note as per SDCL 1-40-27, we require every application or EXNI to contain a Certification of Applicant form.
