AWESOME SWIM SCHOOL AGREEMENT

GENERAL CONDITIONS ENROLMENT

1. Enrolment details as stated on the Enrolment Form (3 Pages). It is imperative that you provide your correct ID number.

2. It is important that you read the clauses dealing with responsibilities and liabilities, acceptance of risks, disclaimers, and accepting

waivers carefully and to seek advice first if you do not understand their meaning, extend and effect. 3. The swim school reserves the right to amend these terms and conditions or any part thereof and shall provide you with prior notice of such change or amendment and

the date on which it takes effect at least 30 days before it takes effect.

4. The minimal enrolment period is six (6) months, but before registering (not afterwards) you may apply to register for a shorter period (not less than three months).

Please note that swim slots are allocated only per calendar year (see 8 below). Automatic Renewal of Contract: After the initial six months this agreement will be renewed

on a month to month basis.

5. If this contract is extended for an additional year or longer after 24 months, a reduced reservation fee of R50.00 for retaining of time slots are payable for each additional

year.

6. The swim calendar is from mid-January to end-November for normal lessons. For the avoidance of any doubt and misunderstanding, the number of swimming weeks

of terms 1 and 4 (summer months) are less than that of terms 2 and 3 (winter months), meaning the effective cost per lesson for winter months is slightly less than that

for summer months.

7. There is no swim lessons during public school holidays, school long weekends and on public holidays, as well as during December months, unless if so arranged by the

swim school. From the beginning of December, booster and crash courses may be offered (dependent on availability of instructors) to interested participants that

need to enrol for them.

8. Once the applicant has submitted the comprehensively completed and signed documentation AND the registration and swim fees have been paid, time slots for swim

lessons will be reserved in the Swim School’s schedule for a calendar year (or the remaining part thereof) on a first-come first-served basis. Enrolled swimmers must

rebook time slots for the next calendar year during October (Refer price list).

FEES & PAYMENT 9. A Price List (1 page) that sets out our current fees and charges are available upon request.

10. A non-refundable enrolment & registration fee is payable upon registration with the swim school. A non-refundable reservation fee is payable every October to reserve

a swimmer’s usual swimming slot for the next year.

11. All swim fees are strictly payable in advance.

12. Payment for a term must reflect in the Awesome Sentrum’s bank account on or before the 1st of the first month of a term. However, the term fee may be paid in three

equal monthly instalments PROVIDED that each monthly instalment is paid before the 1st of each month.

13. Payments are for reserved and scheduled time slots for lessons irrespective whether these slots are used or not used.

14. If a newly enrolled participant does not turn up for the scheduled first lesson, no catch-up lessons will be arranged and there is no refund or credits for the missed

lessons. Furthermore, “no show” slots will be forfeited after two lessons of not pitching up.

15. Please use the Payer’s Surname and Name as reference when making a payment and use the same reference for every payment.

16. Proof of-payment (PoP) of the first EFT payment made should be send via WhatsApp or SMS message to 072 22 77 478, OR a hard-copy of the PoP

can be submitted to the instructor at the office before the first lesson commences. 17. Participants who have attended their swim lessons for 11 months + 1 crash course, as well as through winter without a break, qualify for exemption from paying the

annual fee for reservation of time slots if there were no late payments during the 12-month period. A participant must apply for this exemption before 20 October (e-

mail request only, please). The same slots cannot be guaranteed for participants that do not pay the reservation fee. Participants that took a winter break or requested

any other changes/adjustments and paid the holding fee during the year, do not qualify for this exemption.

18. Fees will be adjusted and details about the adjustments will be communicated at least a month in advance of taking effect. For participants that enrolled less than one

month before the date of communication about the price increase, the notice period will be the period between the enrolment date and the date on which the new

prices take effect.

19. If you notice an obvious error on an invoice or statement, or if you in good faith feel that your account contains incorrect charges, payments or adjustments, please

bring this to the school’s attention per SMS/WhatsApp/e-mail or in writing as soon as possible to resolve. Should a dispute arise about payment YOU EXPRESSLY

ACKNOWLEDGE AND AGREE THAT the payment of any amount that is not in dispute cannot be withheld for any reason (including without limitation when that amount

is on an invoice together with an amount that is in dispute) and that you will pay the undisputed portion on time.

TERMINATING OR CHANGING LESSONS 20. Cancellation or Postponement of Lessons: It No Verbal notices / SMS messages / WhatsApp messages or any informal notes will be accepted. A minimum of 1 calendar

months’ notice (i.e. at least one month in advance) is required on all notices/changes/requests.

21. All Official Forms can be obtained via e-mail request and/or at the office during official working hours only. The completed form can either be returned by e-mail or be

handed in at the office WITH PROOF OF DELIVERANCE OBTAINED, during normal school term hours only.

22. No deck or poolside communication will be acted upon unless followed up on the relevant official form.

TERMINATING LESSONS 23. One calendar months’ notice must be given to terminate this contract. The notice must be given on the official form only (Form 1A) and this form as well as proof-of-

payment (PoP) of the premature cancellation charge (if applicable – see 17 above) must be e-mailed to [email protected]. Such e-mail is to

be received no later than on the 1st day of your last swimming month.

24. If you do choose to terminate this Agreement before 6 months of your Agreement has expired, you will be subject to payment of a reasonable premature cancellation

charge and you will have to pay all outstanding amounts. A reasonable premature cancellation charge for the purposes of this clause shall mean the equivalent fee of

one full month of your fees (i.e. a third of the full fee for one term). For the avoidance of any doubt and misunderstanding, there are no swimming lessons for the

cancellation charge.

25. Participants who want to take a break from lessons during winter, can apply for a discount for the period of the break at least one (1) month in advance provided there

were no late payments during the immediate previous 12-month period . Application forms (Form 3A) for the discount must be obtained, completed and submitted at

the Administrative Office (proof of submission should be obtained). This form (Form 3A), may also be requested and submitted per e-mail.

26. The swim school shall be entitled, in its sole discretion, to cancel this Agreement if it finds the swim student to be unable, physically or mentally, to proceed with swimming

lessons.

CHANGING LESSONS 27. Subject to the availability of slots in the school’s schedule, time slots or the number of classes per week, may be changed on request. However, such request to reduce

/ increase the number of classes per week, must be lodged at least a full calendar month in advance and always on the official application form, Form 2A, available at the

office or via e-mail.

LESSONS MISSED 28. Lessons not attended (missed) are not eligible for rescheduling or any refunding. In exceptional circumstances a request with a medical certificate can be submitted (on

Form 4A) for evaluation by the Director of the school and the Director’s decision is final and no extended communication will be entered into if requests are denied.

29. Lessons cancelled due to lightning cannot be rescheduled, except if offered on Director’s discretion. However, we trust you will agree that a SAFETY FIRST POLICY is

essential.

30. Please keep in mind that by sending your child to swim when ill, you may expose the swim instructor and all other pupils in the following classes to the same illness.

We are obliged to protect the other children in our classes, as well as our instructors and may have to request swimmers to not attend the lesson and return for lessons

when they are well again.

31. It is courteous to let us know if you will not be able to make a lesson. Please do this as soon as possible, preferably via text/WhatsApp on: 072 22 77 748 or 083 302

8930.

32. The swim school reserves the right to cancel / adjust swim slots in unusual circumstances. Such changes / cancellation will be well motivated and clearly communicated.

33. The swim school reserves the right to cancel this Agreement if it finds the swim student to be unable, physically or mentally, to proceed with swimming lessons.

MEDICAL TREATMENT 34. Should a participant requires emergency medical attention, you hereby authorize the school’s personnel and/or its representatives to assist in any way deemed possible

at the time and/or to transport the injured party to the Panorama Medical Center for medical treatment if possible and/or to inform you immediately and/or to arrange

the services of any medical emergency services on your behalf and that the costs incurred from this will be for your account. PLEASE ENSURE FULL MEDICAL

DISCLOSURE WHEN ENROLLING.

WAVER AND INDEMNITY, RISK AND LIABILITY 35. This section is a statement to inform you that there are potential risks involved when attending swim lessons. These risks are similar to the risks that a person would

be exposed to when visiting and using any similar swimming pool.

36. The participant/parents/guardians irrevocably waive and abandon all or any claim(s) which they or their legal representatives may have against the school, its directors,

employees, consultants, substitute instructors, contractors, authorised agents and/or representatives, arising from the injury, death or other harm of whatsoever

nature suffered by the participant (including any minor child) and/or any other person who drops off and/or collects anyone at the school either whilst on the premises

of the school or in connection with any activities on or off the school’s premises and/or travelling on foot or in any motor vehicle owned or operated by the school or

its aforesaid directors, employees, consultants, substitute instructors, contractors, authorised agents and/or representatives.

37. The Parties indemnify each other against any claims from third parties, which may arise as a result of their non-compliance with any provision of this Agreement, or any

negligent act or omission by that Party, its family members, directors, employees, consultants, substitute instructors, authorised agents and/or representatives.

38. The school will constantly endeavour to take such steps as may be reasonably required by the circumstances to do what it can to keep participants out of harm, and free

from loss, taking into account what can be reasonably foreseen and provided for in each case.

NOTICES & COMMUNICATION 39. Most communication will be via notices in the viewing room, bulk communication sent with monthly invoices, WhatsApp broadcasts and/or notices on “Awesome Swim

School” Facebook page. It is your obligation to ensure that you have access thereto and that you check regularly to remain informed on news and school

communication. Should this be out of the question, alternative channels can be requested in writing.

40. It is your obligation to check and verify your details on your invoices on a monthly basis and inform us of any change, especially of your e-mail address. YOU EXPRESSLY

ACKNOWLEDGE AND AGREE THAT it is your responsibility to report immediately in writing if you do not receive your monthly invoice from the second month after

joining the swim school and to check and verify your details monthly before the scheduled payment date.

41. All complaints, concerns or grievances must be submitted in writing on Form 4A per e-mail to [email protected] or handed in at the office. However, you

may communicate with the Director beforehand to inform the Director about your complaints, concerns or grievances and the Director (at the Director’s sole discretion)

may initially waive this requirement for written submission and try to clarify the issue, but may still at any stage during this process require a written submission on

Form 4A. The school will investigate the issue and inform you about the outcome of the investigation and the final decision of the Director as soon as possible taking

into account that an internal investigation and/or hearing may need to be completed first. The Director’s recommendations and decisions are final.

42. Please note that our Staff and Swim Instructors are under no circumstances allowed to send or receive calls and or messages/communicate from their private phones/e-

mails, but will respond to messages/e-mails that have been sent timeously to the school’s phone number 072 22 77 478 or e-mail address

[email protected] (answer on mails may be delayed up to 1 week due to nature of our work).

43. In exceptional circumstances, a locum swim instructor will be arranged in the event that the usual instructor cannot perform the lesson him-/herself due to illness or

absence.

POOL ETIQUETTE 44. Please attend lessons regularly, arrive on time and let us know well in advance if lessons will not be attended.

45. Dress code for boys is tight-fitting swimming trunks and for girls a full coverage swim-suit (can be worn with short ski-pants). Please no baggies, or bikinis. Remove all

jewelry and tie hair back. Swimming caps are compulsory.

46. Let’s practice healthy swimming behaviour to ensure prevention of recreational water illness a. Please encourage participants to go to the toilet before starting the lesson and teach them to not urinate in the pool;

b. Please encourage participants to blow their noses before the lesson;

c. Do not spit in the water - keeping our pool clean protects everyone!

d. No chewing gum, food or sweets to be eaten whilst in the pool;

e. All children under the age of three and/or not yet potty-trained must wear a fitted swim nappy while swimming.

f. No swimming is allowed in case of Skin or Eye infection, Diarrhea, Gastric Flu, Flu, Active Infection, Green Mucus, Open Wounds and/or Bleeding.

g. Inform the instructor if the participant is on medication and provide the necessary medication (i.e. asthma pump) enclosed in a plastic bag for safekeeping during lesson.

h. Based on the Child Protection Act we have a No Photography Policy. You are informed that Clients are prohibited from taking photos/cell phone pictures/videos during

lessons. Request for an opportunity to do this for your child may be submitted and will be granted as long as it will not be disruptive to the class/instruction/other

clients.

47. Let’s practice safe swimming behaviour to ensure Water Safety: a. No running on pool deck;

b. No fooling around / horse play in and around the pool area;

c. No pushing, hitting or biting of anyone;

d. No entering the water before instructor has given the instruction;

e. Get out of the pool immediately at the end of the lesson or if instructed to do so!

f. Nobody is allowed in the pool area if an instructor or caregiver is not present;

g. Parents should please support instructors when they take action to maintain discipline in the pool;

h. No biting or chewing on pool equipment – let’s treat it with respect.

i. Wearing swim caps are compulsory for both male and female swimmers, irrespective of age. Fabric swim caps & Lycra swim caps are available from the school @

R60.00 (cash payment only). We are proud to say that we supply Swimma caps for long hair priced from R200.00 to R260.00 a cap. We do not provide “loan” caps,

neither do we provide caps on credit. Should a swimmer continually arrive without the necessary swim cap, they might forfeit that lesson.

48. Swim nappies can be purchased for emergencies @ R30.00 per nappy (cash payments only) and the school does not prescribe to a “use now, pay later” policy.

49. No parents or other persons are allowed in the pool area during lessons. Parents may watch the lesson from the viewing room or from the glass doors only. Please do

not sit in the pool room while lessons are in progress except when you are invited to do this.

50. It is the parents’ responsibility to watch their children at all times before & after their lessons. Accidents happen quickly and safety should be our main concern.

Instructors / and assistants will not be held responsible for supervising children outside of their lesson times.

51. Please ensure that the property of the school (chairs, doors, walls, windows, toys, carpets, etc.) are not toyed with by siblings or participants while waiting. We try to

keep our school neat and presentable but cannot afford to replace broken furniture every term. Furniture are there for providing seating, not climbing, jumping, or

building obstacle courses.

52. There is to be NO running around, or unassisted diving or jumping into the pool.

53. There will be a 5 minute parent/instructor handover time at the beginning of each lesson when deemed necessary. Please keep your instruction/request/message short

and sweet. Any other (long) discussions should be submitted in writing to [email protected] or done via messaging.

54. Participants should please wait before entering the poolside area until called and/or the previous class has exited the area.

55. Please ensure that your child leaves the pool area as soon as exiting the pool: i.e. not to disturb and/or infringe on the next class’s lesson time.

56. Please refrain from entering the pool area or disturbing the instructor during the lesson. This is for obvious Health & Safety reasons.

57. Equipment must be treated with respect. Any equipment that is misused and this results in the equipment being broken or damaged will be charged for. 58. No parking in front of the gate. Please consider the neighbours and park in the designated parking areas or on the school premises.

✓ It is the responsibility of the parent / guardian to inform Awesome Centre well in advance if the child should not be

picked up due to absence from school/pick-up point.

✓ I agree to pay a monthly transport charge as stated above, which will be payable with swimming fees as quoted before

the 1st of each calendar month, for 12 months of the year, into Awesome Centre’s bank account.

✓ This agreement can be cancelled by either party at any time with a calendar month’s written notice to be handed in

at Awesome Centre or mailed to [email protected]. Failure to give notice will automatically preclude full

payment of the notice month fee, and if payment is not received on or before the 3rd of the month, interest will be

charged at 10% of the outstanding balance.

✓ Please note that all payments shall be done electronically into the Awesome Centre’s bank account, or parents /

guardians are welcome to make cash payments at Awesome Centre (please insist on a receipt upon paying cash).
